Gabriella Serrato addressed the City Council regarding Councilmember Martinez and stated that anything a Councilmember does was City business which included speaking to their constituents. She stated that a Councilmember could not take their hat off and say this was not city business and this was; if one did not want to deal with this then they should not be in that seat. She gave samples of how Councilmember Martinez’s abused her power with her mother to avoid paying her rent. She stated that a leader does not harm the community nor does he/she encourage others to do the same. CONTROL OFFICER AND CODE ENFORCEMENT OFFICER TO COMMUNITY SERVICE OFFICER (CSO) AND AMENDING THE SALARY SCHEDULE
RESOLUTION #2022-98
Staff report was given by Acting Chief Mixer.

Councilmember Tipton stated that he didn’t want to see that the officers only focus on one aspect of their duties and asked if there would be two on duty at the same time. Acting Chief Mixer stated that there would be two on duty and that all would be cross-trained.

Frances de Leon stated that she wanted to make sure that emerging the two positions would not take away from code enforcement. She stated that code enforcement officers must be certified and receive their certification within a year of hiring and asked if any of them were certified. She suggested that the part-time position be made full-time. Acting Chief Mixer stated that there was one employee that was already certified and the other one was scheduled to attend the certification program but all would be trained.

A MOTION by Councilmember White, seconded by Councilmember Tipton to adopt Resolution #2022- 98, “A Resolution of the City Council of the City of Greenfield to Reclassify the Positions of Animal Control Officer and Code Enforcement Officer to Community Service Officer (CSO) and Amending the Salary Schedule”. 25 MEMORANDUM: 10/21/2022
AGENDA DATE: 10/25/2022
TO: Mayor and City Council
FROM: Paul Wood, City Manager
TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF GREENFIELD RENEWING AND

SUPPLEMENTALLY APPROPRIATING FUNDS IN
FISCAL YEAR 2022-2023 IN THE AMOUNT OF $57,000

TO FUND GRANT WRITING SERVICES AND GRANT

WRITING TRAINING FOR STAFF CITYWIDE

BACKGROUND
With the passage of the American Recovery Plan Act (ARPA), the City of Greenfield will be receiving over $4 million over the next two years to help offset Covid – 19 impacts as well has a number of other identified expenditures to help local governments recover from the past 2½ years.

Also, with the passage of ARPA, nearly $2 trillion in funding became available to state and local governments for projects to stimulate the economy, repair infrastructure and many other uses.

The City of Greenfield staff has determined that, as a “disadvantaged community,” our agency should be able to use these funds as leverage to secure many grants that will be funded by ARPA. Since the city does not have the capacity to find, right and manage grants currently, we feel the best use of our time and money would be to contract with a professional grant writing team to provide services to us.

Attached is a proposal from RPPG, a legal firm that specializes in grant writing among other things. Our plan is to engage with RPPG for another period of 12 months for grant writing services as well as grant writing education services that will be taught to every department in the city. In this manner, we intend to continue to take advantage of their expertise to secure currently offered grants citywide. Additionally, as this first round of grants is applied for, we intend for RPPG to assist the city by teaching us how to find, right and manage grants in the future. This City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
26 we believe is a very appropriate way for us to not only take advantage of the available ARPA monies available through the $1.9 trillion federal relief package, but also other normal grant funding mechanisms.

