RECOMMENDATION
It is recommended that the City Council Adopt Resolution No. 2024-59, A Resolution of the City Council of the City of Gonzales Authorizing Task Order #3 Under a Master Service Agreement with MNS Engineers for Environmental Monitoring Services During Construction of the Industrial Wastewater System.

BACKGROUND

Phase 1 of the Industrial Wastewater (IW) System will increase the capacity of the City’s wastewater system by 1.0 million gallons/day. The IW System will be delivered though the following construction contracts
• IW Pipeline contract
• IW Treatment Facility contract
At the September 3, 2024, Council meeting, an $8.6M construction contract for the IW Pipeline Project was awarded to Sierra Construction & Excavation. At that same meeting, the City Council authorized Task Order No. 2 with MNS Engineers for Construction Management and Inspection services. A Preconstruction Meeting for the IW Pipeline Project is scheduled for October 3, 2024, with construction expected to begin in mid-November.

AGENDA
ITEM
10 REVIEW & ANALYSIS
The EIR for the IW System was approved at the September 20, 2022, City Council meeting and the EIR includes a Mitigation Monitoring and Reporting Program that must be complied with during construction of the IW Pipeline and IW Treatment Facility.

In January 2024 City staff issued a Request for Qualifications for Program/Construction Management Services for Wastewater Projects. At the March 18, 2024, Council meeting, the City Council authorized execution of a Master Service Agreement with MNS Engineers that included Task Order No. 1 for Program Management Services.

MNS Engineers’ Statement of Qualifications submitted to the City on March 8, 2024 included Permitting and Environmental Monitoring Services. MNS Engineers provided a letter proposal with a detailed scope of work for Environmental Monitoring Services during construction of both construction contracts that includes managing the adopted project-specific Mitigation Monitoring and Reporting Program to ensure compliance.

MNS’s scope of work includes:
• Worker Environmental Awareness Training
• Pre-Construction Meeting Attendance
• Preconstruction Surveys for Nesting Birds and Burrowing Owls • Paleontological Monitoring, required during groundwork at a depth greater than 5 feet.

MNS’ estimated fee for Environmental Monitoring Services during construction of the IW Pipeline and the IW Treatment Facility is $222,341 and staff recommends adding a contingency budget of $17,659 for unforeseen changes for a total authorization of $240,000.

Therefore, staff recommends that the City Council approve Task Order No. 3 under a Master Service Agreement with MNS Engineers for Environmental Monitoring during construction of the IW System in the amount of $240,000 which includes a contingency budget of $17,659.
