16. Oral Communications
Mayor Pro Tem Silva reminded all those who were able to vote, to vote, and there was a box in front City Hall where they could drop off the ballots 24/7. She felt it was advantageous for our community voters to express their thoughts and their opinions through this means, and even though it's kind of in between all elections, their vote will count. She announced Homecoming was Thursday and encouraged people to wear black and orange.
Mayor Rios reported on the meeting he and City Manager Gil had with the Consul General of Mexico who was looking for a date and space in Gonzales for their staff members to provide services, so people didn't have to travel to San Jose, and he toured the Council Chambers which he thought was ideal.
Council Member Orozco suggested the High School Cafeteria since some times the lines got long especially if people come from out of town, unless they limit it to some appointments.
City Manager Gil mentioned that the Consul General said it would be by appointment only and it would possibly take place on January 10th. He also wanted the community to know that they wouldn't turn anyone away and would take care of everyone if they traveled from South County to San Jose, and people just need to mention that they were coming from outside the area so his office would stay open until everybody was taken care of. He also wanted people to know his office had an Attorney on Thursdays providing free legal assistance on immigration cases.
Mayor Rios suggested to Council Member Orozco since she had 850 followers on Facebook to create a sign up list of people who want to come back to Gonzales and buy a house.
Community Development Director Kinison Brown informed that there was a list already at City Hall of about 310 people and they have been notified of Planning Commission, City Council and LAFCo meetings regarding this project, and anyone interested could call City Hall to get added to the email distribution list.
Council Member Orozco mentioned she had been approached by several people about the project, and she has been referring them to City Hall so they could be added to the list.
Mayor Rios elaborated on a conversation he had with his friends that were in law enforcement who talked to him about Penal Code 415 and how they couldn't cite people for loud music. He asked the City Attorney about a noise disturbance ordinance since there were all sorts of loud music going on his side of the community, and he had received several complaints about it.
City Attorney Rodriquez responded he would look into that.

She informed that the Grand Opening for the Janice and Dennis Caprara Community Center Complex would be held on January 10, 2026.
Police Chief Wise noted for the record that the former Police Chief retired honorably on his own accord and it had nothing to do with the Martinez family whatsoever as it was mentioned earlier.
He also stated that he would let the City know whenever he was ready to retire, and it certainly wouldn’t be at the hands of the Martinez family. In regards to the loud music, he asked the Mayor if he was referring to loud music from vehicles.
Mayor Rios responded yes.
Police Chief Wise mentioned there was a vehicle section pertaining to vehicles and if people call in, the Officers will respond. He elaborated on Penal Code 415 code, the City ordinance, and enforcement procedures.

PUBLIC WORKS / CITY ENGINEER DEPARTMENT
STAFF REPORT
TO: Honorable Mayor Rios and City Council
DATE: November 3, 2025
FROM: Patrick Dobbins, Public Works Director/City Engineer THROUGH: Carmen Gil, City Manager
SUBJECT: Resolution No. 2025-77 Task Order No. 5 MNS Engineers Agreement
RECOMMENDATION
It is recommended that the City Council Adopt Resolution No. 2025-77, A Resolution of the City Council of the City of Gonzales authorizing execution of Task Order No. 5 under a Master Service Agreement with MNS Engineers to continue their Program Management Services on the Wastewater Program in the amount of $158,738.
BACKGROUND
With an agricultural industry requesting to expand production, a growing population in need of homes, and Developers poised to break ground on new housing tracks, the limiting factor to growth in the City of Gonzales is the ability to convey and treat current and future wastewater flows.
The City’s existing municipal wastewater treatment plant (MWWTP) consists of a two-train system:
headworks, influent pump station, aerated lagoons, polishing ponds, and rapid infiltration basins. The MWWTP is rated for an average daily flow of 1.0 million gallons per day (MGD) and maximum/permitted capacity of 1.3 MGD. With current wastewater flows totaling and periodically exceeding 1.2 MGD, the MWWTP is at capacity. Additionally, the Regional Water Board issued new permit requirements in 2023, which the existing MWWTP is unable to meet.
To address the wastewater issues, the City has undertaken a wastewater program consisting of the following phases:
Phase 1 - Industrial Wastewater (IW) System will increase the capacity of the City’s wastewater system by 1.0 million gallons/day. The IW System is being delivered through the following construction contracts:
AGENDA
ITEM
8 Packet Pg. 24
• Phase 1A. IW Pipeline contract – Complete
• Phase 1B. IW Treatment Facility (IWTF) contract – Currently in construction. Completion anticipated March 2027.
