CPMS CONSENT CALENDAR
Meeting Date: March 19, 2024
TO: Mayor and Councilmembers
SUBMITTED BY: Peter Imhof, Planning and Environmental Review Director PREPARED BY: Kathy Allen, Supervising Senior Planner
SUBJECT: Report on Issuance of Emergency Permit for Removal of Sixteen (16) Trees at Pacific Oaks Apartments
7170 Davenport Rd; Case No. 23-0003-EMP
RECOMMENDATION:
Receive and file this report.
BACKGROUND:
On March 7, 2024, the Planning and Environmental Review (PER) Department issued an Emergency Permit (EMP) to allow the property owner of the Pacific Oaks Apartments, the Towbes Group, to remove sixteen (16) trees which were in danger of falling and causing potential harm to life and property. During the rain event on February 3, 2024, a large Carrot Wood tree fell on the apartment complex carport and two vehicles, damaging both vehicles and the carport. Given this incident of the falling tree and an increase in the urgency to remove the other sixteen (16) trees, the applicant requested that the City process the emergency permit for the removal of these trees.
DISCUSSION:
As indicated, the Emergency Permit was issued on March 7, 2024, consistent with the City’s Municipal Code Chapter 17.64. This staff report fulfills notification to the City Council per Municipal Code Chapter 17.64.030(G). The City required onsite notices , which were posted on March 7, 2024, and mailed notices to all property owners and tenants within 500 feet of the property were sent on March 6, 2024.
PER staff reviewed the submitted emergency permit application materials, including the arborist’s report. The subject 16 trees are in poor to moderate health and range in size from 2 inches diameter at breast height (DBH) to 39.5 inches DBH. Due to the recent storms creating soggy soils and the health of the trees, some with compromised root systems, more trees are prone to falling. To protect the safety of the residents of the Pacific Oaks Apartments and to prevent further dam age to the property, staff concluded 1 Meeting Date: March 19, 2024
that an emergency existed that warranted immediate action . PER staff determined that the findings of Section 17.64.030(D) of the Goleta Municipal Code could be made. As such, the EMP was issued on March 7, 2024. All the tree removal work will occur on private property and there will be no impact to public streets.
A follow-up Land Use Permit, Substantial Conformity Determination, and Design Review approval for the removal of the 16 trees is required to be processed by the City. The applicant has submitted these applications to the City, including the tree removals under the EMP and also for other non-emergency proposed changes to the Pacific Oaks Apartment’s original landscape plan and site plan.
This report satisfies the reporting requirement to the City Council. A copy of the EMP is provided as Attachment 1.
GOLETA STRATEGIC PLAN:
The work approved under this Emergency Permit furthers the City’s Strategic Plan as follows:
City-Wide Strategy: Maintain a Safe Community
FISCAL IMPACTS:
There is no fiscal impact associated with this item.
ALTERNATIVES:
There are no alternatives as this action is to receive and file this report.

The City of Goleta issues this Emergency Permit for the removal of sixteen (16) trees located at 7170 Davenport Road (Pacific Oaks Apartments), as described below, based upon the required findings and subject to the attached terms and conditions. If you have any questions regarding this Emergency Permit, pl ease contact Kathy Allen, Supervising Senior Planner, at (805) 961 - 7545.
PERMIT APPROVAL/ISSUANCE DATE: March 7, 2024
PERMIT EXPIRATION DATE: April 5, 2024
PROJECT DESCRIPTION SUMMARY:
The agent, Suzanne Elledge Planning and Permitting Services (SEPPS) applied for an emergency tree removal permit and the non -emergency zoning permit on behalf of the property owner, the Towbes Group, on November 17, 2023. The request included the removal of sixteen (16) trees located at the Pacific Oaks Apartments. With the initial application for the Emergency Permit and the associated non -emergency zoning permit, the applicant submitted an arborist report dated May 13, 2022. Upon review of the May 13, 2022 report, staff requested clarifications from the arborist to document the determination of emergency given that the report was prepared 18 months prior to the emergency permit request.
