Presentation was given by Dr. Daniel Phillips, NDC.

Mayor Walker opened the public hearing at 6:31 p.m.

Beatriz Diaz stated that she was 100% support of district elections and would like the Mayor to be voted by all the residents.

Andrew Sandoval, LULAC, stated that this was the first of a series of meetings that would be taking place. He stated that the City was asked to provide information in Spanish; however, it had not and asked City staff that the information be provided in Spanish. He stated that at the last meeting, Mayor Walker recommended that the Mayor be appointed by the City Council or that it be a rotating Mayor; however, he would not recommend this process. He asked the people of Greenfield to get involved and that the City provide the district process materials in Spanish and that this hearing be redone with the documents be available in Spanish.

John Huerta, Jr. gave his input regarding neighborhoods and communities of interest and recommended that the area of 5th, 6th, 7th, 8th, downtown area and possibly 9th Streets bordered by Apple and Elm Avenues would be a neighborhood as well as the northwest area between El Camino Real to the west of 13th Street and bordered by Walnut Avenue and Oak Avenue; and another one south of Elm could be combined with another district.

Councilmember Martinez stated that she would like to hold off at this time and have another hearing in order to have the information provided in Spanish. Mayor Pro-tem Untalon agreed. City Attorney Cochran recommended that there be some discussion regarding the issues so that decisions could be made because of the strict timeline.

Page | 4
Andrew Sandoval, LULAC, stated that he believed that the demographer could supply a city-wide map with an overlay of registered voters. He stated that he didn’t recommend that Council include future growth into consideration in drawing the district maps. He stated he believed if the Council removed the power to elect its Mayor by appointing the Mayor, it would delude the voting power of the protected class in Greenfield. He stated that he believed that the majority of the Council wanted to keep the Mayor elected at large and not remove that power from the voters.

Stephanie Garcia stated that she agreed with Councilmember Martinez that there was a lack of public participation or knowledge. She stated that she didn’t know enough about this to be for or against it; however, currently as a voter she was able to vote for 2 Councilmembers and having that taken away, she was not okay with that. She stated that she disagreed with Mr. Sandoval about the rotating Mayor because it gave everyone a turn to be the Mayor and that would be good.

Beatriz Diaz’s email was read into the record by the City Clerk.

Mayor Pro-tem Untalon closed the public hearing at 8:36 p.m.

Councilmember White suggested that one of maps have El Camino Real be a dividing line and that would give the downtown businesses more representation.

Mayor Pro-tem Untalon asked that the community to get involved and the Council to share the information on their social media.

CITY ATTORNEY REPORT
City Attorney Cochran thanked city staff, especially Ed and Ann, for their help because there was a lot of work to make sure that this hearing took place. He also thanked the public for participating in the process and stated that there was a FAQ page on the website that was a great resource for the public.

CITY MANAGER REPORT
City Manager Wood stated that he wanted to thank staff as well along with City Attorney Cochran, Dr.

Phillips and the translator for all their hard work.

ADJOURNMENT
Meeting adjourned at 8 43 p.m.

Overview: Key Objectives of This Funding
The Coronavirus State and Local Fiscal Recovery Funds deliver $350 billion for state, local, territorial, and Tribal governments to respond to the COVID-19 emergency and lead a strong, resilient, and equitable recovery.

Key objectives of this funding:
• Fight the pandemic and support families and businesses struggling with its public health and economic impacts
• Maintain vital public services, even amid declines in revenue resulting from the crisis • Build a strong, resilient, and equitable recovery by making investments that support longterm growth and opportunity U.S. Department of the Treasury, Coronavirus State & Local Fiscal Recovery Funds 38 4
Overview: Early Program Implementation
The Coronavirus State and Local Fiscal Recovery Funds deliver $350 billion for state, local, territorial, and Tribal governments to respond to the COVID-19 emergency and lead a strong, resilient, and equitable recovery.