Phase 2 – Inspection, Assessment and Rehabilitation of the 21-inch Trunk Sewer Main – Currently in design. Completion must be accomplished by December 2026 (in advance of IWTF completion).
Phase 3 - MWWTP Rehabilitation to upgrade the MWWTP to meet RWQCB permit requirements. • Phase 3A. MWWTP Rehabilitation Planning Study – In progress. Completion anticipated April 2026. 100% Grant funded.
• Phase 3B. Design/Construction – Pending. Applications for grant funding will be submitted to SWRCB.
Phase 4 - MWWTP Expansion will add additional treatment processes at the MWWTP to expand system capacity to 2.9 MGD.
Phase 5 - Expand IWTF will add additional treatment processes at the IWTF to expand system capacity to
3.5 MGD.
MNS Engineers was selected to provide Program and Construction Management services through a Request for Qualifications process in Spring 2024. A Master Services Agreement was approved at the March 18, 2024 Council meeting that included Task Order No. 1 for Program Management Services.
Task Order No.2 extended MNS’ Program Management Services through April 2025; however, MNS was able to extend the budget under Task Order No.2 through October 2025. MNS is also currently performing Construction Management and Inspection Services on the IWTF contract under Task Order No. 4.
REVIEW & ANALYSIS
MNS Engineers staff has provided excellent Program Management services which includes:
1. Coordinated with Dudek Consulting staff to finalize the bid document for the IWTF which was issued for public bid in January 2025. Efforts included preparation of the Front-End documents and Biddability/Constructability review of the contract documents.
2. Initiated and reviewed a Stormwater Compliance Plan for the IWTF to meet the requirements of the Mitigation Monitoring and Reporting Program per the Project EIR.
3. Conducted bidder outreach to inform contractors of the IWTF bid opportunity.
4. Performed bid phase support services for the IWTF contract. This included issuing five addendums, responding to bidder questions, reviewing the submitted bids to confirm the low bid from Gateway Pacific met the bid document requirements.
5. Coordinated with the selected IWTF contractor to ensure pre-award and post-award required documents were submitted in accordance with the contract.
6. Supported staff’s effort to secure the $6.0M SRF loan amendment.
Packet Pg. 25
7. Coordinated with the State Water Resources Control Board to confirm Gateway Pacific’s bid met all SRF requirements.
8. Applied for and received IWTF building permits from the City Building Official.
9. Worked closely with the City Surveyor (Polaris Consulting) and Real Estate appraiser (Piini Realty) to finalize the temporary and permanent easements along with Right-of-Entry agreements for the IW Pipeline contract. They also coordinated getting the easement documents reviewed and finalized by the six property owners, as well as ensured owner construction prerequisites were met.

Subject: Proposal for Wastewater Program Management Support Dear Mr. Dobbins:
Thank you for the opportunity to submit this proposal for an extension on our as-needed Program Management Support Services for the City of Gonzales (City) Wastewater Program. MNS offers our qualified staff to support this effort. Included within this letter proposal is a brief understanding, scope of work, and our fee schedule for Program Management Support services through June 2026.
Statement of Qualifications
Established in 1962, MNS Engineers, Inc. (MNS) provides quality infrastructure consulting services to the water resource service market throughout the Central Coast. Specializing in the core service of construction management, MNS offers qualified professionals with experience providing program management, procurement services, permit coordination, and grant support. MNS has provided similar support to numerous agencies and projects.
Project Understanding
Known as the “Wine Capital of Monterey County”, the City of Gonzales (City) is located 17 miles south of Salinas in the heart of the 90-mile-long Salinas Valley. Gonzales hosts a population of 8,650 residents, as well as pridefully supports numerous agriculture related businesses such as Taylor Farms, Del Monte Fresh, and Braga Fresh processing facilities.
The City is ripe for expansion with an agricultural industry requesting to expand production, a growing population in need of homes, and Developers poised to break ground on new housing tracks, the limiting factor to growth is the City’s ability to deal with current and future wastewater flows, bringing the wastewater program to the forefront of the City’s priorities.
The City’s existing municipal wastewater treatment plant (MWWTP) consists of a two-train system: headworks, influent pump station, aerated lagoons, polishing ponds, and rapid infiltration basins. The MWWTP is rated for an average daily flow of 1.0 million gallons per day (MGD) and maximum/permitted capacity of 1.3 MGD. With current wastewater flows totaling 1.2 MGD, the MWWTP is at capacity. Additionally, the Regional Water Quality Control Board (RWQCB) issued new permit requirements in 2023, which the existing MWWTP is unable to meet.
