SUBJECT: Notice of Completion of Goleta Valley Community Center Seismic Retrofit Project – CIP No. 9067 (DR4308)
RECOMMENDATION:
A. Adopt Resolution No. 24- entitled “A Resolution of the City Council of the City of Goleta, California Authorizing the Filing of a Notice of Completion for the Goleta Valley Community Center Seismic Retrofit Project DR 4308 (CIP No. 9067)”; and B. Direct the City Clerk to file a Notice of Completion with County Recorder’s Office.
BACKGROUND:
On September 20, 2022, Council approved the plans for the Goleta Valley Community Center Seismic Retrofit Project (Project) and authorized Staff to advertise the Project for construction bids. The bid solicitation was issued on November 9, 2022, and on February 7, 2023, City Council awarded the construction contract to Edwards Construction Group, Inc. (Edwards) in the not-to-exceed amount of $3,801,596 with additional change order authority of $950,400.
DISCUSSION:
The General Services Department issued a Notice to Proceed to the Contractor to commence work on May 30, 2023. The original construction timeline was to be 90 calendar days. However, s everal items extended construction beyond the initial period construction period, including adding appropriate additional contract work to repair damaged areas, removing additional asbestos from the roof, redesigning the barrel roof, seismically bracing the bell tower , adding roof vents to comply with Building Code requirements, as well as delays in receiving materials including the galvanized bracing and the new skylight for the women’s restroom.
Construction was substantially completed in early January of 2024, when the City reoccupied the Goleta Community Center. The facil ity remained closed to the public to allow City staff to further renovate and prepare the building for public use. Edwards completed final punch list items in February 2024, with the final item, installation of a roof vent, completed during the first week of March 2024.

The General Services Department recommends adoption of the proposed resolution to facilitate the final close-out of this project, including filing of a Notice of Completion with the County Recorder’s Office.
GOLETA STRATEGIC PLAN:
Implementation of seismic retrofit improvements directly supports Objective 5.1.2 of the City's Strategic Plan: Complete design and seek funding for Goleta Community Center seismic upgrades and ADA improvements.
FISCAL IMPACTS:
Project Construction Costs
The project was completed within budget. To date, a total of 20 seismic -related change orders have been issued to Edwards, representing a net cost of approximately $137,900.
Four additional change orders were issued to perform other maintenance-related work in the facility, including painting exterior window shade supports, repairing interior plaster and paint, painting the auditorium below the trusses, modifying existing electrical wiring in the attic spaces, and removing hundreds of yards of dilapidated cabling throughout the exterior of the building. Since this work fell outside of the scope of the FEMA -funded project, the cost of approximately $82,000 was paid for exclusively with General Fund monies; no part was charged to the FEMA grant.
Beyond ch ange orders issued to Edwards, d ue to the extended construction period discussed above, the City also issued several change orders to increase the budget related to design and engineering, and construction management.
The budget worksheet for the construction and the overall estimated project costs are shown in the tables below. Note that the City is still processing final invoices so some of the costs outlined below are estimates pending issuance of final payments.
To fulfill FEMA grant requirements and deadlines, there is some urgency to filing the NOC now before all project accounting is complete. Staff would be glad to submit to Council the final project budget at a future date.

ALTERNATIVES:
The Council may elect to direct staff not to file a Notice of Completion for the Seismic Retrofit Project. If a Notice of Completion is not filed, then the City will fail to comply with FEMA grant requirements.

WHEREAS, on February 7, 2023, the City Council authorized the City Manager to execute a construction contract with Edwards Construction Group, Inc. for the Goleta Valley Community Center Seismic Retrofit Project; and WHEREAS, the City Engineer and General Services Director have evaluated the work and has determined that the work was satisfactorily completed within the City extended contract period and within budget; and WHEREAS, the City Engineer and General Services Director have evaluated the work and has determined that the work wa s satisfactorily completed within the City extended contract period and within budget; and WHEREAS, the City Engineer and General Services Director recommend filing of a Notice of Completion pursuant to Government Code section 20854.
NOW, THEREFORE, B E IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF GOLETA, AS FOLLOWS:
SECTION 1.
The work required to be performed by said Contractor has been completed.
SECTION 2.
The work is hereby accepted and approved based upon the recommendation of the City Engineer and General Services Director.
SECTION 3.
The Finance Department is directed to release retention posted for the completion of the project as required by the California Civil Code.
SECTION 4.
The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
