Agenda Item B.5

CPMS CONSENT CALENDAR
Meeting Date: April 18, 2023
TO: Mayor and Councilmembers
FROM: Jaime A. Valdez, Neighborhood Services Director
CONTACT: Michael Baris, Emergency Services Coordinator
SUBJECT: Documentation to Receive State and Federal Funding – CalOES Form 130 RECOMMENDATION:

Authorize the City Manager, by title, to become the Authorized Agent for cost recovery from the California Office of Emergency Services and the Federal Emergency Management Agency.

BACKGROUND:

Every three years, public agencies are required to submit documentation to the California Office of Emergency Services (CalOES) in order to receive federal grant and reimbursement dollars. This documentation is called ‘CalOES Form 130’, and Form 130 allows Goleta to receive federal dollars such as grants like the Hazard Mitigation Grant Program and reimbursement from a presidentially declared disaster.

An up-to-date Form 130 ensures that Goleta is in compliance with protocols set by CalOES and the Federal Emergenc y Management Agency (FEMA). Goleta’s current Form 130 was approved on May 5
th, 2020, and is set to expire on May 5th, 2023.

DISCUSSION:

Form 130 authorizes the City Manager to become the Authorized Agent on behalf of the City. An Authorized Agent can receive fe deral assistance funds from FEMA. This document will be in effect for the next three years and may be cited for future emergencies that affect Goleta in that time frame. Staff recommends that the City Council authorize the City Manager by title, rather than name, in this document so that any acting City Manager may also serve as the Authorized Agent and ensure continuity of the document. 1 Meeting Date: April 18, 2023

FISCAL IMPACTS:

Adoption of Form 130 allows the City to receive federal grant and reimbursement dollars through the state agency, CalOES. The City will be unable to receive federal dollars until this compliance documentation is provided to CalOES.

ALTERNATIVES:

The Council could decide to have Form 130 filled out with specific “Names and Titles.” However, if the City so chooses, the names and titles of the Authorized Agents would be listed and a new Cal OES Form 130 would be required if any of the Authorized Agents are replaced, leave the position listed on the document or their title changes.

This allows the document to rem ain valid (for 3 years) if an Authorized Agent leaves the position and is replaced by another individual in the same title. If “Titles Only” is the chosen method, this document must be accompanied by ac over letter naming the Authorized Agents by nam e and title. This cover letter can be completed by any authorized person within the agency and does not require the Governing Body’s signature.

2. Names and Titles: If the Governing Body so chooses, the names and titles of the Authorized Agents would be listed. A new Cal OES Form 130 will be required if any of the Authorized Agents are replaced, leave the position listed on the document or their title changes.
