RE: Humberto Aceves v. City of Greenfield
Attention Legal Department:

RECEIVED
FEB 16 2022

CITY OF GREENFIELD

Aceves and the monies owed to him as a result.

Such computers should not be erased, reformatted or modified in any way (including but not limited to the installation of new or different operating systems and other procedures described below) that could result in the irretrievable loss of electronic data relevant to this lawsuit. If such major reformatting or modification needs to be performed during the pendency of this lawsuit, you must take steps to ensure that all relevant electronic data is preserved in a usable form. 23 Should Defendant fail to properly preserve electronically stored or other information/ documents relevant to this lawsuit, Plaintiff will seek maximum available sanctions for spoliation and destruction of evidence, which can include an adverse jury inference, judgment as a matter of law, monetary fines and an award of attorney's fees.

FACTUAL BACKGROUND
On or around January 2, 2007, your Company hired Mr. Aceves to serve as a foreman for various locations throughout the City of Greenfield, where he earned an hourly wage of $34.00. Mr.

Aceves generally worked full-time, Monday through Friday, and his duties included, but were not limited to, engaging in the maintenance and repair of public facilities. As demonstrated throughout his time of employment, Mr. Aceves was highly experienced, skilled and reliable.

In July of 2019, Mr. Aceves sustained an injury while performing his regular job duties. As a result, Mr. Aceves filed for worker's compensation and As a competent employee who continued to do his job to the best of his ability, Mr.

Aceves was given no reason to believe that having filed for worker's compensation would result in any adverse employment action.

In 2020, an employee named filed a complaint against a supervisor named and in addition, named The reasons for
complaint included management treating employees poorly, acting inappropriately in the workplace and Mr. Aceves' worker's compensation claim was just a ploy. told that he believed Mr. Aceves was "just playing the system" and expressed wishes to terminate his employment as a result. Mr. Aceves attested to complaint and provided a statement, at which point your Company began to subject him to retaliation.

Subsequently, Mr. Aceves' position within the Company was changed to that of a maintenance worker. Upon the inception of his new position, Mr. Aceves was placed on a probationary period during which he was required to prove he could effectively perform his job duties. After three months as a maintenance worker, your Company informed Mr. Aceves that he failed to adequately perform during the probationary period and terminated his employment. Once terminated, your Company had Mr. Aceves escorted off the premises by police officers which was not only an unusual practice, but unnecessary given the circumstances, and caused Mr. Aceves a great deal of humiliation.

Mr. Aceves had been competently performing his job duties, and was never subjected to any corrective or disciplinary action during the probationary period; therefore, the manner in which his employment was terminated strongly indicates retaliatory motives. 21777 Ventura Blvd, Suite 243 I Woodland Hills, CA 91364 I P (424) 234-5229 I www.employmentlawassist.com [email protected]
24 LEGAL DISCUSSION
Liability for Retaliation Under Labor Code 4 132(a)
California Labor Code §132(a) states that: "Any employer who discharges, or threatens to discharge, or in any manner discriminates against any employee because he or she has filed or made known his or her intention to file a claim for compensation with his or her employer [...] is guilty of a misdemeanor and the employee's compensation shall be increased by one-half, but in no event more than ten thousand dollars ($10,000), together with costs and expenses not in excess of two hundred fifty dollars ($250). Any such employee shall also be entitled to reinstatement and reimbursement for lost wages and work benefits caused by the acts of the employer." Cal. Lab.

Code §132(a).

In this case, Mr. Aceves filed for worker's compensation . Supervisor later indicated to another employee named
that he believed Mr. Aceves' worker's compensation claim to be fraudulent and expressed wishes to terminate Mr. Aceves' employment as a result. later made a complaint against and another member of management, which Mr. Aceves gave a statement in support of.

Subsequent to the complaint, Mr. Aceves was transferred to another position within the Company and terminated shortly after.

