SUBJECT: Notice of Completion for Various Public Works Projects RECOMMENDATIONS:
A. Adopt Resolution No. 24-___ entitled “A Resolution of the City Council of the City of Goleta, California, Authorizing the Filing of a Notice of Completion for 5800-2 Dearborn Place & Armitos Avenue ADA Improvements Project (Phase II);” B. Adopt Resolution No. 24-___ entitled “A Resolution of the City Council of the City of Goleta, California, Authorizing the Filing of a Notice of Completion for the 9099 Crosswalk at Calle Real/Fairview Center – Pedestrian Hybrid Beacon (PHB) Project;”
C. Direct the City Clerk to file a Notice of Co mpletion with the County Recorder’s Office for each completed project.
BACKGROUND:
5800-2 Dearborn Place & Armitos Avenue ADA Improvements Project (Phase II) The Public Works Department solicited competitive bids in the Santa Barbara Independent on June 29, 2023, and July 13, 2023. Public Works staff also posted the contract documents on the City’s website and the City’s PlanetBids portal. The bids were opened virtually via PlanetBids on July 25, 2023. The City received a total of one (1) bid from Toro Enterprises, Inc. (Toro) . The City Council awarded the project at the October 3 , 202 3 council meeting to the lowest bidder, Toro. The project began on November 13, 2023, and construction was completed on December 12, 2023. 9099 Crosswalk at Calle Real/Fairview Center – Pedestrian Hybrid Beacon (PHB) Project 1 Meeting Date: May 7, 2024
The Public Works Department solicited competitive bids for the Project in the Santa Barbara Independent on June 30, 2022, and July 7, 2022, and posted the contract documents on the City’s web site and the City’s electronic bidding portal, PlanetBids.
The bids were opened virtually via PlanetBids on July 21, 2022. The City received a total of three (3) bids from J&H Engineering General Contractors, Inc. (J&H), Toro, and PTM Engineering, Inc. The City Council awarded the project at the council meeting on August 16, 2022, to the lowest bidder, J&H. Due to material lead times, t he project began on April 10, 2023, and construction was completed on October 17, 2023.
DISCUSSION:
5800-2 Dearborn Place & Armitos Avenue ADA Improvements Project (Phase II) On October 30, 2023, Public Works issued Toro a Notice to Proceed to commence work on November 13 , 2023. Construction activities consisted of ADA sidewalk improvements, including the American Disabilities Act ADA curb ramp, curb & gutter, ribbon gutter, ADA driveway approach, and detective warning s at the intersection of Dearborn Place & Armitos Avenue.
Public Works is recommending the adoption of the proposed resol ution to facilitate the final close-out of this project (Attachment 1). A Notice of Completion pursuant to Civil Code section 9204 is recommended for approval and direction to be filed with the County of Santa Barbara, County Recorder Office (Attachment 2). 9099 Crosswalk at Calle Real/Fairview Center – Pedestrian Hybrid Beacon (PHB) Project On April 10, 2023, Public Works issued J&H a Notice to Proceed to commence work on April 10, 2023 . The project consisted of a crosswalk on Calle Real approximately 550 feet west of the Fairview Avenue intersection. A Pedestrian Hybrid Beacon (PHB) was constructed to enhance pedestrian safety and visibility. The installation included PHB signals on poles with mast arms, pedestrian push buttons, striping, and signage.
Public Works is recommending the adoption of the proposed resolution to facilitate the final close-out of this project (Attachment 3). A Notice of Completion pursuant to Civil Code section 9204 is recommended for approval and direction to be filed with t he County of Santa Barbara, County Recorder Office (Attachment 4).
FISCAL IMPACTS:
5800-2 Dearborn Place & Armitos Avenue ADA Improvements Project (Phase II) The project was awarded at the October 3, 2023, City Council meeting for $208,780. In addition, a contract contingency for the project was approved in an amount not to exceed $41,756. The final construction cost was $213,377.15. The construction cost is greater than the construction award cost by 2.2%, which is within the project’s 20% contingency and was due to an increase in quantities.

9099 Crosswalk at Calle Real/Fairview Center – Pedestrian Hybrid Beacon (PHB) Project
The project was awarded at the August 16, 2022 , City Council meeting for $464,332. In addition, a contract conting ency for the project was approved for not exceeding $93,000. The final construction cost was $510,759.26. The construction cost is greater than the construction award cost by 10%, within the project’s 20% contingency. This was due to utility conflicts, unforeseen site conditions, and increased quantities.
ALTERNATIVES:
The City Council may elect to direct staff not to file a Notice of Completion for any of the various projects . If a Notice of Completion is not filed , then the project will not be officially closed out.

WHEREAS, on October 3, 2023, the City of Goleta authorized award of a construction contract to Toro Enterprises, Inc. , for the 5800-2 Dearborn Place & Armitos Avenue ADA Improvements Project (Phase II); and
WHEREAS, the City Engineer has evaluated the work and has determined that the work was satisfactorily completed within the City contract period and within budget; and
WHEREAS, the City Engineer recommends the filing of a Notice of Completion pursuant to Civil Code section 9204.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GOLETA AS FOLLOWS:
SECTION 1.
The work required to be performed by said Contractor has been completed.
SECTION 2.
The work is hereby accepted and approved based on the recommendation of the City Engineer.
SECTION 3.
The Finance Department is directed to release retention posted for the completion of the project as required by the California Civil Code.
SECTION 4.
The City Clerk is directed to forthwith forward a Notice of Completion to the Recorder of the County of Santa Barbara for recording.
SECTION 5.
The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
