RECOMMENDATION:

A. Authorize the City Manager to execute Amendment No. 1 to Professional Services Agreement No. 2022-022 with Matthew Davis – DCME., Inc. for Construction Management Support Services, increasing the contract authority by $11,000 for a new total amount of $55,000, and extending the agreement termination date to December 31, 2023; and
B. Authorize the City Manager to execute Amendment No. 2 to Professional Services Agreement No. 2022-001 with Rincon Consultants, Inc. for Contract City Arborist Services, increasing the contract authority by $130,000 for a new total amount of $237,000.

BACKGROUND:

Public Works staff has engaged private consultants to perform a variety of professional services for the City since incorporation in 2002.

On January 3, 2022, the City of Goleta (City) executed a $44,999 professional services agreement with Rincon Consultants, Inc. (Rincon) for a contract City Arborist. This is a critical role that supports ongoing City operations and programs in the Public Works Department. A contract City Arborist provides a lead role in the implementation of the adopted Urban Forest Management Plan, staffing Public Tree Advisory Committee meetings, and advising on various maintenance operations and capital projects. The contract City Arborist also provides professional consultation on tree issues at City facilities under this agreement to the General Services Department.

On February 16, 2022, the City of Goleta (City) executed a $44,000 professional services agreement with Matthew Davis – DCME., Inc. (DCME), to provide project and 1 Meeting Date: June 20, 2023
2 construction management services for various Capital Improvement Program (CIP) and Capital Maintenance projects.

DISCUSSION:

Public Works selected and executed agreements with the following consultants from the City’s approved pre-qualified consultant list to provide various professional services for the Public Works Department. The information below summarizes the services being provided by each consultant, proposed amendments and agreements, justification, and recommended actions.

(Proposed) December 31, 2023 $11,000 $55,000
Scope:

Provide construction management and support services for the following programs/projects:
 Provide technical review on project deliverables during design  Provide project management support services during construction and post- construction
 Provide construction oversight services, including contract administration, project management, construction, and/or field inspection assistance  Prepare bid-packages, including biddability and constructability review  Prepare Requests For Proposals for professional services, as required to continue progress of projects
Justification/Recommendation:

DCME has been providing project and construction management support services for various CIP and Capital Maintenance projects over the past year to help manage the numerous capital maintenance and CIP projects. Public Works is recommending an amendment to capture the additional time spent by DCME as a result of the declared local emergency on January 9, 2023, and the wide range of damage that occurred throughout the City. DCME shifted priorities to emergency clean-up and maintenance measures, assessing the damage to city facilities and property, and efforts to repair damage.

Public Works staff recommends approval of Amendment No. 1 to Agreement No. 2022- 022 with DCME increasing the compensation amount by $11,000 for a new total not-to- 2 Meeting Date: June 20, 2023

Scope:

Provide contract City Arborist services for the General Services Department (Facilities) and the Parks and Open Space Division and Street Maintenance Division in the Public Works Department. Specific work the contract City Arborist performs includes:
 Tree Permit Application Support
 Tree-Related Emergencies
 Conduct Tree Inspections
 Tree Inventories, Evaluations, and Hazard Assessments  Prepare Tree Inspection Reports and Review Applicant Submitted Reports  Review Construction Plans
 As-needed Consultation and Meeting Support
Justification/Recommendation:

Rincon has been providing contract City Arborist services for various operations and maintenance activities in the Streets Division and the Parks and Open Space Division since January 2021, and more recently for the General Services Department’s facility maintenance group. The contract City Arborist advises City staff and City tree contractors on proper tree care, risk reduction, and a variety of urban forest management activities such as tree species planting recommendations, grant applications, and Public Tree Advisory Commission tree removal appeals. Public Works is recommending a professional services agreement amendment to continue these services through Fiscal Year (FY) 2023/24.

Public Works staff recommends approval of Amendment No. 2 to Agreement No. 2022- 001 with Rincon, increasing the compensation amount by $130,000 for a new total not- to-exceed amount of $237,000 (Attachment 2). The original contract, awarded January 3, 2022, and Amendment No. 1, approved by Council on November 1, 2022, with Rincon Consultants, Inc. for Contract City Arborist Services is provided in Attachment 4. 3 Meeting Date: June 20, 2023
4 FISCAL IMPACTS:

There are sufficient funds in the proposed FY 2023/24 budget for the subject amendments, so no appropriations are necessary for the proposed amendments. The table below lists the vendors, the amended contract amounts, the funding accounts, and the proposed FY 2023/24 budget amounts.

