AGENDA REPORT
MEETING DATE: August 11, 2026
TITLE: Adopt a Resolution Opposing Tentative Order No. R8-2026-0034 in its Current Form and Authorizing Continued Regional Coordination and Advocacy
PRESENTED BY: Konrad Bolowich, City Manager
RECOMMENDATION: ADOPT RESOLUTION OPPOSING THE PROPOSED SANTA ANA REGIONAL MS4 PERMIT IN ITS CURRENT FORM, AND DIRECT STAFF
TO CONTINUE WORKING WITH REGIONAL AGENCIES AND
NEIGHBORING CITIES TO SEEK PRACTICAL, COST EFFECTIVE
ALTERNATIVES; AND AUTHORIZE THE CITY MANAGER AND CITY
ATTORNEY TO TAKE ANY APPROPRIATE ADMINISTRATIVE ACTIONS
NECESSARY TO PROTECT THE CITY'S INTERESTS
2030 VISION STATEMENT:
Goal #2: Maintain public safety by investing in critical improvements to infrastructure.
BACKGROUND:
The Santa Ana Regional Water Quality Control Board is considering a new Municipal Separate Storm Sewer System (MS4) Permit that would establish updated stormwater requirements for cities throughout the Santa Ana Watershed, including Grand Terrace.
The Regional Board is expected to consider adoption of the permit on August 21, 2026.
The City supports protecting local waterways and complying with state and federal water quality laws.
However, many local agencies have expressed concerns that portions of the proposed permit may be difficult to implement, costly, and unsupported by sufficient technical or financial analysis.
DISCUSSION:
If adopted as proposed, the permit would significantly expand the City's responsibilities for managing stormwater runoff. New requirements could include additional inspections, increased reporting, expanded maintenance activities, new development review requirements, and additional planning and recordkeeping.
While the full financial impact on Grand Terrace is still being evaluated, preliminary estimates indicate the permit could substantially increase both annual operating costs and long term infrastructure investments. It is important to distinguish between the estimates currently being discussed.
Staff's preliminary estimate of $200,000 to $350,000 annually reflects potential additional operating costs such as inspections, reporting, staffing, and program administration. A separate regional analysis prepared for San Bernardino County estimates Grand Terrace's share of long term capital improvements could total approximately $124 million over the life of the program. This estimate
reflects future infrastructure investments and should not be confused with annual operating costs.
Staff is continuing to work with regional partners to better understand how these estimates were developed and what costs would ultimately apply to Grand Terrace. Although the City has concerns regarding the proposed permit, staff supports reasonable, science based water quality requirements that are technically achievable and financially sustainable.
For these reasons, staff recommends that the City formally oppose the permit in its current form while continuing to work with the Regional Water Board and other permittee agencies toward practical solutions.
ENVIRONMENTAL IMPACT:
The proposed action is not a project under the California Environmental Quality Act because adoption of a policy position does not authorize or commit the City to any physical improvements.
FISCAL IMPACT:
There is no immediate fiscal impact associated with adopting the proposed resolution. If the permit is adopted, the City could incur additional operating and capital costs. Staff will return to the City Council with updated financial information and implementation recommendations as more detailed analyses become available.

