A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GONZALES
APPROVING THE PURCHASE OF A JOHN DEERE SKID STEER WITH
IMPLEMENTS FROM RDO EQUIPMENT COMPANY IN THE AMOUNT OF
$85,283, AND APPROVE THE SURPLUS SALE OF THE EXISTING
1980 JOHN DEERE TRACTOR
WHEREAS, staff recommends replacing the John Deere Tractor used at the Wastewater Treatment Plant as it’s over 40 years old and needs extensive repairs, is unsafe and should be replaced to comply with California Air Resources Board exhaust emission requirements; and WHEREAS, the State of California adopted Public Contract Code Section 10298 authorizing local agencies to contract with suppliers awarded state bids without further competitive bidding; and
WHEREAS, pursuant to Section 3.16.050 of the Gonzales City Code, the City may utilize its “In-Lieu Purchase Exception” to dispense with formal bidding procedures and rely on the bid or bids of other entities or entity cooperatives to save both time and money; and WHEREAS, the City of Gonzales and RDO Equipment are members of Sourcewell, a cooperative sourcing solution for public agencies that provides expedited quotes, discounts and free shipping on a variety of products and types of equipment; and WHEREAS, the City has obtained a quote from RDO Equipment through Sourcewell for the desired 2023 John Deere Tractor and various needed implements for $85,283; and WHEREAS, the City Manager has approved of the use of the in-lieu exception for this purchase, the quote for the new Skid Steer from RDO Equipment Company through Sourcewell is based on the lowest responsible competitive bid or equivalent thereto for the purchase of the same item made within the last 12 months or other acceptable timeframe, and there is no reason to believe that there has been a significant change in the price of the involved equipment since the RDO bid was made ; and
WHEREAS, funding for this purchase will come from the Sewer Enterprise Fund – Capital Outlay (GL 530-000-6540); and
WHEREAS, staff recommends that the Council authorize the purchase of a new John Deere Skid Steer with implements from RDO Equipment Company in the amount of $85,283 and approve the surplus sale of the existing 1980 John Deere tractor.
NOW THEREFORE, BE IT HEREBY RESOLVED, that all of the recitals set forth above are true and correct to the best of the Council’s knowledge and are hereby adopted as findings.
BE IT FURTHER RESOLVED, the City Council of the City of Gonzales hereby authorizes the purchase of a new John Deere Skid Steer with implements from RDO Equipment Company using funds from the Sewer Enterprise Fund in the amount of $85,283 and approve the surplus sale of the existing 1980 John Deere tractor.
PASSED AND ADOPTED by at least a four-fifths vote at a regular meeting of the City Council of the City of Gonzales duly held on the 20th day of February 2024, by the following vote:
