SUBJECT: Five-Year Review and Annual Financial Report of the City of Goleta’s Development Impact Fees for Fiscal Year 2024/25
RECOMMENDATION:

Adopt Resolution No. 25-__ entitled “A Resolution of the City Council of the City of Goleta, California, Approving the Five-Year Review and Annual Development Impact Fee Financial Report.”
BACKGROUND:

Development Impact Fees ( DIFs) are collected under the authority of the Mitigation Fee Act (also known as “Assembly Bill (AB) 1600,” Government Code Sections 66000, et seq.) to mitigate the impacts of new development on public infrastructure and facilities. Local entities that collect DIFs are subject to certain reporting and accounting requirements under the Mitigation Fee Act. These fees must be used to fund public improvements that bear a reasonable relationship to the impacts of new development, and the City must track, report, and justify the ongoing retention of any unspent fee balances.

The City also collects Quimby Fees under the authority of the Subdivision Map Act (Government Code Sections 66410, et seq.), specifically Government Code Section 66477 for parkland acquisition and development as a condition of subdivision approval.

While Quimby Fees are not required to be included in the City’s annual AB 1600 report, staff incorporates them each year to provide a complete picture of development -related funding for parks and recreation.

This report also includes revenues and expenditures from certain developer agreements.

In some cases, development agreement payments are structured as in-lieu contributions toward public improvements that function similarly to DIFs in mitigating development impacts. Including these payments provides a more comprehensive view of development- related funding.

To comply with the Mitigation Fee Act, staff recommend s that the City Council adopt a resolution approving the Annual Development Impact Fee Financial Report for Fiscal Year (FY) 2024/25 (Attachment 1). This year’s report also includes the required five-year 1 Meeting Date: December 16, 2025

reporting and finding requirements under Government Code Section 66001(d) for the period July 1, 2020, through June 30, 2025.

DISCUSSION:

Mitigation Fee Act Reporting Requirements

The Mitigation Fee Act establishes annual reporting and disclosure requirements for local agencies that collect development impact fees. In compliance with Government Code Section 66006(b) of the Mitigation Fee Act, the required Annual DIF Financial Report for FY 2024/25 is submitted herein as Exhibits 1, 2, and 3 (Attachment 1). These exhibits detail the beginning and ending fund balances, revenues, expenditures , and other reporting elements mandated by the Mitigation Fee Act, which requires that the following information be made available to the public within 180 days after the close of each fiscal year.

For each separate account or fund established pursuant to subdivision (a), the local agency shall make available to the public the following information for the fiscal year:

A. A brief description of the type of fee in the account or fund.

B. The amount of the fee.

C. The beginning and ending balance of the account or fund.

D. The amount of the fees collected and the interest earned.

E. An identification of each public improvement on which fees were expended and the amount of the expenditures on each improvement, including the total percentage of the cost of the public improvement that was funded with fees.

F. An identification of an approxi mate date by which the construction of the public improvement will commence if the local agency determines that sufficient funds have been collected to complete financing on an incomplete public improvement, as identified in paragraph (2) of subdivision (a) of Section 66001, and the public improvement remains incomplete.

G. A description of each interfund transfer or loan made from the account or fund, including the public improvement on which the transferred or loaned fee will be expended, and, in the case of an interfund loan, the date on which the loan will be repaid, and the rate of interest that the account or fund will receive on the loan.

H. The amount of refunds made pursuant to subdivision (e) of Section 66001 and any allocation pursuant to subdivision (f) of Section 66001.

Five-Year Finding Requirements

In addition to the annual reporting requirements, Government Code Section 66001(d) requires the City to make specific findings every five years for each impact fee fund that retains unspent balances. The findings must:

1. Identify the purpose of the fee.
2 Meeting Date: December 16, 2025

Page 3 of 5 ends

2. Demonstrate a reasonable relationship between the fee and the purpose for which it is charged.

3. Identify all sources and amounts of funding anticipated to complete financing for incomplete improvements identified as part of the City’s annual report.

4. Identify the approximate dates on which the funding referred to in Requirement 3 is expected to be deposited into the appropriate account or fund.

Failure to adopt the required five -year findings may result in the City being obligated to refund unspent impact fees to current property owners. Attachment 1, Exhibit 4, includes an excerpt from the City’s Five-Year Capital Improvement Program, adopted on June 17, 2025, that identifies the applicable improvements, funding sources, and expected timelines for these purposes. It should be noted that project costs are estimates and may change with future updates.

