CITY MANAGER DEPARTMENT

STAFF REPORT
TO: Honorable Mayor Rios and City Council
DATE: May 6, 2024
FROM: Carmen Gil, City Manager
THROUGH: Carmen Gil, City Manager
SUBJECT: Resolution No. 2024-15 SWRCB Application for the Planning, Design, and Construction of the 1.0 Million Gallons a Day Industrial Wastewater System and Execute SRF Financial Assistance Agreement and Any Amendments with the SWRCB

RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 2024-15, A Resolution of the City Council of the City of Gonzales Authorizing the City Manager or Designee to Execute and Submit a Clean Water State Revolving Fund Financial Assistance Application to the State Water Resources Control Board (SWRCB) for the Planning, Design, and Construction of the 1.0 Million Gallons a Day Industrial Wastewater System, and Execute SRF Financial Assistance Agreement and Any Amendments with the SWRCB.

BACKGROUND
The City is in the process of securing funding for its Industrial Wastewater System Project. After looking at several options, Staff decided on funding the project through the State Revolving Loan Program with the State Water Resources Control Board. As a part of this process, the Council adopted Resolution No. 2022-81 in 2022. Resolution No. 2022-81 provided the Interim City Manager with authority to execute and submit an application for a loan and to execute related documents. (See Staff Report from November 21, 2022 attached hereto as Attachment A.)

REVIEW & ANALYSIS
Subsequent to the adoption of Resolution No. 2022-81, Carmen Gil, who was the Interim City Manager in 2022, was appointed as the City Manager. In order to maintain a clear record of signing authority, Staff is AGENDA
ITEM
8 requesting that the Council adopt Resolution No. 2024-15. Resolution No. 2024-15 is almost identical to Resolution No. 2022-81 except that it designates the City Manager as the individual with signing authority for relevant documents. A provision was also added to ensure that any documents signed by Manager Gil in her prior capacity as Interim City Manager are still valid. This is largely a ministerial matter, but when it comes to State loan programs, the devil is often in the details and we want to avoid any circumstances whereby we encounter delays due to ambiguity in signing authority.
