Mayor Rios inquired about the warrant for Swinerton.

Public Works Director Dobbins responded that the transition between Harris & Associates and Swinerton was taking longer than anticipated, and there were items that pre-dated Harris & Associates' involvement that they needed to close out. One of them was the baseline schedule that staff wanted to see before construction began and the other one was the trend log which are things that we were adding or taking out of the project, and we're wrapping things up.

Mayor Rios asked if this would be the last one we would see.

Public Works Director Dobbins responded that he would have to look but he believed the invoices were for services for more than one month.

on April 18th at 4:30pm which was a hamburger take out and anyone interested could contact her or Council Member Silva.

Council Member Silva was excited to see a third planter at the Community Garden area. She also reminded everyone that April was the month that we celebrated Earth Day, and wanted to remind everyone to do their part on recycling.

Council Member Orozco hoped everyone had a great Easter. She mentioned people were asking her if the City could do an Easter Egg Hunt for the kids and said she had someone that could sponsor for next year. She also announced the St. Theodore's Church Annual Reverse Draw on June 14th and she and Council Member Silva have tickets. She also asked if we could bring back to Council an appraisal of City owned properties like we had discussed before about the property next to Canyon Creek which was appraised to bring back cost for what we should be charging for that property. She said we’ve also had discussions about other City-owned properties on the leases that are coming up and we should really take a look at what we have been charging for rental of these properties. She mentioned the lease next door is coming up pretty soon and believed it would be a good time to contact an Appraiser or Commercial Realtor to see what they would suggest for rental of our properties.

Mayor Rios believed the one next door, Rene and with Michael’s approval, extended it from three years to five years because of how much of an investment they were making to the property.

Council Member Orozco asked if it came back to the Council for approval.

Mayor Rios responded it didn’t have to because Rene and Mike had set that up so that they had the discretion to be able to allow to give them additional time.

Council Member Orozco asked if that discretion was allowed on other properties or other issues that come before Council when they passed a resolution to approve certain conditions. She found that to be strange since they had approved it, it became before Council, and we had a public hearing.

Mayor Rios mentioned if she read the whole thing, there was that provision that Mr. Mendez had the discretion to extend the lease an additional two years. He said he didn’t read the entire contract, but he was certain that Michael and Rene did. And they asked for additional time because of the amount of money they were investing in that property. He agreed with her, they got a heck of a deal and in two years he would definitely and highly encourage staff to re-look at the cost and charge appropriately, and obviously it has been quite successful for them so he doubted that they’re hurting for money. He said he wanted to bring this up now rather than say why we haven’t increased the price on them, but Mr. Mendez shared with him that they had asked for an additional two years and they granted them because of the amount they invested on the property.

Council Member Orozco said what that did was set a precedent for any other company or individual who wanted to come in and rent one of our facilities to want to do the same thing.

Mayor Pro Tem Funk suggested we should return to Council updates since this was turning into a discussion that was not agendized.

Mayor Rios shared that Mr. Martinez brought to his attention the last time we had heavy rain there was no flashing yellow warning signs on Tenth and Alta Streets since it got flooded there.

He also asked the Council how they felt about moving the meeting time up half an hour, to 5:30pm rather than 6:00pm. He asked if this was something the Council wanted to consider, we could ask staff to bring this back to us since the ordinance stated 6:00pm. He mentioned there were a few staff members that commuted quiet away, especially the City Attorney who commutes the farthest.

Council Member Orozco mentioned that people worked in Salinas that live in Gonzales who attend meetings and are stuck in traffic so it was even challenging to get here at 6:00pm.

Mayor Rios said he would understand if he saw the room completely full on a regular basis with folks coming from Salinas but it wasn’t.

Council Members Silva, Worthy and Mayor Rios said they were ok with that.

Mayor Pro Tem Funk suggested directing staff to bring it back so we can consider it then.

City Attorney Rodriquez indicated that we could do this change by way of a resolution as opposed through an ordinance change, so staff will bring a resolution back for Council discussion, take public comment, and decide whether or not to take action.

Mayor Rios asked staff to bring it back before the Council.

BUSINESS FROM CITY MANAGER

14. Oral Communications
City Manager Gil reminded everyone about the Car Show on April 20th, and cars will show up as early as 9:00am and the streets would need to be cleared by then; Groundbreaking Ceremony on April 27th at 1:00pm and the School Band will kick off the festivities; and Cinco de Mayo on May 5 th
.

Council Member Silva asked if there will be a Dia del Niño event in April.

City Manager Gil responded yes, the last Sunday in April, which was April 27th.

