AGENDA REVIEW
Item I-1, I-2 and I-3 were postponed to the June 28, 2022 City Council meeting.

PUBLIC COMMENTS FROM THE AUDIENCE REGARDING ITEMS NOT ON THE AGENDA Beatriz Diaz thanked Chief Langborg, Officer Dyels, City Manager Wood and Mayor Pro-tem Untalon for attending the scholarship event hosted by Councilmember Martinez and LULAC for the graduating seniors and 8th graders.

Raul Rodriguez, Greenfield Recreation & Cemetery District, stated that the District had merged and now they were one board that served both districts. He stated that one of their biggest challenges was the swimming pool at Greenfield Oak Park. He stated that the pool was about 70 years old and needed a lot of work. He stated that the Board had made the decision to close the pool because it would be over $100,000 or more to fix both the pool and dressing rooms which also needed to be fixed. He also stated that the Board would be informing the County of the closure; however, wanted to inform the City as well.

Laura Mireles stated that the City hired new city employees and trained them; however, some were not doing their job. She stated for example the code enforcement officers were not doing their job because there were lots of parking issues and asked that staff start implementing the laws. She also stated that the alleys were in bad shape and that the City needed to look cleaner and better. She stated that the issue with the basketball courts at Patriot Park got full attention but no attention had been given to the Avila Boxing. She asked that the Council represent the community as a whole and not just a part of it. 9 City Council Minutes

COMMENTS FROM CITY COUNCIL
Councilmember White congratulated the class of 2022. He also reminded everyone that Cyclovia was on June 26th and that there would be a lot of healthy activities at the event. He asked for an update on the Greenfield signs and stated that they needed to get completed. He reported that he attended the TAMC meeting regarding the South of Salinas Project and the Abbott Street Interchange Project and stated that once the projects were completed, it should alleviate the congestion. He thanked Carlos Venegas for the Memorial Day ceremony at the cemeteries and memorial hall. He stated that the basketball courts at Patriot Park had been improved and asked that staff develop a Park Master Plan and place it on a future agenda so that Council could review it.

Councilmember Martinez stated that she was glad that the basketball courts were painted but they should have been pressure-washed. She stated that the City had a lot of issues at Patriot Park and there needed to be more events and involvement from the public. She stated that the more involvement the people were, the more people would respect the park. She thanked everyone that attended the youth event and thanked Officer Dyels, Chief Langborg, City Manager Wood and LULAC for their participation.

She announced that Cyclovia was on June 26th and stated that Council could still do something at the event. She stated that the Council and staff had been working with the Avila Project and stated that Council did advocate for all groups. She stated that the City needed to do something about the homelessness. She stated that the City needed to collaborate with other agencies to do something for them and make sure that they were not going hungry. She stated that she would like to have a separate budget for the cannabis funds in order to see what monies were coming in and where they were being spent.

Councilmember Tipton stated that the parking problem was getting worse and the City needed to step up and do something about it. He stated that laws were not being enforced and that there was a parking situation and code enforcement went right by it and did not do anything. He stated that he received complaints about the fireworks and the City needed to look at options on how this could be handled. He asked that traffic enforcement take placed on Oak between 11th and 12th because people were using it a drag strip.

Mayor Pro-tem Untalon thanked the public works staff and stated that they were trying to keep up with the parks short-staffed. She stated that the parks and restrooms were very clean and that everyone needed to do their part and clean up after themselves. She reminded everyone that it was fire season and to be mindful of that and of the pets when lighting fireworks. She announced that there would be a 4th of July event at Patriot Park. She also stated that summer school started tomorrow for the younger kids and that the high school had already started and to be mindful of the kids on the sidewalks and streets.