Liability for Retaliation in Violation of Labor Code 4 1102.5 Labor Code §1102.5 prohibits retaliation by an employer against an employee for disclosing any information to any person with authority to investigate, or any public body investigating, violation of a state or federal statute or regulation if the employee has reasonable cause to believe that the information discloses a violation of state or federal statute, or a violation of or noncompliance with a local, state, or federal rule or regulation.

In order to establish a prima facie case of retaliation under § 1102.5(b), plaintiff must demonstrate that he or she engaged in a protected activity as set forth in § 1102.5, that the employer subjected him or her to an adverse employment action, and a causal link between the two. (McVeigh v.

Recology San Francisco (2013) 213 Cal.App.4th443,468). A Plaintiff who successfully prosecutes for retaliation in violation of § 1102.5 may recover compensatory damages, including economic and emotional distress damages. (Gardenhire v. Housing Authority of the City of Los Angeles (2000) 85 Cal.App.4th 236,237, 240-241).

Here, the prima facie case is satisfied, as Mr. Aceves; (1) engaged in a protected activity when he gave a statement in support of formal complaint against and (2) Mr. Aceves' suffered an adverse employment action when Defendant terminated his employment; and (3) there is a causal link between Mr. Aceves' statement in support of complaint and the retaliatory conduct of Defendant. Specifically, Mr. Aceves provided a statement in support 21777 Ventura Blvd, Suite 243 I Woodland Hills, CA 91364 I P (424) 234-5229 I www.employmentlawassist.com [email protected]
25 of formal complaint against and after had already expressed wishes to terminate Mr. Aceves' employment. Shortly after Mr. Aceves supported complaint, his employment was terminated.

Wrongful Termination in Violation of Public Policy
"[W]hen an employer's discharge of an employee violates fundamental principles of public policy, the discharged employee may maintain a tort action and recover damages traditionally available in such actions." Tameny v. Atlantic Richfield Co. (1980) 27 Cal.3d 167, 170 "[T]he cases in which violations of public policy are found generally fall into four categories: (1) refusing to violate a statute; (2) performing a statutory obligation (3) exercising a statutory right or privilege; and (4) reporting an alleged violation of a statute of public importance." Gantt v. Sentry Insurance (1992) 1 Ca1.4th 1083, 1090-1091. Similarly, "an employer's authority over its employee does not include the right to demand that the employee commit a criminal act to further its interests, and an employer may not coerce compliance with such unlawful directions by discharging an employee who refuses to follow such an order . . ." Tameny, supra, 27 Ca1.3d at p. 178.

In this case, Mr. Aceves was terminated because he filed for worker's compensation and supported another employees formal complaint against the Company by providing a statement, which is expressly contrary to the public policy behind Labor Code § 132(a) and Labor Code § 1102.5.

Damages for wrongful termination in violation of California public policy are calculated based on lost wages, emotional distress damages, and a civil penalty of 810 000.00.

Reasonable Attorney's Fees and Costs
Labor Code § 1194 provides in pertinent part that an "employee is entitled to recover in a civil action the unpaid balance of the full amount of ... overtime compensation, including interest thereon, reasonable attorney's fees, and costs of suits." Labor Code § 218.5(a) provides in relevant part that, "in any action brought for the nonpayment of wages... the court shall award reasonable attorney's fees and cost to the prevailing party..." Furthermore, "[i]n civil actions brought under [FEHA], the court, in its discretion, may award to the prevailing party . . . reasonable attorney's fees and costs, including expert witness fees." Government Code, § 12965, subd. (b). In this case, Mr. Aceves is entitled to reasonable attorney's fees and costs, for his individual wage and hour claims. Accordingly, you and your Company will be held liable for Mr. Aceves' attorney's fees and costs, which are estimated at an excess of $40,000.00 if we proceed to litigation.

