Agenda Item D.1

CPMS DISCUSSION/ACTION
Meeting Date: September 1, 2026
TO: Mayor and Councilmembers
SUBMITTED BY: Peter Imhof, Planning and Environmental Review Director PREPARED BY: Anne Wells, Advance Planning Manager
SUBJECT: Firearms and Ammunition Retail Sales Study Session RECOMMENDATION:

Receive a presentation and provide feedback to staff on possible regulation of firearm s and ammunition retail sales and any related regulations associated with that use.

BACKGROUND:

The Second Amendment of the United States Constitution protects the individual right to keep and bear firearms for lawful purposes . In recent years, the United States Supreme Court has decided sev eral high-profile court cases involving the Second Amendment, including decisions striking down provisions of New York and Hawaii state laws, respectively, regulating firearms.1 All firearms dealers are required to comply with existing federal and state laws. All firearms dealers are required to apply for federal and state licenses and permits that involve background checks, interviews, and compliance with operational standards. Once federally licensed by the Bureau of Alcohol, Tobacco, Firearms & Explosives (ATF), firearms dealers are also required to adhere to California laws.

Subject to existing federal and state laws , as well as constitutional considerations, a number of cities and counties in California have adopted ordinances that further regulate the sale of firearms and ammunition locally. A summary of state laws and published ordinances in California is provided in Attachment 1. Of note, requirements for a business license are standard practice in most, if not all, local jurisdictions . Requirement s for firearms and ammunition retail uses are sometimes explicitly detailed in the local business license regulations, sometimes in the zoning regulations, and , for some cities and counties, there are no local firearms retail-specific requirements at all. 1 See New York State Rifle & Pistol Assn., Inc. v. Bruen (2022) 597 U.S. 1; Wolford v. Lopez (2026) 609 U.S. ___, No. 24-1046 (decided June 25, 2026).

While the City of Goleta currently regulates the safe storage of firearms in a residence in Title 9 Public Peace and Welfare , and unlawful firearm discharges near schools and unlawful firearm and weapons in City parks or beaches in Title 12 Streets, Sidewalks and Public Places of the Goleta Municipal Code, there are no specific zoning regulations regarding the retail sale of firearms and ammunition. Firearms and ammunition retailers are treated as “ General Retail” and allowed in four commercial zone distri cts with an issued business license. As long as a firearm retailer is located in a commercial zone district where General Retail is allowed , and receives a business license, the use is currently permitted by right.

In response to recent City Council and community interest in developing firearm s retail- specific regulations, this staff report introduces related regulatory concepts for Council consideration. Importantly, any future City regulation of firearms sales will have to observe and adhere to Second Amendment rights, as they have been interpreted by the courts , and as Second Amendment jurisprudence continues to evolve . While r easonable restrictions may be acceptable, local regulations that prohibit lawful access or acquisition of firearms in the City would not be permissible.

Accordingly, should the City choose to consider new, firearms-related regulations, those regulations will be developed with careful attention to the evolving constitutional framework interpreting the Second Amendment. While the examples provided below are a helpful, operating framework for the City Council and the public , since firearms and ammunition sales implicate Second Amendment rights, they are distinguishable from the City’s ability to regulate cannabis or tobacco, and distinguishable from the First Amendment framework applicable to adult -oriented businesses . City staff will solicit feedback as part of this study session and then work with the City Attorney’s Office to ensure any new local regulations fit within the appropriate legal framework.

DISCUSSION:

Staff seeks community input and City Council direction on whether and how to change the City’s approach to the regulation of firearm s and ammunition retail sales, as well as feedback on any related regulation s associated with that use . Some options are presented below by topic area for Council’s consideration.

Options for Firearms and Ammunition Retail Use-Specific Regulations Currently, as noted above, the City does not have any specific zoning regulations regarding the retail sale of firearms and ammunition. Instead, the s ale of firearms and ammunition falls under the “General Retail” commercial use classification in Title 17 of the Goleta Municipal Code (see Section 17.72.030). General Retail uses are exem pt or permitted ministerially with a business license within specific commercial zoning districts, including: Regional Commercial (CR), Community Commercial (CC), Old Town (OT), and General Commercial (CG) in Title 17 of the Goleta Municipal Code (see Table 17.08.020 Land Use Regulations – Commercial Districts).

