RESOLUTION NO. 2023-67
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GONZALES ESTABLISHING NEW WATER AND SEWER RATES FOR CALENDAR YEARS 2024 THROUGH 2028
WHEREAS, The City Council approved an agreement with Lechowicz & Tseng to prepare a Water and Sewer Rate Study at the November 21, 2022 Regular Meeting; and WHEREAS, A draft Water and Sewer Rate Study was presented to the City Council at the Regular Meeting on August 7, 2023 and the Final Water and Sewer Rate Study was presented to the City Council at the Regular Meeting on September 18, 2023 which was accepted as the basis of commencement of the rate setting process; and
WHEREAS, in accordance with Proposition 218, water and sewer increases are subject to the majority protest provisions of Proposition 218, which requires notices to be mailed to affected property owners and utility rate payers advising them of the proposed increases, the date of the public hearing, and the protest provisions, at least 45 days prior to the hearing; and WHEREAS, Lechowicz & Tseng mailed the Notices to affected property owners and utility rate payers on September 29, 2023; and
WHEREAS, the City Council of the City of Gonzales conducted a Public Hearing on November 20, 2023 in accordance with the Proposition 218 procedures; and WHEREAS, the City Council received ____ protests at the Public Hearing, short of a majority protest, and after giving the protests due consideration, the City Council decided to move forward with action adopting new water and sewer rates; and NOW THEREFORE, BE IT HEREBY RESOLVED, by the City Council of the City of Gonzales:
1. All of the recitals set forth above are true and correct, and by this reference are incorporated herein as findings; and
2. The Water and Sewer Rate Study report prepared by Lechowicz & Tseng, which is attached hereto as Exhibit “A”, and by reference incorporated herein, is hereby formally accepted as final and complete; and
3. The new water and sewer rate schedule within the Water and Sewer Rate Study Report is hereby approved. By this action, the existing water and sewer rate schedule is rescinded as of January 1, 2024.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Gonzales duly held on the 20th day of November 2023, by the following vote:
