CPMS CONSENT CALENDAR
Meeting Date: May 20, 2025
TO: Mayor and Councilmembers
SUBMITTED BY: Luz “Nina” Buelna, Public Works Director
PREPARED BY: Dan Rowell, Environmental Services Project Manager SUBJECT: 2025 – 2026 MarBorg Proposed Solid Waste Rate Increase RECOMMENDATION:

Adopt Resolution No. 25-__, entitled “A Resolution of the City Council of the City of Goleta, California, Increasing Solid Waste Maximum Rates.” BACKGROUND:

Franchise Agreement with MarBorg Industries
On April 5, 2011, the City of Goleta approved Franchise Agreement No. 2011 -023 with MarBorg Industries (MarBorg) to provide citywide residential and commercial solid waste collection services.

Annual Solid Waste Rate Adjustments
Following the Proposition 218 Protest Hearing held on May 17, 2022, the City Council authorized annual adjustmen ts to solid waste service fees beginning July 1, 2023, and continuing each July 1 through 2028. These adjustments may account for inflation per the California Price Index (CPI) and disposal (tipping) fee changes. Increases are subject to the following limits:
 Rate adjustments must not exceed 10% in any given year.  Any increase above 10% or for reasons other than CPI or tipping fees requires a Proposition 218 protest hearing.

The proposed Fiscal Year 2025–2026 rate increase does not exceed 10%, so no hearing is required.

Franchise Agreement Rate Adjustment Process
The Franchise Agreement sets a “Maximum Rate” cap, which limits what MarBorg can charge residential and commercial customers. Each year, MarBorg may request a rate increase up to that cap.
 Per Section 12.2 of the Agreement, MarBorg must submit a formal request and supporting documentation for any rate increase.
 If approved, the new rates would take effect on July 1, 2025.

Two factors determine eligible rate adjustments:

1. Collection Costs: The Los Angeles -Long Beach -Anaheim CPI from the U.S.

Bureau of Labor Statistics can be adjusted based on inflation.

2. Disposal Costs: Can be adjusted based on changes in the tipping fee charged by the County of Santa Barbara at the Tajiguas Landfill.

DISCUSSION:

FY 2025/26 Solid Waste Collection Rates
On March 12, 2025, Public Works staff received a request from MarBorg Industries for a rate increase, as outlined in Attachment 1. Below is a summary of the rate adjustment request and its components:

1. Rate Structure
As defined in the Franchise Agreement, the solid waste rates consist of two components:
 Service Component (60.2%) – Adjusted annually based on the Consumer Price Index (CPI).
 Disposal Component (39.8%) – Adjusted based on actual tipping fee costs set by the County of Santa Barbara.

2. CPI-Based Adjustment (Service Component)
Public Works staff has reviewed and verified the CPI data submitted by MarBorg.

The CPI change from December 2023 to December 2024 is 3.42%. This percentage is applied to the service component:
 3.42% × 60.2% = 2.058%
The result is rounded up to 2.06% for the FY 2025–26 rate adjustment.

3. Tipping Fee Adjustment (Disposal Component)
2 Meeting Date: May 20, 2025

Page 3 of 6 ends

Public Works staff also reviewed the request for an increase in the disposal component, based on updated tipping fees from the Santa Barbara County. The changes are as follows:
 Trash, Recycling, and Food Waste fees will increase from $189.00/ton to $196.50/ton, an increase of $7.50/ton.
 Green Waste fees will increase from $56.00/ton to $58.00/ton, an increase of $2.00/ton.

Public Works staff has reviewed and confirmed that the tipping fee increase provided by the County of Santa Barbara for Fiscal Year 2025 –26 is 3.95%. This information is included in MarBorg’s rate adjustment request letter and h as been independently verified by City staff in coordination with County staff. These increases in tipping fees result in a 3.95% increase to the disposal component, which, when applied to the 39.8% disposal portion of the rate, results in:
 3.95% × 39.8% = 1.57% increase for FY 2025–26.

Both tipping fee increases are associated with the Tajiguas ReSource Center. The processing facility recovers recyclables and organics from the trash waste streams to prevent them from being landfilled. Additionally, food waste will be recovered and sent to an anaerobic digester to turn it into usable compost. The facility will increase the area ’s recycling rates upwards of 85%, generate green energy , reduce greenhouse gas emissions (Methane emissions), and allow the City to comply with regulatory requirements.

Under the terms of the Franchise Agreement, this 3.95% increase is applied only to the disposal component of MarBorg’s total solid waste revenue, representing 39.8% of the overall rate structure.

