BACKGROUND:
General Plan
The City of Goleta adopted its General Plan/Coastal Land Use Plan (General Plan) on October 2, 2006. The General Plan contains the following seven state-required elements and two optional elements as follows: Land Use Element, Open Space Element, Conservation Element, Safety Element, Visual and Historic Resources Element, Transportation Element, Public Facilities Element, Noise Element, and Housing Element.
The Land Use Element includes a Land Use Plan Map (Figure 2 -1), which identifies a 1 Meeting Date: September 1, 2026
land use designation for each parcel in the City. The most recent amendment occurred on April 21, 2026.
The Land Use Plan Map (Attachment 4) identifies the subject parcel as Open Space- Active Recreation (OS-AR). Land Use Element Policy LU 6.3 (Attachment 5) identifies the purpose of the OS-AR Land Use Designation and how it is intended to operate.
General Plan Amendment Request
This General Plan Amendment initiation (GPA-I) was submitted on February 19, 2025 by the applicant representative J. Ritterbeck of True North Land Use Consulting on behalf of the property owners of 7979 Hollister Avenue, Bell Canyon Recreation, LLC. The request is to change the land use designation of the property from OS -AR to Visitor Serving Commercial in order to facilit ate the creation of a coastal-oriented RV/campground and other lod ging options and commercial amenities . The GPA -I request was deemed completed on June 9, 2026, after the change of ownership approved by the City on May 8, 2026.
General Plan Amendment Initiation Process
The General Plan Amendment (GPA) process is governed by Article 6 of State Planning and Zoning Law (Government Code Sections 65350 et seq.). Pursuant to state law, GPAs require the Planning Commission’s consideration and recommendation. However, the final decision is a legislative action and is reserved for the City Council to make.
Before a GPA can be considered, it must be initiated, applying procedures established by City Council Resolution No. 12 -13 for the initiation process, as codified in Goleta Municipal Code (GMC) Section 17.67.030. These procedures require that all requests for GPAs be referred to the City Council for initiation at a public hearing prior to processing.
Resolution No. 12 -13 and GMC subsection 17.67.030(B) provide five factors the City Council must consider for the initiation of a GPA. These five factors are:
1. The amendment proposed appears to be consistent with the Guiding Principles and Goals of the General Plan;
2. The amendment proposed appears to have no material effect on the community or the General Plan;
3. The amendment proposed provides additional public benefit to the community as compared to the existing land use designation or policy;
4. Public facilities appear to be available to serve the affected site, or their provision will be addressed as a component of the amendment process; or
5. The amendment proposed is required under other rules or regulations.
Initiation of the GPA is a procedural step authorizing staff to begin analysis, public review, and environmental assessment, upon formal application submittal. It does not constitute approval of the amendment or any future projects on the site. All aspects of a future development proposal, including the environmental analysis, would be considered by the 2 Meeting Date: September 1, 2026
Planning Commission at a noticed public hearing, followed by the Planning Commi ssion making a recommendation to the City Council. The City Council would be the decision - making body for all the project components at a public hearing.
Site Information
The 4.46-acre subject parcel is currently owned by Bell Canyon Recreation, LLC, located at 7979 Hollister Avenue. It is geographically located south of Highway 101 and west of Cathedral Oaks Road (see Figure 1: Subject Site with the parcel shaded in blue). The current General Plan land use designation and zoning at the subject site is Open Space- Active Recreation (OS-AR). The land use designation surrounding the subject site to the east and south is Open Space–Active Recreation (OS-AR), to the west is Visitor Serving Commercial (VS), to the north is Highway 101. The area surrounding the subject site and existing land uses of those sites are shown in Figure 2 below. The subject parcel is currently developed with the oil processing facility, also known as the Ellwood Onshore Oil and Gas Processing Facility (EOF). The parcels to the east and south are developed with a commercial golf course (Sand Piper Golf Course), and to the west is a commercial resort (The Bacara Ritz-Carlton Resort).

Site Background
The Ellwood Onshore Facility (EOF) is located in the City of Goleta (City) and is subject to City regulatory requirements and the EOF Land Use Permit No. 08 -134-LUP. In the 1920s and 30s, the EOF was developed as a crude oil storage facility to assist Platform Holly with approximately four aboveground s torage tanks, and subsequently two oil storage sumps. The site was redeveloped in the early 1970s with aboveground storage tanks and associated facilities for the storage, processing, and transmission of crude oil and gas produced from the surrounding Ellwood Oil Field. In approximately 1986, it was redeveloped with the oil and gas processing facilities currently located on site.
The Venoco Liquidating Trust (Venoco Trust) formerly occupied, owned, operated, and was the guarantor of the EOF , was subject to the City’s regulatory and permit authority.
On January 10, 2024, Bell Canyon Recreation, LLC was granted ownership of the EOF by the U.S. Bankruptcy Court based on an Order of Purchase Agreement transferring the property from the Venoco Trust to Bell Cany on Recreation, LLC (U.S. Chapter 11 Case No. 17-10828). Bell Canyon Recreation, LLC, as the new EOF owner, is subject to the City’s regulatory and permit authority. During the bankruptcy period, the oil and gas processing facility was decommissioned and is now hydrocarbon-free. On May 8, 2026, the City of Goleta approved the Change of Ownership application and formally accepted the application for the request for General Plan Amendment Initiation. The GPA -I (25- 0001 GPA) was deemed complete on June 8, 2026.
