Re: Letter of Support from City of Greenfield, CA

May 24, 2022
To Economic Development Administration:

On behalf of the City of Greenfield, CA, I would like to express our strong support for the Center for Employment Training's application for funding to expand their technical training facility through the “Public Works and Economic Adjustments Assistance (EAA) Program” in Monterey County.

As a mission-aligned and values-driven organization, we believe CET has demonstrated its skills and experience in effectively implementing and administering services that align with our region's Comprehensive Economic Development Strategy to help the underserved populations with barriers to employment break the poverty cycle. This funding will assist CET in offering additional services and skills training that will reduce unemployment rates by elevating our regional workforce population and creating a more robust access point to high-quality in-demand occupations that lead to self-sufficiency.

I am particularly excited to support CET due to its strong commitment to job training and workforce development in thriving regional employment sectors and for their outreach and recruitment efforts encouraging low-income individuals in rural and agricultural sectors to break the generational cycle of poverty within their families and acquire quality skills training to embark on a career path.

I look forward to continuing to support CET's vision to create a more robust technical training facility within Monterey County through the Public Works and EAA programs to increase our workforce, establish effective career pathways, and build community engagement in high demand occupational sectors.

I appreciate your consideration in CETs application and look forward to supporting their program growth and public outreach within Monterey County.

SUBJECT: US 101 Auxiliary Lane – South of Salinas Project – SUPPORT Dear Senator Feinstein, Senator Padilla, and Representative Panetta:

I am writing on behalf of the City of Greenfield to express our support for the US 101 Auxiliary Lane – South of Salinas project for federal highway funding.

The US 101 Auxiliary Lane project provides near-term operational improvements and addresses safety issues along northbound US 101 south of Salinas by extending the existing northbound acceleration lane at Spence Road to Eckhardt Road creating an auxiliary lane to allow adequate space for trucks to accelerate from Spence Road onto US 101 and to provide a deceleration lane for traffic exiting US 101 to Eckhardt Road. This near-term improvement can be constructed while design continues on the larger US 101 South of Salinas project that will ultimately provide the improvements required to eliminate the at-grade left turns between the Abbott Street and Chualar interchanges.
29 US 101 is California’s major north-south coastal route between Los Angeles and San Francisco, and is a vital asset to national, state, regional, and local economies. It is a major trade corridor for the distribution of fresh produce to markets around the country. US 101 is also a major commute route between homes in southern Monterey County and jobs in Salinas, Monterey Peninsula, and north to Silicon Valley.

Thank you for your consideration of this important regional project for federal funding.

Sincerely,

Lance Walker

AGENDA DATE: MAY 24, 2022
TO: Mayor and City Council
FROM: Douglas Pike, City Engineer, John Alves, Interim PW Director TITLE: YANKS PROJECT RELEASE OF LETTER OF CREDIT FOR PHASE 1

WATER IMPROVEMENTS
RECOMMENDATION:

Release Irrevocable Standby Letter of Credit Number 27-SB-5227 for Yanks Phase 1 Water Improvements.

BACKGROUND AND ANALYSIS:

The Yanks development was developed (entitled) by the County of Monterey prior to annexation.

Site grading, drainage and utility improvements for their Phase 1 is permitted by the City. As a condition of this permit, a bond, or letter of credit was required for improvements that will become City owned and maintained.

Only the water main, valves, fire hydrants and associated components and accoutrements will be owned by the City, accessible for maintenance by easement. All roads, storm drain facilities, sewer mains, streetlights, etc. will be private and maintained by the developer.

The developer subsequently provided Irrevocable Standby Letter of Credit Number 27-SB-5227 for the improvements to be accepted by the City.

Staff has inspected the Phase 1 improvements and determined that they are complete and acceptably installed per the plans and specifications.

The developer has not provided a schedule for development. Since the completed water mains to the development will require added maintenance, flushing and sampling/testing if not put “in service”, the Public Works Department has determined that it would be prudent to isolate the water infrastructure into the development by closing the valve pending building development. The 31 City will require the first user to re-disinfect the main prior to their being allowed to connect. The Developer has agreed to this approach, rather than pay for the alternative maintenance.

FINANCIAL AND BUDGET IMPACT:
• There is no anticipated cost impact to the City that cannot be passed on to future developers of building(s) on the Yanks development.