The overall rate increase is (2.06% CPI + 1.57% tipping fee), which equals 3.63%. Since the increase is less than 10% , it does not require a Proposition 218 Protest Hearing process.

In accordance with Franchise Section 12.2.1, MarBorg, shall send out a rate increase notice to all accounts forty-five (45) days prior to the effective date of the increase.

If the City Council approves the rate increase by Resolution (Attachment 2), the approved rates will be effective July 1, 2025. The impact on residential and commercial rate payers is shown in Table 1 of select residential and commercial rates. The full rate schedule is included in Attachment 3.

o Customer Satisfaction: On a monthly basis, MarBorg provides the City with a list of complaints received and their resolution. Most complaints relate to missed pick- ups, carts placed out late, or extra material for collection. There are no longstanding unresolved issues that need addressing.
o Timely Paymen t of fees : MarBorg pays all fees to the City on time and in accordance with the Franchise Agreement.
o Competitive Rate Guarantee: Public Works staff has reviewed the existing rates of the County of Santa Barbara and the proposed rates of the City of Sant a Barbara. While the actual service level and days of service vary between agencies, the City of Goleta rates are equal to or lower than those in the surrounding area.

This is in accordance with Section 12.3 of the Franchise Agreement, Competitive Rate Guarantee.
o Special Collections: MarBorg provides special collection services (bulky items, batteries, waste, and major appliances or “white goods”) at no additional expense.

Each residential property is entitled to four (4) on-call services per fiscal year, and multi-family units each get one (1) collection per unit . These collections include bulky item collections . Bulky items include furniture, white goods, green waste, electronic waste, fluorescent bulbs, household batteries , and clothing. Note that electronic waste and white goods are in unlimited quantity. Since implementing the number of bulky collections to four and offering them at multi-family complexes, we have seen an increase in annual requests of 40%.
o Sharps and Goleta Buyback Center: MarBorg continues to provide a mail-back program for sharps and access , at no additional cost, to the Goleta Buyback Center. This center accepts antifreeze, batteries, oil, paint, fluorescent bulbs, compact discs, cell phones, computers, televisions, and other electronic waste. o Participation in local events and Community clean-ups: MarBorg continues to proactively participate in local clean-up events as requested by the City. o Maximum Rates Adjustment Request: MarBorg submitted a request to the City on March 12, 2025 , to adjust the Maximum Rates effective July 1, 2025. Per Section 12.2.1 MarBorg did not meet the agreement requirement to submit a rate increase request at least one hundred and twenty days (120) or by March 3, 2025.

The City received the request fourteen (14) days late, but City staff recommends that City Council approve the increase and waive the breach of contract as immaterial.

The Public Works Department concludes that the contractor, MarBorg, is in compliance with the Franchise Agreement and has faithfully submitted the request for the rate increase. Public Works staff, through the writing of this report , support the findings and recommend the requested rate increase pending receiving any letters of concern from the public.

FISCAL IMPACTS:

The overall increase to the Mar Borg customers/rate payers will be 3.63%, with specific rates provided in Attachment 3.

Under the Franchise Agreement, the City receives from MarBorg a monthly 5% Franchise Fee and a monthly 12% Environmental Services Program Fee. These fees are calculated on the adjusted gross monthly revenue derived from franchise collection operations in the City and remitted to the City monthly. A $28,955 City revenue increas e is projected for the Franchise Fee, and a $69,193 City revenue increase is projected for the Environmental Services Fee for FY 2025/2026 compared to FY 2024/2025. Under the Franchise Agreement’s rate model, all residential and commercial rates are increased uniformly.

ALTERNATIVES:

Council may elect not to approve the rate increase at this time, keeping the existing rates in place. At that time, MarBorg may, in accordance with Section 19.1.3 Notice of Appeal, file a notice of appeal citing its f actual contentions and providing all associated back -up documentation. Per the Franchise Agreement, the City Manager shall decide on the matter within 30 days of receipt of the appeal.

Ms. Nilsson,
As outlined in MarBorg’s contract with the City of Goleta, Article 12, Section 12.2, rates shall be adjusted each July 1. The method of determining this rate adjustment is defined by Amendment 1, approved September 5, 2017. Section 12.2.1 of this amendmen t states that the Contractor’s Recurring Rate Revenue shall be organized into a Service Component and Material Tipping Fee Component. The Service Component shall be ad justed based on the ch ange in the Consumer Price Index (CPI). The Material Tipping Fee Co mponent shall be adjusted to reimburse the Contract for its actual Material Tipping Fee Cost.

