ORDINANCE NO. 2010-68
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GONZALES APPROVING ZOA 2010-05 AND AMENDING GONZALES CITY
CODE TITLE 12, CHAPTER 12.112.110 TO PROVIDE FOR
INSTALLATION OR REPAIR OF STREET IMPROVEMENTS
BY ABUTTING PROPERTY OWNERS
WHEREAS, on July 12, 2010 the Planning Commission of the City of Gonzales conducted a duly noticed public hearing in order to consider amendments to Title 12 Chapter 12.112 of the Gonzales City Code to add new section 12.112.110 to provide for construction of street frontage improvements and following public comment and consideration of the staff report, did recommend by resolution that the City Council adopt said amendments; and
WHEREAS, on August 16, 2010 the City Council of the City of Gonzales conducted a duly noticed public hearing in order to consider amendments to Title 12 Chapter 12.112 of the Gonzales City Code to consider adoption of new Section 100 as recommended by the Planning Commission; and
WHEREAS, the City Council has determined that the proposed zoning amendment is necessary and appropriate to ensure consistent application of various parts of the Gonzales City Code; and
WHEREAS, the City Council has independently reviewed the proposed zoning amendments for compliance with the California Environmental Quality Act (CEQA) and has determined that the proposed amendments qualify for a "general rule" exemption in that is can be foreseen with reasonable certainty that the amendments will not have a significant adverse impact on the environment, and that no further documentation is required.
NOW, THEREFORE, the City Council of the City of Gonzales ordains as follows:
Section 1. All of the recitals set forth above are true and correct to the best of the Council's knowledge and by this reference are incorporated herein as findings.
Section 2. Gonzales City Code Title 12, Chapter 12.112. Section 110 is hereby added to read:
12.112.110: STREET IMPROVEMENTS:
A. Whenever a parcel is the subject of an application for a zoning approval, such approval shall require that street improvements including curb gutter, sidewalks, and street trees are repaired, replaced or if lacking, installed by the property owner on the property's street frontage(s) consistent with city codes and standards and the California Building Code."
Section 3. This ordinance shall be in force and effect commencing thirty (30) days atter the date of its final passage and a summary thereof shall be published once within fifteen (15) days in a newspaper of general circulation printed and published in the County of Monterey and circulated in the City of Gonzales.
This ordinance was introduced and read on the 16" day of August, 2010 and was finally adopted on the 7* day of September 2010 by the following vote:
