SUBJECT: Amendment No. 1 to Professional Design Services Agreement 2024- 045 with Jeff rey Miller Architecture and Design (JM|A+D ) for the Goleta Valley Library ADA, Safety, and Building Improvement Project (CIP 9130)
RECOMMENDATION:
A. Authorize the City Manager to execute Amendment No. 1 to Professional Design Services Agreement 20 24-045 between the City of Goleta and Jeffrey Miller Architecture and Design, to expand the scope of work , update the fee schedule, and add $ 174,311 to the compensation , thereby increasing the not -to-exceed amount to $854,295; and
B. Authorize a budget transfer of $128,633 from various operating accounts into the Capital Project accounts for the Goleta Valley Library ADA, Safety, and Building Improvement Project (CIP 9130) as described in the Fiscal Impacts Section.
BACKGROUND:
In October of 2023, the City received a $4.2M Building Forward Library Facilities Improvement Program grant (Grant) from the California State Library to make several infrastructural improvements to the Goleta Valley Library (Library). On December 19, 2023, Council adopted Resolution No. 23-75, authorizing the City Manager to accept the grant funds and execute the grant agreement.
On May 21, 2024, Council authorized the City Manager to execute an agreement with Jeffrey Miller Architect and Design (JMAD) for Architectural and Engineering services for the Goleta Valley Library ADA, Safety, and Building Improvements Project (Project) a nd to accept a donation of $250,000 from the Friends of the Goleta Valley Library to fund the City’s grant match for the Americans with Disabilities Act (ADA) restroom improvements portion of the project. On May 6, 2025, Council authorized the City Manager to execute 1 Meeting Date: June 17, 2025
an agreement with Kitchell/CEM for Construction Management, Inspection, and Testing services for the project.
DISCUSSION:
The contract amendment consists of two additions to the design scope:
Required Design Modifications:
This component addresses design changes necessitated by unforeseen site conditions, as identified through preliminary engineering studies and plan checks. These modifications involve the installation of additional utility infrastructure, the incorporation of structural re inforcements to specific sections of the building to adequately support increased structural loads, and the implementation of stormwater mitigation measures.
Interior Design Scope:
The second addition expands the project scope to include interior design e lements, funded through sources other than the Grant or matching funds. Initially, interior furnishings and equipment were excluded from the project scope, as the Grant explicitly prohibits funding for such items , including those necessary for ADA compliance.
However, a n ADA evaluation revealed that several existing furnishings, including the service desk and various bookstacks, do not meet current accessibility standards. These furnishings date back to the facility’s original construction in 1973 a nd are largely incompatible with modern technology, including computer systems.
FISCAL IMPACTS:
Sufficient funding is available within the existing project budget to cover the additional required design modifications scope related to the required site an d structural modifications associated with the grant funding. The portion of the scope costs $80,846.
For the interior design portion of the amendment, which totals $93,465, a budget transfer is proposed from existing Library operating accounts to the Ca pital Project accounts to fund these services. Due to the temporary closure of the Library, several operating accounts were identified with unexpended funds that will remain unused through the end of the current fiscal year.

2 Meeting Date: June 17, 2025
The proposed budget transfer of $128,633 consists of $93,465 for interior design work and $35,168 that will be allocated toward the purchase of furniture and equipment upon completion of the interior design phase.
In addition to the funding identified for transfer, the Friends of the Goleta Valley Library have committed to donate additional monies to fund various elements of the project that were not covered by the grant, including a new service desk, mobile shelving, bike racks, book drops, and computer desks. Staff will return to City Council at a future date to formally accept the donation and appropriate the funding.
ALTERNATIVES:
Council may choose not to approve the proposed contract amendment and associated budget transfers or may elect to exclude the interior design component from the scope of services. However, because a portion of the interior design elements are directly related to accessibility compliance, staff would be required to identify alternative methods or funding sources to implement the necessary ADA-related improvements.