Early program implementation:
• Over $245 billion disbursed to state, local, and Tribal governments, with over 99 percent of funds available in 2021 in the hands of governments across the country, as of today • Recipients have used SLFRF funds to meet immediate pandemic needs and make investments in long-term growth and opportunity for their communities, with examples including:
– Supporting the public health response: testing and vaccination clinics, expansion of rapid testing, vaccination incentive programs, distribution of PPE, contact tracing operations & COVID19 mitigation in congregate settings – Strengthening the economic recovery: youth jobs programming, jobs and workforce training for dislocated workers, technical support to small businesses in underserved communities, creation and preservation of affordable housing, rental assistance, expansion of childcare, education programs for disproportionately impacted communities & rehiring government workers – Making longer term investments: expanding high-speed broadband access to unserved and underserved communities
• Treasury has carefully considered feedback from recipients and stakeholders, including over 1,500 comments, and hundreds of meetings and correspondence with recipients and stakeholders U.S. Department of the Treasury, Coronavirus State & Local Fiscal Recovery Funds 39 5
Important Note: Projects Already Underway in SLFRF Program • The final rule takes effect on April 1, 2022
• If a use of funds complies with the final rule, Treasury will not take action to enforce the interim final rule, regardless of when the funds were used (e.g., if the IFR would not permit that use of funds); recipients can take advantage of the expanded flexibilities in the final rule now
• Until April 1, the interim final rule remains in effect; funds used consistently with the IFR while it is in effect are in compliance with the SLFRF program U.S. Department of the Treasury, Coronavirus State & Local Fiscal Recovery Funds For more, please see the Statement Regarding Compliance with the Coronavirus State and Local Fiscal Recovery Funds Interim Final Rule and Final Rule 40 6

U.S. Department of the Treasury, Coronavirus State & Local Fiscal Recovery Funds Recipients have requested greater flexibility, simplicity & clarity in the final rule to respond to new pandemic needs and make transformative investments 41 7
Approach to the Final Rule
Treasury’s final rule provides greater flexibility and simplicity for recipients to turn the tide on the pandemic, maintain vital public services amid revenue shortfalls, and build a strong, resilient, and equitable recovery.

KEY NEW FEATURES IN THE FINAL RULE
• Major simplification for thousands of recipients through the $10 million revenue loss standard allowance Public Sector Revenues
• Providing a broader set of eligible uses for impacted and disproportionately impacted populations
• Clarifying that reasonably proportional capital expenditures may be allowable (e.g., affordable housing, hospitals)
Public Health &
Economic Response
• Streamlining options to provide premium pay by broadening the share of essential workers who can receive premium pay without a written justification
Premium Pay for
Essential
Workers
• Expanding water and sewer projects that are eligible
• Broadening eligible broadband investments to allow recipients to address access, affordability & reliability challenges

Replace Public Sector Revenue Loss
Recipients may use these funds to provide government services, up to the amount of revenue loss experienced due to the COVID-19 public health emergency. • Determine revenue loss, using one of two available options:
– Elect “standard allowance” of up to $10 million to spend on government services through the life of the program, which greatly simplifies the program for small localities – Calculate actual revenue loss according to Treasury formula » Calculate revenue loss either on a calendar or fiscal year basis » Must adjust actual revenue totals for the effect of tax cuts and tax increases that are adopted after January 6, 2022, to more accurately reflect revenue loss due to the pandemic
• Spend on government services up to the revenue loss amount – Government services generally include any service traditionally provided by a government unless Treasury has stated otherwise, such as:

U.S. Department of the Treasury, Coronavirus State & Local Fiscal Recovery Funds • Funds available under the “revenue loss” eligible use category generally may be used to meet the non-federal cost-share or matching requirements of other federal programs – However, note that SLFRF funds may not be used as the non-federal share for purposes of a state’s Medicaid and CHIP programs, even under the “revenue loss” category • SLFRF funds beyond those that are available under the “revenue loss” eligible use category above may not be used to meet the non-federal match or cost-share requirements of other federal programs other than as specifically provided for by statute (e.g., the Infrastructure Investment and Jobs Act for Bureau of Reclamation and certain broadband deployment projects)