Page 3 of 8 ends

Options for firearms and ammunition retail use-specific regulations are presented below.

Of note, new regulations, if any, must be consistent with the Goleta General Plan / Coastal Land Use Pla n (General Plan). If staff moves forward with the development of new regulations that require a companion General Plan amendment , amending the General Plan will take more time and be procedurally more involved. For that reason, an option that avoids the need to amend the General Plan may be a preferable first step and could be accomplished more quickly.

Title 17 Zoning Option
This option allows for the development of regulations and standards specific to firearm s and ammunition retail sales use in Titl e 17 Zoning of the Goleta Municipal Code . “Firearms and Ammunition Retail”, or something similar, could be added as a new, separate retail classification to the commercial land use regulations found in Chapter

17.08 Commercial Districts of Title 17 Zoning of the Goleta Municipal Code . Additional requirements, such as buffer requirements from sensitive uses , as detailed later in th is staff report, could be added to Chapter 17.41 Standards for Specific Uses and Activities.

A description of the new use could also be added to Chapter 17.72 General Terms – Use Classification. This approach would be analogous to how Adult-Oriented Businesses are currently regulated under Section 17.41.050 , though the constitutional framework is distinguishable.

Title 5 Business Licenses and Regulations Option
Alternatively, City Council may consider adding additional provisions to Title 5 Business Licenses and Regulations of the Goleta Municipal Code for “Firearm s and Ammunitions Retail.” If City Council is interested in this ap proach, City staff could evaluate existing tobacco retailing requirements found in Chapter 5.07 Tobacco Retailing License, and how those requirements may be applied to the legal framework applicable to firearms and ammunition sales. Specific requirements and standards could be included in Title 5.

Title 5 / Title 17 Option
Another option is to add regulations to both Title 17 Zoning and Title 5 Business Licenses and Regulations, as described in the options above . This option presents a comprehensive, clear, and transparent format for improved regulatory oversight of this use.

Staff Considerations – Title 5 versus Title 17
A Title 17 Zoning amendment would reflect the most common approach utilized by other California jurisdictions in placing location restrictions on the retail sale of firearms, which could be done in combination with Title 5 amendments that focus on operational, licensing, security and similar standards specific to firearms and ammunition retail sales.

For potential sensitive use buffers, including where a particular commercial use may locate in relation to other, surrounding land uses, City staff believes Title 17 provides the most appropriate framework. Either stand-alone Title 17 Zoning amendments regulating land uses , or Title 17 land use amendments in combination with Title 5 changes addressing operational, licensing, security and similar requirements , is City staff’s recommended approach for new firearms and ammunition regulations.

Options for Firearms and Ammunition Retail Use Standards

Currently, and as noted previously, specific standards for firearms and ammunition retail uses are not provided in the Zoning Ordinance of the Goleta Municipal Code. Specific standards to consider are outlined below, for Council consideration and feedback:

Applicable Zoning Districts
Currently, retail use s (including firearm s and ammunition retail use) are allowed in Regional Commercial (CR), Community Commercial (CC), Old Town (OT), and General Commercial (CG). These zone districts are intended for retail use establishments and were planned as such during the development of the General Plan . Council may wish to change the locations where firearm s and ammunition retail uses are a llowed, such as limiting firearms and retail uses only to certain commercial zone districts and banning them in others. Alternatively, or in addition, the Council could consider allowing firearm s and ammunition retail as a principally permitted use in cert ain non -commercial zone districts, such as Industrial zone districts, where retail is presently only permitted as an accessory use to a primary use, such as manufacturing. However, these options may require a more detailed General Plan amendment , a need fo r more thorough environmental and legal review, and must be evaluated in the context of Second Amendment jurisprudence.

Sensitive Uses
While cannabis, tobacco and adult -oriented businesses follow different legal and constitutional doctrines than firear ms regulation, standards including buffers from sensitive uses could be developed for firearms and ammunition retail regulations that are analogous to those uses presently regulated under the Goleta Municipal Code .

