RECOMMENDATION:
Approve and authorize the City Clerk to accept the Grant Deed for a Public Easement at 22 South Fairview Avenue.
BACKGROUND:
The Cox Communication project is a private land development project covering 2.43 acres on two Assessor Parcel Numbers (APN s), 071-021-01 and 071-021-44, located at 22 South Fairview Avenue. The project involves a revised Development Plan to regulate all aspects of the existing on-site development, including the demolition of an existing 3,360 square foot building and an existing 4,124 square foot building, construction of a new 6,519 square foot single-story building, installation of two emergency power diesel generators, and other related site improvements.
The project site is Cox Communications Headquarters located at 22 South Fairview Avenue.
DISCUSSION:
During the development review process , the City included a condition of approval development plan revision Case No. 18 -093-DPRV, requiring frontage improvements along the property that comply with Americans with Disabilities Act (ADA) requirements and repair any damaged sidewalk . The develop er has made the necessary ADA improvements to the sidewalk, curb and gutter, and driveway approach. Some of the public sidewalk improvements extended into private property APN 071 -021-44 and therefore there was a need to adjust the property boundary through an offer to dedicate via a Grant Deed. COXCOM, LLC, the property owner , and staff have prepared the Grant Deed to offer as a Public Easement (Attachment 1). Public Works staff are requesting that the City Council approve and authorize the City Clerk to accept the Grant Deed for a Public Easement along 22 South Fairview.

FISCAL IMPACTS:
Recordation of the Grant Deed for the public easement will have no fiscal impact on the City. The documentation check and the easement process costs associated with the grant deed public easement will be paid for by the developer.
ALTERNATIVES:
The City Council may elect to not approve the grant deed for the subject public easement; however, doing so would result in substandard public sidewalk width that does not meet the development project conditions.
