A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GONZALES AWARDING A CONTRACT WITH TOPE’S TREE SERVICE FOR THE TREE
REMOVAL CONTRACT AT THE COMMUNITY CENTER SITE, REJECTING
ALL OTHER BIDS, AND AUTHORIZING AND DIRECTING CITY STAFF TO EXECUTE A CONTRACT WITH TOPE’S TREE SERVICE IN THE AMOUNT OF $90,000 WHICH INCLUDES A CONTINGENCY BUDGET OF $10,300 FOR
UNANTICIPATED FIELD CHANGES
WHEREAS, staff issued bid documents for the Tree Removal Contract at the Community Center Site on August 25, 2022; and
WHEREAS, on September 21, 2022, the City received the following bids for this contract:

WHEREAS, staff determined that Tope’s Tree Service provided the lowest responsive and responsible bid, and that Tope’s Tree Service is qualified to undertake the proposed work and willing to perform the same on a timely basis; and
WHEREAS, removal of the tress was analyzed under CEQA/NEPA and the project (including tree removal) was determined to be Categorically Exempt, with an NOE filed on April 1, 2022; and
WHEREAS, funding for this project will come from City Measure X Funds; and WHEREAS, Swinerton Consulting staff will provide Construction Management and Inspection Services on the contract under their consultant agreement with for Program Management/Construction Management Services.
NOW THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Gonzales that Tope’s Tree Service submitted the lowest responsive and responsible bid for work associated with the Tree Removal Contract, that the City accepts Tope’s Tree Service bid and that the contract is hereby awarded to the Tope’s Tree Service, all other bids are rejected, and the City Manager is directed to notify all other bidders in writing of the City’s decision.
BE IT FURTHER RESOLVED that the City Manager is authorized and further directed to prepare and execute the appropriate contract in a not-to-exceed amount of $90,000 which is based on their base bid amount of $62,000, their additive alternate cost of $17,700 for removal of the stumps and include a contingency budget of $10,300 for unanticipated field changes, and amend the FY 2022-2023 City Budget by increasing the Measure X (Budget Unit 850) Contractual Services - General (Object Code 6235) by $90,000.