4 Meeting Date: September 1, 2026
Relevant General Plan and Goleta Municipal Code (GMC) Provisions General Plan Policies LU 6.2 and 6.3 outline the differences between the passive (Open Space-Passive Recreation or OS -PR) and active recreation (Open Space -Active Recreation or OS-AR) land use designations. These policies are provided as Attachments 5 and 6 for reference. Generally, the OS-PR designation reflects sites that are in a more natural state (e. g., Lake Los Carneros or Ellwood Mesa) as compared to open space areas that have ac tive recreational uses or could be used for active recreational uses (e.g., Girsh Park or Sandpiper Golf Course). OS -AR sites may include both active and passive uses.
Further, Section 17.72.030 of the GMC includes three types of lodging and visitor services as a use classification . These types of lodging are Hotel/Motels, Recreational Vehicle Parks (RV), and Time Share Uses and these lodging types are described in the following excerpt from Title 17:
Review of the use tables in the zoning districts of Title 17:
Hotels/Motels uses are allowed by right in the Regional Commercial, Community Commercial, and Visitor Serving zone districts and with approval of a Conditional Use Permit in the Old Town zone d istrict. Further, Hotels/Motels are allowed in the Hotel Overlay locations namely at the northeast corner of Storke and Hollister and northeast corner of Robin Hill Road and Hollister
RV Park uses are allowed with the approval of a Conditional Use Permit in the Old Town, Visitor Serving, and General Commercial zone districts. Time Share uses are allowed by right in the Visitor Serving zone district.
Further, GMC Section 12.01.030(A) generally makes it unlawful to camp inside or outside a vehicle in or on any of the following locations:
Public road
City-owned building and parking lot unless certain conditions are met All other public property
5 Meeting Date: September 1, 2026
Private property unless located in a Recreational Vehicle Park (RV) as defined in GMC Section 17.72 or with a temporary overnight camping license.
Based on the provision of Section 12.01.030, camping is allowed within the City as part of an approved RV park. A copy of Chapter 12.01 of the GMC regarding camping is provided as Attachment 3.
DISCUSSION:
The primary question for City is what uses does the Council envision on th e subject property now that the EOF has been decommissioned:
1. Current OS -AR – Noncommercial uses include but are not limited to parks, playgrounds, recreation facilities, trails, wildlife preserves. Commercial uses include playing fields, sports courts, gymnasiums, swimming pools, picnic facilities, tennis courts, golf courses, and b otanical gardens, as well as related food concessions or community centers.
2. Applicant Desired Change to Visitor Services (in order to create an RV park) – Allowed uses include resorts, hotels and motels, bed and breakfasts, RV parks, visitor services and attractions, eating and drinking establishments, retail stores, coastal-related commercial uses, entertainment and recreation services, wireless telecommunications, and one caretaker unit.
3. Staff Alternative to add the RV Park use to all OS-AR zoned properties throughout the City.
Regardless of the land use designation of the property, t he parcel is adjacent to an Environmentally Sensitive Habitat Area (ESHA). The City’s ESHA policies and regulations will be applicable no matter what the land use designation is, and any future development will need to abide by the adopted protections for sensitive habitat. Further, as the site is located within the Coastal Zone, California Coastal Commission approval of any development proposal will also be needed after City action, if the City’s LCP had not been certified by the Coastal Commission at the time of City action.
Applicant’s Request
The applicant has requested the change in land use designation shown on Figure 2-1 of the General Plan for the subject parcel from OS -AR to VS in order to submit a development proposal to the City for consideration. The applicant’s desired development, RV parking and hotel/motel, is currently not allowed under the existing OS-AR designation but is allowed under the VS designation.
In contrast, the V S designation would allow a substantially broader range of uses, as identified above and in Table 2-2 of the General Plan and provided as Attachment 8. The proposed requested change to Figure 2 -1 of the General Plan would therefore expand the range and intensity of potentially permitted uses on the subject parcel. This increase 6 Meeting Date: September 1, 2026
in allowable uses warrants consideration of the potential effects on surrounding land uses and environmental resources.
The applicant’s justification letter, provided as Attachment 9, identifies the reasons for the request for a land use designation change. The applicant has shared that its vision for the site is to develop an RV Park facility and a small Hotel/Motel resort, along with associated accessory uses, as potential future development. These uses envisioned with the future project align with the range of uses allowed under the VS zone district. Further, these uses may be compatible with the surrounding open space context , if appropriate ly designed and limited.
However, the broader range of uses permitted under the Visitor Serving Commercial designation, particularly larger-scale commercial, retail, dining, entertainment, and visitor- serving uses, could result in increased development intensity, activity, traffic, noise, lighting, and other impacts. Such changes could adversely affect the character of the surrounding area and function of adjacent open space areas and may create potential conflicts with the nearby ESHA.