BACKGROUND AND ANALYSIS
In accordance with Greenfield Ordinance 8, Chapter 16 (Removal of Vegetative Growth and/or Refuse), Subchapters 8.16.120 through 8.16.170 the City Council is required to conduct a Public Hearing to consider and hear any public objections before filing a report to the County Auditor for cost recovery of abatement services provided to property owners that have not reimbursed the City. There are four properties for your consideration which are identified in Exhibit-A.

Prior to this Public Hearing, multiple attempts have been made to contact the property owners to notify them of the hazard(s) on their property and all subsequent action taken by the City. Please refer to Exhibit-A for a detailed and chronological description of the attempts made by the Fire Department prior to this Public Hearing.

Finally, in accordance with Greenfield Ordinance 8, Chapter 16, Subchapters 8.16.120 through 8.16.170, the property in consideration had a Notice of Report of Cost and Hearing (see Exhibit-B) posted onsite on 01/18/2022. All property owners were mailed a Notice of Report and Hearing (see Exhibit-B) on 01/18/2022, and the City Clerk was given a copy of the report for public viewing, as well as a copy to post outside of City Hall on 02/07/2022.

EXHIBIT- "A"
This exhibit contains specific information about the property under consideration. 65 4
Property Address or Location: Northern side of Elm Avenue between Cerrato’s Court and Don Vincente Drive
APN: 109-212-005-000
Registered Property Owner: Norma Palameres and Luciano Del Toro Vargas To avoid the City taking this action, the following steps were taken to contact the property owner and notify them about the hazards on their property and their legal responsibilities as a property owner in the City of Greenfield. The goal was to inform them about the hazards so they could mitigate the problem(s) without any intervention on behalf of the City.
• On March 1, 2021, Greenfield Fire Department (GFD) mailed a courtesy letter because this property owner had been contacted in 2020, regarding hazardous vegetation and refuse on their property. The intent of this letter was to remind them that fire season was approaching, and it was time to abate any hazards on their property. The courtesy letter contained a copy of frequently asked questions regarding weed and refuse abatement and a copy of the GFD Cutting Standards.

All correspondence was written in English and Spanish.
• The March water bill from the City of Greenfield (if applicable) included a flyer advising property owners to have their property abated of hazardous vegetation and refuse by May 1, 2021. This flyer was also written in English and Spanish. • On April 13, 2021, GFD posted videos in English and Spanish on our Facebook page notifying property owners that fire season was coming, and all properties were required to be abated of hazardous vegetation and refuse by May 1, 2021. • On May 6, 2021, the property owner was mailed a letter advising them that property in their name was out of compliance with City of Greenfield Ordinance

8.16 and was required to be abated at their earliest convenience. This letter included pictures showing the hazards on their property. • On May 1, 2021, the Greenfield Fire Department (GFD) announced on Social Media and through a press release given to local media, that Fire Season had been declared in Monterey County. The media release also included a reminder to property owners that all property in the City of Greenfield was required to be abated of hazardous vegetation and refuse in preparation of fire season. • On May 27, 2021, a second courtesy letter was mailed to the property owner advising them that their property remained out of compliance and that the City Council would determine if their property was a public nuisance at the June 8, 2021, City Council Meeting. They property owner was advised that abating the hazards on your property would end the requirement for the City to take any additional action.
66 5
• On June 8, 2021, the Greenfield City Council adopted Resolution 2021-45, which declared that this property was out of compliance with Ordinance 8.16 and was a public nuisance. It was noted that neither the property owner nor any representatives spoke on their behalf during the public comment portion of this agenda item at the city council meeting.
• On June 9, 2021, this property was tagged with an order to abate notice and the property owner was mailed a USPS certified letter containing an order to abate.