DEMAND
Notwithstanding the egregious Labor Code violations of your Company as a California employer, Mr. Aceves is willing to resolve this matter amicably without resorting to litigation. In exchange for signing a California Civil Code § 1542 waiver of all claims, we request the following: a 21777 Ventura Blvd, Suite 243 I Woodland Hills, CA 91364 I P (424) 234-5229 I www.employmentlawassist.com [email protected]
26 payment of $45,824.00 for the wrongful termination of his employment and emotional distress in the amount of $15,000.00 to Mr. Aceves for a total amount of $60,824.00, plus an agreement to provide a neutral reference to future employers and payment of our attorney fees.

If you also wish to resolve this matter informally prior to litigation, please contact our office in writing no later than February 26, 2022. If we do not receive your written response by said date, you will be served with a lawsuit asserting our client's rights for your violations of California Labor Code.

TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF GREENFIELD APPROVING THE SUBMISSION OF A
LETTER IN SUPPORT OF MONTEREY COUNTY’S

REQUEST TO AUTHORIZE LEGISLATION ALLOWING A
VETERAN’S HOME TO BE BUILT IN THE REGION

BACKGROUND
Currently, there are extended wait times to access the established Veterans Homes in the State for much needed services. If Veterans are unable to access Veteran Home services timely, they will have to seek other options, potentially out of the State of California or even risk becoming homeless. Veterans in need of Skilled Nursing and Memory Care must wait years before they get admitted. The construction of a new Veterans Home in Monterey County would help to alleviate the long wait times and keep our Veterans in the State. Current wait times for these services are:
• Yountville: 5 years wait time for admittance.
• West Los Angeles: 2 years wait time for admittance.
• Fresno: 4 years wait time for admittance.
• Redding: 5 years wait time for admittance.

California is losing veterans at an alarming rate – much faster than the next 2 largest veteran population states (Texas and Florida). We owe all we have to the veterans of this Nation, and it is our joint obligation to do all we can to care for those who have selflessly served for the freedoms we have today. Currently California Veterans receive more than $8 Billion in Federal VA Compensation and Pension Payments. In addition, many receive Post 9/11 GI Bill, Chapter 33 Education Benefits and DoD Retirements. If Veterans leave the state, so will the need for Veteran Serving organizations that create City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
56 high paying jobs with the Federal VA, State, Counties, Private Sector and Non-Profits that serve our Veterans. Veterans positively impact the California Ecosystem.

The construction of a new Veteran’s Home will lower or eliminate wait times for admittance into the CalVET Veterans Homes for services including combined skilled nursing & memory care services. Adding an additional Veterans Home will increase the number of homes to 9 in the state. Homes are available to Disabled and Aged Veterans as well as spouses. This home will provide much needed care to our states heroes and decrease the risk of these Veterans becoming homelessness. In addition, the location in Monterey County, will provide an attractive geographical location with a rich Military History and current Military presence. Residents of the Veterans Home would have easy access to the Major General William H. Gourley VA-DoD Outpatient Clinic, Commissary’s, Post Exchanges, Military Gyms and other Military / Veteran accessible facilities. There are a large variety of beaches, walking / bike trails and County / State / National parks that will promote outdoor activity.

Additionally, Monterey County is interested in contributing land for a new CalVET Veterans Home and Federal Grants are available for 65% of construction costs of the new Veteran Home.

BUDGET AND FINANCIAL IMPACT
No budget impact.

Re: Support for a Veteran’s Home in Monterey County
Dear Monterey Bay Region Federal and State Legislators:

On behalf of the City of Greenfield, we are writing to support Monterey County’s request for authorizing legislation allowing a Veteran’s Home to be built in the region.

Currently, there are extended wait times to access the established Veterans Homes in the State for much needed services. TO: Mayor and City Council
PREPARED BY: John Alves, Interim Public Works Director, Douglas Pike, City Engineer TITLE: ADOPTION OF A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF GREENFIELD, CALIFORNIA, AUTHORIZING THE PAVEMENT
MANAGEMENT PROGRAM UPDATE 2022 FUNDING AGREEMENT
“AGREEMENT”) BY AND BETWEEN THE TRANSPORTATION
AGENCY FOR MONTEREY COUNTY (“TAMC”) AND THE CITY OF

GREENFIELD

BACKGROUND AND ANALYSIS
The Measure X sales tax measure provides much needed transportation and streets maintenance funding for all local jurisdictions in the County of Monterey, and is administered by the Transportation Agency of Monterey County (TAMC). One of the requirements to receive funds is for the City maintain a Pavement Management System (PMS) that meets TAMC requirements.