RESOLUTION NO. 2026-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, CALIFORNIA, OPPOSING THE SANTA ANA REGIONAL
WATER QUALITY CONTROL BOARD TENTATIVE ORDER R8-2026-
0034, NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
(NPDES) PERMIT AND WASTE DISCHARGE REQUIREMENTS FOR
DISCHARGES OF POLLUTANTS IN RUNOFF FROM THE MUNICIPAL
SEPARATE STORM SEWER SYSTEMS (MS4) IN THE COUNTIES OF
ORANGE, RIVERSIDE, AND SAN BERNARDINO WITHIN THE SANTA
ANA REGION
WHEREAS, The Santa Ana Regional Water Quality Control Board (the “Board”) has regulated pollution from urban areas through three separate permits issued to each of the three counties and their cities within the watershed, which includes Orange, Riverside, and San Bernardino counties. These permits were first issued in the 1990s and have been renewed four times since then. The permits are known as Municipal Separate Storm Sewer System (“MS4”) permits. An MS4 is a conveyance or system of conveyances (including roads with drainage systems, city streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains) usually owned by a city or county.; and
WHEREAS, The Board is preparing to renew the MS4 permits for a fifth time.
Instead of issuing three separate permits, the Board is proposing to adopt a single MS4 permit for all the counties and cities in the Santa Ana River watershed. The Board is considering Tentative Order R8-2026-0034 (Tentative Order), which is a region-wide MS4 Permit; and
WHEREAS, Once adopted, the Tentative Order would regulate discharges of pollutants in stormwater and urban runoff from cities in Orange, Riverside, and San Bernardino Counties that are within the Santa Ana River watershed, including the City of Grand Terrace; and
WHEREAS, the Tentative Order significantly expands documentation, inspection, maintenance, development-review, reporting, and enforcement requirements applicable to the City and other permittees; and
WHEREAS, the Board received testimony, staff presentations, and public comments at a public meeting that occurred on July 24, 2026. The Board closed the evidentiary hearing without taking action on the Tentative Order, and a further public meeting for the Board to continue consideration of the Tentative Order is scheduled for 9:00 a.m. on August 21, 2026;
WHEREAS, San Bernardino County, the San Bernardino County Flood Control District, the City of Riverside, and officials in Orange and Riverside counties, have raised concerns regarding the Tentative Order's cost, feasibility, legal basis, and effect on housing and essential municipal services, and are seeking workable alternativePage 13 of 50 01247.0001 2176063.1
compliance pathways, longer compliance schedules, requirements tied to pollutants the cities can control, recognition of municipal affordability, and funding for mandated capital work; and
WHEREAS, San Bernardino County commissioned a regional cost analysis prepared by Beacon Economics, to evaluate a full regional watershed-management scenario. The study estimates approximately $10.7 billion to $10.9 billion over 20 years for the County, its Flood Control District and 16 cities; and WHEREAS, The City supports clean water and the protection of the region's watersheds, and remains committed to meeting reasonable, technically sound, and lawful stormwater requirements applicable to the storm drain system the City owns or operates; and
WHEREAS, The City supports reasonable clean-water requirements, but opposes requirements that are technically unproven, financially infeasible, or disproportionate to Grand Terrace's responsibility and ability to pay; and
WHEREAS, the Tentative Order lists the City as a permittee but does not identify the City as responsible for any of the four San Bernardino County total maximum daily loads ("TMDLs") shown in Appendix 1, yet would subject the City to the general permit requirements; and
WHEREAS, a City-specific cost estimate has not been prepared, but based on the administrative and field requirements a reasonable initial planning range is approximately $200,000 to $350,000 in annual operating costs, with approximately $300,000 in first-year implementation costs. This is equal to approximately 2.3% to 4.0% of the City's $8.7 million General Fund. This is excluding any major regional treatment or diversion facilities; and
WHEREAS, the City has not been provided a defensible, City-specific determination of its cost allocation, facility assumptions, or implementation schedule, and the City is therefore unable to responsibly commit to speculative regional capital obligations; and
WHEREAS, the City Council opposes the Board’s Tentative Order as drafted.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The City Council of the City of Grand Terrace hereby finds and determines that the above recitals are true and correct and incorporated herein by this reference.
SECTION 2. The City Council opposes Tentative Order R8-2026-0034 (NPDES No.
CAS618000) in its current form, and respectfully requests that the Board decline to adopt the Tentative Order as currently drafted.
01247.0001 2176063.1
SECTION 3. The City Council respects the Board’s mission and shares the goal of clean water for our communities, and affirms the City’s commitment to complying with reasonable, technically supported, and lawful stormwater requirements applicable to the storm drain system the City owns or operates. The City opposes the requirements in the Tentative Order, which are technically unproven, financially infeasible, or disproportionate to the City's responsibility and ability to pay.
SECTION 4. The City Council requests that the Board revise the Tentative Order to, among other things: (a) provide workable alternative-compliance pathways; (b) extend compliance schedules to reasonable and achievable timeframes; (c) tie the City's obligations to pollutants and facilities the City actually owns, operates, or can control, and recognize that the City has not been assigned responsibility for any of the four San Bernardino County TMDLs in Appendix 1; (d) recognize municipal affordability and the City's limited General Fund; and (e) identify and provide funding assistance for any mandated capital work.
SECTION 5. The City Council requests that the Board delay adoption as to the City as necessary to develop, and provide to the City, a City-specific allocation, including acreage, population, capital-facility assumptions, implementation schedule, regional costallocation methodology, and shared-service options, before any final requirements are imposed on the City.
SECTION 6. The City Council directs staff to undertake all efforts to place into the administrative and public record information and documentation to support the potential disproportionate financial and operations impact of the Tentative Order on the City.
SECTION 7. The City Council authorizes and directs staff to coordinate with other affected permittees to develop and implement strategies to oppose the Tentative Order collaboratively.
SECTION 8. City staff is authorized and directed to take all actions necessary and appropriate to carry out the intent of this Resolution.