During the rain event on February 3, 2024, a large Carrot Wood tree fell on the carport and two vehicles at the Pacific Oaks Apartments at 4 a.m., damaging both vehicles and the carport. Given this incident of the falling tree and an increase in the urgency to remove the other sixteen (16) trees, the applicant has requested that the City process the emergency permit for the removal of the sixteen (16) trees. Staff attempted to contact the arborist who prepared the May 13, 2022 report to obtain the arborist’s updated input regarding the health of these sixteen (16) trees. The arborist who prepared the report is no longer with the firm, RRM Design Group (San Luis Obispo office), and RRM Design Group does not currently have a licensed arborist on its staff at the San Luis Obispo office.
Due to the recent storms creating soggy soils and the poor to moderate health of the trees with compromised root systems, a situation has developed where more trees could be prone to falling.
To protect the safety of the residents of Pacific Oaks Apartments and to prevent further damage to the property, the applicant is requesting immediate removal of the sixteen (16) trees listed in Attachment C and shown on the site plan in Attachment D, even though it is not possible to obtain an updated review by the original arborist. Given the hazardous conditions described above and the tree that has already fallen on the subject property, staff concurs with the applicant that an emergency exists that warrants immediate action.
Removal of the trees will occur during normal business hours by the tree company contracted by the Towbes Group. Residents will be notified of the work prior to starting the tree removal. All work will be on private property and there will be no impact to the public streets. The sixteen trees range in size of 2 inches (diameter at breast height, DBH) to 39.5 inches DBH. The type of 4 trees includes Brazilian Pepper, Eucalyptus (red ironbark and silver dollar gum), Canary Island Pine, and New Zealand Laurel.
The Pacific Oaks Apartments site will be accessed via four (4) driveways including one (1) driveway off of Pacific Oaks Road and three (3) driveways off of Davenport. Internal access driveways are located throughout the property.
None of the trees proposed to be removed are within the 100’ streamside setback. A follow -up Substantial Conformity Determination and Design Board Review will be conducted for the removal of these trees in addition to other revisions to the approved Landscape Plan that was associated with the original Development Plan for the Pacific Oaks Apartment development.

FINDINGS OF APPROVAL
Emergency Permit 23-0003-EMP
The Director of Planning & Environmental Review grants the Emergency Permit upon reasonable terms and conditions, including an expiration date and a requirement for subsequent discretionary and ministerial permits, as required by GMC Title 17, Chapter
17.64 (Emergency Permits), based on the following verification and findings:
Section 17.64.030 ( B & D) – Verification of Emergency and Required Findings
A. Based on the facts, the Director finds that an emergency exists, and the nature of the emergency requires action more quickly than provided for by the procedures for permit processing, and the action will be completed within 30 days.
Processing of the normally required permit through the local review process would significantly and adversely delay a prompt response to the current hazardous situation. Local review of a project takes approximately six (6) to eight (8) weeks; immediate action is required to address the public safety threat posed by the recent storms resulting in soggy soils. Combined with the poor to moderate health of the trees with compromised root systems , these conditions create a situation where additional trees could be prone to falling.
B. Public comment on the proposed emergency action has been reviewed.
Emergency permits may be issued immediately, without public notice and comment, in the event of a significant safety hazard to members of the public , private property owners, and public infrastructure. In this instance, no public comment has been solicited given the need to do the work. However , in accordance with Section 17.64.030(C) , notice will be posted on site in three locations in addition to mailed notices to property owners and tenants within 500 feet of project site as soon as possible, during the effective period of this emergency permit. Public comment will be taken and responded to, as appropriate.
C. The work proposed would be consistent with the requirements of the General Plan and Title 17.
The purpose of the work is to alleviate the current public and private safety hazards by removing the existing trees that pose a danger of falling on residents of an apartment complex.
The need to maintain public safety is consistent with applicable policies of the GP/CLUP, primarily Safety Element SE 1.7 (abatement of public safety hazards) .