Staff’s Identified Alternative
Staff has come up with a nother option to achieve the Applicant’s desire for RV parking and hotel/motel uses, which is to add to the RV park use to the OS/AR designation, which is provided as Attachment 7.
The staff alternative provides a more targeted approach of adding new allowed uses to the OS-AR designation could be more compatible with the site. This alternative would amend the text of the OS-AR land use category outlined in Table 2-4 of the General Plan to allow for RV park use found in Visitor Serving Commercial. This text amendment could include the RV Par k for future development in the existing O S-AR designated parcels (which could be made subject to an approval of a Conditional Use Permit) , while not allowing other uses listed in the Visitor Serving Commercial designation that could result in greater commercial intensity or adverse effects on adjacent areas.
GPA Initiation Criteria
As previously noted, the Council must consider a specific set of five factors when determining whether to initiate a GPA. Pursuant to Resolution 12-13 and GMC subsection
17.67.030(B), below is a discussion of the GPA initiation factors for City Council consideration for both the GPA change to Figure 2-1 and the text change to Table 2-4 of the Land Use Element.
The Applicant has provided a justification statement, provided as Attachment 9 , which cites the reasons to support the initiation of the GPA from OS-AR to VS and which are not repeated here.
Council should keep in mind that allowing the Applicant’s request to change Figure 2-1 of the General Plan to VS would only affect 7979 Hollister Avenue. In the alternative, i f Council determines to allow the initiation to study the changing of Table 2-4 to the General Plan to add the RV parking use to the OS-AR designation, then that change would affect 7 Meeting Date: September 1, 2026
all the parcels that are designated OS -AR in the city. This would include Sandpiper Golf Course, Girsh Park, the Swell tennis club on Cathedral Oaks, and OS-AR-designated City parks.
Staff has prepared an evaluation in a pros vs. cons argument format for the three possible options (retain existing OS-AR designation as adopted, initiate request to amend Figure 2-1 of the General Plan, or initiate an amendment to Table 2 -4 of the General Plan) applying each of the criteria for the Council’s consideration as a side-by-side comparison.

The parcel is currently owned and operated by Bell Canyon Recreation LLC, and all public facilities required to serve the site already do so. The provision of public facilities would also be addressed as a component of any future development.
5. The amendment proposed is required under other rules or regulations.
The proposed GPA to either Figure 2-1 or Table 2-4 is not required under other rules or regulations. The request is made by the owners of 7979 Hollister Avenue.
CONCLUSION
As mentioned above, if Council decides to initiate the GPA and study changing Figure 2- 1 to VS , as requested by the Applicant , that change would only affect 7979 Hollister Avenue. If Council decides to initiate the alternative GPA and study changing Table 2-4 to add RV park use to OS-AR as the staff-identified Alternative, then that change would affect all the parcels that are designated OS -AR. This latter change would include Sandpiper Golf Course, Girsh Park, the Swell tennis club on Cathedral Oaks, the Lake Los Carneros Swim Club on Covington Drive, and City parks.
It appears that both the requested amendment to Figure 2 -1 or the text to Table 2-4 can be supported by the five GPA initiation factors , as shared above. However, rather than changing the entire land use design ation of the property as requested by the applicant , amending Table 2-4 to allow RV park use could accommodate the applicant’s intended development while providing the City greater control over the range and intensity of future uses. As a result, the alternative would likely achieve similar objectives as the applicant- requested Figure 2-1 GPA, while reducing the potential for broader or more intensive development impacts.
Based on the analysis of the five factors above, if Council is interested in allowing the consideration of a future RV park development at the site, the n staff recommends initiating the text amendment GPA to Table 2 -4, to add RV park use to the OS-AR designation rather than the applicant’s request to change Figure 2-1 from OS-AR to VS.
Draft Resolutions for the GPA initiation to change Figure 2-1 from OS-AR to VS and the alternative to modify Table 2-4 regarding uses within OS-AR are provided as Attachments 1 and 2 , respectively, to this report. Section E of the Resolution s requires that the applicant apply for the GPA within two years of adoption of the Resolution (GMC Section
17.67.030(D)). If that were not to occur, then the Council action to initiate the GPA would expire. Lastly, Council’s decision to initiate the GPA would not obligate the City to approve the GPA in the future.
ENVIRONMENTAL REVIEW:
The initiation of a GPA is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15060(c)(3) of the CEQA Guidelines (Title 14, Chapter 3 of t he California Code of Regulations) because the activity is not a “project” as defined in Section 15378(b)(5), as an organizational or administrative activity by government that will not 13 Meeting Date: September 1, 2026
result in direct or indirect physical changes in the environment. The initiation is also exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines because the activity is covered by the general rule which exempts activities that can be seen with certainty to have no possibility for causing a significant effect on the environment.
However, if the GPA is initiated, then the environmental impacts will be assessed as part of the environmental review for the GPA.
FISCAL IMPACTS:
The case processing costs associated with the initiation of the proposed GPA at 7979 Hollister Avenue are being borne by the Applicant.