AGENDA REPORT
MEETING DATE: August 11, 2026
TITLE: Annual Update to the Capital Project Needs Analysis (CPNA) for FY 2028- 2032
PRESENTED BY: Shanita Tillman, Grants & Government Affairs Manager RECOMMENDATION: ADOPT A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, APPROVING THE FIVE-YEAR
MEASURE I CAPITAL PROJECT NEEDS ANALYSIS FOR FISCAL YEARS 2028–2032
2030 VISION STATEMENT:
This item supports Goal #2, Maintain Public Safety, by planning for future transportation improvements that help maintain safe and reliable streets.
BACKGROUND:
Measure I is a one-half cent sales tax approved by San Bernardino County voters to fund transportation improvements throughout the county. As a participant in the Measure I program, the City of Grand Terrace is required to annually adopt a Five-Year Capital Project Needs Analysis (CPNA) identifying planned transportation projects and anticipated funding.
DISCUSSION:
The proposed Fiscal Year 2028-2032 Capital Project Needs Analysis (CPNA) updates the City's fiveyear transportation planning document required by the San Bernardino County Transportation Authority (SBCTA). The CPNA continues to identify the Commerce Way Extension as the City's priority Measure I project. The project will extend Commerce Way from approximately 900 feet north of De Berry Street to Main Street, improving traffic circulation, connectivity, and access to surrounding commercial and industrial areas.
Adoption of the CPNA allows the City to continue planning for the project and maintain eligibility for future Measure I funding. The CPNA is updated annually to reflect the project's status and anticipated funding schedule.
ENVIRONMENTAL IMPACT:
Approval of the CPNA is a planning action and does not authorize construction. Environmental review will be completed for individual projects, as required, before construction begins.
FISCAL IMPACT:
Adoption of the CPNA does not authorize any new expenditures or construction contracts. The CPNA identifies anticipated Measure I and local funding needed to complete the project. Future funding appropriations and construction contracts will be presented to the City Council for approval through
the normal budget and procurement process.
RESOLUTION NO. 2026-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, STATE OF CALIFORNIA, ADOPTING THE MEASURE I FIVEYEAR CAPITAL PROJECT NEEDS ANALYSIS FOR FISCAL YEARS 2028 THROUGH 2032.
WHEREAS, San Bernardino County votes approved Measure I in November 2004, authorizing the San Bernardino Associated Governments, acting as the San Bernardino County Transportation Authority, to impose a one-half percent retail transactions and use tax applicable to both incorporated and unincorporated territories of the County of San Bernardino; and
WHEREAS, revenue from the tax can only be used for transportation improvement and traffic management programs authorized in the Expenditure Plans set forth in Ordinance No. 04-1 of the Authority; and
WHEREAS, the Strategic Plan requires each local jurisdiction applying for revenue from the Valley Major Street and Freeway Interchange Programs to annually adopt and update a Five-Year Capital Project Needs Analysis.
NOW, THEREFORE, THE CITY COUNCIL OF GRAND TERRACE DOES
RESOLVE, DETERMINE, FIND AND ORDER AS FOLLOWS:
SECTION 1. That the City Council of the City of Grand Terrace, State of California, hereby adopts the Measure I Give-Year Capital Project Needs Analysis for Fiscal Years 2028 through 2032, attached to this resolution as Exhibit A.