Mayor of the City of Greenfield
32 A PROCLAMATION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF GREENFIELD PROCLAIMING OCTOBER AS CHILDREN’S ENVIRONMENTAL HEALTH MONTH
WHEREAS, our children are California’s future and are especially vulnerable to environmental health issues because they are physiologically very different from adults and are in a dynamic state of growth. From birth through young adulthood, children experience rapid physiological growth, and their systems absorb more toxins in proportion to their body weight than do adults’ systems. Children also have higher metabolic rates than do adults, and relative to body size, children eat and drink more food and liquid than their full-grown counterparts. Children also have unique behavior and activity patterns. They live and play much closer to the ground than do adults, and are therefore exposed differently to toxins; and WHEREAS, all children are affected by environmental hazards because different kinds of pollution can be found throughout our state. Contaminants are transported through many media, including air, water, soil, and food, and are absorbed by children when they breathe, drink, eat, and touch the contaminated media. Children’s exposure to these toxins can harm their health; and WHEREAS, many pesticides used in California are associated with major childhood health conditions. Some pesticides are known neurotoxins and have been linked to higher rates of attention deficit/hyperactivity disorder and autism spectrum disorders in children. In addition, studies have demonstrated strong associations between pesticides and asthma diagnoses for children under five years of age. Many pesticides also contain endocrine-disrupting chemicals and PFAS, which mimic hormones and impact brain development; and WHEREAS, it is an established fact that children from low-income communities and communities of color are at disproportionate risk for exposure to environmental hazards, and the Office of Environmental Health Hazard Assessment within the California Environmental Protection Agency reports that Latino, Black, immigrant, and children of color in California are more likely to reside in areas with disproportionately higher exposure to environmental contaminants; and
WHEREAS, the aim of Children’s Environmental Health Month is to raise awareness about the importance of ensuring clean air and water, safe food and consumer products, and healthy environments during a child’s development and beyond; and WHEREAS, Children’s Environmental Health Day was created by the Children’s Environmental Health Network and celebrated nationally since October 13, 2016; and
WHEREAS, Children’s Environmental Health Month encourages individuals and organizations to raise awareness and understanding of children’s environmental health issues, seek improved environmental health policies and protections for children, and perform acts of sustainability or environmental health wellness; and
WHEREAS, together, we can safeguard the health, safety, and well-being of our children, who are our most precious resource.

NOW, THEREFORE, I, Lance Walker, Mayor of the City of Greenfield and the City Council do hereby proclaim October 2022 as Children’s Environmental Health Month

ORDINANCE CANCELLING THE DEVELOPMENT

AGREEMENT BETWEEN THE CITY OF GREENFIELD
AND CANNA CULTURE CORPORATION AT 802 EL
CAMINO

AUTHORITY AND PROCEDURES
Development Agreement Process: Chapter 16.37 and Section 17.16.160 of the City of Greenfield Municipal Code set forth the procedures for approval, amendment, and cancellation of development agreements (DAs). Such action on DAs must be done by Ordinance and requires public hearing before both the Planning Commission and City Council.

The Council is the designated approving authority; however, the Planning Commission considers the request and makes a recommendation to the City Council. The Commission’s action is by resolution, and the Commission may recommend that the Council approve, conditionally approve, or disapprove the DA as set forth in Section 16.37.080.

Before taking action on the DA, the City Council must make certain findings as set forth in Section 17.16.160.C. These findings include:

1. The development agreement is consistent with the general plan objectives, policies, land uses, and implementation programs and any other applicable specific plans;

2. The development agreement is in conformance with the public convenience and general welfare of persons residing in the immediate area and will not be detrimental or injurious to property or persons in the general neighborhood or to the general welfare of the 34 2
residents of the city as a whole; and

3. The development agreement will promote the orderly development of property or the preservation of property values.

BACKGROUND
The City received a request from the owner of the property at 802 El Camino Real to cancel the existing commercial cannabis Development Agreement (DA) that was adopted and recorded in 2017. The DA was between the City of Greenfield and Canna Culture Corporation. The 2017 DA established the terms and conditions for commercial cannabis operations at the site. Canna Culture did not proceed through the Building Permit process, and the regulatory permit was never issued. Canna Culture is no longer interested in commercial cannabis operations at the site and has requested that the City cancel the DA.

A developer of a gas and diesel fueling station, car wash, convenience store, and quick service restaurants has submitted various Planning applications to develop the project site. Cancellation of the DA is required as a pre-condition to developing the site with non-commercial cannabis uses. City staff are reviewing the Planning application and will bring the various entitlement requests to the Planning Commission for consideration, once the application has been deemed complete and the requisite environmental analysis has been conducted.

