Location
Base Bid Cathedral Oaks Road (Winchester Canyon Road to Paseo del Pinon) Cathedral Oaks Road (Paseo del Pinon to Evergreen Drive) Phelps Road (Pacific Oaks Road to Storke Road)
Colusa Drive (Del Norte Drive to Calle Real)
Alternate 1 Caroldale Place (Caroldale Lane to cul-de-sac) Caroldale Lane (Camino Laguna Vista to La Patera Lane)
Hollister Avenue (Cathedral Oaks Road to City Right of Way) Alternate 3 Storke Road (Hollister Avenue to US 101 On-Ramp) Alternate 4 North Fairview Avenue (US 101 On Ramp to Calle Real) On June 4, 2024, the Public Works Department presented the City Council with three options for bike lanes and parking modifications along Cathedral Oaks Road, spanning from Paseo Del Pinion to Northgate Drive . Subsequently, on July 16, 2024, the City Council decided to proceed with Alternative 3. This option featu res bike lanes next to the curb, with parallel parking shifted between the bike and travel lanes, and the implementation of back-in angled parking on the north side of Cathedral Oaks Road.

DISCUSSION:

The scope of work for this project includes pavement restoration and reconstruction, resurfacing, Americans with Disability Act (ADA) curb ramp upgrades, striping improvements, and traffic striping and marking replacement.

The City issued Granite the notice to proceed with construction on July 15, 2024, and construction on the project began July 29, 2024 , on Phelps Road. Granite has performed pavement work on every project road except for Caroldale Place. During the project's construction, unforeseen site conditions necessitated the City to direct the contractor to remove and replace additional asphalt sections and modify the pavement operations on Cathedral Oaks. These measures are being undertaken to address the increased pavement failures. Public Works staff recommends taking advantage of efficiencies of proximity and having the contractor improve areas adjacent to the current work areas, including the overlay of the bike path along Cathedral Oaks and intersection resurfacing at Storke Road and Hollister Avenue. An increase in the contingency budget would b e required to take advantage of these considerations. When the project was awarded, staff requested a contingency of 20% of the contract amount, and staff is now requesting to increase the contingency budget to 27% of the original contract amount to take on these additional tasks. Further competitive bidding to secure such work would not produce any advantage to the City, as the cost of mobilization that would need to be 2 Meeting Date: September 17, 2024

priced into such bids and which Granite is able to avoid because it has already mobilized would cause such bids to substantially exceed in price that which Granite would charge, and therefore such increases are exempt from competitive bidding under Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.App.3d 631, 636.

Public Works staff recommends that the City Council approve and authorize the Public Works Director to increase the change order in the amount of $ 367,820 for a construction contingency amount of $1,418,420.

The total estimated costs and funding sources associated with the Project are listed in Table 3 below. The additional 7% of construction contingency will be covered by FY 24/25 General Fund Account.