Willdan Engineering has submitted a proposal to provide construction inspection services for the grading phase of the Gateway at Grand Terrace development on a time and materials basis for an estimated 240 inspection hours, with a not-to-exceed amount of $36,240.
DISCUSSION:
The proposed agreement authorizes Willdan Engineering to provide construction inspection services during the grading phase of the Gateway at Grand Terrace development. Services include construction inspection, documentation, coordination with materials testing, review of construction activities, and project closeout, as needed, to support issuance and administration of the grading permit. The agreement establishes a not-to-exceed amount of $36,240.
ENVIRONMENTAL IMPACT:
The proposed action is not a project under CEQA pursuant to Section 15378 of the CEQA Guidelines because it is an administrative action that will not result in a direct or reasonably foreseeable indirect physical change to the environment.
FISCAL IMPACT:
There is no fiscal impact to the General Fund. Prior to issuance of the grading permit, the developer will deposit funds with the City into a project-specific deposit account. All costs associated with this agreement will be paid from that account. The agreement establishes a not-to-exceed amount of
$36,240.

In the event of a conflict between the provisions of Exhibit “B” and any other provisions of this Agreement, the provisions of Exhibit “B” shall govern.

For the services rendered pursuant to this Agreement, Consultant shall be compensated in accordance with the “Schedule of Compensation” attached hereto as Exhibit “C” and incorporated herein by this reference, but not exceeding the maximum contract amount of Thirty Six Thousand Two Hundred and Forty Dollars and Zero Cents ($36,240.00) (“Contract Sum”).

The invoice shall contain all information specified in Exhibit “C”, and shall detail charges for all necessary and actual expenses by the following categories: labor (by sub-category), travel, materials, equipment, supplies, and sub-contractor contracts. Sub-contractor charges shall also be detailed by such categories. Consultant shall not invoice City for any duplicate services performed by more than one person.
City shall independently review each invoice submitted by the Consultant to determine whether the work performed and expenses incurred are in compliance with the provisions of this Agreement. Except as to any charges for work performed or expenses incurred by Consultant which are disputed by City, City will use its best efforts to cause Consultant to be paid within forty five (45) days of receipt of Consultant’s correct and undisputed invoice; however, Consultant acknowledges and agrees that due to City warrant run procedures, the City cannot guarantee that payment will occur within this time period. In the event any charges or expenses are disputed by City, the original invoice shall be returned by City to Consultant for correction and resubmission. Review and payment by the City of any invoice provided by the Consultant shall not constitute a waiver of any rights or remedies provided herein or any applicable law.
2.3 Additional Services. City shall have the right at any time during the performance of the services, without invalidating this Agreement, to order extra work beyond that specified in the Scope of Services or make changes by altering, adding to or deducting from said work. No such extra work may be undertaken unless a written order is first given by the Contract Officer (as defined below) to the Consultant, incorporating therein any adjustment in (i) the Contract Sum (or a portion of the compensation due to Consultant) for the actual cost of the extra work, and/or (ii) the time to perform this Agreement, which said adjustments are subject to the written approval of the Consultant. Any increase in compensation of up to ten percent (10%) of the Contract Sum but not exceeding a total contract amount of Twenty-Five Thousand Dollars ($25,000) or in the time to perform of up to ninety (90) days may be approved by the City Manager. Any greater increases than Twenty-Five Thousand Dollars ($25,000), taken either separately or cumulatively, must be approved by the City Council. No claim for an increase in the Contract Sum or time for performance shall be valid unless the procedures established in this Section are followed.