The Planning Commission considered the DA cancellation request on May 3, 2022, and on a 5-0 vote, recommended that the City Council adopt an ordinance cancelling the Development Agreement between the City of Greenfield and Canna Culture Corporation.

DISCUSSION
The cancellation of a DA is allowed by mutual consent of all parties to the agreement. In this case, a commercial cannabis operator that in 2017, obtained a regulatory permit and DA for commercial cannabis operations on the site never completed the permitting process to establish such operations. The project developer is not interested in pursuing a commercial cannabis operation on the site. There are other available sites within the City for commercial cannabis operations, and the City staff support the requested DA cancellation.

The draft City Council ordinance is included as Attachment 1, and the letter from Canna Culture Corporation requesting the Development Agreement cancellation is included as Attachment 2.

NEXT STEPS
Second reading and possible adoption would occur at a subsequent City Council meeting, anticipated for November 15, 2022. Any cancellation of the existing Development would be effective 30 days after adoption, and City staff would coordinate with the requester to execute the Development Agreement cancellation and record it with Monterey County. 35 3

FISCAL IMPACT
The costs for staff and consultant time to process the Development Agreement cancellation request are the responsibility of the applicant. The applicant has signed an agreement to pay for these costs and have submitted a deposit intended to cover all costs. There is no impact on the City’s General Fund.

CEQA REVIEW
The requested Development Agreement cancellation is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061 of the CEQA Guidelines.

Section 15061 states that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The Development Agreement cancellation would allow uses and buildings at the project site that are consistent with the site’s Highway Commercial Zoning. The DA cancellation would not facilitate substantial additions or changes in use, and instead removes a use that is currently allowed at the site.

RECOMMENDATION
Staff recommends that the City Council introduce and conduct first reading of an ordinance cancelling the Development Agreement between the City of Greenfield and Canna Culture Corporation. This is a public hearing item, so action should occur following the public hearing.

ALTERNATIVES

1. The City Council could decide to not cancel the existing Development Agreement. In this alternative, a motion and vote to do so should be conducted.

TITLE: CONSIDERATION OF A RESOLUTION APPROVING A
REVISED DESIGN REVIEW PERMIT FOR PHASE 1

COMMERCIAL CANNABIS OPERATIONS AT THE NEXT
WAVE FACILITY AT 689 EL CAMINO REAL
Design Review
While Design Review authority is typically at the Planning Commission level, commercial cannabis-related projects require City Council review and approval, and hence the City Council is the final decision-maker on the requested Design Review for this project. Section 17.10.040 of the City’s Zoning Code sets forth the responsibilities for Design Review. Those responsibilities include, among others, hearing and deciding applications for design review. The Zoning Code requires design review for all non-residential development. The purpose of design review is set forth in Section 17.16.070.A of the Zoning Code, which states:

The purpose of the design review process is to promote the orderly and harmonious growth of the city, to encourage development in keeping with the desired character of the city; to ensure physical, visual, and functional compatibility between uses; and to help prevent the depreciation of land values by ensuring proper attention is given to site and architectural design.

It is within the purview of the City Council to “approve, conditionally approve, or deny the proposed design review application.” As part of the design review process, the City Council may require that “the applicant modify plans in whole or in part and may condition the design review approval to ensure inclusion of specific design features, use of specific construction materials, and conformance with all applicable provisions of this Title” (Section 17.16.070.F).

BACKGROUND
The 689 El Camino Real site has an approved Conditional Use Permit for Commercial Cannabis operations from 2017. The associated Regulatory Permit, which was for cultivation, manufacturing, and distribution operations for Zen Brand/Mazel Tech (now Next Wave), was approved on February 27, 2017. The Development Agreement was adopted and the Conditional Use Permit was approved on June 27, 2017. An initial Design Review Permit for full build-out of the 689, 699, and 701 El Camino Real properties was approved on September 12, 2017, and subsequently expired after the applicant did not proceed through the building permit and construction processes.