One tree has already fallen at the Pacific Oaks Apartments and the applicant has provided an Arborist’s report, dated May 13, 2022, identifying other trees that are in poor to moderate health with poor root systems that pose a danger of falling. 6 Case No: 23-0003-EMP
Project Name: Pacific Oaks Apartments
Project Address: 7170 Davenport Road
APN: 073-230-050
In addition, the project will be consistent with the City’s Zoning Ordinance, Title 17 of Goleta Municipal Code. All work would be limited to the hours between 8:00 AM and 5:00 PM to mitigate the noise impacts resulting from the removal of the trees.
The issuance of this Emergency Permit is in accordance with the procedures for granting Emergency Permits pursuant to Title 17.64. The emergency action taken by the City is permitted under Title 17.64.020, which recognizes that certain actions warrant immediate, special consideration to lessen or remediate an emergency.
The emergency action is expected to require approximately 5-7 business days to complete. Follow-up permits pursuant to Title 17.64 will be required to validate the emergency work. This Emergency Permit, as well as all follow-up permits, will be noticed according to the permit procedures outlined in the Title 17.64.030 C., thus allowing opportunity for public comment.
In addition, the Emergency Permit will be posted at three conspicuous locations along the perimeter of the property. Title 17 does not require public noticing before emergency actions can begin. The project will be reviewed in greater detail during any required City review and additional conditions may be imposed as necessary or appropriate. Impacts to on-site environmental resources from emergency work will be mitigated by the imposition of Emergency Permit conditions.

CONDITIONS OF APPROVAL
Emergency Permit 23-0003-EMP
Standard Conditions
1. The Emergency Permit shall expire on April 5, 2024. In addition, the applicant shall apply for approval of a Substantial Conformity Determination and Design Board Review within 30 days of issuance of this emergency permit, if needed. All information required for a complete application shall be provided within 30 days of this Emergency Permit.
2. This Emergency Permit is based upon and limited to compliance with the Project Description, as described in this Emergency Permit, and the conditions of approval.
The applicant’s contract crews conducting the tree removals shall not deviate from the project description or conditions unless such deviation is reviewed and approved by the Director of Planning & Environmental Review
and determined to be in conformity
with this permit. Deviations may require approved changes to the permit and/or further environmental review. Deviations without the above-described approval will constitute a violation of the permit.
3. The Director of Planning & Environmental Review may order an immediate suspension of all, or part of the work authorized under this permit , if the Director determines that such action is necessary to avoid or mitigate significant impacts to health and safety or the environment. Violation of any of the conditions of this permit constitutes a violation of the GMC Title 17, the Zoning Ordinance. Appropriate measures include revocation of the permit, stop work order and other corrective measures as determined by the City.
Special Conditions
4. The emergency action is expected to require approximately 5-7 business days to complete. Follow-up permits pursuant to Title 17.64 will be required to validate the emergency work.
5. All work, either to address the current emergency and/or complete processing and removal of all debris shall be limited to the hours of 8:00 AM to 5:00 PM , Monday through Friday, not including holidays.
6. As recommended in the Biological Report prepared by Watershed Environmental, Inc on November 28, 2023, if tree removals must occur during the bird nesting season (February 1–September 1), breeding/nesting bird surveys shall be performed no more than seven (7) days before the trees are removed by a qualified City of Goleta or County of Santa Barbara approved biologist. Nesting bird pre- construction surveys shall occur at the locations where trees will be removed and should extend outward 8 Case No: 23-0003-EMP

500 ft. or to the property line, whichever is closer. If occupied bird nests or cavity roosts are found, the biologist shall determine an appropriate buffer zone that considers the bird species, nest location, nest height, existing level of disturbance in the vicinity of the nest, and proposed construction activities. The buffer zone should range from 100 ft. for nesting passerine species to 500 ft. for nesting raptors, and shall be demarcated with bright-orange construction fencing, flagging, construction lathe, or other means to mark the boundary, unless the City approved biologist considers a smaller buffer adequate based on the factors listed above.