RECOMMENDATION:

Staff recommends that the City Council approve Release of Irrevocable Standby Letter of Credit Number 27-SB-5227 for Yanks Phase 1 Water Improvements

AGENDA DATE: May 24, 2022
TO: Mayor and City Council
PREPARED BY: Paul Mugan, Community Development Director Rob Mullane, AICP, Planning Consultant
TITLE: ADOPTION OF AN ORDINANCE CANCELLING THE

DEVELOPMENT AGREEMENT BETWEEN THE CITY OF
GREENFIELD AND EAST OF EDEN CANNABIS CO. AT 60
4TH STREET

BACKGROUND
On May 10, 2022, the City Council voted 5-0 to introduce an ordinance cancelling the Development Agreement between the City and East of Eden Cannabis Co. for a commercial cannabis operation at 60 4th Street. The ordinance is now before the City Council for adoption.

DISCUSSION
The cancellation of a DA is allowed by mutual consent of all parties to the agreement. In this case, a commercial cannabis operator that in 2017, obtained a regulatory permit and DA for commercial cannabis operations on the site never completed the permitting process to establish such operations. The new property owner is also not interested in pursuing a commercial cannabis operation on the site and instead is seeking funding from the Small Business Administration for an equipment rental establishment. There are other available sites within the City for commercial cannabis operations, and the City staff support the requested DA cancellation.

No revisions to the draft ordinance were directed at the May 10, 2022 City Council meeting, when the Council introduced the ordinance and conducted first reading of the ordinance. The draft City Council ordinance is included as Attachment 1, and the letter from East of Eden Cannabis Co. requesting the cancellation is included as Attachment 2. 36 FISCAL IMPACT
The costs for staff and consultant time to process the Development Agreement cancellation request are the responsibility of the applicant. The applicant has signed an agreement to pay for these costs and have submitted a deposit intended to cover all costs. There is no impact on the City’s General Fund.

CEQA REVIEW
The proposed DA cancellation would allow continued uses and buildings at the project site that are consistent with the site’s Highway Commercial Zoning and Mixed Use Overlay, including uses within and/or changes to the existing building on the site. As such, the DA cancellation qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 of the State Guidelines for the Implementation of CEQA. The DA cancellation would not facilitate substantial additions or changes in use, and instead removes a use that is currently allowed at the site.

RECOMMENDATION
Staff recommends that the City Council conduct second reading of and adopt an ordinance cancelling the Development Agreement between the City of Greenfield and East of Eden Cannabis Co. Any cancellation of the existing Development would be effective 30 days after adoption.

PROPOSED MOTION
I MOVE THAT THE CITY COUNCIL CONDUCT ADOPT ORDINANCE NO. 557

CANCELLING THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF GREENFIELD AND EAST OF EDEN CANNABIS CO. FOR COMMERCIAL CANNABIS OPERATIONS AT 60 4TH STREET.

NOW, THEREFORE, BE IT HEREBY RESOLVED, that the City Council of the City of Greenfield has considered all written and verbal evidence regarding the proposed cancellation of the Development Agreement between the City of Greenfield and East of Eden Cannabis Co. and has made the following findings:

1. FINDING: That the proposed cancellation of the Development Agreement is in conformance with Section 16.37.110 of the City’s Municipal Code that sets forth the process for cancelling development agreements.
(a) The cancellation is requested by mutual consent of the parties to the Development Agreement;
(b) Public hearings on the cancellation of the Development Agreement were conducted by the Planning Commission and City Council, with such public hearings noticed in accordance with the requirements of sections 16.37.080 and

16.37.090 of the City’s Municipal Code and pursuant to sections 65090 and 65091 of the California Government Code;
(c) The cancellation of the Development Agreement would allow other noncommercial cannabis uses to be development on the subject parcel, with such development adhering to the requirements and regulations of the property’s Commercial Highway zoning and in compliance with the City’s General Plan.

2. FINDING: Section 15301 of the State CEQA Guidelines states that a Class 1 Categorical Exemptions is for permitting existing public or private structures and facilities, involving negligible or no expansion of an existing use at the time of the lead agency’s determination. State CEQA Guidelines Sections 15300.2(a) through (f) list specific exceptions for which a Categorical Exemption shall not be used. These exceptions are as follows:

Location. Classes 3, 4, 5, 6, and 11 are qualified by consideration of where the project is to be located – a project that is ordinarily insignificant in its impact on the environment may in a particularly sensitive environment be significant. Therefore, these classes are considered to apply in all instances, except where the project may impact an environmental resource of hazardous or critical concern where designated, precisely mapped, and officially adopted pursuant to law by federal, state, or local agencies.