A new Design Review and Lot Merger for the first phase of a phased build-out were considered by the Planning Commission and City Council in October and November 2021. The phase 1 Design Review was approved by the City Council on November 9, 2021. The November 2021 Design Review approval allowed tenant improvements to the existing building for cultivation and distribution operations, along with a new parking lot, new landscaping, new decorative fencing and gates along the northeast and southeast property lines, and a new sidewalk along the El Camino Real frontage. A building permit for these improvements was obtained, and construction is nearing completion.

PROJECT DESCRIPTION
The project is a request for revised Design Review to include non-volatile manufacturing processes in a 503-sq ft portion of the 14,093-sq ft building on a 1.86-acre site at 689 El Camino Real (APN: 109-162-012-000). The project is proposed by Next Wave, the current property owner. No changes to the building’s exterior or site plan are proposed. The plan set remains substantially as approved in the November 2021 Design Review approval; however, a revised floor plan has been submitted to identify the areas for each of the operation, including nonvolatile manufacturing operations in a portion of the building. Revised conditions of approval reflecting the non-volatile manufacturing processes are included as Exhibit A to the draft Resolution (Attachment 1) of this staff report. The revised floor plan is included as Exhibit B to the draft Resolution.

PROJECT ANALYSIS
The request is limited to incorporation of non-volatile manufacturing uses in a ~500-sq ft area of the existing 14,093-sq ft building at 689 El Camino Real (see Figure 1). No alterations to the site plan are proposed, nor would there be any changes to the building’s exterior. As such, the project remains consistent with the General Plan and Zoning Code requirements as analyzed in the November 9, 2021 Design Review approval. The current project requires a revised Design Review for the revised floor plan and to incorporate the non-volatile manufacturing uses into the project’s conditions of approval.

Figure 1 –Location Map and Site Plan

Non-Volatile Manufacturing Component
The proposed manufacturing component involves use of an ice hash washing system, rosin press, freeze dryer, and an air compressor. These methods will ensure the only materials used in the manufacturing process will be water and ice to create a variety of products such as rosin, topicals/balms, bubble hash, pre rolls, and dried flower. The process uses non-volatile chemicals – essentially water and ice – and relies on temperature and pressure manipulation to produce the designed cannabis product. No volatile or flammable products would be used, and hence the process presents no hazards or hazardous materials. Additional information on the request to incorporate non-volatile manufacturing operations at the project site is included as Attachment 2.

Solid wastes would be separated and removed from the site by an appropriately-qualified, third party waste management company. The liquid waste stream for the manufacturing process would Phase 1 Project Site

Phase II Development
699 El Camino Real

need to be sampled and tested, and pre-treated if necessary, to the satisfaction of the Public Works Director to ensure that the liquid waste stream does not adversely impact the City’s Wastewater Treatment Plant. This requirement is incorporated as a revised condition of approval (Condition #21) in Exhibit A of Attachment 1.

PLANNING COMMISSION REVIEW
The Planning Commission considered the proposed revised Design Review on October 4, 2022, and recommended approval of the project on a 5-0 vote.

CEQA
A programmatic Mitigated Negative Declaration (MND) was prepared in 2017 for several of the original commercial cannabis developments in the City, including the original development proposed for the 689, 699, and 701 El Camino Real site. The commercial cannabis operations anticipated for the 689, 699, and 701 El Camino Real included cultivation, distribution, and manufacturing.

Given that this project is essentially a partial rebuild of that prior-reviewed and -analyzed project, the 2017 MND suffices for the environmental review, and no subsequent CEQA analysis is required. In addition, the incorporation of non-volatile manufacturing processes poses a minimal risk of upset and a much lower risk than volatile extraction methods. Similarly, nonvolatile extraction does not use or produce hazardous materials or waste. Sampling, testing, and pre-treatment of the liquid waste stream is required by the City’s Public Works Department to ensure that there are no significant impacts to the City’s wastewater treatment plant. The manufacturing processes and facilities would also need to comply with pertinent Building and Fire Code requirements.