To address the wastewater issues, the City is undertaking a multi-phased wastewater program, for which MNS has been serving as Wastewater Program Manager since March 2024. Since assuming the role of Program Manager, MNS and the City have made great strides on the wastewater program, completing construction on Phase 1A Industrial Wastewater Conveyance System, beginning construction on Phase 1B Industrial Wastewater Treatment Facility, beginning the planning study for Phase 2 Municipal Wastewater Treatment Plant Upgrades, as well as assisting the City through on-going issues with the Municipal Wastewater Treatment Plant.
The following Table provides a summary of the City’s wastewater program phasing, the status, and next steps.

PUBLIC WORKS / CITY ENGINEER DEPARTMENT
STAFF REPORT
TO: Honorable Mayor Rios and City Council
DATE: November 3, 2025
FROM: Patrick Dobbins, Public Works Director/City Engineer THROUGH: Carmen Gil, City Manager
SUBJECT: Ordinance No. 2025-153 Updating Chapter 10.16 Sewer Use of the Gonzales Municipal Code
RECOMMENDATION
It is recommended that the City Council introduce, waive reading, and read by title only Ordinance No. 2025-153, An Ordinance of the City Council of the City of Gonzales Updating Chapter 10.16 Sewer Use of the Gonzales Municipal Code.
BACKGROUND
Wastewater discharged to the City sewer system is governed by the City’s Sewer Ordinance codified in Municipal Code Chapter 10.16. Expanding the City’s wastewater system by building an Industrial Wastewater System (currently under construction) and upgrading the Municipal Wastewater Treatment Plant necessitated the City to update the Sewer Ordinance. The updated Sewer Ordinance will align City requirements with current State regulations, Regional Water Board permit requirements, and formalize existing City processes.
The MWWTP receives approximately 65 percent of its wastewater from three significant users (Taylor Farms, Del Monte/Mann Packing and Braga Fresh). Discharges from those facilities contain cleanizers and sanitizers that occasionally exceed the prescribed limit resulting in disrupting the biological treatment process at the MWWTP. These upsets result in significant periods of time during which the MWWTP struggles to treat wastewater.
AGENDA
ITEM
11 Packet Pg. 46
The updated Sewer Ordinance includes:
1. A Source Control Program, prepared under Title 40 of the Code of Federal Regulations to regulate significant wastewater dischargers.
2. Requires pretreatment of ag-wash water by processing facilities before discharging to the City’s sewer system.
3. Establishment of a formal Pretreatment Permit Program
4. Enforcement measures (inspections, regular self-reporting and penalties) The objectives of the Source Control Program are to prevent:
• Interference and/or upset with biological treatment process at the MWWTP • Pass-through of conventional and toxic pollutants
• Harm to the sanitary sewer system or WWTP infrastructure from pollutants • Contamination of biosolids at the MWWTP
• Worker or public exposure to chemical hazards
REVIEW & ANALYSIS
The City engaged Larry Walker Associates to prepare the updated Sewer Ordinance and supporting documents. The consultant’s scope of work included the following steps:
• Evaluated the current wastewater treatment system processes • Prepared a “Local Limits Plan” which identified what can and cannot be discharged to the sewer system. This will protect the biological treatment process at the City’s WWTP from interference from cleanizers and sanitizers discharged by the processing facilities • Drafted an updated Sewer Ordinance for review by City staff and City Attorney. • Prepared Pretreatment Program Administrative Manual
The updated Sewer Ordinance includes the flowing support documents:
• Local Limits Report
• Source Control Program Administrative Procedures Manual • Current User Inventory
• Wastewater Discharge Application
• Wastewater Permit
• Inspection Checklist
• Enforcement Response Plan
City staff provided the draft sewer ordinance to the major wastewater dischargers (Taylor Farms, Del Monte/Mann Packing, Braga Fresh, Green Valley Farm Supply, Silva Farms) for their review and no comments were received.
In conclusion, staff recommends that the City Council introduce, waive reading, and read by title only Ordinance No. 2025-153 amending Chapter 10.16 Sewer Use of the Gonzales Municipal Code and set the second reading and public hearing for the November 17, 2025 City Council meeting.