3.3 Force Majeure. The time period(s) specified in the Schedule of Performance for performance of the services rendered pursuant to this Agreement shall

The Contract Officer shall ascertain the facts and the extent of delay, and extend the time for performing the services for the period of the enforced delay when and if in the judgment of the Contract Officer such delay is justified. The Contract Officer’s determination shall be final and conclusive upon the parties to this Agreement. In no event shall Consultant be entitled to recover damages against the City for any delay in the performance of this Agreement, however caused, Consultant’s sole remedy being extension of the Agreement pursuant to this Section.

Unless earlier terminated in accordance with Article 7 of this Agreement, this Agreement shall continue in full force and effect until completion of the services but not exceeding 1 year from the date hereof (“Term”), except as otherwise provided in the Schedule of Performance (as shown on Exhibit “D” attached hereto).

(g) Enforcement of Contract Provisions (non-estoppel). Consultant acknowledges and agrees that any actual or alleged failure on the part of the City to inform Consultant of non-compliance with any requirement imposes no additional obligations on the City nor does it waive any rights hereunder. (h) Requirements Not Limiting. Requirements of specific coverage features or limits contained in this section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If the Consultant maintains higher limits than the minimums shown above, the City requires and shall be entitled to coverage for the higher limits maintained by the Consultant. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the City.
Project Title, Plan No #### 6

(j) Additional Insured Status. General liability and automobile policies shall provide or be endorsed to provide that City and its officers, officials, employees, and agents, and volunteers shall be additional insureds under such policies. This provision shall also apply to any excess/umbrella liability policies. (k) Prohibition of Undisclosed Coverage Limitations. None of the coverages required herein will be in compliance with these requirements if they include any limiting endorsement of any kind that has not been first submitted to City and approved by the City in writing.
(l) Separation of Insureds. A severability of interests provision must apply for all additional insureds ensuring that Consultant’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the insurer’s limits of liability. The policy(ies) shall not contain any crossliability exclusions. (m)Pass Through Clause. Consultant agrees to ensure that its subconsultants, subcontractors, and any other party involved with the services who is brought onto or involved in the services by Consultant, provide the same minimum insurance coverage and endorsements required of Consultant. Consultant agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section.
Consultant agrees that upon request, all agreements with consultants, subcontractors, and others engaged in the services will be submitted to City for review. (n) City’s Right to Revise Specifications. The City reserves the right at any time during the Term of this Agreement, to change the amounts and types of insurance required by giving the Consultant ninety (90) days advance written notice of such change. If such change results in substantial additional cost to the Consultant, the City and Consultant may renegotiate Consultant’s compensation. (o) Deductibles / Self-Insured Retentions. Any deductibles and selfinsured retentions must be declared to and approved by City. At the option of the City, either: the insurer shall reduce or eliminate such deductibles or self-insured retentions with respect to the City, it officers, officials, employees, agents and volunteers, or the Consultant shall provide a financial guarantee satisfactory to the city guaranteeing payment of losses and related investigations, claims administration and defense expense.

In addition, the Consultant reserves the right to terminate this Agreement at any time, with or without cause, upon sixty (60) days’ written notice to City, except that where termination is due to the fault of the City, the period of notice may be such shorter time as the Consultant may determine.