BUDGET AND FINANCIAL IMPACT
Approval of the revised Design Review would not have an immediate budget or financial impact on the City, as the applicant is responsible for the cost recovery charges for City staff and consultant charges. The inclusion of manufacturing processes in the 689 El Camino Real facility would generate additional revenues to the City’s general fund in the form of additional cannabis business taxes. The tax rate for manufacturing operations is 5% multiplied by $1,650/square foot/year, with a cap of $100,000 imposed for operations between 1,212 sq ft and 5,000 sq ft in size. The proposed project includes approximately 503 square feet of manufacturing-related activities, resulting in annual tax revenues of approximately $41,498 per year in taxes to the City.

This would be in addition to the taxes collected for the cultivation activities on the site, which in the November 2021 Design Review approval were estimated to be $120,000/year.

RECOMMENDATION
It is recommended that the City Council approve a revised Design Review for the proposed Phase I development to allow incorporation of non-volatile manufacturing operations in a 503-sq ft portion of the existing building at 689 El Camino Real. 81 5

ALTERNATIVES

1. Deny the revised Design Review. The denial should be based on specific findings of inconsistency with State law, the General Plan, Zoning Regulations and/or other pertinent City standards.

2. Approve the revised Design Review with revisions and/or additional changes to the project’s conditions of approval.

NOW, THEREFORE, BE IT HEREBY RESOLVED, that the City Council of the City of Greenfield has considered all written and verbal evidence regarding this revised design review application at the public hearing and has made the following findings pursuant to Section 17.16.070 regarding the proposed development:

1. FINDING: That the proposed development is consistent with the objectives of the general plan, complies with applicable zoning regulations, specific plan provisions, planned unit development provisions, applicable city design guidelines, and improvement standards adopted by the City.
a. The proposed site is designated by the general plan for light industrial uses and is in the I-L, Light Industrial zoning district. Light industrial uses of the type proposed are allowed uses in these general plan and zoning code districts. 84 3
b. Chapter 5.28 of the municipal code and the land use table of Chapter 17.26 of the zoning code specify that cannabis cultivation, distribution, and manufacturing facilities are allowed uses in the I-L, Light Industrial zoning district. c. The proposal to include non-volatile cannabis manufacturing operations for an existing, permitted commercial cannabis operation would be consistent with prior Planning permit approvals for the project site.
d. The proposed project is consistent with general plan policies that call for the recruitment of businesses, industries, and other employers whose operations are consistent with long-term economic development goals of the City; the proposed project provides new jobs to further the City’s jobs to housing goals; the proposed project supports an important existing industry in the City that provides a greater diversity of the type of industrial development and employment opportunities available in the community. It will also provide a significant source of revenue to the City that will continue to enable the City to provide services and benefits to the community that are otherwise challenging to provide because of budget limitations and insufficient revenues.
e. The general plan encourages development of commercial and industrial uses that are consistent with the scale and character of surrounding land uses. The proposed project will include non-volatile manufacturing processes for the previously-approved build-out of the site. The proposed scale and intensity of the development are appropriate for a light industrial development similar to nearby industrial and commercial cannabis cultivation and manufacturing facilities. f. Continued light industrial development at this location will support the vitality of the City’s north light industrial district and further light industrial development along and adjacent to the El Camino Real light industrial corridor. g. The preliminary site plans and building drawings for the proposed project conform to the zoning code requirements and commercial development standards for the light industrial zoning district relating to minimum lot size and building coverage, building and site setback, building height, fences and walls, landscaping, lighting, parking, and signage.