Public Works Director Dobbins reported on the status of the Fifth Street truck ban. He stated that the Council adopted resolution establishing Fifth Street from US101 to Alta Street as a truck ban and engaged a consultant to prepare the sign package. Staff received the Caltrans encroachment permit and went out to bid about a year ago, and the engineer's estimate was in the order of $35,000. In mid-August, staff received a single bid that was submitted in the amount of $72,000.

He mentioned that unfortunately, we don't have the funding in our road or districts funds to pay for that. He highlighted that there were $25,000 in the bid received for traffic control on US101. He talked to consultants and said an option was that the City could buy the signs and Public Works staff could install them within the City, and find a contractor to install them on US101. He mentioned one of the constraints to deliver Public Works projects was the City Manager's signature authorization for services over $5,000 and anything over that required to come before the City Council, the RFP process, and it was time consuming.

Mayor Rios said this may be something we need to look at to authorize the City Manager to sign for a higher amount.

Mayor Pro Tem Funk agreed this should come back and believed we were at a good point when we can increase that.

COMMUNITY DEVELOPMENT DEPARTMENT

ACTIVITY REPORT
TO: Honorable Mayor Rios and City Council
DATE: April 15, 2024
FROM: Taven Kinison Brown, Community Development Director THROUGH: Carmen Gil, City Manager
SUBJECT: Community Development Department Activity Report - March/April 2024

ECONOMIC DEVELOPMENT
Freeway Oriented Reader Board. Following staff’s update to the City Council, on February 5, 2024, staff has prepared revisions to the City of Gonzales Sign Ordinance (Zoning Code Section 12.116) to enable Freeway Oriented Reader Board signs. On Monday, April 8, 2024, the Planning Commission considered revisions to the Sign Ordinance to enable such signs. Public Notice will be prepared directing the new Ordinance before the Council for first reading on May 6, 2024, and May 20, 2024, for adoption. Thirty days later the new ordinance would be in effect.

On a separate track, staff continues to engage with Legacy Signs who has shown interest in proposing such a sign on City property and extending a revenue opportunity to the community. A formal Conditional Use Permit and lease request is expected soon.

Business Development. The Economic Development Director attended the ICSC Conference in Monterey on March 25-27, 2024, on behalf of the City. There, Taven networked with companies looking to expand their store locations and services in the region and California and also learned of real estate listing services and databases that may be leveraged to the City’s advantage. One significant lesson learned is that many of the City’s vacant and underutilized properties, such as those found on or just off Alta Minor are not listed with nationwide and local listing services, so businesses and commercial brokers are not generally aware of our local potential sites. Director Kinison Brown is now assembling a City portfolio of AGENDA

such properties. He will be contacting each property owner to solicit their approval for staff to enter their site’s availability and potential economic utility. More to come.

HOUSING
Housing Element. On Monday, February 12, 2024, staff held a second workshop with the Planning Commission and concluded a 30-day public review period. Three commissioners (of 4) were in attendance, and no persons from the public were present or spoke by Zoom. Commissioners commented on how out-of-reach housing prices are for so many in the community and how complex and involved the Housing Element is; that it is hard to grasp. To date, staff has only received a single written response from LandWatch Monterey County.

On February 28, staff made final notes and no revisions and forwarded the Housing Element to the State Department of Housing and Community Development. The State then has 90 days to review and return comments to the City, should additional issues need to be addressed or clarified. After receiving initial comments, the City can move to adopt and resubmit to HCD for another 60-day review. HCD then either finds the element in compliance or provides further comment followed by subsequent 60-day review(s) until certification.

From that point with a certified housing element, we will work to implement the Housing Element through zoning actions, program creations, and other mechanisms.

Vista Lucia Specific Plan. The VLSP Draft Environmental Impact Report completed its 45-day public review and staff and consultants are preparing responses to the comments received. A copy of the EIR is available on the City of Gonzales website (https://gonzalesca.gov/services/communitydevelopment/development-activity-projects) under the Vista Lucia Project section.

CODE ENFORCEMENT
The City continues to meet with property owners, inspect potential violations, and documents on progress to remedies.

BUILDING DIVISION ACTIVITY
From March 1, 2024, to March 31, 2024 (31 reporting days), the City issued 21 permits from the Building Division for four ADUs and a JADU, residential solar projects, roof repair, modifications to a cellular facility and electrical and plumbing work to abate code enforcement notifications. The estimated valuation of all improvements was $721,034.00.

GENERAL COMMUNITY DEVELOPMENT ACTIVITY
The City Council approved modifications to the City’s aged “Taxicab” Ordinance to facilitate and streamline the application processes for new cab services to the City. The Yellow Cab Company has welcomed the City’s actions and has applied for a business license to begin service in the community soon.

