RESOLUTION NO. 2022-59

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GONZALES

AUTHORIZING EXECUTION OF AN AGREEMENT WITH AMERICAN RAMP COMPANY TO INSTALL PHASE 2 OF THE SKATE PARK FOR A NOT-TO-EXCEED FEE OF $214,755 AND AUTHORIZING THE USE OF THE CITY’S IN-LIEU

PURCHASE EXCEPTION
WHEREAS, Phase 1 of the City Skate Park (“Park”) was constructed in 2017 and completed in February 2018; and
WHEREAS, the elements for Phase 1 of Park were purposely set on one half of the site with the other half left empty until additional funds became available to construct Phase 2; and WHEREAS, the City is now ready to move forward with Phase 2 of the Park, and has received a quote of $214,755 for the Phase 2 elements from American Ramp Company, the company that provided the elements for Phase 1 of the Park, through Sourcewell, a sourcing entity that provides public agencies with the benefits of cooperative contracting opportunities; and WHEREAS, pursuant to Section 3.16.050 of the Gonzales City Code, the City may utilize its “In-Lieu Purchase Exception” to dispense with formal bidding procedures and rely on the bid or bids of other entities to save both time and money; and WHEREAS, the Acting City Manager and Staff have determined that 1) the bid for the purchase of the Phase 2 Skate Park elements, in this case in the form of a competitively bid contract with American Ramp Company through Sourcewell, is and remains valid through the current date, 2) with the exception of unavoidable Covid-related contract increases felt throughout the nation, that there has been no significant change in the price of the requested park elements since the time the American Ramp Company pricing through Sourcewell was established, 3) that there is no reason to believe that there would be a significant difference in the price of the unique Park improvements to be purchased from the American Ramp Company based on region; and 4) the purchase contract through Sourcewell is based on the lowest responsible competitive bid or equivalent thereto for the purchase of the desired Skate Park elements and installation thereof; and WHEREAS, funding for this contract will come from $178,800 in Proposition 68 grant funds and $35,955 from the Public Facilities Impact Fund (Fund 241); and WHEREAS, Staff recommends that the Council authorize execution of an agreement with American Skate Ramp Company to complete Phase 2 of the project due to compatibility issues with the existing skate park pieces and to minimize coordination of installation, warranty and maintenance needs.

NOW THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Gonzales as follows:

1. All of the recitals set forth above are true and correct to the best of its knowledge and by this reference are incorporated herein as findings.