2. FINDING: That the proposed architecture, site design, and landscape design are suitable for the purposes of the building and the site and will enhance the character of the neighborhood and the community.
a. The proposed architecture for the project site is consistent with the design of contemporary light industrial facilities in the industrial park overlay (IPO) zoning district.
b. The proposed design and its use of color and material is reflective of the higher attention to design required for facilities in the industrial park overlay (IPO) zoning district.
c. The site design is in conformity with the requirements of the zoning code and is an appropriate site layout for a commercial cannabis cultivation, manufacturing, and distribution facility.
85 4

3. FINDING: That the architecture, including the character, scale and quality of the design, relationship with the site and other buildings, building materials, colors, screening of exterior appurtenances, exterior lighting and signing and similar elements establishes a clear design concept and is compatible with the character of buildings on adjoining and nearby properties.
a. The proposed architectural design for the site improvements adheres to a clear design concept appropriate for light industrial facilities. b. The existing building’s appearance will be improved, and additional landscaping, new fencing, and a parking lot will improve the aesthetics of the site. c. Exterior lighting and signage will be appropriate for the type and scale of the proposed light industrial development and the signage requirements of chapter

5.28 of the municipal code.

4. FINDING: That the proposed project addresses vehicular, bicycle, and pedestrian transportation modes of circulation.
a. The proposed project continues to provide both on-site and off-site parking, for both vehicles and bicycles, and a parking program will be required that provides parking that meets the requirements of the zoning code. b. A public sidewalk was constructed to align with the future extension of the public sidewalk along El Camino Real, thereby providing safe and convenient pedestrian access from the City’s existing sidewalk system. c. Primary vehicle access is from El Camino Real.

5. FINDING: That the prior Initial Study/Mitigated Negative Declaration for the initial development of the commercial cannabis facility on the project site, adopted in June 2017, provides the requisite environmental review for the proposed site improvements for the Phase I development, such that no further CEQA review is required. Manufacturing uses were previously included in the permitted commercial cannabis operations for the site, and the proposed non-volatile manufacturing operations do not involve hazardous substances, nor do they introduce new hazards or hazardous conditions. The non-volatile manufacturing processes would comply with all applicable City and State requirements, including those of the City’s Building and Fire Codes.

NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council of the City of Greenfield approves the revised design review application in accordance with the requirements of Sections 17.16.070 of the City of Greenfield Municipal Code, subject to revised conditions of approval incorporated into Exhibit A to the City Council Resolution.

PASSED AND ADOPTED by the City Council of the City of Greenfield, at a regularly scheduled meeting held on the 25th day of October 2022, by the following vote:

Re: Additional commercial cannabis manufacturing Type-6 activities City of Greenfield Planning Department
599 El Camino Real
Greenfield, CA 93927
Planning Commission,
Next Wave, Inc. is currently licensed through the City of Greenfield for commercial cannabis activities cultivation and distribution. In additional to these current licenses, Next Wave would like to add a type-6 non-volatile manufacturing component to the license to establish a type-12 microbusiness.

It has come to our attention that the manufacturing component was not initially approved through the planning commission. This letter is being drafted to describe the manufacturing operating procedures implemented, which well have no negative environmental impacts to the current project. We are currently awaiting approval of our annual microbusiness license through the Department of Cannabis Control pending CEQA approval from the City of Greenfield for the manufacturing addition.

Addendum A on the next page contains detailed information on the type-6 non-volatile manufacturing addition for Next Wave.

Our facility build-out will be complete this month and we would greatly appreciate your time on this matter so we can begin operating as soon as possible. Thank you and please let us know if you need any additional information regarding our manufacturing component.

Kind regards.

Vyasa Pearson
97 Addendum A
Manufacturing Addition
Type-6 Non-Volatile

SCOPE OF OPERATIONS
In order to manufacture non-volatile products, applicant will utilize an ice hash washing system, rosin press, freeze dryer, and an air compressor. These methods will ensure the only materials used in the manufacturing process will be water and ice to create a variety of products such as rosin, topicals/balms, bubble hash, pre rolls, and dried flower.

Equipment
a. Ice Hash Washing System
a. Applicant will be using a Pure Pressure Bruteless Commercial ice hash washing system
b. This system is capable of washing 15,000 or more fresh frozen grams per batch, or 16 lbs or more per day and designed to scale output and increase quality. c. The system’s washing vessel is made with durable, food contact approved, sanitary, welded steel. This ensures cleaning is a breeze and enables users to keep their wash environment as clean as possible compared to plastic-based solutions. The system is built here in North America.
d. The system includes an integrated stainless steel false bottom that protects trichomes during the wash process, keeping the bags and ice 3” above the hash.