BUILDINGS
Community Center Complex Project – Staff presented a progress report at the 2/05/2024 Council meeting. On 2/28/2024 the Otto/WRNS team submitted 100% Construction Documents (plans, structural calculations, and technical specifications) to the city. This represents a major milestone as it completed the design phase of the Community Center Complex Project. On 3/08/2024 the Construction Documents were uploaded for building code review by 4Leaf (contract building department staff). The city will hold a Groundbreaking Ceremony at the site on 4/27/2024 and construction is expected to begin in early May 2024.

WASTEWATER

1. Industrial Wastewater (IW) System – Construction documents for the IW Conveyance and Treatment Facility were completed in September 2022. Staff and real estate appraiser are finalizing the temporary and permanent easements needed for the pipeline contract. City staff is coordinating with the State Water Resources Control Board (SWRCB) regarding the City’s State Revolving Fund loan application. On 1/11/2024, SWRCB staff emailed City staff that SRF Agreement is with their Contract Department, and it will take three to four months for them to email us the SRF Agreement.

On 3/20/2024, SWRCB staff said it would be approximately eight weeks to receive the SRF Agreement. Staff has been connecting with State Legislators and staff to see if that timeline can be advanced.

2. RFQ for Program and Construction Management services - On 01/30/2024 staff issued a Request for Qualifications for Program and Construction Management services for Wastewater projects. Four firms submitted Statement of Qualifications by the 2/29/2024 deadline. At the 3/18/2024 Council AGENDA

meeting, a contract with MSN Engineers to provide Program and Construction Management services for Wastewater projects was approved.

3. RFQ for Wastewater Design services – On 3/28/2024 staff issued a Request for Qualifications for Design Services for Wastewater projects. The deadline for consultants to submit a Statement of Qualifications is 4/25/2024.

4. Wastewater Treatment Plant Repairs – At the 2/05/2024 meeting, the City Council authorized emergency work to repair the berms and improve the percolation at the disposal fields. This was based on staff observing the percolation of treated wastewater in the three disposal fields slowed over the last two weeks due to a higher water table because of the higher-than-normal rain last year and this winter’s rainfall. Staff engaged Swift Tectonics to regrade the berms at the disposal fields that should restore the capacity of the disposal fields. Staff also had Rain 4 Rent to provide and install a temporary pipeline to pump treated wastewater from the disposal fields to the emergency overflow basin near the WWTP headworks. Swift Tectonics completed the grading work to restore the disposal fields to their design configuration.

WATER

1. Johnson Canyon Parallel Waterline – A design contract with Schaaf & Wheeler was approved at the 6/20/2023 Council meeting. The contract was executed, and a kick-off meeting was held on 6/29/2023. The 90% Design Submittal was received on 12/22/2023. Staff reviewed the submittal and provided Schaaf & Wheeler with our comments. Upon receiving the 100% plans and technical specifications, staff will issue the project for public bid in the very near future.

ROADS

1. Fifth Street Truck Ban – This project was issued for public bid on 7/17/2023 and one bid was received and opened on 8/17/2023. The submitted bid was double the $35,000 estimate by the designer, so the project will be rescoped and additional funding must be identified to install the signs.

2. Safe Routes to School Steering Committee – The community member Steering Committee led by TAMC staff continues to hold their monthly meetings.

3. Monterey Salinas Transit Circulator – Over the last two years, MST staff has coordinated with city staff to replace the Dial-a-Ride Service with a fixed route bus service in Gonzales. MST and city staff met on 10/09/2023 and drove the proposed route to observe the various stops and developed some adjustments to the bus route. On 1/03/2024 staff emailed our review comments on the 60% design submittal to MST staff. MST’s design consultant is working on the 90% design submittal.

MST staff presented the project at the 4/01/2024 Council meeting.

This early coordination is critical due to the long lead time for electrical gear. On 3/04/2024 the Design/Build team submitted a PG&E new service application for the project. PG&E is currently working on designing the new electrical service for the site which is expected to entail installing a transformer on a power pole for the 2000-amp service.

APRIL 27 GROUNDBREAKING CEREMONY
The City will hold a Groundbreaking Ceremony at the project site on 4/27/2024. It will start at 1:00PM and expected speakers include:
• State Senator Anna Caballero
• Field Representative for Speaker of the Assembly Robert Rivas • Supervisor Luis Alejo
• Mayor Jose Rios
• Cindy Aguilar on behalf of the Gonzales Youth Council • City Manager Carmen Gil
Major donors, elected officials, the Design/Build team, members of the Gonzales Youth Council will take turns with ceremonial shoveling of dirt.

