This letter is meant to seek your concurrence and commitment to completing the environmental review processes for the Vista Lucia Specific Project and its several companion components. I hope to bring Amendment #4 to the City Council on March 4, 2024, but first need your acknowledgement of several items: The remaining Scope of Work, the remaining account balance and expenses to come, and an extension of the time frame to include a few more months and ending on December 31, 2024.
Scope
n Amendment #3 to the scope (City Council action on October 16, 2024) we collectively agreed on the new work needed from Hexagon Consultants to perfect the VMT analysis against a rule set that had changed from the first early draft of the DEIR. Prior to the Council date, on October 2, 2023, Pembrook acknowledged the additional expense to be incurred of $21,375.00 through EMC Planning Group. (A separate check to counter this new expense was not submitted by Pembrook, we just drew against the existing fund balances.
Amendment #3 also acknowledged that existing funds tasked to the FEIR preparation and for Public Hearings by EMC would be used to prepare a formalized re-draft and update of the DEIR to reduce errors or the need for corrections as two-years had passed since the first draft DEIR was made public. This was a sound practice, but now we need to get the EIR scope of work updated for the coming FEIR preparation and for Public Hearings by EMC. EMC estimates that the original amounts for two these tasks as described in the original contract and continued through Amendments #1, and #2 will be sufficient to complete their responsibilities. • Response to Comments (FEIR) $ 16,830.00

Extension of Time
The present end of contract falls on June 31, 2024 (set in Amendment #2). As we anticipate getting through City Council in Summer and Fall of this year, and then moving to LAFCo, it seems prudent to add a few months to the contract term. This Amendment #4 will extend the term of EMC's contract to December 31, 2024.
Glenn, returning this document with your signature below will acknowledge your willingness to pay and agree to the modified Scope of Work, expenses and timeframe as illustrated above.
Please deposit $31,122.56 to the SEIR efforts as we approach the close of the 45-day Public Review Period for the EIR on March 18, 2024, and we re-engage with EMC to prepare the Response to Comments, FEIR document.
We then, will prepare the staff report and formal Amendment to the Contract and target that the City Council approve Contract Amendment #4 during their Consent Session at the regular meeting scheduled for Monday, March 18, 2024, 6:00 pm.