This has been accomplished by the City of Greenfield since Measure x was adopted by the voters by entering into a cooperative agreement through TAMC for a consultant to provide these services to multiple agencies to take advantage of a cost sharing arrangement.

At their January 26, 2022 meeting, the TAMC Board authorized staff to continue this service and enter into reimbursement agreements with local agencies for TAMC to procure professional and technical services for Pavement Management Program Update services, The City of Greenfield is one of the seven agencies that expressed an interest in participating in the joint procurement by TAMC for Pavement Management Program Update 2022 Services on our behalf. The Funding Agreement confirms our intent to participate in the joint procurement and to contribute its proportionate share of costs. TAMC will select and hire a qualified consultant to provide these services.

Attached documents relating to the joint procurement for Pavement Management Program Update 2022 Services include:

1. Pavement Management Program Update 2022 Funding Agreement City Council Memorandum
599 El Camino Real Greenfield CA 93937 831-674-5591
www.ci.greenfield.ca.us
62 2. Preliminary Cost Estimate Breakdown by Agency
The estimated cost to the City of Greenfield for these TAMC administered services is $4452.00.

Staff recommends that the City Council adopt the Pavement Management Program Update 2022 Funding Agreement and provide a signed original to TAMC by Monday, March 28, 2022. A final cost breakdown by task and agency will be prepared before execution of the contract resulting from the RFP.

If the City were to reject this option, we would be responsible for hiring a specialty consultant on our own at an increased cost to the City.

FISCAL IMPACTS
The cost of maintaining our current Pavement Management System (PMS) is estimated by TAMC at $4452.00, which costs are included in the Streets Capital Program and budget adopted by the City. Costs will be paid by the Streets Fund, which includes Measure X funding.

RECOMMENDATION
Staff recommends that the City Council adopt the Pavement Management Program Update 2022 Funding Agreement and provide a signed original to TAMC by Monday, March 28, 2022.

Staff recommends the Council Authorize the City Manager to execute the agreement

PAVEMENT MANAGEMENT PROGRAM REQUIREMENTS
The approved ordinance for the Transportation Safety & Investment Plan (Measure X) outlines the requirements for the use of local road maintenance, pothole repair and safety funds.   It includes a requirement for each jurisdiction to have a pavement management program.  "Each city and the County of Monterey shall develop, or participate in the development of by TAMC, a pavement management program.  They shall submit regular reports on the conditions of their streets, to ensure timely repairs and keep the public informed.  Development of the pavement management program by TAMC is eligible to be funded out of this program prior to distribution of funds to the cities and the County."
SYSTEM REQUIREMENTS:  In order to receive Measure X funds, the cities and the County shall utilize a pavement management program (PMP) and submit regular reports on the conditions of their streets, to ensure timely repairs and keep the public informed.  The pavement management program should utilize an approved software‐based tool for analyzing pavement conditions and reports findings on rehabilitation/maintenance strategies based on funding levels.  The pavement management program used by the jurisdiction must contain, at a minimum, the following features:
 Store the inventory all roadways within a jurisdiction (in a compatible database with other jurisdictions).
 Assess the condition of the roadways (based on seven distresses and three severity levels).
 Provide the current Pavement Condition Index (PCI) for the roadways (as per ASTM D6433).
 Identify all pavement sections needing maintenance, rehabilitation, or replacement.  Calculate budget needs for maintenance, rehabilitation or replacement of deficient pavement sections (for the current year and the next three years at various overall condition levels).
 Develop maintenance strategiesforthe most cost‐effective level of maintenance orrepair appropriate at the time of the inspection.
 Generate pavement management program reports (in various formats). 76 DRAFT

Page 11 of 11 ends

All jurisdictions must implement and maintain an approved Pavement Management Program (“StreetSaver” or equivalent).  The “StreetSaver” Pavement Management Program developed by Metropolitan Transportation Commission (MTC) is the most utilized program in the Bay Area and would be an excellent program for this region as well.  The use of the “StreetSaver” Pavement Management Program is recommended (but not required) since it would allow good compatibility between local jurisdictions and also provide regional benefits.

