Title: Upcoming Public Hearing on Fire and Vegetation Management CEQA: Not a Project.
Recommendation: This is an informational notice to inform the citizens of Grass Valley that a public hearing will take place during the City Council Meeting on July 25, 2023.
The purpose of this hearing is to gather public feedback and guidance from the City Council regarding Fire and Vegetation Management, as well as a possible sales tax.
Prepared by: Timothy M. Kiser, City Manager
Council Meeting Date: July 11, 2023 Date Prepared: July 3, 2023 Agenda: Presentation
Background Information: The City would like to notify everyone about an important public hearing scheduled for the City Council Meeting on July 25, 2023. The purpose of this hearing is to gather valuable feedback and guidance from both the residents of the City and the City Council regarding Fire and Vegetation Management, as well as the potential implementation of a sales tax to support those areas and the public safety risks posed to Grass Valley by extreme weather events and wildfire.
The focus of the discussion during this hearing will primarily revolve around two crucial topics: Fire Resiliency and Vegetation Management. Fire Resiliency entails initiatives aimed at enhancing the city's ability to handle fire incidents effectively. Proposed measures include increasing firefighter staffing and potentially adding another fully staffed fire engine company. These efforts are essential to ensure the safety and wellbeing of our community in the face of fire-related challenges.
Additionally, the discussion will center on Vegetation Management, a critical aspect of protecting our City from the impact of wildland fires. This aspect encompasses various strategies, including hardening the areas surrounding critical infrastructure such as hospital, schools, and water treatment plants, among many other critical pieces of public infrastructure. Furthermore, it aims to safeguard the City and its residents by reducing fuel and vegetation loads throughout the City and its geographical sphere of influence. Developing and creating temporary refuge areas, along with other vegetation mitigations, will also be explored during the hearing.
We encourage all residents and concerned individuals to attend this public hearing to voice their opinions, share insights, and contribute to the decision-making process. Your participation is invaluable in shaping the future of our city and ensuring the safety of our community.
Council Goals/Objectives: The execution of this action attempts to achieve Strategic Goal #5 – High Performance Government and Quality Service.

Subject: For next City Council June 27, 2023
Certain roads in downtown, especially those North of Richardson Street need repair and haven't been fixed for over two decades.
Numerous times we've called to find out when they'll be repaved properly and not just patched with asphalt. We're continuously told that "we're next on the list" but that's old news.
The parking on North Auburn Street has at times been choked when rentals are full. The police have been called when vehicles are left for over three days or even months. They call us back and tell us it's okay because the cars belong to neighbors. Yet, there is a law that prevents people from leaving a car on the street for over three days.
We've asked to have our curbs repainted with no reply making it necessary to do it ourselves. The runaround has lasted at least fifteen years. Our emails, letters, phone calls and online forms requesting help have all been ignored or passed on to somebody else until it comes back full-circle. The city has claimed that it cannot help with any of these issues. We pay our taxes and the extra Measure E sales tax that seems to be awarded to other areas.
1.We want to know when the streets will be repaired in our neighborhood and it should be in the near future. We've been waiting for too long.
2.We want the police to ticket those who abuse the no-parking areas or leave their vehicles in the street over three days.
Item # 2.
2 3.We'd like the city staff to be considerate enough to return our calls and letters.
4.We want the city to form citizens committees for voicing our concerns about safety and traffic issues. We need to be heard and not ignored.

Recommendation: To continue the Winter Storm February 24th, 2023 to March 1st, 2023 proclamation declaring a Local State of Emergency
Prepared by: Timothy M. Kiser, City Manager
Council Meeting Date: 7/11/2023 Date Prepared: 7/3/2023 Agenda: Consent
Background Information: Due to conditions of extreme peril to the safety of persons and property have arisen within the City of Grass Valley, caused by the winter storm February 24th, 2023 to March 1st, 2023 which has cut power, downed trees, blocked roads and created other hazards to health and human safety commencing at which time the City Council of the City of Grass Valley was not in session. The city found it necessary to proclaim the existence of a local emergency throughout the city.

Title: Local Emergency Proclamation (Drought Conditions) CEQA: Not a Project.
Recommendation: Drought Conditions proclamation declaring a Local State of Emergency
Prepared by: Timothy M. Kiser, City Manager
Council Meeting Date: 7/11/2023 Date Prepared: 7/3/2023 Agenda: Consent
Background Information: On May 10, 2021, Governor Newsom modified a State of Emergency Proclamation that declared that a State of Emergency to exist in California due to severe drought conditions to include 41 counties, including Nevada County. The Proclamation directed state agencies to partner with local water suppliers to promote conservation through the Save Our Water campaign, a critical resource used by Californians during the 2012-2016 drought. Some municipalities have already adopted mandatory local water-saving requirements, and many more have called for voluntary water use reductions.
Nevada Irrigation District (NID) declared a drought emergency throughout the District’s service area on April 28, 2021, which includes portions of the City of Grass Valley, and requested that customers conserve 10 percent of their normal water usage. Both NID and Nevada City have now mandated at least 20% conservation requirements.
On June 22, 2021, City Council approved Resolutions No. 2021-41 declaring a local emergency due to drought conditions and No.2021-42 mandating water conservation.
All treated Water Customers are required to reduce water use by 20%.
Council Goals/Objectives: This resolution executes portions of work tasks towards achieving/maintaining Strategic Plan – Water and Wastewater Systems and Underground Infrastructure. The City of Grass Valley is devoted to providing a safe Place to Live, Work and Play.
Fiscal Impact: The Fiscal Impact to the Water Fund should be minor, but if the drought continues for several years the impact could be more significant.