ALTERNATIVES:

The City Council may elect not to authorize one or more of these agreement amendments and direct the Public Works Department to seek statements of qualifications and proposals from additional qualified firms. Doing so could cause delays in the management and delivery of Public Works services provided by the Engineering, Street Maintenance, and Parks and Open Space Divisions and could impact the schedule and/or grant funding for capital maintenance and CIP projects.

SUBJECT: Rincon Environmental On-Call Arborist Services Agreement

The Public Works Department oversees management and maintenance of the City’s urban forest, which includes over 15,000 trees in parks, open spaces, along public streets, and at City-owned facilities. Management of the urban forest includes overseeing tree trimming and tree removal contractors, directing the work of biologists and certified arborists, obtaining regulatory agency approval for work in ESHAs, responding to citizen requests for service, and interfacing with the Public Tree Advisory Commission. Due to a significant backlog of deferred maintenance on trees in the public spaces and the need for professional arborist assistance, the Public Works Department is requesting City Manager approval to enter into a $44,999 service agreement with Rincon Environmental.

Rincon Environmental is on the City’s list of pre-qualified consultants. Furthermore, they recently expanded their Arborist and Forestry Services with the hiring of Greg Ainsworth, an International Certified Arborist and Qualified Tree Risk Assessor. Mr. Ainsworth serves as an on-call City Arborist for Thousand Oaks and Agoura Hills. Existing funding is available in the Parks and Open Space Professional Services Account (101- 50-5400- 51200) and the Public Works Streets Maintenance Contract Services Account (101- 50- 5800-51300).

Rincon will assist with the following tasks:

1. Tree Permit Application Support – Support the City with reviewing and processing tree permit applications for permission to trim, remove or plant trees on public land, including parkways, including construction projects that may impact City trees. Included will be evaluations of trees and review of tree reports for compliance with the City’s tree protection ordinance. Rincon wi ll receive general direction from staff and provide recommendations on best practices in the industry for maintaining trees located within public land and City right -of-way. A Certified Arborist will be available to coordinate and communicate with applicants on an as-needed basis.

DocuSign Envelope ID: 26BB2A99-0545-43B0-81A5-91D2BB45007B 41 2. Tree-Related Emergencies – Respond to emergency requests on an on-call basis for tree removal and pruning of potentially hazardous trees, including tree’s that present an imminent threat to people or property.

3. Conduct Tree Inspections – Conduct landscaping and tree inspections prior to commencement of work and during evaluation period, observation and overseeing of work in progress, and final
inspection of completed work for various types of projects as needed.

4. Tree Inventories, Evaluations and Hazard Assessments – Rincon will coordinate with the City’s Parks and Open Space Manager on inventorying and evaluating trees. An International Society of Arboriculture Qualified Tree Risk Assessor (TRAQ) will conduct as-needed evaluations of trees located within public land, City parks (e.g., Evergreen Park), parkways, and right-of-way, including those that present a hazardous condition to people or property. Data will be collected on the whole tree, including identification of species, trunk diameter, height, canopy spread, physical condition, and health evaluation.

Recommendations will be provided on procedures to trim branches, secure trees, or whole tree removal to minimize tree- related hazards. Data will be collect ed using Collector, Survey 123, ArborPro, or equivalent. Tree locations will be georeferenced and collected using a Global Poisoning System (GPS) with sub -meter accuracy. Data will be provided in Excel spreadsheet, including ArcGIS shapefiles for cataloging all tree inventories. Data collected on all tree inventories, evaluations and hazard assessments will be documented for future reference and planning (e.g., City Urban Forest Management Plan).

5. Prepare Tree Inspection Reports and Review Applicant Submitted Reports – Prepare tree reports and other tree related documents and analyses for City projects, such as parks and City maintained right-of way. Review and make recommendations as to the adequacy of tree reports by outside consultants for City projects, and their compliance with City ordinances, policies and guidelines.

Rincon’s Director of Urban Forestry and Arborist Services (Lead Arborist), Greg Ainsworth, will be available to support City staff in pre- project scoping meetings, construction-related meetings, Planning Commission meetings, City Council meetings, public hearings, PTAC meetings, and other meetings where arborist support is requested. Rincon’s Lead Arborist will be available to attend virtual meetings, share files/plans as needed, and lead discussions.
