AUTHORIZING THE INTERIM CITY MANAGER OR DESIGNEE TO EXECUTE AND
SUBMIT A CLEAN WATER STATE REVOLVING FUND FINANCIAL ASSISTANCE
APPLICATION TO THE STATE WATER RESOURCES CONTROL BOARD (SWRCB) FOR THE PLANNING, DESIGN, AND CONSTRUCTION OF THE 1.0 MILLION
GALLONS A DAY (MGD) INDUSTRIAL WASTEWATER SYSTEM, AND EXECUTE SRF
FINANCIAL ASSISTANCE AGREEMENTS AND ANY AMENDMENTS WITH THE SWRCB
R E C I T A L S
A. The State of California State Water Resources Control Board (the “Board”) has a funding program entitled “Clean Water State Revolving Fund,” (“CWSRF”) and pursuant to this program, the Board makes funds available for various capital wastewater and recycled water‐ related projects.
B. The City of Gonzales (the “City”) owns and operates a Wastewater System (the “System”) and engages in various capital improvement projects to improve and maintain the System.
C. The City wishes to apply for CWSRF funds to cover the cost of the 1.0 MGD Industrial Wastewater System Project (“Project”).
D. The Project will be implemented in multiple phases to increase industrial wastewater capacity.
The City is currently seeking CWSRF funding for Phase 1 of the Project.
NOW, THEREFORE, the Council of the City of Gonzales RESOLVES as follows:
SECTION 1. The Council hereby finds that it is in the City and the public’s interest in the health, safety and welfare of the community to file a Financial Assistance Application with the Board to seek funds available under the State Revolving Fund for the Project.
SECTION 2. The Council hereby authorizes and directs the Interim City Manager or the Director of Public Works, to:
▪ File and sign, for and on behalf of the City, a Financial Assistance Application for a financing agreement from the Board for the planning, design, and construction of the Project.
▪ Provide the assurances, certifications, and commitments required for the financial assistance application, including executing a financial assistance agreement from the Board and any amendments or changes thereto.
▪ Represent the City in carrying out the City’s responsibilities under the financing agreement, including certifying disbursement requests on behalf of the City and compliance with applicable state and federal laws.
SECTION 3. The Council finds that the filing of a Financial Assistance Application with the State Water Resources Control Board does not constitute a project requiring California Environmental Quality Act (CEQA) review. This action does not meet the definition of a project under Public Resources Code Section 21065 and CEQA Guidelines Section 15378(b)(5), because it is an administrative governmental activity which will not cause a direct or indirect physical change in the environment. The Council further finds that the potential environmental effects of implementation of the Project were analyzed and discussed in the Industrial Wastewater Conveyance and Industrial Wastewater Treatment Facility Environmental Impact Report (SCH # 2020069049) certified in September 2021.