Based on the monthly billing from July 2024 th rough February 2025, and the actual material tipping fees, the weighting of the above components is as follows:

Component Weight Current Rate
Revenue
Service 60.2% $7,374,924
Disposal 39.8% $4,880,304
Total 100% $12,255,228

The change in CPI from December 2023 to Dece mber 2024 is 3.42%, as determined by the U.S.

Department of Labor, Bureau of Labor Statistics. This value was determined for the Los Angeles area. The relevant BLS report is attached. An increase of 3.42% of the Service Component results in an additional $252,514 in annual revenue.

On July 1st, 2025, we also expect the County of Santa Ba rbara to raise the tipping fee for trash, recycling, and foodwaste from $189 to $196.50/ton, and the greenwaste tipping fee from $56 to $58/ton.

With the implementation of the Minimum Delivery Agreement (MDA) between the City of Goleta and the County of Santa Barbara, these rates must cover the costs of either the MDA tons or the actual annual tons, whichever is greater. Acco rding to our calculations, the City of Goleta delivered 27,284 tons of MDA-qualifying material to the County. The MDA requirement is 28,292 tons. Of this, we estimate that 3,693 tons will be delivered from franchise roll-off customers and 8 therefore does not need to be incorporated into the rates. That leaves 24,599 tons of MDA material, as well as 4,128 tons of greenwaste (t he actual amount collected over the last 12 months). This will amount to $192,746 in increase d tipping fees over the course of the year, a

3.95% increase over the current tip fees.

The overall effect on the rates is as follows:

Component Revenue
Adjustment
Percent of
Revenue
Percent
Increase
Resulting
Increase
Service $ 252,514 60.2% 3.42% 2.06%
Disposal $ 192,746 39.8% 3.95% 1.57%
Total $ 445,260 100% 3.63%

An increase of 3.42% on 60.2% of the revenue is 2.06% (.0342 x .602 = .0206).

An increase of 3.95% on 39.8% of the revenue is 1.57% (.0395 x .398 = .0157).

The total increase in revenue needed from the cu rrent fiscal year to the next fiscal year is $445,260, which includes the increases in projecte d material tip fees, and the CPI increase applied to the service component of the rates.

Based on these calculations, we propose the at tached rates for the 2025/ 2026 year. All rates have been increased by 3.63% over the current rates.

Sincerely,

Derek Carlson

Resolution No. 25-__, entitled “A Resolution of the City Council of the City of Goleta, California, Increasing the Solid Waste Maximum Rates”
20 RESOLUTION NO. 25-__

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

GOLETA, CALIFORNIA, INCREASING SOLID WASTE MAXIMUM
RATES

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GOLETA, AS FOLLOWS:

SECTION 1.

On Tuesday, May 20, 2025 , the City Council held a duly noticed meeting with respect to the solid waste maximum rates.

SECTION 2.

Section 53756 of the California Government Code authorizes the City to adopt a schedule of fees or charges authorizing automatic adjustments for inflation, provided that the City Council adopts such schedule of fees or charges for a period not to exceed five years. The City Council hereby adopts the increase in solid waste collection fees for CPI and tipping fee totaling 3.63% as follows:
a) Beginning July 1 , 20 25 and through June 30, 202 6, the Service Component of the Maximum Rates shall be increased 2.06%, which reflects the change in the Los Angeles -Riverside-Orange County Consumer Price Index (CPI), from February 2020 to February 2021, as published by the U.S. Department of Labor’s Bureau of Labor Statistics. b) Beginning July 1, 2025, and through June 30, 2026, the Material Tipping Fee Cost component of the Maximum Rates will be increased by 1.57% to reflect the increase to the refuse, recycling , and green waste tipping fees as established by Santa Barbara County.
c) This resolution is adopted in accordance with Resolution 22 -18, which provides that b eginning on July 1, 2023, and each July 1 thereafter, through and including July 1, 2028, the rates for the solid waste service fees identified above may be adjusted annually to account for CPI and disposal fee c osts, pursuant to the franchise agreement terms, not to exceed 10% per year, and in no event shall such an increase cause the solid waste service fees to exceed the cost of providing service. If tipping fees or CPI would require greater than a 10% increas e in any given year, or if additional fees are warranted for any other reason, a protest hearing will be conducted in compliance with Proposition 218.

SECTION 3.

The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