ALTERNATIVES:
The City Council has all of the following options:
1. Choose not to initiate processing of the requested GPA. If not initiated, the parcel and its zoning designation will remain unchanged , and the applicant would need to work within the existing land use designations for a new use of the property;
2. Choose to initiate the processing of a General Plan Amendment to change the land use designation shown in Figure 2 -1 of the Land Use Element from OS -AR to Commercial Visitor Serving.
3. Choose to initiate the processing of a General Plan Amendment for a text modification to Land Use Table 2-4 for the Open Space Active Recreation Land Use Category to allow for RV Park use subject to a Conditional Use Permit requirement;
4. Continue the item so staff can return with alternative land use designation options as directed by Council; or
5. Continue the item for additional information or discussion.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GOLETA, AS FOLLOWS:
SECTION 1. General Plan Initiation Factors
The City Council makes the following statements regarding the initiation factors outlined in City Council Resolution No. 12-13 and Goleta Municipal Code Section 17.67.030:
1. The amendment proposed appears to be consistent with the Guiding Principles and Goals of the General Plan.
The proposed amendment is consistent with the Guiding Principles and Goals of the General Plan, as follows:
The proposed amendment to Figure 2 -1 would not expand the area of development within the city as the site has been developed for over 50 years and the reuse of the site would stay within the footprint of an already disturbed site. Further, any future development would need to be developed with the City’s existing Environmental Sensitive Habitat Area policies and regulations. The proposed amendment would maintain economic prosperity with a sustainable economy that is not based on growth and there would be no impact on housing. Further, the amendment to Figure 2-1 would facility the removal of a non-conforming industrial facility in the Coastal Zone and allow the site to be redeveloped with a use available to the public. Further, the amendment to Figure 2-1 would be applicable only to 7979 Hollister Avenue.
2. The amendment proposed appears to have no material effect on the community or the General Plan or Specific Plan.
It is anticipated that the proposed amendment from Open Space – Active Recreation (OSAR) to Visitor Serving Commercial (C -V) would have no material effect on the community or the General Plan because the change would apply only to the 18 Resolution No.26-_ Initiation of General Plan Amendment to Figure 2-1 for 7979 Hollister Avenue Page 3 approximately 4.46-acre subject parcel. The change to Figure 2-1 of the General Plan would not change the overall land use pattern of the City just the designation on this single site. Further, the change to Figure 2-1 to VS designation would be located within the proximity to another VS designated parcel approximately 300’ to the west . The site would remain subject to applicable development standards, environmental requirements adopted within the city to which the future development proposals would be subject.
3. The amendment proposed provides additional public benefit to the community as compared to the existing land use designation or policy.
The proposed land use change from OS-AR to VS would provide a different type and possible price point of coastal visitor-serving lodging than is currently available in the city. The change to Figure 2-1 of the General Plan to VS could provide an expanded range of uses at this site that could add to the economic viability of with the reuse of this site. While the current land use OS-AR allows for a variety of active uses, including commercial recreation uses like sports facilities, rental and food sales, VS would provide for a more expansive list of uses including the uses that the applicant is most interested in developing , i.e., RV park, hotel/motel and ancillary commercial uses i n support of the lodging use.
4. Public facilities appear to be available to serve the affected site, or their provisions will be addressed as a component of the amendment process.
Public service/facilities already exist to serve the site. The site is already connected to water, electricity, and gas services currently. Septic system is currently in use at the site. The site would be required to connect into the sewer line located in Hollister Avenue as part of the future development proposal.
5. The amendment proposed is required under other rules or regulations.
The proposed GPA is not required under other rules or regulations. The request is made on by the owners of the 7979 Hollister Avenue.
SECTION 2. Environmental Assessment
The initiation of a General Plan Amendment is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15060(c)(3) of the CEQA Guidelines (Title 14, Chapter 3 of the California Code of Regulations) because the activity is not a “project” as defined in Section 15378(b)(5) as an organizational or administrative activity by government that will not result in direct or indirect physical changes in the environment.
The initiation is also exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines because the activity is covered by the general rule which exempts activities that can be seen with certainty to have no possibility for causing a significant effect on the environment.

The initiation of the General Plan Amendment does not suggest how the City Council may ultimately act on the General Plan Amendment when it is brought forward for City Council consideration. The initiation of the General Plan Amendment shall not influence the City Council’s determination of the General Plan Amendment in the future.
SECTION 4. Effective Date
This Resolution becomes effective upon adoption.

WHEREAS the City Council considered the entire administrative record, including staff reports, the General Plan, and oral and written testimony from interested persons;
12 -13 and Goleta Municipal Code Section 17.67.030 to initiate the exploration of amending Table 2-4 of the General Plan:
1. The amendment proposed appears to be consistent with the Guiding Principles and Goals of the General Plan.
The proposed amendment is consistent with the Guiding Principles and Goals of the General Plan in that it would limit the range of additional use to just RV parks in the OS-AR district and can make it subject to a discretionary approval process instead of the entire range of uses allowed by the Visitor serving zone district. Further allowing RV parking in the OS-AR zone and in particular at this site, it may create a lower cost lodging facility in the Coastal Zone. Further, the existing Environmental Sensitive Habitat Area policies would not change or be affected, would continue to preserve 28 Resolution No.26-_ Initiation of GPA for Text Amendment to Table 2-4 of the General Plan Page 3 passive open space and agricultural areas within the City as currently designated, may aid in fostering economic prosperity with a sustainable economy . Lastly, amendment to Table 2 -4 would not ch ange the location of any OS-AR designated property nor change the city’s adopted land use pattern.
