DISPENSING WITH BIDDING PROCEDURES PURSUANT TO GONZALES CITY CODE SECTION 3.16.050 AND AUTHORIZING THE PURCHASE OF A TYPE 1
FIRE ENGINE FROM FIRE APPARATUS SOLUTIONS IN AN AMOUNT
NOT TO EXCEED $750,000
WHEREAS, the City of Gonzales Fire Department provides all-risk emergency response to the City of Gonzales and the Gonzales Rural Fire Protection District; and WHEREAS, The Fire Department has an aging apparatus fleet that suffers from constant breakdowns, necessitating significant repair costs; and WHEREAS, a reliable Type 1 Fire Engine is critical for safe and effective emergency response; and
WHEREAS, Staff has concluded there is an immediate need to purchase a Type 1 Fire Engine and has received County CDBG funding in the amount of $630,000 and $120,000 from Measure K towards the purchase of the new engine; and
WHEREAS, after being unable to find a vendor that could provide a Type 1 Engine within or near this cost range, or any sooner than 18-24 months from ordering, the City solicited and received a proposal from Fire Apparatus Solutions for a new Type 1 Fire Engine at a cost of $750,000 that can be delivered within 3-6 months from the time of purchase; and WHEREAS, Staff is of the opinion that adherence to purchase bidding requirements set forth in Chapter 3.16 of the Gonzales Municipal Code will result in a significant delay in the purchase of this apparatus which is vital to the provision of service directly impacting the health, welfare and safety of the residents and business owners of the City and District ; and WHEREAS, Section 3.16.050 of the Gonzales City Code provides exceptions to the bidding requirements for the purchase of equipment when an “emergency” (defined in part as a breakdown in machinery or an essential service which requires the immediate purchase of supplies or services to protect the public health, welfare and safety) arises or where the equipment can only be purchased from a single vendor.
NOW THEREFORE, BE IT HEREBY RESOLVED, that the City Council of the City of Gonzales hereby resolves as follows:
1. Based on the recitals set forth above, and the facts and circumstances set forth in the oral staff report on July 21, 2025, which are incorporated herein by reference, the City Council hereby finds that an emergency , as defined in Gonzales City Code (:GCC”) 3.16.050 A.2. and B, exists with respect to the need to take immediate action to purchase a Type 1 Fire Engine, and as such, that the bidding procedures set forth in GCC Section 3.16.050 may be dispensed with.
2. Based on the recitals set forth above, and the facts and circumstances set forth in the oral staff report on July 21, 2025, which are incorporated herein by reference, the City Council hereby finds the Type 1 Fire Engine the City desires can only be obtained from one vendor in order to meet the City’s purchase and delivery constraints and needs, and that as such, pursuant to GCC Section A.3., the bidding procedures set forth in GCC Section 3.16.050 may be dispensed with.