Cumulative Impact. All exemptions for these classes are inapplicable when the cumulative impact of successive projects of the same type in the same place, over time is significant.
39 3
Significant Effect. A categorical exemption shall not be used for an activity where there is a reasonable possibility that the activity will have a significant effect on the environment due to unusual circumstances.

Scenic Highways. A categorical exemption shall not be used for a project which may result in damage to scenic resources, including but not limited to, trees, historic buildings, rock outcroppings, or similar resources, within a highway officially designated as a state scenic highway. This does not apply to improvements which are required as mitigation by an adopted negative declaration or certified EIR.

Hazardous Waste Sites. A categorical exemption shall not be used for a project located on a site which is included on any list compiled pursuant to Section 65962.5 of the Government Code.

Historical Resources. A categorical exemption shall not be used for a project which may cause a substantial adverse change in the significance of a historical resource.

None of the exceptions would apply to the cancellation of a development agreement for commercial cannabis uses; therefore, the project is eligible for a Class 1 exemption.

Section 3. Severability: If any section, subsection, clause, phrase, sentence, or word of this ordinance is for any reason held invalid by a court of competent jurisdiction or by preemptive legislation, such decision or preemptive legislation shall not affect the validity of the remaining portions of this ordinance. TO: Mayor and City Council
PREPARED BY: Douglas Pike, P.E. City Engineer
TITLE: A RESOLUTION OF THE CITY OF GREENFIELD ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2022-23 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017

BACKGROUND AND ANALYSIS
In April 2017, the Governor signed Senate Bill 1 (SB1), also known as the Road Repair and Accountability Act (RRAA) of 2017. Beginning November 1, 2017, the State Controller will begin to deposit funds generated from increased fuel taxes and vehicle registration fees, into the newly created Road Maintenance and Rehabilitation Account (RMRA). The four sources of revenues for the RMRA are:
• A 12-cent per gallon gasoline excise tax, effective November 1, 2017 • A 20-cent per gallon diesel excise tax increase, effective November 1, 2017 • Vehicle registration surcharge, effective January 1, 2018 • A $100 per year zero-emission vehicle registration surcharge, effective January 1, 2020 A portion of the RMRA funds will be distributed annually to eligible cities and counties for basic road maintenance, rehabilitation, and critical safety projects on local streets and road systems.

The distribution will be made using the same formula that applies to the existing base 18-cent per gallon gasoline excise tax. The City’s annual allocation estimate of RMRA funding for FY 2022/23 is $ 419,467.

SB1 emphasizes the importance of accountability and transparency in the delivery of California’s transportation programs. As outlined in the RRAA Reporting Guidelines, recipients of the RMRA funding are held accountable through performance goals that are tracked and reported. In order to be considered for funding in Fiscal Year 2021/22 agencies must provide a proposed list of projects to the California Transportation Committee by July 1, 2022. This will enable the RMRA funds to be included in the City’s annual road maintenance budget.

The City of Greenfield has previously, through the SB 1 program, completed the following projects:

City Council Memorandum
599 El Camino Real Greenfield CA 93937 831-674-5591
80 • FY 2017-18: 1. Commercial/residential Alleys Repaving including stormwater and pedestrian improvements: and 2. Administrative/Staff related costs of Public Works employees assigned to the Streets Division and providing local street and road maintenance and repair services.
• FY 2018-19: 1. Commercial/residential Alleys Repaving including stormwater and pedestrian improvements; and 2. Administrative/Staff related costs of Public Works employees assigned to the Streets Division and providing local street and road maintenance and repair services.
• FY 2019-20: 1. Pedestrian safety and accessibility improvements downtown, and in the vicinity of schools, high density housing, and high pedestrian traffic areas. Improvement will include focused safety studies and engineering, addition of accessible parking on ECR downtown, crosswalk safety improvements, sidewalk repairs, infill sidewalk improvements, pedestrian and bicycle signage, legends and other pedestrian and bicycle safety improvements; and 2. Administrative/Staff related costs of Public Works employees assigned to the Streets Division and providing local street and road maintenance and repair services.
• FY 2020-21: Similar to 2019-20: Pedestrian safety and accessibility improvements downtown, and in the vicinity of schools, high density housing, and high pedestrian traffic areas.
• FY 2021-22: 1. Pedestrian, bicycle safety and accessible parking project improvements.