DIF Categories and Other Development-Related Fees

At the beginning of FY 2024/25, the City’s adopted DIF categories, along with other development-related revenue sources, included the following:

 Transportation
 Parks and Recreation (residential and commercial/industrial)  Public Administration (including Police)
 Library
 Fire
 Storm Drain
 Bicycle and Pedestrian
 Non-Residential Affordable Housing
 Quimby
 Developer Agreements (in addition to DIFs)

For a detailed description of each fee category, see Exhibit 1 of Attachment 1. The following Table 1 summarizes the beginning fund balances, total revenues, total expenditures, and the ending fund balance for each DIF account, including Quimby and Developer Agreement funds, for FY 2024/25.

Note:
 *Parks and Recreation “Total Expenditures” includes a one -time transfer of approximately $3.1 million to the Quimby Fund to reflect prior-year Quimby Fee collections previously held in the Parks DIF Fund. This transfer does not represent new spending on capital projects.

 **Quimby “Total Revenue” includes a one -time interfund transfer of prior -year Quimby Fee collections of $3.1 million from the Parks and Recreation DIF Fund to establish the standalone Quimby Fund. This transfer reflects a cleanup adjustment and does not represent new revenue received in FY 2024/25.

 The City also collects Affordable Housing In -Lieu Fees unde r its Inclusionary Housing Program.

These fees are not governed by the Mitigation Fee Act and are therefore not included in this report.

Beginning January 1, 2026, these fees will be subject to the separate reporting and posting requirements of Government Code Section 65906.6.

Exhibit 2 to Attachment 1 contains a Statement of Revenues, Expenditures and Changes in Fund Balances for each DIF fund account for FY 2024/25. These statements provide details on the revenue and expenditure activities of each fund over the last fiscal year, showing which funds were received and how they were spent. Exhibit 3 to Attachment 1 provides the adopted Development Impact Fee schedules.

Historically, Quimby Fees were deposited into the Pa rks and Recreation (Parks) DIF Fund. Toward the end of FY 2023/24, staff created a separate Quimby Fund to improve transparency and ensure compliance with the Subdivision Map Act, which governs Quimby Fees differently than DIFs. Although the use of these funds is similar, the way the fee is assessed and annually adjusted differs from the Parks DIF. In FY 2024/25, staff completed the interfund transfer to move prior Quimby Fee collections from the Parks DIF fund balance into the newly established Quimby Fund. Some related capital projects still have existing appropriations from the Parks DIF Fund, in which staff will continue working 4 Meeting Date: December 16, 2025

Page 5 of 5 ends

with project managers to transition these appropriations to the Quimby Fund as appropriate.

No loans, refunds, or allocations pursuant to Government Code Sections 66001(e), 66001 (f), or Section 66006(b)(1)(G) were made during the reporting period. Unexpended fund balances represent fees collected for Council-approved public improvement projects that are either under construction or will be constructed when financially feasible, as programmed in the adopted Five -Year Capital Improvement Program. The City intends to use the unexpended fund balances for their designated improvement purposes, which include appropriations for active multi -year capital projects and projects programmed in the adopted Five-Year Capital Improvement Program, as shown in Attachment 1, Exhibits 2 and 4.

FISCAL IMPACTS:

This item is a reporting and compliance disclosure requirement under the Mitigation Fee Act and has no fiscal impact, other than staff time required to prepare the report . The action does not authorize any expenditures, amend any appropriations, or modify any fees. The report provides a summary of development impact fee activity only.

4Affordable Housing Fee adopted by City Council on October 19, 2021. 2 Transportation fees are calculated for the PM Peak Hour by using the Institute of Transportation Engineers (ITE) Trip Generation Rate most applicable to the proposed development. The appropriate ITE Generation Rate is determined by Public Works Staff using the most current rates (currently 10th edition of ITE Manual) at the time of fee payment. If no applicable ITE Trip Generation rate can be found in the current ITE Manual, the Developer may use a site specific Traffic Study to generate Peak Hour Trips (PHT), prepared by a registered Traffic Engineer (T.E.) in the State of California, and approved by Public Works. 3Developers, if they wish, may make payment of fees prior to the "Certificate of Occupancy" milestone but no earlier than issuance of the Entitlement Permit.