On both the tag and order mailed the property owner was advised to immediately abate the hazards on their property. Additionally, the tag and order advised them that if they failed to abate the hazards on their property a Public Hearing would take place on July 13, 2021, at 6:00 pm where the City Council would consider any objections before ordering the Fire Chief and/or his designee to enter their property to begin mitigation.
• On June 23, 2009, I sent an email to the property owner advising them that an Order to Abate had been issued for their property. I received no response • On July 13, 2021, a Public Hearing was held during the scheduled City Council Meeting to determine if Resolution 2021-56 would be signed and order the Fire Chief and/or his designee to enter this property and abate the hazards. It was noted that neither the property owner nor any representatives spoke on their behalf during the public comment portion of this agenda item at the city council meeting. Resolution 2021-56 was approved unanimously and signed. • On July 15, 2021, a local contractor and I entered this property to photograph the current condition of the property and to begin hazard abatement. The property was then abated of the hazards by the contractor.
• On August 4, 2021, this property owner was sent an invoice detailing the cost of abatement and given a due date of September 17, 2021 to reimburse the City for these costs. The following invoice remains unpaid.
• August 5, 2021, I received a phone call from Mr. Luciano Del Toro Vargas stating that he had not received any of the notifications regarding hazards on his property. During this conversation I reminded him that we had similar conversations in 2020 regarding his property and I even arranged for him to dump garbage at the City Public Works Facility at no cost. He asked if I would waive the administrative fee and allow him to make a series of payments to pay his invoice. I advised him that I would discuss this with the City Manager. He also requested that all correspondence and phone communication go directly to him in the future.
• August 5, 2021, I spoke with the City Manager who gave his permission to work with Mr. Del Toro Vargas and allow him to make payments and waive the 67 6
administrative fee. I then sent an email with an updated invoice and advised him that the City Manager had agreed to his request.
• On September 10, 2021, the City received the first payment of $708.85. They payment was three days late and required me to call Mr. Del Toro Vargas to remind him to make the payment.
• On September 10, 2021, I sent Mr. Del Toro Vargas an email acknowledging the receipt of his first payment. I also reminded him that he still had three remaining payments.
• On October 14, 2021, I sent Mr. Del Toro Vargas a reminder email that his second payment was due on October 17,2021.
• On October 27, 2021, I sent Mr. Del Toro Vargas an email advising him that the City had not received his October payment and that I would no longer take the time to remind him about his payments. I further advised him that if he failed to make any remaining payments, I would begin the process of cost recovery by putting a lien on his property.
• On October 29, 2021, Mr. Del Toro Vargas made a second payment to the City in the amount of $1,000.00.
• On November 3, 2021, I sent Mr. Del Toro Vargas an email acknowledging the receipt of the payment. This was the last communication that I have had with Mr.

Del Toro Vargas.

87 MEMORANDUM: February 18. 2022
AGENDA DATE: February 22, 2022
TO: Mayor and City Council
FROM: Paul Wood, City Manager
TITLE: A RESOLUTION TO SUPPLEMENTALLY APPROPRIATE
FUNDS FOR THE FISCAL YEAR 2021 – 2022 OPERATING
BUDGET IN THE AMOUNT OF $148,000 FOR

SUPPLEMENTAL POLICE TRAINING, THE PURCHASE

OF WATER METERS AND METER MODULES,

PURCHASE OF SLUDGE PUMPS/INSTALLATION AND

INITIAL STUDY/POLE AUDIT FOR LIGHTING POLE

PURCHASE PROJECT

BACKGROUND
On June 8, 2021, the City Council approved a biennial (two-year) budget for fiscal years 2021- 2022 and 2022-2023. The purpose of passing a biennial budget is to better coordinate multi-year strategy and projects over a longer period of time.