Jurisdictions may elect to use an alternative pavement management program provided it meets the above listed minimum requirements and receives written approval from TAMC.

The Agency will assist with the development of an overall pavement management implementation plan for this region with the participation and coordination of all the cities and the county.  The Agency recommends the development of a regional system to benefit from a coordinated system.  The regional system would be developed collaboratively between local jurisdictions.  In order to have a regional database, it is recommended that all agencies utilize a common pavement management program.  This would allow compilation of information on a regional basis.  It would also create opportunities for interagency coordination and to guide regional transportation investments and planning.

UPDATE REQUIREMENTS:  The jurisdictions must complete the following updates:
 Review and update the pavement information for all roads every two years.  Pavement conditions must be re‐inspected every three years for arterials and collectors.  Pavement conditions must be re‐inspected every six years for residential streets and local/rural roads, unless otherwise approved by TAMC.  Pavement condition surveys may be done by either automated or manual inspections and may be done either individually or in conjunction with another agency.  A percentage of the network can be scheduled each year so that the entire network is updated on a regular cycle.

REPORT REQUIREMENTS:  All jurisdictions shall submit an annual Pavement Management Program Report Letter to TAMC no later than December 31 of each year the Measure X tax is in effect using the approved report letter format.  It shall include all the highlighted information and shall be on local agency letterhead (see attached template).

All jurisdictions shall also participate in the biennial pavement needs survey conducted for the California Statewide Local Streets and Roads Needs Assessment and provide the requested roadway data for their jurisdiction.

AGENDA DATE: March 8, 2022
TO: Mayor and City Council
PREPARED BY: John Alves, Acting PW Director/Douglas Pike, City Engineer TITLE: A RESOLUTION TO AMEND PUBLIC WORKS CONSTRUCTION CONTRACT WITH F. LODUCA CO., “THE GREENFIELD SIDEWALKS AND ACCESSIBLE PARKING PROJECT” TO CONSTRUCT ADDITIONAL OR MODIFIED

IMPROVEMENTS BY CHANGE ORDER AND AUTHORIZE THE CITY MANAGER TO FINALIZE AND EXECUTE THESE CONTRACT CHANGE ORDERS (CCO’S)

BACKGROUND AND ANALYSIS
On July 13, 2021, the City Council approved award of a contract with the Frank Loduca Company for “The Greenfield Sidewalks And Accessible Parking Project” in the contract amount of $626,842.20.

This project is completing pedestrian and accessible parking improvements on Oak and El Camino Real as well as safety improvements on Apple Avenue at Cesar Chavez School. The project will also provide concrete repairs to uplifted sidewalks in Special Assessment District 1 in the vicinity of Village Green Park.

The following additional work is proposed for Council Approval and authorization:

1. CCO#1 - Addition of voice activated feature associated with the crosswalk pedestrian button activated systems being installed at two locations (two on Apple at Cesar Chavez School) This feature adds the voice message “Flashers Activated” when the pedestrian button is pressed.

Adding the voice feature increases the cost by $7,211.34.

2. CCO#2 – Addition of three additional locations to install pedestrian button activated flashers at midblock crosswalks on El Camino Real. The locations are the mid-block crosswalks between Apple and Palm, Palm and Oak, and Oak and Maple. These locations will include a third dual facing flashing sign in the median island. This proposed CCO will include the option for the voice alert feature. The proposal cost increase is $74,025.00 to add flashing pedestrian signs at the three locations. The addition of optional Audible message feature adds an additional cost of $10,871.01, making the total cost increase $84,842.01.

