A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GONZALES
AUTHORIZING THE EXECUTION OF FUNDING AGREEMENTS WITH
THE STATE WATER RESOURCES CONTROL BOARD FOR THE ALPINE
COURT WATER AND SEWER SERVICE EXTENSION PROJECT
WHEREAS, Alpine Court is located at 52 Gonzales River Road, adjacent to, but outside the Gonzales City limits; and has 19 dwelling units served by private on-site water and sewer systems; and
WHEREAS, the on-site water system has two wells; one for domestic use and the other for irrigation use, both of which exceed the Maximum Contaminant Level for the State Drinking Water Standard for nitrates. The on-site water system is permitted as the River Road Water System #25 (Monterey County Health Department Domestic Water Supply Permit No. 0308051, issued on March 8, 2005). The on-site sewer septic system failed several years ago, so sewerage is pumped and trucked for disposal; and
WHEREAS, the City received grant funding from the State Water Resources Control Board (SWRCB) to design the improvements needed to connect Alpine Court to the City water and sewer systems (the Project); and
WHEREAS, design of the water and sewer improvements to connect Alpine Court to the City water and sewer systems were completed in November 2023, and the City received approval from the Local Agency Formation Commission to extend the water and sewer services outside of the City limits for this Project; and WHEREAS, the City applied to the SWRCB for supplemental State Revolving Fund (SRF) construction application assistance for the Alpine Court Water and Sewer Service Extension Project; and
WHEREAS, the SWRCB’s Technical Assistance Provider, NV5, Inc., is preparing a scope of services to complete the Drinking Water SRF Construction Application and include Biological and Cultural Resource studies to maximize state and federal funding resources the project is eligible for; and
WHEREAS, the City Manager (“Authorized Representative”) or designee is hereby authorized and directed to sign and file, for and on behalf of the City, a Financial Assistance Application for financing agreements from the State Water Resources Control Board for construction of the Project; and
WHEREAS, the Authorized Representative, or her designee, is designated to provide the assurances, certifications, and commitments required for the financial assistance applications, including executing a financial assistance agreement from the State Water Resources Control Board and any amendments or changes thereto; and
WHEREAS, the Authorized Representative, or her designee, is designated to represent the City in carrying out the City’s responsibilities under the financing agreements, including certifying disbursement requests on behalf of the City and compliance with applicable state and federal laws.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Gonzales hereby authorizes the execution of agreements with the SWRCB that will fully fund the construction to connect Alpine Court to the City water and sewer systems.