b. The results of sampling and analysis identifying the nature and concentration, and/or mass, where required by the standard or by the Public Works Director, of regulated pollutants in the discharge from each regulated process.
c. Instantaneous, daily maximum, and long-term average concentrations, or mass where required, shall be reported.
d. The sample shall be representative of daily operations and shall be analyzed in accordance with procedures set out in Section 10.16.390 of this Chapter. Where the standard requires compliance with a BMP or pollution prevention alternative, the user shall submit documentation as required by the Public Works Director or the applicable standards to determine compliance with the standard.
e. Sampling must be performed in accordance with procedures set out in Section 10.16.400 of this Chapter.
f. The user shall take a minimum of one representative sample to compile that data necessary to comply with the requirements of this paragraph.
g. Samples should be taken immediately downstream from pretreatment facilities if such exist or immediately downstream from the regulated process if no pretreatment exists. If other wastewaters are mixed with the regulated wastewater prior to pretreatment, the user should measure the flows and concentrations to evaluate compliance with the pretreatment standards.
h. The Public Works Director may allow the submission of a baseline report which utilizes only historical data so long as the data provides information sufficient to determine the need for pretreatment measures.
i. The baseline report shall indicate the time, date and place of sampling and methods of analysis, and shall certify that such sampling and analysis is representative of normal work cycles and expected pollutant discharges to the POTW.
C. Certification: A statement, reviewed by the Authorized Representative of the User as defined in Section 10.16.040 of this Chapter and certified by a qualified professional, indicating whether pretreatment standards are being met on a consistent basis, and, if not, whether additional operation and maintenance (O&M) and/or additional pretreatment is required to meet the pretreatment standards and requirements.

The following conditions shall apply to the compliance schedule required by Section
10.16.300(D) of this Chapter:
A. The schedule shall contain progress increments in the form of dates for the commencement and completion of major events leading to the construction and operation of additional pretreatment required for the user to meet the applicable pretreatment standards (such events include, but are not limited to, hiring an engineer, completing preliminary and final plans, executing contracts for major components, commencing and completing construction, and beginning and conducting routine operations);
B. No increment referred to above shall exceed nine months; C. The user shall submit a progress report to the Public Works Director no later than fourteen days following each date in the schedule and the final date of compliance including, as a minimum, whether or not it complied with the increment of progress, the reason for any delay, and if appropriate, the steps being taken by the user to return to the established schedule; and
D. In no event shall more than nine months elapse between such progress reports to the Public Works Director.
10.16.320 REPORTS ON COMPLIANCE WITH CATEGORICAL
PRETREATMENT STANDARD DEADLINE
Within 90 days following the date for final compliance with applicable categorical pretreatment standards, or in the case of a new source following commencement of the introduction of wastewater into the POTW, any user subject to such pretreatment standards and requirements shall submit to the Public Works Director a report containing the information described in Section 10.16.200(F) and (G) and 10.16.300(B)(6) of this Chapter. For users subject to equivalent mass or concentration limits established in accordance with the procedures in Section
10.16.060, this report shall contain a reasonable measure of the user’s long term production rate.
For all other users subject to categorical pretreatment standards expressed in terms of allowable pollutant discharge per unit of production (or other measure of operation), this report shall include the user’s actual production during the appropriate sampling period. All compliance reports must be signed and certified in accordance with Section 10.16.410(A) of this Chapter. All sampling will be done in conformance with Section 10.16.400 of this Chapter.
10.16.330 PERIODIC COMPLIANCE REPORTS
A. Except as specified in Section 10.16.330(C) of this Chapter, SIUs must, at a frequency determined by the Public Works Director submit no less than twice per Packet Pg. 86
Attachment: Exhibit A - Gonzales Sewer Use Ordinance Revised (3397 : Ordinance No. 2025-153 (Introduce) Updating Chapter 10.16 Sewer Use City of Gonzales Sewer Use Ordinance (October 2025)
33 year (July and January) reports indicating the nature, concentration of pollutants in the discharge which are limited by pretreatment standards and the measured or estimated average and maximum daily flows for the reporting period. In cases where the pretreatment standard requires compliance with a BMP or pollution prevention alternative, the user must submit documentation required by the Public Works Director or the pretreatment standard necessary to determine the compliance status of the user.
B. The City may authorize a user subject to a categorical pretreatment standard to forego sampling of a pollutant regulated by a categorical pretreatment standard if the user has demonstrated through sampling and other technical factors that the pollutant is neither present nor expected to be present in the discharge or is present only at background levels from intake water and without any increase in the pollutant due to activities of the user. This authorization is subject to the following conditions:
1. The waiver may be authorized where a pollutant is determined to be present solely due to sanitary wastewater discharged from the facility provided that the sanitary wastewater is not regulated by an applicable categorical pretreatment standard and otherwise includes no process wastewater.