Importantly, should the City Council provide direction to evaluate a s ensitive use buffer for firearms and ammunition sales, it would require additional spatial analysis that would be included as part of the future, public ordinance adoption process.

Under this option, sensitive uses for Council consideration may align with those protected by tobacco, cannabis, and adult business regulations. These sensitive uses include day cares2, schools (K-12), parks, youth centers, such as the Goleta Community Center, and residentially zoned properties.

2 Title 17 and state law distinguish between “Day Care Centers” (other than family day care homes) and “Family Day Care” (located in the provider’s own home), all licensed by the state. The Municipal Code also uses the term “Day Care Facility.”

As used in this staff report, the term “day cares” refers to both “Day Care Centers” and “Family Day Cares” generically. Key definitions follow below.

§ 17.73.010 Definitions.

Day Care Center.

Day care center has the same meaning as in California Health and Safety Code Section 1596.76.

Health and Safety Code Section 1596.76.
“Day care center” means a child day care facility other than a family day care home, and includes infant centers, preschools, extended day care facilities, and schoolage child care centers, and includes child care centers licensed pursuant to Section 1596.951.
4 Meeting Date: September 1, 2026

Page 5 of 8 ends

Additional sensitive uses that Council may wish to consider could include g eneral assembly uses, such as churches , g yms and a thletic clubs, m artial arts and dance studios, the Goleta branch post office , libraries, City Hall, bike paths, and beaches and beach parking lots. Staff seeks Council guidance on what, if any, sensitive uses to include for further evaluation.

Of note, the distribution of sensitive uses, particularly residential zoning, covers much of the City and overlaps with most areas of the City where retail use is allowed. As such and as described above, a Title 17 Zoning amendment on sensitive uses will require City staff to evaluate and recommend to t he Planning Commi ssion and City Council a n

§ 17.72.020 Public/Quasi-Public Uses.

Day Care Facility.

Establishments providing non-medical care for persons on a less than 24-hour basis other than Family Day Care. This classification includes nursery schools, preschools, and day care facilities for children or adults, and any other day care facility licensed by the State of California.

§ 17.72.070 Accessory Uses.

Family Day Care.

A State-licensed home which regularly provides care, protection, and supervision of children under 18 years of age in the provider’s own home, for periods of less than 24 hours per day, while the parents or guardians are away, as further defined and permitted pursuant to the California Health and Safety Code and other applicable State Regulations. The term “Family Day Care” includes the terms “Large Family Day Care” and “Small Family Day Care” as such terms are defined in California Health and Safety Code Sections 1597.465 and 1597.44.

Small. As defined in California Health and Safety Code Section 1597.44.

Large. As defined in California Health and Safety Code Section 1597.465.

Health and Safety Code Section 1597.44.

A small family day care home may provide care for more than six and up to eight children, without an additional adult attendant, if all of the following conditions are met:
(a) At least one child is enrolled in and attending kindergarten or elementary school and a second child is at least six years of age.
(b) No more than two infants are cared for during any time when more than six children are cared for. (c) The licensee notifies each parent that the facility is caring for two additional schoolage children and that there may be up to seven or eight children in the home at one time. (d) The licensee obtains the written consent of the property owner when the family day care home is operated on property that is leased or rented.

Health and Safety Code Section 1597.465.

A large family day care home may provide care for more than 12 children and up to and including 14 children, if all of the following conditions are met:
(a) At least one child is enrolled in and attending kindergarten or elementary school and a second child is at least six years of age.
(b) No more than three infants are cared for during any time when more than 12 children are being cared for.
(c) The licensee notifies a parent that the facility is caring for two additional schoolage children and that there may be up to 13 or 14 children in the home at one time. (d) The licensee obtains the written consent of the property owner when the family day care home is operated on property that is leased or rented.

ordinance that takes into consideration spatial distribution and any recommended buffers in detail, to ensure that such regulations are permissible.