This project includes construction of accessible parking on ECR downtown, crosswalk safety improvements, sidewalk repairs, infill sidewalk improvements, pedestrian and bicycle signage, legends and other pedestrian and bicycle safety improvements at a local school; and 2. Administrative/Staff related costs of Public Works employees assigned to the Streets Division and providing local street and road maintenance and repair services.

In addition to an approved project list, the guidelines state all projects proposed to receive funding shall be included in the agencies’ adopted budgets. The FY 2022/23 Improvement and Maintenance Projects have been identified in the CIP program Budget.

The following list of proposed projects will be funded in-part or solely with fiscal year 2022-23 Road Maintenance and Rehabilitation Account revenues:
81 • Administrative/Staff related costs of Public Works employees assigned to the Streets Division and providing local street and road maintenance and repair services. This contribution will enhance the ability of the City to perform a greater amount of its own pothole repairs, concrete repairs, striping and other maintenance tasks, creating a leveraged savings in reducing contract costs. This project will provide these anticipated benefits for the entirety of the fiscal year
• As recommended by the Traffic Safety Committee, and as needed in accordance with Public Works maintenance needs, complete the following project:
o Project Title: Downtown Area Pavement Rehabilitation, Pedestrian and Safety Improvements
o Description and Location: Pedestrian safety improvements In the older Downtown area, and in the vicinity of Mary Chapa school, and shall include pavement rehabilitation, addition of high visibility crosswalks with flashing pedestrian warning systems, pavement and sidewalk repairs, pedestrian and bicycle signage, legends and other repairs to the older streets in town.

Improvements will include items from focused safety studies. o Schedule: These proposed improvements are anticipated to be designed and constructed before June, 2023.
o Useful Life: It is expected that Concrete components will have a 50-yr. life, Asphalt pavement components will have a 20-year life, Signage components will have a 20-year life, and striping components will have a 5-year life.

Also, this bill includes a “Maintenance of Effort” (MOE) requirement for local funds contributed to street and road repairs to help ensure that the new funding augments existing budgets for road repairs. Specifically, it requires each city to spend no less than the annual average from its general fund during FY 2010 through FY 2012. The City tracks this also for purposes of reporting our Maintenance of effort for Measure X funds. The estimated, average MOE for the City of Greenfield currently is $11,436. Sources of local funds include Gas Tax, Special Tax Revenue Funds, and Street Capital Funds.

In order to receive SB1 funds through the Transportation Agency for Monterey County (TAMC), the City must enter into an agreement with TAMC for the allocation of funding. The attached resolution and Agreement is the for requested by TAMC for this purpose.

FINANCIAL AND BUDGET IMPACT
Estimated FY 2022/23 annual revenue anticipated from SB1 is approximately $419,467. This amount will be included in the Revenues for FY 2022/23 and will be added as a funding source for These identified CIP project improvement projects. These monies will augment the General, Gas Tax and Measure X funds for the indicated maintenance and improvement projects. 82 RECOMMENDATION

TITLE: DISCUSSION AND STAFF DIRECTION RELATED TO

IMPLEMENTING TERM LIMITS FOR CITY COUNCIL MEMBERS
BACKGROUND:

Government Code section 36502 authorizes the adoption of limits on the number of terms that may be served by the Mayor and City Council members. The limits must be approved by a majority of voters at a regularly scheduled election. There are a variety of “term limits” that can be imposed. They can apply to the mayor only, the council only (non-mayoral seats), or to both.

Some term limits only limit the amount of consecutive terms that can be served, while others put an overall cap on the number of years/terms that can ever be served regardless of whether consecutive or not.

If Council is interested in pursuing term limits, the Council should:

1. agendize the issue (current step) and commence some open session discussions,

2. determine the actual term limits the Council would like to impose,

3. draft a proposed ordinance

4. adopt a resolution to submit the proposed ordinance to voters for approval

5. the measure, with the proposed ordinance attached, will be placed on the ballot at the next election for consideration by voters.

6. If approved, the ordinance will be added to the City’s Municipal Code.

City Council Memorandum

89 Please note that there are a number of procedural requirements and nuances that need to be followed in this process. If Council wishes, the City Attorney’s office could outline the process in detail. If Council would like, the City Attorney can also provide additional information – like which Cities and Counties currently have term limits and samples of different types of term limit ordinances that have been adopted.