For information purposes, the proposed flashing light system being installed on Oak at the Post Office is different in that the Ped Button activates lights in the pavement as well, and has a built in voice feature capability.

F. Loduca Co. has performed well, however the contract completion date will be extended due to contract delays to accommodate general workload and procurement challenges associated with current general economic trends.

City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
78 Additionally, this increase in scope includes added project management and inspection costs by our City Engineer (MNS Engineers, Inc.). The estimated increase in services is 15% of the value of construction.

Assuming all change order work is approved, the increase to the authorized professional services would be $74,025.00 x .15 = $11,103.00
This project contains elements funded by the following funding sources: SB1-(RMARA) Funds, Measure X Local Transportation Funds (LTF), and Gas Tax Funds. and Special District Streets and Storm Drain Maintenance District #1 and Lighting and Landscaping District #2 Funds (St. Charles Place Subdivision).

FINANCIAL AND BUDGET IMPACT
The City’s initial approval was in the contract award amount of $626,842.20. The proposed CCO addition is in the amount of:

1. Option 1: $84,842.01 + $7,211.34. = $92,053.35 (with voice feature) or if Council chooses to not add the voice feature the total will be

2. Option 2: $73,971.00 (eliminate CCO # 1 for $7,211.34 and the voice feature for $10,871.01 in CCO#2.)
Additionally, if approved, $11,103.00 will be authorized for additional project management and inspection for construction.

All costs of developing and constructing the Sidewalk and Accessible Parking Improvement Project will be from funds budgeted and allocated for this purpose from the programmed Regional SB1-(RMARA) Funds, Measure X Local Transportation Funds (LTF), Gas Tax Funds, and Special District Maintenance Funds.

FROM: Paul Wood, City Manager
TITLE: A DISCUSSION OF THE CITY COUNCIL OF THE CITY OF

GREENFIELD RELATED TO SETTING UP A PROGRAM TO

IMPROVE STREET SWEEPING EFFECTIVENESS

BACKGROUND
Over the years, as the City has grown, in both geographical size and population, it has become increasingly more difficult for the street sweeper to be effective.

The difficulties arise because there are more and more vehicles parking on the streets and the City has no enforcement mechanism to empty the streets when it is time for the street sweeper makes its rounds, thus the sweeper ends up mostly sweeping down the middle of the street.

This item proposes to be a discussion only item to gather information and get direction from Council related to a proposed program to be more effective in sweeping the streets.

City staff understands that a program of this nature has the potential to make many people happy and many people angry. We, of course, would like to maximize the first group and minimize the second.

This program would have an objective of making sure that the street sweeper has the ability to sweep the gutters of the roadways that it does not currently have the access to do on many streets. This means that cars parked on the street now that block the street sweeper from sweeping the gutters would have to be moved so that the sweeper can sweep the gutters.

The program that we would propose initially is one that would incorporate at least some of the following steps:
• A media campaign that would inform the community of the program (via ALL available outlets) that would start NOW
• A signage program that would clearly state the days and times that street sweeping is scheduled in each neighborhood
City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
90 • An enforcement program that would be “firm, but fair” and would enable the community to make a few mistakes as the implementation gets started, but as time goes by, and the community becomes more familiar with the requirements, would increasing become more punitive. This approach might entail the following:
o if a community member does not move their car for the sweeper,  the first week, staff will place a reminder note on the windshield of vehicle  the second week, the vehicle will be cited
 the third and subsequent weeks, the vehicle will be towed at the owner’s expense
City staff will take questions and looks for direction as to if the Council would like to proceed with a program of this type.

BUDGET AND FINANCIAL IMPACT
The implementation of such a program would certainly have a financial impact. That impact is unknown at this time, but if staff is directed to pursue this program, a complete budget will be prepared.

PROPOSED MOTION:

DISCUSSION ITEM ONLY, NO MOTION.
