Honorable councilmembers:

I hope and trust you and your fellow officials will discuss splitting up Item D1 on today's City Council agenda into digestible parts instead of lumping so many powers and responsibilities into one bill, even if consideration is divided into two sessions. Especially the last section that places virtually all liability and expenses on the permit holder.

If there is no City responsibility for,

say, infrastructure changes why have
a municipal government in the first place? To my mind this is a dangerous suggestion and staff must reconsider where the buck should stop. Take more time and please hold at least the permit penalties section for another separate discussion.

By the way, thanks also for your email Councilmember Smith. You are correct we have had some phone problems ar home and email is currently the best way to communicate with me.

Thank you for listening,

Vic Cox
Comments to Agenda Item D1
April 21, 2026
Subject: Ordinance Amending Chapter 12 of the Goleta Municipal Code to Update Requirements and Procedures for Encroachment Permits. Agenda Item D1 It appears that the Goleta Municipal Code governing encroachment permits was carried over from the County of Santa Barbara and has not been updated since 2002.

Official notices should be delivered for elderly by US Mail and also by e-mail.

The Regulations should not be exempt from the California Environmental Quality Act. It is known that exposures can cause illnesses many years after they happened.

Under Definitions page 1 of the Ordinance it is confusing who is the “Director”, if it is the Public works director or who will be the designee.

Page 2 ends

“Cul-de-sac” which in most cases have restrictions.

Under “Permit” it states that staging within a street “ is expressly prohibited”.

How can the public do repairs or large tree removals if the Arborists are not allowed to bring the large trucks that are required to remove the mulching done of the tree?
Section 12.02.050. The Department may require the applicant to file a plat. This is work that is going to be paid with the Permit. Or?

12.02.070 points 2 and 3 need to be reevaluated. The City has already seen what can happen to work performed that has to be redone. If all of a sudden there is an event of Mother Nature like “Atmospheric Rivers” or other events with “climate change” surprises. The Applicant should not be one responsible of Natures events.

12.02.140 Stop work orders as stated should be all in writing and state the reason why it is done. It is requested from the Applicant that in an appeal denial the Applicant needs to enumerate all the reasons why the appeal should be granted.