8.6 Waiver. No delay or omission in the exercise of any right or remedy by non-defaulting party on any default shall impair such right or remedy or be construed as a waiver. A party’s consent to or approval of any act by the other party requiring the party’s consent or approval shall not be deemed to waive or render unnecessary the other party’s consent to or approval of any subsequent act. WILLDAN CONSTRUCTION SERVICES EXPERTISE
Willdan provides expertise in all areas of project and construction management, contract administration, construction inspection and observation, grant funding administration and compliance, labor compliance, and community relations.
Willdan's corporate philosophy emphasizes strong leadership, cost effectiveness, timely performance, and consistent reciprocal communication with clients and internal and external resources.
Our resident engineers, construction managers, and construction inspectors offer reliable service, quality workmanship, use of good judgment, fair and equitable treatment, and adherence to our corporate integrity. These experienced team members identify and correct discrepancies, ambiguities, omissions, or conflicts in plans, specifications, and bid schedules that might generate misinterpretation and/or lead to agency and contractor disagreements. Our professionals are adept at anticipating issues before they arise through continual review of project plans, specifications, contractors’ schedules, and contract documents. Potential problems are brought to the attention of the City's Project Manager and/or the contractor, along with constructive recommendations for solutions, so that costly delays and negative impacts on the public and the project are mitigated.
METHODOLOGY
Project Understanding
Willdan understands the City of Grand Terrace requires the services of a qualified construction inspector to provide full time and on call inspection services for 240 Working Hours and will include inspection of Mass Grading Plans- Phase 1 and the Precise Grading Plan. The scope will include attending the pre-construction meeting, rough grade inspection with BMPs, wet utilities, precise grade inspection including grading, paving, concrete work, ADA requirements, fencing, retaining wall, storm drain work, review of compaction report, record of survey, final grade certifications, street Improvements, erosion control, punch list and final inspection.
Project Approach
Willdan provides expertise in all areas of construction management, inspection, labor compliance, and community relations to residents and businesses affected by construction. Our experienced team members serve as construction managers, resident engineers, and inspectors and provide significant insight for identifying and correcting discrepancies, ambiguities, omissions, or conflicts in contract documents that could generate misinterpretation and/or disagreements between the City and the contractor. Our goal is to anticipate or diminish potential problems before they arise through continual review of project plans, specifications, contractor’s schedule, and other contract documents. The graphic below shows potential cha0000llenges when undertaking a pavement project and how Willdan works to mitigate those challenges.
City of Grand Terrace

Our team is adept at:
Anticipating job site problems and dealing with issues in a professional, straightforward fashion Calling job site problems to the project manager’s and/or contractor’s attention Offering constructive recommendations and achieving cooperation from the contractor Addressing concerns of the public
Our approach to issue resolution is to:
Obtain and document the facts surrounding the issue.
Develop reasonable solutions in conjunction with the contractor and City project manager. Respond quickly and effectively so that job progress and quality do not suffer.
Through close communication with the City’s project staff, timely corrective action is taken to alleviate potential adverse impacts of work progress, costly change orders, and construction claims.
QUALITY CONTROL/QUALITY ASSURANCE
Willdan will perform Quality Assurance and Quality Control of this project through a diligent review of all work and documentation. Quality Assurance and Quality Control will begin with the pre-construction meeting, at which time the scope of the project and control requirements will be reviewed with the General Contractor.
Once construction begins, the next step in the Quality Control process will be the verification of materials and components to be installed. Once the material and components arrive onsite, Willdan Inspectors will spotcheck these materials and components to verify they match the construction documents. The Inspectors will maintain a detailed record of samples, tests, material releases, and certificate of compliance for the project.
Willdan Inspectors closely monitor projects to ensure compliance with all contract requirements. Most of our inspectors have American Construction Inspectors Association (ACIA) certification and attend regular seminars, college courses, and in-house presentations to keep abreast of current construction technologies.
In addition to ACIA, many of our staff are certified QSPs and QSDs and are provided with the latest information concerning the implementation of the State Water Board permit. Willdan’s inspectors have knowledge of basic soil dynamics and are highly cognizant of the crucial role of soils compaction in construction. They are also familiar with the need for general material testing for asphalt and concrete. The basic goal of the quality assurance plan is to provide quality work delivered on time and within budget. We do this by adhering to the following steps.
Willdan adopted Caltrans' Construction Manual (LAPM) as our in-house quality standard and has incorporated Caltrans' prescribed standards and procedures into our everyday inspection routine. This ensures we meet federal and state guidelines from the start.
Contractor Compliance
Our inspection staff has extensive experience with a myriad of public works projects and our staff has a clear understanding of the issues surrounding inspection of the work. For example, when constructing trench backfill, our inspector will ensure adequate compaction has been achieved.
Inspectors will monitor the work for conformance with the plans and specifications. Willdan’s inspectors will monitor the contractor’s operations for conformance with City compaction standards by working with the City’s approved material testing lab and will not accept any trench backfill or allow any pavement repair until proper compaction is verified by the lab. Delivery tickets will be checked to ensure materials match the approved submittals.