2. The amendment proposed appears to have no material effect on the community or the General Plan or Specific Plan.
The proposed amendment to Table 2 -4 of the General Plan would not change the adopted Figure 2-1 of the General Plan nor change the overall land use pattern of the City. The added uses would be subject to discretionary approval so that the site- specific impacts could be analyzed and evaluated on a case-by-case basis. Further the amendment would provide only RV park use as an additional use for private property owners of Open Space – Activity Recreational zoned property for development consideration.
3. The amendment proposed provides additional public benefit to the community as compared to the existing land use designation or policy.
The proposed amendment to Table 2-4 of the General Plan could provide RV lodging benefits to the city while assisting private property owners of Open Space – Active Recreation zoned site with an additional use that could assist with economic viability..
The additional use would be subject to discretionary approval so any impa cts could be addressed while not changing the adopted land use map of Figure 2-1.
4. Public facilities appear to be available to serve the affected site, or their provisions will be addressed as a component of the amendment process.
Not applicable since this amendment would be Citywide and the availability of public facilities/ infrastructure would be evaluated at the time of development.
For reference, most public utilities required to serve the site already do so. The site would need to be connected to the sanitary sewer which is in Hollister Avenue directly adjacent to the site. The provision of public facilities would also be addressed as a component of any future development.
5. The amendment proposed is required under other rules or regulations.
The proposed General Plan Amendment to Table 2 -4 of the General Plan is not required under other rules or regulations.
SECTION 2. Environmental Assessment
The initiation of a General Plan Amendment is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15060(c)(3) of the CEQA Guidelines (Title 14, 29 Resolution No.26-_ Initiation of GPA for Text Amendment to Table 2-4 of the General Plan Page 4 Chapter 3 of the California Code of Regulations) because the activity is not a “project” as defined in Section 15378(b)(5) as an organizational or administrative activity by government that will not result in direct or indirect physical changes in the environment.
The initiation is also exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines because the activity is covered by the general rule which exempts activities that can be seen with certainty to have no possibility for causing a significant effect on the environment.
SECTION 3. Action
The City Council hereby authorizes the initiation of an amendment to Table 2-4 of the General Plan to include additional use specifically, RV Park to the Open Space – Active Recreation land use category with the approval of a conditional use permit.
Further, the initiation of t he General Plan Amendment does not suggest how the City Council may ultimately act on the General Plan Amendment when it is brought forward for City Council consideration. The initiation of the General Plan Amendment shall not influence the City Council’s determination of the General Plan Amendment in the future.
SECTION 4. Effective Date
This Resolution becomes effective upon adoption.
SECTION 5. Time Limit
The Council action to initiate this General Plan Amendment will automatically expire after two (2) years from the date of this Resolution, if an application for the General Plan Amendment is not submitted to the Planning and Environmental Review Department during this timeframe.
SECTION 6. Certification
The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

RE: Request to Initiate a General Plan Amendment for 7979 Hollister Ave. to Change the Land Use Designation from Open Space/Active Recreation to Visitor-Serving
Greetings, City staff.
On behalf of the applicant and owner, Bell Canyon Recreation, LLC, we would like to submit this Applicant Letter and Justification Statement as part of our application for an owner - initiated General Plan Amendment Initiation (GPA-I) request. The request is to change the General Plan Land Use Element designation of the subject property, located at 7979 Hollister Avenue (Assessor’s Parcel No. 079-210-042) from Open Space / Active Recreation to Visitor- Serving. The site is currently home to the now idled, shut -in, and cut-off oil and gas facility known as the Ellwood Onshore Facility or “EOF.”
BACKGROUND
INFORMATION
The EOF continues to be a legally permitted, albeit “nonconforming” use of the site. The Venoco Liquidating Trust handled the bankruptcy of Venoco, Inc. and its subsidiary Venoco, LLC, which owned the EOF site. Upon purchase of the site, the new owners took over the clean-up efforts that had been started by the State of California while it was plugging and abandoning oil wells associated with Platform Holly and decommissioning the two PRC 421 piers. Located approximately two miles offshore, Platform Holly remains in an abandoned state while its final disposition is being analyzed and yet to be determined ( i.e., abandoned in place, repurposed, decommissioned/removed) . All connections from the Platform to the EOF have been severed and the two facilities are no longer connected via oil pipelines, gas lines, or electricity.