CONSTRUCTION PHASE 1
The Design/Build team is planning to set-up their construction trailers, install construction fencing and perform other preconstruction activities the last two weeks of April. This includes closing the on-site parking lot used by staff with Head Start and the other modular buildings on the Fairview Middle School property.

The contractor’s preliminary baseline schedule is attached and shows completion of Phase 1 in November 2025. Throughout the project, the construction manager will monitor the contractor’s updated schedule to confirm their progress and determine if the project will be completed within the authorized contract time.

FUNDING/FINANCING UPDATES
The Community Center Complex is estimated to cost $34,050,000 for Phases 1 and 2 consisting of the Community Center, Teen Innovation Center, County Library, and all site work. Construction of this significant civic project will be funded by a variety of sources including the following:
• Measure X (local sales tax)
• $5.0M State grant secured by State Senator Anna Caballero • Community Development Block Grant (FY 2022/23 and FY 2023/24) • $1.8M County contribution to relocate existing library from the Gonzales Shopping Center • Grants (Electric Vehicle Charging Station Grant and Building Forward Library Grant) • Capital Campaign with a $10.0M goal with pledges and contributions currently totaling $6.3M As the Council’s aware, the city applied to the US Department of Agriculture (USDA) for a low interest loan secured by City revenue sources, including Measure X. The formal application was submitted to USDA in July 2023 and the City received an approval letter from USDA in September 2023, indicating that a Rural Development Loan in the amount of $9,825,000 was approved for Phase 1 of the Community Center Project. The USDA Loan will become effective upon completion of Phase 1, so staff is obtaining a Construction Loan (“Bridge Loan”).

The USDA’s September 20, 2023 Loan Condition lists the items the city must satisfy for the following project phases:

1. Prior to Construction

2. During Construction

3. After Project Completion
Staff and our consultants are currently addressing the twenty “Prior to Construction” conditions which includes:
• Obtaining a Construction Loan
• Establishment of a Debt Service reserve account
• Insurance and Bonding
• Property ownership certificates
• Copies of various agreements with the Design/Build team, Construction Manager, and other third parties (ie, Lease with the County for the library)
Staff will present Construction Loan documents for City Council approval at the May 6 Council Meeting.

Staff will also recommend issuing a Notice to Proceed with Construction for Phase 1 to Otto Construction at the May 6 Council Meeting.

Packet Pg. 44
Current funding for the project is:
1 Teen Innovation Center Grant (State Grant) $5,000,000 2 USDA Loan (paid by Measure X funds and other city funds) $9,825,000 3 Community Development Block Grant through Monterey County (Federal monies) $704,857
4 County Contribution for Library $1,800,000
5 Electric Vehicle Charging Station Grant $400,000
6 Building Forward Library Grant Program $1,067,430
7 Capital Campaign Contribution (private contributions and pledges) $6,316,566 Funding as of 4/01/2024 = $25,113,853
DBE Contract “Stipulated Sum” for Phase 1 = $23,619,838 Estimated Cost for Phase 2 = $10,430,162
Total Estimated Cost for Phases 1 and 2 = $34,050,000
Current hard cost shortfall to construct Phase 2 = $8,936,147 The city has until September 2024 to obtain the additional funding needed to construct Phase 2 as part of the initial construction phase.

CITY MANAGER DEPARTMENT

STAFF REPORT
TO: Honorable Mayor Rios and City Council
DATE: April 15, 2024
FROM: Carmen Gil, City Manager
SUBJECT: Resolution No. 2024-11 Establishing 5:30 PM as the New Start Time for Regular Council Meetings

RECOMMENDATION
It is recommended that the Gonzales City Council:
• Receive the staff report;
• Accommodate public comment period;
• Discuss the staff report and;
• Adopt Resolution No. 2024-11, A Resolution of the City Council of the City of Gonzales Establishing 5:30 P.M. as the New Start Time for Regular City Council Meetings.

BACKGROUND
At the March 18th Council meeting, staff was directed to pursue the possibility of starting Council Meetings at 5:30 P.M. instead of 6:00 P.M. After careful consideration and a thorough review of our policies, Resolution No. 2024-11 was prepared to establish a new start time of 5:30 P.M.

REVIEW & ANALYSIS
If the Council decides to adopt the new start time of 5:30 P.M., staff will still have enough time to set up and prepare for the meetings. Zoom is still a viable option for those not being able to attend in person or until a bit later. The Zoom link is added to every agenda for convenience.

Changing the start time to an earlier time actually helps create cost efficiencies as it reduces excess hourly staff’s time.

CONCLUSION
It is recommended that the Council adopt Resolution No. 2024-11, A Resolution of the City Council of the City of Gonzales Establishing 5:30 P.M. as the New Start Time for Regular City Council Meetings.
