RESOLUTION NO. 2025-41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GONZALES
APPROVING AN AGREEMENT BETWEEN THE CITY OF GONZALES,
CITY OF SOLEDAD, CITY OF GREENFIELD, AND TRI-CITIES DISPOSAL & RECYCLING SERVICES FROM JULY 1, 2025 THROUGH JUNE 30, 2035
IN SUBSTANTIAL FORM AND CONTENT, AND AUTHORIZING THE
CITY MANAGER TO EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY GONZALES, AND APPROVING THE FY 2025-2026 GARBAGE
COLLECTION AND DISPOSAL RATES
WHEREAS, the Cities of Gonzales, Soledad, and Greenfield jointly contracted for solid waste, recycling, and yard waste collection services through a Franchise with Tri-Cities Disposal and Recycling, Inc. in 2004; and
WHEREAS, the current Franchise Agreement has been extended and further Revised and Restated through June 30, 2025; and
WHEREAS, the Cities are currently very satisfied with Tri-Cities Disposal & Recycling performance; and
WHEREAS, Tri-Cities Disposal & Recycling is willing to provide similar services under a new Franchise Agreement; and
WHEREAS, Tri-Cities Disposal & Recycling’s proposed new Franchise Agreement includes increased rates for Garbage Collection and Disposal Rates for services provided; and WHEREAS, although the Franchise Agreement is being presented this evening for Council approval, given the number of involved cities, managers and attorneys, there is some possibility that minor changes may be made to the Agreement before its final execution by all parties. As such, Staff is requesting that the Agreement be approved as to “substantial form and content” with execution conditioned upon a determination by the City Manager and legal counsel that none of the changes, if any, require further Council consideration and that the Agreement is in acceptable final form; and
WHEREAS, City taff and the Salinas Valley Solid Waste Authority, as Contract Administrator, have reviewed the proposed new Franchise Agreement and the increases to the maximum corresponding Garbage Collection and Disposal Rates and found them to be reasonable and consistent with the terms of the agreement; and WHEREAS, given that the proposed new Franchise Agreement will provide for the continued collection of solid waste in the service area in the same basic manner as it currently exists in the service area, the Council finds that the approval of the Franchise Agreement is exempt from CEQA pursuant to CEQA Guidelines Section 15301- licensing of existing operations, involving negligible or no expansion of use. Alternatively, the Council also finds that it can be seen with certainty that there is no possibility that approval of the Franchise Agreement may have a significant effect on the environment (CEQA Guidelines Section 15061 (b) (3).
NOW THEREFORE, BE IT HEREBY RESOLVED, by the City Council of the City of Gonzales, the Agreement between the City and Tri-Cities Disposal and Recycling Services, Inc., a copy of which is attached hereto as “Exhibit A” and by this reference incorporated herein, is hereby approved in substantial form and content, and the City Manager is authorized and directed to execute the same on behalf of the City upon confirmation by the City Manager and legal counsel that the Parties thereto have agreed upon the Agreement’s final form and content and that further Council consideration is not warranted.
BE IT FURTHER RESOLVED, by the City Council of the City of Gonzales, that the Fiscal Year 2025-2026 Garbage Collection and Disposal Rate Schedule, attached here to as “Exhibit B” and incorporated herein by reference, is hereby approved to become effective July 1, 2025.