Mayor Walker stated that he also had received a lot of complaints about the fireworks because the loud noise scared young kids and pets and asked that the Police try to enforce it better this year. He stated that parking was a lot worse and that in some locations there were blind spots and people couldn’t see traffic coming. He stated that there had been a lot of speeding going on at 7th and Maple. He stated that he was excited that the Chevron and California Gourmet Pizza were re-building. He also congratulated the 2022 grads. He announced the 4th of July celebration that would be held at Patriot Park and stated that he would be doing a guitar give away.

TO: Mayor Walker, Mayor Pro-tem, Untalon, and all City Council Members
PREPARED BY: Jim Langborg, Fire Chief

TITLE: RESOLUTION TO ORDER THE FIRE CHIEF TO ABATE

HAZARDOUS CONDITIONS ON NUISANCE PROPERTIES

BACKGROUND AND ANALYSIS
In accordance with Greenfield Ordinance 8.16 (Removal of Vegetative Growth and/or Refuse), the City Council must order the Fire Chief by resolution to abate hazards located on nuisance properties. This allows the Fire Chief and/or his designee to legally enter a property and take all action needed to ensure it is free of hazardous vegetation and refuse. To ensure staff has followed Ordinance 8.16 and made a good faith effort to work with property owners, the following attempts to communicate were taken:
• In March of 2020, the City Council adopted revisions to Ordinance 8.16 which addressed public safety hazards caused by the accumulation of hazardous vegetation and refuse.

The City followed all required public notification mandates. • On March 1, 2022, GFD sent a courtesy letter in English and Spanish to property owners contacted the prior year for weed and refuse abate reminding them that fire season is coming and to abate any hazards on their property. This letter also contained a copy of frequently asked questions regarding weed and refuse abatement and a copy of the GFD cutting standards. All informational documents were provided in English and Spanish.
• The April 2022, water bill included a brochure advising property owners that all hazardous vegetation and refuse must be abated by May 1, 2022. The informational brochure was provided in English and Spanish.
• On April 5, 2022, GFD posted information in English and Spanish on their Facebook page notifying property owners that fire season was coming, and all properties were required to be abated by May 1, 2022.

City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
35 2
• On May 3, 2022, the GFD began conducting property inspections. 47 warning letters were mailed advising property owners their property was out of compliance. At the writing of this report, 7 property owners remain out of compliance. These letters also contained a copy of frequently asked questions regarding weed and refuse abatement and a copy of the GFD cutting standards. All informational documents were provided in English and Spanish.
• On June 8, 2022, a second courtesy letter was mailed to all property owners whose property remained out of compliance advising them that the City Council would determine if their property was a public nuisance at the June 28, 2022, City Council Meeting. This letter encouraged property owners to abate all problems on their property before June 28th, to avoid the City acting on their behalf. • On June 28, 2022, the Greenfield City Council adopted a resolution declaring all out of compliance properties as a Public Nuisance. This was the first step in accordance with Ordinance 8.16 to enable the City to abate the hazards on nuisance properties. • On June 29, 2022, properties that remained out of compliance were tagged with an order to abate notice and mailed a USPS certified letter containing an order to abate.

Property owners were also advised that they would have the opportunity to contest any further action by attending the July 12, 2022, City Council Meeting.

FINANCIAL AND BUDGET IMPACT
If all properties require abatement by the City, it could cost over $20,000. All expenses associated with abatement will be passed onto the property owner. Staff is committed to ensuring the City is cost neutral and that no expenses are subsidized by taxpayers. During Fiscal Year 2021/2022 the City notified the County Assessor to apply $5,141.00 to property owners who did not reimburse the City for abatement services.

RECOMMENDATION
It is the recommendation that the City Council adopts the attached resolution, ordering the Fire Chief to abate the hazards on the properties listed Exhibit-A.

TITLE: A RESOLUTION TO EXTEND THE AGREEMENT WITH

FLUID RESOURCE MANAGEMENT (FRM) TO MANAGE

THE GREENFIELD WASTEWATER TREATMENT PLANT
FOR A PERIOD OF TWO (2) MONTHS AT AN
APPROXIMATE COST OF $70,000

BACKGROUND
On January 26, 2022, the City of Greenfield entered into an agreement with Fluid Resource Management (FRM) for plant management services for our wastewater plant. The intent has been to improve plant efficiency, efficacy, and to better train staff. On April 26, 2022, the City Council approved a recommendation to extend the agreement for another two (2) months in order to accomplish the task of improving the plant’s performance.