On November 21, 2024, the County’s Air Pollution Control District (APCD) tested all remnant facilities at the site that the State and new owners had cleaned and declared that “[a]ll permitted equipment has been removed from the facility or has been rendered hydrocarbon free and non-emitting.” This was a major milestone for the City and the safety of the surround community and visitors. This was an even more significant step towards the new owners being able to move forward to formally abandon the site and draft plans to redevelop the site with a Use that is more appropriate and suitable for both the property and City. 57 True North Land Use Consulting

GENERAL PLAN AMENDMENT INITIATION
The new owner is requesting that the City Council Initiate a General Plan Amendment to change the General Plan Land Use Element designation of the subject property from Open Space / Active Recreation to Visitor-Serving. When the new owner acquired the property in January of 2024, the initial discussion and vision for the site was to redevelop it as an Recreational Vehicle (RV) Park. After discussions with City Planning staff, we were told that although an RV Park was a good use for the site and one that had been previously envisioned, it was not listed as a permitted use in the Open Space/Active Recreation (OS - AR) Land Use Element Table nor in the accompanying Title 17 Zoning District “OSAR .” Rather than request that the RV Park Use Classification be added as an allowable use in OS-AR/OSAR, which would apply citywide, the new owners are requesting that the City consider redesignating the site as Visitor Commercial (also known as Visitor -Serving. The new “C-VS” classification would allow RV Parks as well as other “coastal -dependent” uses that are much more appropriate for the property due to its proximity to the Pacific Ocean and its adjacency to the Ritz-Bacara Resort, which is also designated and zoned to allow Visitor- Serving uses.
Specifically, the City’s General Plan Land Use Policy LU 3.6 states that Visitor Commercial “is intended to provide for a variety of commercial uses of low to moderate intensity often at or near scenic locations that may serve as destinations for visitors.
Customers are anticipated to drive or be transported to these establishments by vehicles. Development in Visitor Commercial areas shall be designed in a manner that will limit encroachment into residential or resource areas. When located near the beach or other natural areas, public access to resource areas shall be required. Transient lodging units such as hotels that are operated as hotel condominiums, time-shares, or under a fractional ownership model shall be permitted uses, regulated through measures including but not limited to owner -occupancy limitations, to assure these accommodations are available without limitation to the general public and protect the City’s transient occupancy tax base.
It is understood that subsequent by the new property owners that if the Council approves the GPA-I, it will be necessary to process subsequent applications for a Zoning Map Amendment and a General Plan Amendment prior to or concurrently with an application to decommission the site to remove the cleaned remnant EOF equipment and to redevelop the site with a “coastal-dependent” use.
It is worth noting that the subject property is located within the Coastal Zone of the State and is therefore subject to the C alifornia Coastal Act. The requested change in the Land Use Designation would be further supported by the following Coastal Act Polices:
30222 The use of private lands suitable for visitor-serving commercial recreational facilities designed to enhance public opportunities for coastal recreation shall have priority over private residential, general industrial, or general commercial development, but not over agriculture or coastal-dependent industry.

In addition, land divisions, other than leases for agricultural uses, outside existing developed areas shall be permitted only where 50 percent of the usable parcels in the area have been developed and the created parcels would be no smaller than the average size of surrounding parcels.
(b) Where feasible, new hazardous industrial development shall be located away from existing developed areas.
(c) Visitor-serving facilities that cannot feasibly be located in existing developed areas shall be located in existing isolated development or at selected points of attraction for visitors.
30255 Coastal-dependent developments shall have priority over other developments on or near the shoreline. Except as provided elsewhere in this division, coastal-dependent developments shall not be sited in a wetland. When appropriate, coastal -related developments should be accommodated within reasonable proximity to the coastal- dependent uses they support.
CONSISTENCY WITH GPA INITIATION FACTORS
Pursuant to Goleta Municipal Code subsection 17.67.030.B (Initiation Factors), the proposed Amendment must be consistent with the following factors, which must be considered by the City Council for Initiation of all proposed General Plan Amendments (as applicable). • The amendment proposed appears to be consistent with the Guiding Principles and Goals of the General Plan;
Section 2.2 of the City’s General Plan Land Use Element provides eleven Guiding Principles and Goals, which provide the foundation for the Land Use Plan. The proposed GPA Initiation is consistent with the Guiding Principles, as discussed below:
1. Ensure that the amounts, locations, and characteristics of new development are determined in a manner that will preserve sensitive habitats and other natural resources.
The proposed amendment will have no impact on sensitive habitats or natural resources since no sensitive habitats or natural resources exist on the site and no physical development is included as a part of the requested amendment.
2. Preserve open space within the city that is accessible to residential neighborhoods as well as a greenbelt around the city’s northern, western, and southern boundaries.
The subject property is currently developed with a legally permitted, nonconforming oil and gas facility knows as the EOF. The EOF site currently has no public open space 59 True North Land Use Consulting
Phone: (805) 448-8927 Email: [email protected] Page | 4 and the proposed amendment does not include any physical development, therefore there will be no impact on any public open space off-site.
3. Preserve agricultural lands to allow future potential for agricultural production, including a locally grown food supply, specialty agriculture, and floriculture.
The subject property is neither zoned nor used for agricultural purposes. Therefore, the proposed amendment will not impact agricultural lands.
