Agenda Item A.8

CONSENT CALENDAR
Meeting Date: January 16, 2024
TO: Mayor and Councilmembers
SUBMITTED BY: Jaime A. Valdez, Neighborhood Services Director PREPARED BY: JoAnne Plummer, Parks and Recreation Manager SUBJECT: Amendment No. 2 to Agreement No. 2023 -022 with Filippin Engineering, Inc. for Construction Management and Engineering Services for the Community Garden at Armitos Park and the Splash Pad at Jonny D. Wallis Neighborhood Park
RECOMMENDATION:

A. Authorize the City Manager to execute Amendment No. 2 to Professional Services Agreement No. 2023 -022 with Filippin Engineering, Inc. for construction management, inspection, testing and engineering services at the Goleta Community Center, increasing the contract authority by $187,000, for a new total contract amount not-to-exceed $478,847.

B. Approve a budget appropriation of $187,000 from the Park DIF Fund Balance to the accounts identified in the fiscal impact section of the report.

BACKGROUND:

On March 21, 2023, City Council awarded a Professional Services Agreement to Filippin Engineering, Inc. to provide construction management, inspection, and testing (CMIT) services for the Community Garden at Armitos Park and the Splash Pad at Jonny D Wallis Neighborhood Park in the amount of $291,847, assuming a maximum construction timeline of six months.

On December 22, 2023, Amendment No. 1 (included as part of Attachment 1) was completed for a time extension to avoid termination of the initial contract which had an end date of December 31, 2023. As a result of Amendment No. 1, the new termination date is December 31, 2024.

DISCUSSION:

The projects were planned and awarded to run simultaneously to reduce costs and impacts to the residents. Early in the project, supply chain demands on a primary element in the Splash Pad Project, created an unforeseen extension of the projects, separating 1 Meeting Date: January 16, 2024

Page 2 of 3 ends

the efforts into two separate projects to manage. The proje ct team evaluated opportunities to reduce oversight costs, but the demands of the project and need for daily inspections increased the necessary time in the field.

In addition to the projects now running consecutively, the Community Garden Project has also experienced significant delays with materials, extending the project period by more than three months. The Splash Pad Project at Jonny D Wallis Neighborhood Park resumed in mid-November, and the team is working hard to complete this project early so the public can benefit from the new amenities this spring. The current project completion date has been pushed to the end of April, and Amendment No. 2 to this contract has the assumption of both projects finalized before May of 2024. Amendment No. 2 maintains the termination date of December 31, 2024; however, it increases the contract authority by an additional $187,000 for a new not-to-exceed total of $478,847.

FISCAL IMPACTS:

The current funding for the Community Garden Project and the Splash Pad Projec ts is currently tied up in construction contracts, including the contingency. The Community Garden Project currently has over $300,00 remaining in contingency and is expected to be completed with at least $200,000 to $250,000 going unspent. Once the proj ect is closed out, these remaining funds will be returned to the Park Development Impact Fee Fund Balance. As a result, staff is requesting an additional appropriation of $187,000 from Park DIF Fund Balance for Construction Management and Engineering Services as detailed below. Sufficient Park DIF Fund Balance is available to accommodate this appropriation and would be returned at the time project closure (completion) occurs.
