RECOMMENDATION
It is recommended that the City Council:
• Adopt Resolution No. 2022-59, A Resolution of the City Council of the City of Gonzales Authorizing Execution of an Agreement With American Ramp Company to Install Phase 2 of the Skate Park for a Not-To-Exceed Fee of $214,755, And Authorizing the Use of the City’s In-Lieu Purchase Exception; and
• Amend the FY 2022-2023 City Budget by Increasing the Public Facilities Impact Fund (Fund 241) Capital Outlay - Improvements (Object Code 6530) by $36,000.
BACKGROUND
The City’s Skate Park is located at 203 First Street and is one of the various recreational facilities in Centennial Park. The first phase of the skate park was fabricated and installed by American Ramp Company in late 2017 and completed in February 2018. The elements in the skate park were purposely set on one half of the site with the other half left empty until additional funds became available.
Proposition 68 was approved by California voters in 2018 and is providing $4.0 Billion in park funding to all cities and counties in the state. Prop 68 includes an allotment of $178,800 to each city. In early 2021 Staff performed the required public outreach with skate park users and held a public hearing at the May 17, 2021, City Council meeting which included presenting the feedback received from the public. Earlier this year, the city executed an agreement with the State Department of Parks and Recreation to receive the funding.
The attached exhibit shows the elements to be installed at the skate park under this agreement.
AGENDA
ITEM
17 REVIEW AND ANALYSIS
When Phase 1 of the skate park was constructed in 2017, American Ramp Company was the only aboveground ramp builder in the United States. Staff is recommending that the Council authorize execution of this agreement with American Ramp Company to fabricate and install the Phase 2 elements due to compatibility issues with the existing skate park pieces and to minimize efforts for future maintenance needs. Additionally, American Ramp Company and the City of Gonzales are members of Sourcewell which is a cooperative sourcing solution for public agencies which provides for discounts and free shipping on products. Per Gonzales City Code Section 3.16.050, the City has an “In-Lieu Purchase Exception” that allows the City, by four-fifths vote, to rely on the purchasing procedures and bid results of other public entities in lieu of going out to bid for the purchase of equipment. The City’s Sourcewell membership allows the City and a multitude of other public entities to rely on publicly competitively bid contracts for a wide variety of supplies and related installation services.
Like most construction projects over the last year, the cost for the Phase 2 improvements increased significantly due to COVID supply chain issues. The quote from American Ramp Company through Sourcewell to fabricate and install the Phase 2 improvements increased from $180,000 to $214,755. Staff is proposing to allocate $35,955 from the Public Facilities Impact Fund to close the gap.
American Ramp Company staff has indicated it will take four to five months to fabricate the new elements, two weeks for shipping and one week for installation. It should be noted that installation of the equipment by either City forces or an independent contractor would likely result in a loss of the warranty on the involved improvements, thus undermining the value of the Phase 2 ramp elements.