4. Maintain economic prosperity with a sustainable economy that is not based on growth.
The proposed amendment would facilitate the redevelopment of the site with a coastal- dependent commercial use that is more suitable for the Coastal Zone property and its proximity to the Pacific Ocean. Furthermore, the amendment would facilitate the rezoning of the property and future redevelopment of the site after the existing EOF equipment is decommissioned and removed. A commercial coastal -dependent use of the use will allow continued economic prosperity that is not based on growth.
5. Manage the types, amounts, and timing of future growth based on maintenance of service levels and quality of life.
The proposed amendment does not include any physical development at the site.
Future redevelopment of the EOF site would require approval of additional permits by the Planning Commission, City Council, and staff, including a formal GPA, a rezoning of the lot, a Development Plan for decommissioning and redevelopment, consultation with other oversight agencies, environmental analysis, and an additional Coastal Development Permit reviewed and approved by the CA Coastal Commission since the City does not currently have an approved/adopted Local Coastal Program. As such, the City will retain the ability to manage the types, amounts, and timing of the future development at the site and base said development on service levels and quality of life.
6. Maintain a balanced community, with an appropriate mix of residences, workplaces, and services.
While the proposed amendment does not include physical development, it does facilitate the redevelopment of the site to allow future use(s) comprised of an appropriate mix of residences, workplaces, and services that the present (EOF) use and (OS-AR) classification do not provide.
7. Maintain an appropriate balance between job -generating development and housing supply.
While the proposed amendment does not include physical development, it does facilitate the redevelopment of the site to allow future use(s) that are both job-generating and potentially provide one or more housing units either as a primary or accessory use.
Use Classifications that are supported by the General Plan’s “ C-VS” land use designation include the following: Eating and Drinking Establishments, Other Retail Trade Establishments, Coastal -Related Commercial, Entertainment and Recreation 60 True North Land Use Consulting
Phone: (805) 448-8927 Email: [email protected] Page | 5 Services, Other Services, Resorts, Hotels, Motels, Bed and Breakfast Inns, RV Parks, Other visitor Services and Attractions, a Caretaker Unit, and Telecommunications.
Additional Use Classifications that are enumerated in GMC Title 17 Zoning for the “VS” Zone District include, but are not limited to, the following: Day Care Facility, Government Buildings, Parking, Catering Services, Commercial Entertainment and Recreation (i.e., Banquet and Conference Center, Cinemas, Indoor Sports and Recreation, Outdoor Entertainment), Restaurant, Lodging and Visitor -Services (i.e., Hotels and Motels, RV Parks, Time Share Use), and a Caretaker Unit.
As such, the opportunity for job-generating development on the site or increasing future housing supply in the City as part of a redevelopment project would be facilitated by the amendment to reclassify the land use designation of the site from OS-AR to C-VS.
8. Maintain a balance of housing types, densities, and sizes and ensure creation and maintenance of quality, livable residential environments.
The proposed amendment does not include any development that would not impact existing housing (i.e., types, densities, sizes) and would not impact the maintenance of the quality or livability of residential environments in the City. Therefore, this Principal/Goal is not applicable to the proposed GPA-I.
9. Ensure that the locations, amounts, and timing of new development are consistent with resource and service constraints, including, but not limited to, transportation infrastructure, parks, water supply, sewer system capacity, and energy availability.
As previously discussed above in #5, t he proposed amendment does not include any physical development at the site. Future redevelopment of the EOF site would require approval of additional permits, which would allow the City to ensure that the locations, amounts, and timing of new development are consistent with resource and service constraints, including, but not limited to, transportation infrastructure, parks, water supply, sewer system capacity, and energy availability. As such, the City will retain the ability to ensure new development meet these criteria when a subsequent application to decommission and redevelop the EOF site is submitted.
10. Ensure that all new development and changes to existing development are compatible with the character, scale, and design of the neighborhood.
As previously discussed, while the proposed amendment does not include any physical development at the site, the City will retain the ability to ensure new development meets these criteria when a subsequent application to decommission and redevelop the EOF site is submitted.
11. Influence future land use changes in nearby areas outside Goleta to avoid, lessen, and/or mitigate impacts within the city.
The proposed amendment does not include any physical development and therefore, would not have any potential to influence or impact on nearby areas outside the City. 61 True North Land Use Consulting
Phone: (805) 448-8927 Email: [email protected] Page | 6 • The amendment proposed appears to have no material effect on the community or the General Plan;
The proposed amendment is intended to facilitate the envisioned decommissioning and redevelopment of the EOF site with a use that is consistent with the General Plan. Rather than pursuing a zoning text amendment that would allow the originally intended future use of an RV Park in the OSAR zone district, which would then have applied citywide in all OSAR zoned lands, the new owner is seeking a site -specific land use classification change to a classification that already allows this and other coastal -dependent uses .
