A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GONZALES
ACCEPTING CONSTRUCTION OF A DISPOSAL BED AT THE WASTEWATER
TREATMENT PLANT AS COMPLETE, AUTHORIZE STAFF TO FILE A NOTICE
OF COMPLETION WITH THE COUNTY RECORDER AND RELEASE
RETENTION MONIES HELD BY THE CITY TO THE CONTRACTOR 35 DAYS
AFTER THE NOTICE OF COMPLETION IS RECORDED
WHEREAS, During October and November, the Wastewater Treatment Plant was struggling to dispose of wastewater due to high groundwater that slowed percolation of treated wastewater using the three existing disposal beds, and increased ag-wash water discharged from processing facilities in the Industrial Business Park; and WHEREAS, at a Special Meeting on December 11, 2024, the City Council authorized staff to proceed with emergency work at the WWTP to construct a new disposal bed; and
WHEREAS, City staff executed a construction contract with Swift Tectonics in the amount of $284,522 with a contingency of $55,478 for a total of $340,000; and WHEREAS, Swift Tectonics understood the urgency and serious nature of the project; their staff worked 10-hour days, 6 days a week and completed the new disposal bed on December 24, 2024; and
NOW THEREFORE BE IT HEREBY RESOLVED by the City Council of the City of Gonzales that the Emergency Construction of the Disposal Bed at the Wastewater Treatment Plan is hereby accepted.
BE IT FURTHER RESOLVED that within ten days of adoption of this Resolution, City staff shall file with the County Recorder a Notice of Completion and release retention monies to the Contractor.