2. The monitoring waiver is valid only for the duration of the effective period of the wastewater discharge permit, but in no case longer than five (5) years. The user must submit a new request for the waiver before the waiver can be granted for each subsequent wastewater discharge permit.
3. In making a demonstration that a pollutant is not present, the user must provide data from at least one sampling of the facility’s process wastewater prior to any treatment present at the facility that is representative of all wastewater from all processes.
4. The request for a monitoring waiver must be signed in accordance with Section 10.16.040 and include the certification statement in 10.16.410(A) of this Chapter.
5. Non-detectable sample results may be used only as a demonstration that a pollutant is not present if the USEPA approved method from 40 CFR Part 136 with the lowest minimum detection level for that pollutant was used in the analysis.
6. Any grant of the monitoring waiver by the Public Works Director must be included as a condition in the user’s wastewater discharge permit. The reasons supporting the waiver and any information submitted by the user in its request for the waiver must be maintained by the Public Works Director for three years after expiration of the waiver.
7. Upon approval of the monitoring waiver and revision of the user’s permit by the Public Works Director, the user must certify on each report with the statement in Section 10.16.410(C) of this Chapter, that there has been no increase in the pollutant in its wastestream due to activities of the user.
8. In the event that a waived pollutant is found to be present or is expected to be present because of changes that occur in the user’s operations, the user must immediately: Comply with the monitoring requirements of Section
10.16.330(A) of this Chapter, or other more frequent monitoring requirements imposed by the Public Works Director, and notify the Public Works Director.

34 9. This provision does not supersede certification processes and requirements established in categorical pretreatment standards, except as otherwise specified in the categorical pretreatment standard.
C. To the extent consistent with Federal and State law, the City may reduce the requirement for periodic compliance reports (see Section 10.16.330(A) of this Chapter) to a requirement to report no less frequently than once a year, unless required more frequently in the pretreatment standard or by the USEPA, where the user’s total categorical wastewater flow does not exceed any of the following:
1. 0.01 percent of the design dry-weather hydraulic capacity of the treatment plant, or 5,000 gpd, whichever is smaller, as measured by a continuous effluent flow monitoring device unless the user discharges in batches;
2. 0.01 percent of the design dry-weather organic treatment capacity of the wastewater treatment plant(s); and
3. 0.01 percent of the maximum allowable headworks loading for any pollutant regulated by the applicable categorical pretreatment standard for which approved local limits were developed in accordance with Section 10.16.080 of this Chapter.
Reduced reporting is not available to users that have in the last two years been in significant noncompliance, as defined in Section 10.16.040 of this Chapter. In addition, reduced reporting is not available to a user with daily flow rates, production levels, or pollutant levels that vary so significantly that, in the opinion of the Public Works Director, decreasing the reporting requirement for this user would result in data that are not representative of conditions occurring during the reporting period.
D. All periodic compliance reports must be signed and certified in accordance with Section 10.16.410(A) of this Chapter.
E. All wastewater samples must be representative of the user’s discharge. Wastewater monitoring and flow measurement facilities shall be properly operated, kept clean, and maintained in good working order. The failure of a user to keep its monitoring facility in good working order shall not be grounds for the user to claim that sample results are unrepresentative of its discharge.
F. If a user subject to the reporting requirement in this section monitors any regulated pollutant at the appropriate sampling location more frequently than required by the Public Works Director, using the procedures prescribed in Section 10.16.400 of this Chapter, the results of this monitoring shall be included in the report.
10.16.340 REPORTS OF CHANGED CONDITIONS
Users must notify the Public Works Director of any planned significant changes to the user’s operations or system which might alter the nature, quality, or volume of its wastewater at least ninety days before the change. For purposes of this requirement, significant changes may include, but are not limited to, flow increase of twenty percent or greater, the discharge of any Packet Pg. 88

35 previously unreported pollutants, the increase of regulated pollutant concentrations, or the introduction of a new product using different raw materials.
A. The Public Works Director may require the user to submit such information as may be deemed necessary to evaluate the changed condition, including the submission of a wastewater discharge permit application under Section 10.16.200 of this Chapter.
