A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GONZALES
APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN
THE CITY OF GONZALES AND TRI-CITIES DISPOSAL AND RECYCLING
SERVICES REGARDING NEGOTIATIONS FOR AMENDMENTS TO THE
EXCLUSIVE SOLID WASTE, RECYCLING AND ORGANICS COLLECTION
SERVICES PROGRAM AGREEMENTS
WHEREAS, Senate Bill (SB) 1383, as enacted in 2017 and adopted by CalRecycle in 2020 establishes statewide targets to reduce the disposal of organic waste by 50 percent by 2020 and 75 percent by 2025 and requires that 20 percent of edible food that is currently disposed be recovered for human consumption by 2025; and,
WHEREAS, the Revised and Restated Franchise Agreement (Franchise Agreement) between the Cities of Gonzales, Greenfield, and Soledad and Tri-Cities Disposal and Recycling Services, Inc. for Solid Waste, Recycling, and Organics Collection Services, approved by the City of Gonzales on October 3, 2016, requires amending to comply with SB 1383 regulations and City Code Chapter 5.30.; and,
WHEREAS, Section 10.8 of the Franchise Agreement requires that any amendment to be approved by written agreement of both or all parties; and, WHEREAS, City Staff and the Salinas Valley Solid Waste Authority, as Contract Administrators, have reviewed the proposed Memorandum of Understanding, and find it acceptable, where all parties commit to immediately implement, or to the extent already implemented, continue to conduct, its solid waste, recyclables, and organics collection services in compliance with the mandates of AB 341, AB 1826, AB 1594, SB 1383 and City Code Chapter 5.30, through the term of the current Franchise Agreement, June 30, 2025.
NOW THEREFORE, BE IT HEREBY RESOLVED, by the City Council of the City of Gonzales, that the Memorandum of Understanding between and the City of Gonzales and TriCities Disposal and Recycling Services, Inc., a copy of which is attached hereto as “Exhibit A” and by reference is incorporated herein, is hereby approved and the City Manager is authorized and directed to execute the same on Behalf of the City.
BE IT FURTHER RESOLVED, by the City Council of the City of Gonzales, that the aforementioned Memorandum of Understanding does not result in an increase to customer rates and the Fiscal Year 2022-23 Rate Schedule, attached here to as Exhibit B and incorporated herein by reference, remains in effect through June 30, 2023, or until otherwise revised by the City Council.