Sensitive Uses and Buffers
Analogous to the way the City permits cannabis, tobacco, and adult business uses, buffers from sensitive uses could be developed for firearms and ammunition retail sales, though the latter involves a different legal analysis. Subject to feedback from Council, City staff could evaluate buffers from the f ollowing sensitive uses consistent with applicable law:
 day cares
 schools (K-12)
 parks
 youth centers, such as the Goleta Community Center
 residentially zoned properties

Separation of Use Standards
Council could consider adding a firearms and ammunition retail use separation requirement. Such a separation requirement would be analogous to the cannabis use regulations ( e.g., a 600 -foot separation requirement between storefronts) and adult - oriented business use regulations ( e.g., a 1,000 -foot separation requirement between storefronts). Staff seeks Council’s feedback on whether or not to include separation standards in possible regulations and, if so, feedback regarding the separation distance, which would then be evaluated consistent with applicable law.

Other Possible Requirements

As staff moves forward with crafting firearm s and ammunition –specific standards, additional requirements could be addressed. For example, hours of operation, fencing requirements, security and safety, discharge restrictions, and advertising are topics that can be addressed in the future. City staff is aware a number of jurisdictions in California include these type of standards alongside business license requirements or that otherwise exist outside the City’s Zoning Ordinance. While not imperative for this Study Session, Council may wish to provide staff with feedback regarding these or other possible requirements.

If any proposed zoning or land use changes render existing uses non -conforming, then the existing Title 17 provisions regarding termination of non-conforming uses would apply.

See Chapter 17.36 of the Goleta Municipal Code . Goleta’s Municipal Code establishes the procedure for termination of a legal non -conforming use , following an appropria te amortization period . That amortization period is determined through the process and factors identified under Chapter 17.36. Any determination regarding a particular non - conforming use would occur based on the circumstances applicable at that time. The City’s process includes notice and an opportunity for public hearing, and the application of the City’s non -conforming use provisions as it relates to any particular use is not the subject of this study session.

Permit Procedures

Currently, retail uses, such as firearms and ammunition retail stores, are an allowed use in specific commercial zoning districts including Regional Commercial (CR), Community Commercial (CC), Old Town (OT), and General Commercial (CG). No permit is required.

Staff seeks Council feedback regarding the permit path.

If directed to establish related regulations, staff will carefully consider the various regulatory restrictions to ensure that they are consistent with applicable law.

Business License Regulations

The City’s Firearms Dealer Business License is the City’s current permitting tool for these types of uses. There are no companion requirements in Title 5 Business Licenses and Regulations. Staff seeks Council feedback regarding interest in adding new provisions to Title 5 with more specific requirements for th is business license type. This approach would be similar to how the City licenses tobacco retail and commercial cannabis businesses, for example , though those uses have a distinguishable legal framework.

Adding a new chapter to specify related requirements for firearms and ammunition retail businesses could add transparency and clarity to the permitting process.

If staff were to add new provisions to Title 5 to specify requirements of the firearm s and ammunition retail business license, City staff could evaluate possible language that may address:
 application procedures and requirements
 compliance with federal and state requirements
 grounds for denial or revocation of the license
 operating requirements
 suspension of license terms
 safety and security requirements
 limitations on the City’s liability
 enforcement

Next Steps

The Study Session will inform staff on how and where to regulate firearm s and ammunition retail, and any additional related feedback. Feedback regarding the location of possible new requirements, such as in Title 5 Business Licensing and Regulations and/or Title 17 Zoning, will guide the next steps. The Study Session will also inform staff on how to address sensitive uses and buffers. Staff will utilize this feedback to draft new requirements, including for firearms and ammunition retail.

7 Meeting Date: September 1, 2026

Page 8 of 8 ends

Procedurally, any changes proposed to Title 17 Zoning will report first to the Planning Commission and then to the City Council with the Planning Commission’s recommendation. If feedback is received to consider new requirements to the Business License and/or regulations are added to Title 5 Business Licensing and Regulations , State law does not require that ordinance go first to the Planning Commission before it comes to the City Council.

Staff will keep in mind th e fact that new regulations, if any, must be consistent with the Goleta General Plan / Coastal Land Use Plan (General Plan). If staff moves forward with the development of new regulations, a companion General Plan amendment may be necessary, depending on the specific land use changes . This step is important from the perspective that amending the General Plan takes time and is procedurally more involved.

Staff will attempt to find solutions to avoid amendments where possible, in order to preserve the General Plan, as adopted.