B. The Public Works Director may issue a Wastewater Discharge Permit under Section
10.16.290 of this Chapter or modify an existing Wastewater Discharge Permit under Section 10.16.260 of this Chapter in response to changed conditions or anticipated changed conditions.
10.16.350 REPORTS OF POTENTIAL PROBLEMS
A. In the case of any discharge, including, but not limited to, accidental discharges, discharges of a nonroutine, episodic nature, a noncustomary batch discharge, a slug discharge or slug load, that might cause potential problems for the POTW, the user shall immediately telephone and notify all appropriate agencies, including, but not limited to, the Public Works Supervisor of the incident. This notification shall include the location of the discharge, type of waste, concentration and volume, if known, and corrective actions taken by the user.
B. Within five business days following such discharge, the user shall, unless waived by the Public Works Director, submit a detailed written report describing the cause(s) of the discharge and the measures to be taken by the user to prevent similar future occurrences. Such notification shall not relieve the user of any expense, loss, damage, or other liability which might be incurred as a result of damage to the POTW, natural resources, or any other damage to person or property; nor shall such notification relieve the user of any fines, penalties, or other liability which may be imposed pursuant to this Chapter.
C. A notice shall be posted on the user’s bulletin board or other prominent place advising employees who to call in the event of a discharge described in Section
10.16.350(A) of this Chapter. Employers shall ensure that all employees who could cause such a discharge to occur, are advised of the emergency notification procedure.
D. SIUs are required to notify the Public Works Director immediately of any changes at its facility affecting the potential for a slug discharge.
10.16.360 REPORTS FROM UNPERMITTED USERS
All users not required to obtain a Wastewater Discharge Permit shall provide appropriate reports to the Public Works Director as the Public Works Director may require.
10.16.370 NONCOMPLIANCE SAMPLING AND REPORTING
If sampling performed by a user indicates a violation of the Wastewater Discharge Permit or the provisions of this Chapter, the user must notify the Public Works Director within twenty-four hours of becoming aware of the violation. The user shall repeat the sampling and analysis and Packet Pg. 89

36 submit the results of the repeat analysis to the Public Works Director within thirty days after becoming aware of the violation.
Resampling by the user is not required if the City performs sampling at the user’s facility at least once a month, or if the City performs sampling at the user between the time when the initial sampling was conducted and the time when the user or the City receives the results of this sampling, or if the City has performed the sampling and analysis in lieu of the user.
10.16.390 ANALYTICAL REQUIREMENTS
All pollutant analyses, including sampling techniques, to be submitted as part of a Wastewater Discharge Permit application or report shall be performed in accordance with the techniques prescribed in 40 CFR Part 136 and amendments thereto, unless otherwise specified in an applicable categorical pretreatment standard.
If 40 CFR Part 136 does not contain sampling or analytical techniques for the pollutant in question, or where the USEPA determines that the 40 CFR Part 136 sampling and analytical techniques are inappropriate for the pollutant in question, sampling and analyses shall be performed by using validated analytical methods or any other applicable sampling and analytical procedures, including procedures suggested by the Public Works Director or other parties approved by USEPA.
10.16.400 SAMPLE COLLECTION
Samples collected to satisfy reporting requirements must be based on data obtained through appropriate sampling and analysis performed during the period covered by the report, based on data that are representative of conditions occurring during the reporting period.
A. Except as indicated in paragraphs (B) and (C) below, the user must collect wastewater samples using 24-hour flow proportional composite sampling techniques, unless time proportional composite sampling or grab sampling is authorized by the Public Works Director. Where time proportional composite sampling or grab sampling is authorized by the City, the samples must be representative of the discharge. Using protocols (including appropriate preservation) specified in 40 CFR Part 136 and appropriate USEPA guidance, multiple grab samples collected during a 24-hour period may be composited prior to the analysis as follows: for cyanide, total phenols, and sulfides the samples may be composited in the laboratory or in the field; for volatile organics and oil and grease, the samples may be composited in the laboratory. Composite samples for other parameters unaffected by the compositing procedures as documented in approved USEPA methodologies may be authorized by the City, as appropriate. In addition, grab samples may be required to show compliance with instantaneous limits.
B. Samples for oil and grease, temperature, pH, cyanide, total phenols, sulfides, and volatile organic compounds must be obtained using grab collection techniques.
C. For sampling required in support of baseline monitoring and 90-day compliance reports required in Sections 10.16.300 and 10.16.320 of this Chapter, a minimum of four grab samples must be used for pH, cyanide, total phenols, oil and grease, sulfide, Packet Pg. 90
