CITY MANAGER DEPARTMENT

STAFF REPORT
TO: Honorable Mayor Rios and City Council
DATE: January 18, 2022
FROM: Rene Mendez, City Manager
SUBJECT: Resolution No. 2022-03 CalPro Memorandum of Understanding

RECOMMENDATION
Staff recommends the City Council approve Resolution No. 2022-03, A Resolution of the City Council of the City of Gonzales Authorizing the Execution of a Memorandum of Understanding (MOU) between the City of Gonzales and the Painters & Allied Trades, District Council 36, on Behalf of CalPro, the California Professional Employees, Local Union #2345 for 2022 thru 2024.

BACKGROUND
The current 3-year MOU with the Public Works’ employee group ended December 31, 2021. Staff has been meeting with a representative of the employee group over the last several weeks to negotiate a new MOU.

REVIEW AND ANALYSIS
Resolution No. 2022-03 (attached) represents the Tentative Agreements between City staff and the employee representative for a new 3-year MOU that would go through the end of 2024. Specifically, the proposed MOU reflects:

1. A salary equity adjustment to the appropriate pay scales (Attachment A to the MOU) of the positions in this employee group for 2022, to bring the salaries in line with the rest of the South County Cities;

2. An increase in the progression between salary steps from 4% to 4.5% to again bring the salaries in line with the rest of the South County Cities;

3. A 3.5% salary adjustment for 2023 and 2024;

4. An increase in the safety boots allowance from $150 to $200 annually to keep pace with inflation;

5. An increase in the certificate incentive pay from $25 to $50 per certificate, not to exceed $200 per month; and
AGENDA
ITEM
16 6. A few minor language clarifications.

The fiscal components of the new MOU would go into effect the first pay period in January 2022 and subsequent adjustments would go into effect the first pay period of the year for 2023 and 2024.

In addition, while negotiating and presenting for approval new MOUs are part of doing business, it is important to point out that our Public Work Employees during the very challenging last two years, have really stepped up to help the community get through the COVID-19 Pandemic. Whether maintaining the infrastructure in a heighten safety environment, building the little food pantries, installing the parklets to keep our restaurants operational, enhanced cleaning of all facilities, providing staff food and mask distributions efforts, names just some of the efforts undertaken and/or supported by Public Works.

Explain Recommendation and How it Supports the Vision
Gonzales will continue to be a safe, clean, family-friendly community, diverse in its heritage, and committed to working collaboratively to preserve and retain its small-town charm.

Explain: The MOU continues the positive Employer-Employee relation with the Public Works employees necessary for good employee relationships, that would result in maintaining a high level of public service necessary to keep the operations of the City moving forward.

Explain how the Recommendation Directly Implements the Mission The City Council and Staff of the City of Gonzales will realize our Vision by providing the leadership, commitment, and resources necessary to provide excellent services that enhance the quality of life of our diverse community.

Explain: Public Works employees represented by this union are an essential part of the excellent services provided to the community. To continue to enhance the quality of life in Gonzales, employees must be valued and appreciated as this MOU does.

City services will be delivered in a cost-effective, respectful, and friendly manner to insure the safety and well-being of the residents and the promotion of business, recreational, housing and employment opportunities in an environmentally sustainable manner.

Explain: Staff believes the attached MOU represents a cost-effective way to provide for the community and the employees represented.

Strong fiscal policies allow us to provide appropriate infrastructure for:
• Public Safety X Yes No N/A
• Housing Yes No X N/A
• Recreation X Yes No N/A
• Environment X Yes No N/A
• Education Yes No X N/A
Explain: Positive labor relationships are necessary to ensure the high level of service necessary to maintain the City’s infrastructure.

ALTERNATIVES
Alternative 1 – The City Council could make changes in the Resolution or Memorandum of Understanding.

Alternative 2 – The City Council could direct the City Manager to renegotiate the Memorandum of Understanding.

Staff recommends against either of these alternatives as the employees bargaining group negotiated fairly, and the results are very similar to previous efforts.

BUDGET IMPACT
The three-year cost impact of the proposed MOU is $87,500. On annual basis costs are estimated at $40,060 for 2022; $23,400 for 2023; and $24,040 for 2024. These cost impacts will be spread out over multiple funds and as a result, there is sufficient room in the budget to cover the increases.

CONCLUSION
Staff recommends the City Council approve Resolution No. 2022-03, A Resolution of the City Council of the City of Gonzales Authorizing the Execution of a Memorandum of Understanding (MOU) between the City of Gonzales and the Painters & Allied Trades, District Council 36, on Behalf of CalPro, the California Professional Employees, Local Union #2345 for 2022 thru 2024.