GOLETA STRATEGIC PLAN:

City-Wide Initiative: 7. Maintain a Safe and Healthy Community

FISCAL IMPACTS:

This item is to facilitate discussion and receive feedback on possible new regulations for the Goleta Municipal Code. As such, there is no immediate fiscal impact associated with the discussion.

However, should the City Council direct staff to move forwar d with ordinance development, future actions may require staff resources, mapping services, and legal review. Any fiscal impacts will be identified and brought forward for Council consideration as part of future actions.

ALTERNATIVES:

No alternatives are provided as staff is seeking feedback on the desire for possible new regulations.

September 1, 2026, Firearm Sales Study Session 2
51 Background
September 1, 2026, Firearm Sales Study Session 3
• Second Amendment of the U.S. Constitution protects right to bear fire
arms
• Retailers/dealers must comply with federal and state laws and obtain f
ederal and state licenses and permits
• Local regulations are allowed if they do not unreasonably interf
ere with Second Amendment rights (some
cities/counties regulate, many do not)
52 Existing Goleta Municipal Code (GMC)
Existing GMC Regulations
•Safe storage of firearms in residences (Title 9)
•Unlawful firearm discharges (Title 12)
•Firearms and ammunition retailers are treated as “General Re
tail” in four commercial zone districts: Regional Commercial (CR), Community Commercial (CC), Old Town (OT), and
General Commercial (CG) (Title 17)
•Business license is required
September 1, 2026, Firearm Sales Study Session 4
53 Options for New Regulations Location
•Title 5 (Business Licenses): add “Firearms and Ammunition Re
tail” business license requirements
•Title 17 (Zoning): add “Firearms and Ammunition Retail” use regula
tions, possible sensitive use buffers
•Title 5 / Title 17: include hybrid of both options above Question: Which location(s) in GMC, if any, is desired for new regulations?
September 1, 2026, Firearm Sales Study Session 5
54 Options for New Use Standards
Applicable Zoning Districts
•Currently allowed in Regional Commercial (CR), Community Commercial (CC), Old T
own (OT), and General Commercial (CG)
•City could change the locations where firearms and ammunition ret
ail uses are allowed
•May trigger a General Plan amendment
Question: Maintain existing zones where firearms and ammunition retai
l uses are allowed?
September 1, 2026, Firearm Sales Study Session 6
55 Options for New Use Standards
Sensitive Uses
•Buffers from sensitive uses could be evaluated
•Sensitive uses could include Family Day Cares (Large) and Day Care F
acilities, schools (K-12), parks, Goleta Community
Center, youth centers, residentially-zoned parcels, other Question: Which sensitive uses to prioritize, if any?
September 1, 2026, Firearm Sales Study Session 7
56 Options for New Standards
Sensitive Uses and Buffers
•Examples from the GMC (distinguishable legal standards):
•Cannabis: 600 feet GCC, K-12; 100 feet residential zones •Tobacco: 1,000 feet schools (including day cares)
•Adult-Oriented Businesses: 1,000 feet schools, day
car
es, community assembly, and parks; 600-1,000 feet
from residential zones
Questions: Are there desired buffer distances?
September 1, 2026, Firearm Sales Study Session 8
57 Options for New Use Standards
Separation of Use Standards
•Possible separation requirement could be evaluated,
similar to cannabis r
etail (600 feet) or adult businesses
(1,000 feet)
Question: Include a separation standard? Higher or lower priority than sensitive use buffers?
September 1, 2026, Firearm Sales Study Session 9
58 Options for New Regulations
Other Possible Requirements
•Hours of operation, fencing requirements, nonconforming uses, discharge r
estrictions, firearms and ammunition
retail as an accessory use, etc.

Question: Are there other specific use standards to focus on? September 1, 2026, Firearm Sales Study Session 10
59 Options for New Regulations or Licenses
Business Licenses
• Language could be evaluated to address:
• application procedures and requirements
• compliance with federal and state requirements
• grounds for denial or revocation of the license
• operating requirements
• suspension of license terms
• safety and security requirements
• limitations on the City’s liability
• enforcement
Question: Are there operational requirements to focus on for business licenses? September 1, 2026, Firearm Sales Study Session 11
