A. Adopt Resolution No. 23-___ entitled “A Resolution of the City Council of the City of Goleta, California, Authorizing the Filing of a Notice of Completion for the 2020-2021 Pavement Rehabilitation Project;” and
B. Direct the City Clerk to file a Notice of Completion with County Recorder’s Office.
BACKGROUND:
The 2020-2021 Pavement Rehabilitation Project (Project) was constructed as part of the Pavement Maintenance Program (PMP). The PMP is a critical planning tool to assist staff in establishing a list of priority roadways to be included in the City’s annual pavement rehabilitation projects to effectively maintain the City’s 85 centerline miles of roadways.
In addition to the PMP recommendations, the paving priority list of street sections considered for rehabilitat ion is developed based on public input and staff’s experience and understanding of the roadway network.
On September 21 , 20 21, the City Council awarded the construction contract to Toro Enterprise, Inc. (Toro) in a not -to-exceed amount of $ 5,807,003.10 with contingency contract change orders in an amount not to exceed $1,161,400.62 for a total construction contract amount of $6,968,403.72.
DISCUSSION:
On October 26, 2021, Public Works staff issued Toro a Notice to Proceed on the Project to commence work on November 16, 2021. The scope of this project includes pavement restoration, resurfacing, curb ramp reconstruction, and pavement striping at various locations throughout the City. The project was able to utilize green technology by using rubberized asphalt, per the Project plans and specifications. Rubberized asphalt consists 1 Meeting Date: July 18, 2023
of regular asphalt concrete mixed with crumb rubber made from recycled tires and is a noise-reducing pavement material.
The work was performed per the City Council-approved project plans and specifications.
The project experienced two major delays; one due to a required Planning permit to trim trees within an Environmental Sensitive Habitat Area (ESHA) and the second due to an unanticipated need for a Caltrans Encroachment Permit to remove traffic loops at Gl en Annie and Calle Real. Toro completed construction on February 23, 2023, under budget and within contract working days.
Public Works is recommending adoption of the proposed resolution to facilitate the final close-out of this project (Attachment 1). A Notice of Completion (Attachment 2) pursuant to Public Contract Code §20854 is recommended for approval with direction to be filed with the County of Santa Barbara, County Recorder Office.
FISCAL IMPACTS:
Total Project Costs
The Project was awarded at the September 21, 2021, City Council meeting for $5,807,003.10 with contingency contract change orders in an amount not to exceed $1,161,400.62 for an authorized construction contract amount of $6,968,403.72. The final construction cost was $5,514,594.33. The completed construction cost is less than the project award by 10 percent.
The total project cost which included conceptual design, environmental, final design, and construction was estimated to be $ 8,695,000. The Final Project Cost in Table 1 below is estimated to be $6,792,095, bringing the total project saving to approximately $1.9 million which can be used on future Capital Improvement Program (CIP) or pavement projects.

ALTERNATIVES:
The City Council may elect to direct staff not to file a Notice of Completion for the Project.
If a Notice of Completion is not filed, then the project will not be officially closed out.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GOLETA, CALIFORNIA, AUTHORIZING THE FILING OF A NOTICE
OF COMPLETION FOR THE 2020-2021 PAVEMENT
REHABILITATION PROJECT
WHEREAS, on September 21, 2021, the City of Goleta authorized award of a construction contract to Toro Enterprise, Inc. (Toro), for the 2020-2021 Pavement Rehabilitation Project;
WHEREAS, the City Engineer has evaluated the work and has determined that the work was satisfactorily completed within the City extended contract period and within budget on February 23, 2023; and
WHEREAS, the City Engineer recommends the filing of a Notice of Completion pursuant to Government Code section 20854.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GOLETA AS FOLLOWS:
SECTION 1.
The work required to be performed by said Contractor has been completed.
SECTION 2.
The work is hereby accepted and approved based on the recommendation of the City Engineer.
SECTION 3.
The Finance Department is directed to release retention posted for the completion of the project as required by the California Civil Code.
SECTION 4.
The City Clerk is directed to forthwith forward a Notice of Completion to the Recorder of the County of Santa Barbara for recording.
5 SECTION 5.
The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