Title: 2023 Sewer Main Replacement Project – Authorization to Award Contract CEQA: Exempt – Section 15301 “Existing Facilities”
Recommendation: That Council: 1) approve the findings that the project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA), 2) authorize the City Engineer to award a construction contract to McIntosh Equipment, 3) authorize the Mayor to execute the construction contract, subject to legal review and, 4) authorize the City Engineer to approve construction change orders for up to 10% of the contract amount.
Prepared by: Bjorn P. Jones, PE, City Engineer
Council Meeting Date: 07/11/2023 Date Prepared: 07/06/2023 Agenda: Consent
Background Information: The 2023 Sewer Main Replacement Project involves sewer main line, manhole and cleanout replacements, along with associated hot mix asphalt pavement improvements. Three sewer line segments were included for replacement, located on Miners Trail, Hocking Avenue, and Jan Road.
Four bids were opened and received on June 20, 2023. A bid summary is attached. Staff reviewed the low bid of $279,060 submitted by McIntosh Equipment and after consultation with legal counsel, determined the bid to be complete and responsible. During review, minor inaccuracies on the proposal form of McIntosh Equipment were noted and included the failure to check a certification box and a mathematical error in the Bid Items cost breakdown. Using specifications provided in the proposal documents to resolve the numerical discrepancy, the total bid cost should have read $279,060, while $279,000 was listed on the proposal form. As the next closest bid totaled $401,250, the error does not affect McIntosh’s status as the low bidder.
Staff believes that the minor irregularities are inadvertent errors, inconsequential in nature and do not fundamentally change the bid proposal or in any way provide a competitive advantage to the low bidder. The allowable bid protest period expired on June 23, 2023 and no protests were received.
The sewer facilities improvements associated with this project are exempt from environmental review pursuant to Section 15301 “Existing Facilities” of the CEQA Guidelines.
Staff requests that Council waive the Proposal form irregularities discussed and authorize the City Engineer to award a contract for the 2023 Sewer Main Replacement Project to McIntosh Equipment in the amount of $279,060.

Title: First-Time Homebuyer Loan Extension Policy
CEQA: Not a project.
Recommendation: That Council approve the proposed First-Time Homebuyer Loan Extension Policy.
Prepared by: Taylor Day, City Clerk
Council Meeting Date: 7/11/2023 Date Prepared: 7/6/2023 Agenda: Consent
Background Information: The City of Grass Valley's First Time Homebuyers (FTHB) Program has been instrumental in assisting eligible individuals and families in realizing their dreams of homeownership. The program offers assistance loans to first-time homebuyers, providing access to housing opportunities that might otherwise be unattainable.
As the FTHB loans approach their maturity dates, it becomes necessary to establish a clear policy regarding loan extensions. By defining the eligibility criteria and the evaluation process for extension requests, the City aims to ensure fairness, transparency, and accountability in granting extensions while safeguarding the program's sustainability.
The policy establishment of a process and conditions under which the City of Grass Valley may grant extensions of time on matured FTHB loans. The FTHB loans may be extended beyond their date of maturity under the following conditions: (i) Borrower Eligibility: The borrower must remain eligible to participate in the FTHB Program.
This includes meeting the established criteria such as income limits, creditworthiness, and other eligibility requirements set forth by the program. (ii) Loan Default: The borrower must not be currently in default on their FTHB loan. This criterion ensures that only borrowers in good standing are considered for loan extensions. (iii) Determination by the City Manager or Designee: The City Manager or their designated representative shall assess each extension request on a case-by-case basis. The decision to grant an extension will be based on an evaluation of the borrower's circumstances and the overall objectives of the FTHB Program. The extension should align with the program's purpose of supporting first-time homebuyers in the Grass Valley community.
Council Goals/Objectives: This item supports the City’s goals associated with providing efficient government services.
Item # 7.
Fiscal Impact: Costs associated with this service are paid with program income earned from CDBG and HOME loan programs.

Title: Collection of delinquent sewer and/or water accounts on the Nevada County tax roll
CEQA: Not a Project
Recommendation: After holding a public hearing, adopt Resolution 2023-46 requesting that the County of Nevada levy and collect delinquent water and sewer service charges on the tax roll.
Prepared by: Taylor Day, City Clerk
Council Meeting Date: 7/11/2023 Date Prepared: 7/5/2023 Agenda: Public Hearing
Background Information: Health and Safety Code Section 5473 authorizes the City to place delinquent sewer and/or water service charges on the tax roll for collection after the approval by a two-thirds vote by the members of the City’s legislative body. This is done in the same manner as property taxes are handled. This action was last performed in 2022. The City uses this option for sewer and/or water accounts where service cannot be discontinued as a collection method. Since the County started using the teeter plan for the distribution of tax revenues, the City has been receiving sewer and/or water bills placed on the tax roll even if the property owner doesn’t pay the tax bill. The method is very effective and allows the City to collect charges from customers that have not made payment.
All affected property owners have been notified as required by the Health and Safety Code. Any amounts received from customers prior to submitting this request will be removed from the list.
The delinquent amount as of July 6, 2023, is $54,639.58, by the July 11, 2023, City Council Meeting this amount could be less due to any payments received. The City mailed notification letters on June 23,2023 to inform property owners of any delinquent balances. A list of the delinquent accounts will be provided to the Council prior to the meeting.
Council Goals/Objectives: The Collection of delinquent sewer and/or water accounts on the Nevada County tax roll executes portions of work tasks towards achieving/maintaining Strategic Plan Goal #7 – Water and Wastewater Systems & Underground Infrastructure.