After 5 months, the results have been excellent, and will continue to improve with the proper guidance and training of staff. Staff from the Central Coast Water Board inspected the WWTP on June 29, 2022 and were pleased to see the amount of progress that has been made, while noting a few items that require attention. In order to fulfill the remaining training needed and continued improvement of the plant’s performance, staff has recommended to extend the agreement with FRM to assist with these items. This effort is expected to take another two months, concluding at the end of August 2022.

Staff would like to extend the agreement with FRM for another (2) two months in order to further accomplish the tasks at hand.

The expected cost is approximately $70,000
City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
59 To date, the Central Coast Water Boards is impressed with the City’s improvements to efficiency and effectiveness efforts to bring the City’s WWTP up to the mandated state standards.

I MOVE TO ADOPT RESOLUTION #2022-67 , A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF GREENFIELD TO EXTEND THE AGREEMENT WITH

WHEREAS, on January 26, 2022, the City of Greenfield entered into an agreement with Fluid Resource Management for plant management services for our wastewater treatment plant; and
WHEREAS, after five (5) months, the results have been excellent and the plant’s performance has improved substantially, as noted by the Central Coast Water Board during their June 29, 2022 inspection of the plant; and
WHEREAS, there is still a need for proper training of staff and improvements to the plant and staff recommends to extend the agreement with FRM for another two (2) months; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Greenfield hereby authorizes the extension of the Agreement with Fluid Resource Management to Manage the Greenfield Wastewater Treatment Plant for a period of two (2) months at an approximate cost of $70,000:

PREPARED BY: Douglas Pike, P.E. City Engineer
Jamie Tugel, Public Works Director
TITLE: A RESOLUTION ACCEPTING AN IRREVOCABLE EASEMENT

OFFER OF STORM DRAIN EASEMENT TO FACILITATE

STORM WATER PIPELINE ACCESS FROM THE PROPOSED
WALNUT TRAVEL CENTER TO THE 3RD STREET WALNUT
SPECIFIC PLAN STORMWATER BASIN.

BACKGROUND
The Walnut Travel Center Parcel Map was approved and associated improvement plans have been reviewed and are in the permitting process for both private and public improvements. This project includes a new fueling station with fast-food restaurants and travel services. The development will include a temporary stormwater basin on adjacent land within the Walnut Ave.

Specific Plan Area owned by the Robasciotti family.

The Robasciotti family, owners of much of the Walnut Avenue Specific Plan Area, is required to work cooperatively with Peter Singh, Owner/Developer of the Travel Center, and the City, to dedicate an easement for the temporary basin and future access to the 3rd Street Stormwater Basin. This will assure the temporary basin remains temporary, and when the Robasciotti processes a Tentative and Final Map, the Travel Center will have pipeline access to the 3rd St.

Basin. Because the Robasciotti’s map is in development, and the precise route of the storm drain pipeline is TBD, this Irrevocable Easement Offer is for a general EASEMENT described as “for temporary storm water drainage facilities and will be modified and re-recorded to encompass only actual drainage facilities upon construction of permanent storm water drainage facilities.” The purpose of this staff report is to recommend that the Council approve and accept the attached Irrevocable Easement Offer (considered as a DRAFT) of storm drain easement to facilitate this 62 temporary storm water basin as well as future pipeline access from the proposed Walnut Travel Center to the 3rd Street Walnut Specific Plan stormwater basin.

The Authorization of the acceptance of the Irrevocable Easement Offer is included in the attached Resolution. The Resolution authorizes the City Manager to finalize, and sign the offer on behalf of the City. The easement dedication documents have been prepared by John A.