Even though we have a budget in place for both this year and next, planning is an inexact practice and adjustments need to be made periodically. As we have completed the first half of the first fiscal year (July 1 - December 31, 2021) City staff has (1) found errors in the original budget that need to be corrected and (2) made adjustments to operations that require the adjustment of the budget.

This staff proposal consists of 4 adjustments that affect 4 different funds, only one of them is the General Fund. The proposed supplemental appropriations are as follows:

1. Supplemental appropriation in the amount of $25,000 to pay for additional training for Police Department personnel

2. Supplemental appropriation in the amount of $23,000 to pay for replacement of sludge pumps at the Wastewater Treatment Plant
City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
88 3. Supplemental appropriation in the amount of $50,000 to pay for an initial study of purchasing the City’s light poles from PG&E, and

4. Supplemental appropriation in the amount of $50,000 to purchase water meters for new subdivisions
Additional Police Training
Over the past 4 years, the City management has made a conscious effort to increase the amount of training in all departments. The Police Department has led the way in training and wanting its staff to be as prepared as possible when they are in the field and the office.

The Police Department is funded in many ways, via the General Fund, the supplemental sales and use taxes and via grants. This supplemental appropriation for training will be funded by one of the grants, the Supplemental Law Enforcement Services Fund (SLESF). The City normally received $100,000 per year from the state sponsored grant. The PD does not spend all of this money every year. At this time, the fund balance in the SLESF is approximately $307,000.

The $25,000 that the PD is requesting would be paid for with a portion of this fund balance.

Purchase of Water Meters
Whenever a subdivision is developed, water meters are attached to each property in order to monitor water consumption so that the City can bill properly for the use of water.

Whenever a subdivision is started, the Public Works department calculates the number of meters needed and budgets for the expense and the revenues (the revenues come from development fees specifically allocated to the meters).

When the budget was prepared for the FY21-22 year, the budgeted appropriations line item was inadvertently omitted for meters. This supplemental appropriation is to add back the originally calculated meters expense ($50,000) as well as the development fees related to it (also $50,000).

This transaction does affect the General Fund, but it does not have a net negative effect on the budget as both the revenue and the expenditure will be increased by the same amount.

Replacement Sludge Pumps
Currently, the Wastewater Treatment Plant is being operated by Fluid Resource Management (FRM) with the intent to bring the operation into compliance with State Water Board requirements and to increase efficiency and efficacy to bridge the 5-year gap until our new plant is completed.

Part of the plan is to strategically repair/replace equipment that will not be operable for the next 5 years. This is the case with the sludge pumps. City staff is asking to supplementally appropriate $23,000 for the replacement of the current sludge pumps. 89 The funding will be coming directly from the Sewer Enterprise Fund, and not impact the General Fund.

Initial Study of Light Pole Purchase
The Light Pole Purchase project is a potential project that projects to save the City up to $40,000 per year in avoided maintenance charge for the current owner of our City light poles, PG&E.

The total cost of the project is expected to be approximately $275,000. The calculated payback period would be 6-10 years, with an ongoing annual savings of approximately $40,000.

By purchasing the poles, it is estimated that the City, by using its own resources and personnel, can save up to $40,000 per year. Since light poles are situated in both LLMDs and the City in general, the savings will be allocated between the City and the LLMDs based on the number of poles in each area. As the benefits are allocated, so will the cost of this project. The exact burden of each area has not been determined, but the breakout between the City and the LLMDs might be 50-50 or 60-40 (larger share borne by the General Fund).

The actual calculation of the split would be determined after an inventory of the poles is completed. It is very likely that the amount charged to the General Fund would be in the range of $25,000 - $30,000, with the remained being funded by the LLMDs themselves. The City Engineer has determined that this is an appropriate expenditure for the LLMDs.

The amount requested ($50,000) is expected to cover the initial comprehensive GIS audit of existing streetlights.