Currently, the City has over 250 acres of OS-AR/OSAR lands that are designated, zoned, and used for outdoor active recreation. The EOF site is approximately 4.5 acres in size and the change in designation would be a decrease of well under 2 percent of the lands with this land use designation. As such, the change in classification itself would have no material effect on the community or the General Plan because it would be consistent with all applicable principles and goals of the Plan and the CA Coastal Act. • The amendment proposed provides additional public benefit to the community as compared to the existing land use designation or policy; The proposed amendment would allow the EOF site to be fully decommissioned, have all of the remnant equipment properly removed from the site, and for the site to be redeveloped with a greater range of coastal-dependent use that would provide a real public benefit to the community compared to the existing remnant oil and gas facility being either left at the site or having the equipment repurposed on- site with a use that is consistent with the existing land use designation of OS-AR. • Public facilities appear to be available to serve the affected site, or their provision will be addressed as a component of the amendment process; Goleta Water District and the County Fire Department currently provide public services to the subject property. No change is proposed to the intensity of use and the amendment will not impact the utilities that serve the parcel and businesses. The new owners understand that any future redevelopment of the site would also need to tie into Goleta Sanitary District’s existing sanitary sewer lines that run along Hollister Aveune and provide service to the Ritz-Bacara Resort.
• The amendment proposed is required under other rules or regulations.
Not applicable. No other rule(s) or regulation(s) require the proposed amendment.

GENERAL PLAN AMENDMENTS
The following Amendments are proposed as a part of this GPA-I request:
Amendment to Figure 2-1 (Land Use Map)
Amendment to Figure 2- 2 (Pacific Shoreline Sites)

LU 9.2 Site #2 – Coastal Recreation. [GP/CP] This parcel, occupied as of 2005 by the Venoco EOF, is designated in the Open Space/Active Recreation Commercial Visitor-Serving use category. The requirements applicable to this site are as follows (see Figure 2-2):
a. The Recreation designation shall continue the nonconforming status of the existing use. The use was nonconforming at the time of incorporation of the City of Goleta. Its nonconforming status dates to the early 1990s when the property’s zoning was changed by the County of Santa Barbara to the Recreation District as part of a plan to consolidate onshore oil and gas processing at the Las Flores Canyon site in the unincorporated area west of Goleta.
b. T
he intent is that in the long- term use of the property for oil and gas processing shall be terminated. The processing of hazardous materials and the risks associated with air emissions make this location, which is adjacent to Bacara Resort and Sandpiper Golf Course and near Ellwood School and the residential neighborhoods of Santa Barbara Shores and Winchester Commons, unsuitable for oil and gas processing in the long term.
c. Until such time as the oil and gas processing use is terminated, any modifications or alternations of the existing facilities shall be in accordance with the provisions of LU
10.1 and shall be designed to improve air quality, reduce environmental impacts and hazards, and improve safety for nearby lodging, recreational, and residential uses. d. Upon termination of the oil and gas processing use, the priority use for the site shall be coastal -dependent and coastal -related recreational uses that are conducted primarily outdoors or limited to small-scale structures. Adequate on-site parking shall be provided to serve all recreational uses (see related Policy OS 2).
Amendment to Land Use Policy
LU 10.1
LU 10.1 Oil and Gas Processing Facilities (Venoco Ellwood Onshore Oil and Gas Processing Facility). [GP/CP] As of 2005, the city had one existing oil and gas processing facility situated within its boundaries, the Venoco-owned EOF, which is a nonconforming use.
The EOF and other oil and gas processing facilities generate emissions of air pollutants, pose safety hazards to nearby areas, create visual impacts, and create risks to marine and land resources associated with spills, leaks, or pipeline ruptures. The following standards shall apply to oil and gas processing facilities:
a. The City supports County policies regarding consolidation of oil and gas processing in the South Coast Consolidation Planning Area at Las Flores Canyon in the unincorporated area west of Goleta. No new oil and gas processing facilities shall be permitted within Goleta.
64 True North Land Use Consulting
Phone: (805) 448-8927 Email: [email protected] Page | 9 b. The Venoco EOF site is an inappropriate location for processing of oil and gas because of the public safety and environmental hazards associated with this type of use and its close proximity to residential neighborhoods, Ellwood School, Bacara Resort, and environmentally sensitive habitat areas. The site is designated in the Open Space/Active Recreation Commercial Visitor -Servicing use category on the Land Use Plan map and shall continue to be a nonconforming use. c. T he EOF shall continue to be subject to the rights and limitations applicable to nonconforming uses under California law. No modifications or alterations of the facility or other actions shall be authorized that would result in the expansion of the permitted throughput capacity of the EOF. The existing maximum permitted capacity shall not be exceeded, except for very minor increases that may be incidental to actions designed to improve safety or reduce environmental impacts. d. Until the EOF use is terminated, the priority shall be to insure [sic] that the facility strictly meets or exceeds all applicable environmental and safety standards.
CONCLUSION
In conclusion, the requested General Plan Amendment Initiation is appropriate and justified for the reasons stated above. On behalf of the new property owners, Bell Canyon Recreation, LLC, we appreciate consideration of their request . Reclassifying the site from OS -AR to C- VS would enable the full decommissioning of the EOF, complete removal of all the equipment that the new owners and the State of California have flushed and cleaned of all residual hydrocarbons, and to redevelop the site with a new Use that will better -serve the City and the general public.
