Item II. Law Enforcement Services Agreement with Santa Barbara County Sheriff’s Office for Fiscal Years 2023/24, 24/25, 25/26, and 26/27 Background
The City of Goleta contracts with the Santa Barbara County Sheriff’s Office (“SBSO”) for law enforcement services, as do the cities of Buellton, Carpinteria and Solvang (collectively, “Contract Cities”).
On June 18, 2019, the City Council approved and authorized the City Manager to execute the most recent operative agreement—that has since been amended as detailed below—for law enforcement services—i.e., the Agreement to Provide Law Enforcement Services by and between the County of Santa Barbara and the City of Goleta from July 1, 2019 through June 30, 2023 (“Agreement No. 2019-043”).
On July 20, 2021, the Council approved and authorized the Mayor to execute Amendment No. 1 to Agreement No. 2019-043 that resolved a dispute for Fiscal Year (FY) 2021/22 costs.
On September 20, 2022, the Council approved and authorized the Mayor to execute Amendment No. 2 to Agreement No. 2019-043 that resolved the dispute regarding FY 2022/23 costs and all of Goleta’s remaining obligations under the Agreement.
On June 6, 2023, the Council approved and authorized the Mayor to execute Amendment No. 3 to Agreement No. 2019-043 to allow the SBSO and Contract Cities more time to continue their efforts to negotiate a future agreement without a lapse in law enforcement services to the City. 65266.00326\41632549.1
• This additional amendment allowed the term of the Agreement to be extended an additional 90 days, and to terminate upon the earlier of the following occurrences: (i) 11:59 p.m. on September 29, 2023; or (ii) the effectiveness of the fully executed Future Agreement.
• Amendment No. 3 further specified an increase in contract cost of 7.4% over FY 22/23 costs and is subject to a subsequent adjustment to establish actual costs of service during the extended term.
• The City and the Sheriff’s Office agreed to continue future contract negotiations as expeditiously as possible, and that nothing in the amendment shall be precedential to the future agreement or cost model therein.
New Contract Key Terms
After nearly a year of negotiations, on September 5, 2023, the staff for the Contract Cities and the SBSO reached tentative agreement on key deal points needed to secure a new contract prior to the expiration of Amendment No 3. In addition to numerous contract language clarifications and improved definitions and reporting, the salient items are as follows for all the Contract Cities:
COST MODEL: Shift from the previous Deputy Sheriff Service Unit (DSSU) back to Full-Time Equivalent (FTE) positions to reflect direct and indirect costs of providing law enforcement services.
TERM: A new four-year term from July 1, 2023, to June 30, 2027. The terms of the agreement may be thereafter extended for a maximum of three (3) one-year periods, to no later than June 30, 2030, by mutual agreement of the City and County.
COSTS: A mutually agreed upon base year amount for FY 2023/24 with cost-of-living adjustment (COLA) increases in subsequent years based on the applicable Santa Barbara County MOU terms for Deputy positions in the respective Fiscal Year plus an escalator of 2.78% for that same year. In other words, the 2.78% escalator is fixed for all future years of the contract; the COLA increase for Deputies is variable based on the Deputy’s MOU then in effect.
In the case of Goleta, the application of these costs over the course of the Agreement is as follows:
• The initial year (FY 2023/24) is $10,884,869.
• In FY 2024/25, that amount would increase by 7.28% (4.5% MOU COLA increase plus
2.78% escalator) for a total of $11,667,287.
• In FY 2025/26, the contract amount is anticipated to increase by 5.28% (2.5% MOU COLA increase plus 2.78% escalator) for a total of $12,293,848; however, the increase and final contract amount are subject to change if the Deputy’s MOU is reopened prior to FY 2025/26.
• For FY 2026/27 and 2027/28 (and any extensions thereafter), the MOU COLAs are subject to future negotiation between the County and the Deputy’s bargaining unit.
Assuming for the sake of argument that the MOU maintained a 2.5% COLA increase, FY 2026/27 and 2027/28 would also be subject to a 5.28% increase in the contract amount for a total, respectively, of $12,942,964 and $13,626,352. 65266.00326\41632549.1
GENERAL LAW ENFORCEMENT SERVICES: Enhanced meet-and-confer process for level of service reviews for the City’s general law enforcement services (i.e., non-menu items).
Currently, the Agreement provides for three “posts” (24/7 patrol service) as well as services (full or partial FTE equivalency) for administrative and Contracts Bureau staff, Lieutenant, Sergeants, and Commander.
MENU ITEMS: Additional safeguards relating to payment of Menu Item services and flexibility related to changes to the provision of Menu Items (those beyond the basic patrol functions such as Community Resource Deputies, Parking Enforcement Officer, and Motorcycle Deputy positions).
COMMUNITY ORIENTED POLICING AND DEI: SBSO commits to providing law enforcement services consistent with the objectives of building trust and legitimacy, fostering a culture of transparency and accountability, maintaining a safe community, and engaging in communityoriented policing. Moreover, SBSO commits to demonstrating respect for the diversity of the CITY’s community and ensuring equity, inclusion, and access for all residents and visitors in the provision of law enforcement services.
PERFORMANCE MEASURES: Identifiable objective standards for fostering community trust, legitimacy, transparency, accountability, and maintaining a safe community.
REPORTING: More detail relating to existing practices for reporting law enforcement services statistics and data reporting, as well as additional reporting requirements in the event the County implements new systems/software that may provide additional data and statistics.
Next Steps
Final legal terms in the contract are presently being negotiated, and the parties believe all matters should be fully resolved by close of businesses on September 11, 2023. Assuming that deadline is met, County staff has informed the Contract Cities that the new Agreement for Law Enforcement Services will be placed on the Board of Supervisor’s agenda for its September 19, 2023 meeting. In order to approve the contract prior to the expiration of the Third Amendment to the existing Agreement, the City will correspondingly endeavor to place the new Agreement on its September 19, 2023 Council agenda.
Fiscal Impacts
The FY 2023/24 adopted budget amount for the contract was $10,639,936, which includes $100,000 from the Citizen’s Option for Public Safety (COPS) program allocated by the State. An additional appropriation of $244,933 from the General Fund will most likely be needed to support the full contract amount of $10,844,869. Staff plan to include this recommended appropriation as part of the September 19, 2023 report. It should be noted that staff is looking into the final FY 2023/24 COPS allocation, as $100,000 is the base amount allocated. The City received approximately $165,000 in the prior fiscal year. Updates are normally provided by the State in the middle of September. Depending on the final amount, staff will adjust the General Fund appropriation accordingly.