The integrated baffles in the false bottom create a turbulent-free zone at the bottom of the vessel to protect the trichomes. Both vessels come with a thick 1” cryogenic insultation steeve which helps reduce ice usage by up to 50% and is removable for easy cleaning.
e. This system comes with everything accessory operators need to produce premium bubble hash consistently. The 65 gallon Bruteless wash vessel comes with 5 strategically placed ports and virtually every wash setup related tool necessary, including hoses, water, pumps, a sigh glass, a temperature gauge, and much more.
b. Rosin Press
a. Applicant will use a Pure Pressure Longs Peak rosin press. b. This system features an 8-ton pneumatic, oil-less & maintenance-free cylinder for maximum throughput and control.
c. The premium 6061 aluminum heat plate assemblies offer independent thermocouples, 0 degrees – 300 degrees evenly distributed heat and temperature accuracy to 1 degree.
98 d. Each system comes with intuitive Pressware technology, which offers a full color LCD touch screen with custom software for unparalleled consistency and control including the ability to save up to 29 pre-set recipes. e. This system processes up to 7lbs of flower per day or 12+ lbs of sift or hash per day. This system can press 80 or more grams of dry silt or hash at one time, or 40+ grams of flower.
c. Freeze Dryer
a. The applicant will be using a Harvest Right freeze dryer, with an additional tray and more capacity than standard sized freeze dryer.
b. This system provides total control over every variable of the freeze-drying process so that we can tailor your cycles perfectly to your strain’s unique characteristics. These freeze dryers are used by some of the very best hash makers on the planet. This freeze dryer has 5 tray slots and can output between

1.8 to 2.5 lb of dry hash per cycle.
c. Scientific model Harvest Right freeze dryers freeze down to -46 degrees and other automatic drying sensors to ensure your ice water hash is completely dry before cycle completion. These models also offer full color touchscreen display with customization of up to 10 thermal treatments and 12 drying steps per cycle d. Air Compressor
a. Applicant will use a California Air Tools 4 HP Ultra Quiet Air Compressor b. It features a high-volume medium pressure pump, 20-gallon tank, and is rated to 4 horsepower, all while only producing 75 decibels of sound, which is significantly quieter than an average air compressor
c. This air compressor is 75 decibels for the vacuum cleaning and 65 decibels for conversion/laughter
d. The air compressor will be located inside the manufacturing room rather than outside to avoid any noise interference with regard to environmental impacts.

The decibel level mentioned above will not be detectable from the exterior of the building.
e. This air compressors demands virtually no maintenance due to the oil-free piston construction.

Products
a. Rosin Manufacturing
• Frozen plant material, ice, and water are added into a 65-gallon wash barrel • Raw cannabis plant material is stirred in allowing resinous trichomes to become brittle and separate from plant material
• Several different sized micron screens are then used to separate trichomes from water and plant material
• Resinous trichomes are then removed from the screens to be dried in freeze dryers
99 • Dried trichomes then called water hash or bubble hash and placed into filter bags (similar to tea bags)
• The filter bag with trichomes is then placed in a rosin press, where heat and pressure are applied to separate the “rosin” from the resin gland “trichomes” b. Topical/Balm manufacturing
• Raw cannabis plant material is added to a base oil (olive oil, coconut oil, etc.) and heated
• The oil is then separated from plant material with a filter • Next, the oil is heated, then bee’s wax and proprietary essential oils are added • The mixture is then poured into final containers to cool and harden c. Bubble Hash
• Frozen raw cannabis plant material, ice and water are added into a 65-gallon wash barrel
• The plant material is stirred in allowing resinous trichomes to become brittle and separate from plant material
• Then several various sized micron filters are used to separate trichomes from water and plant material
• The resinous trichomes are then removed from the screens and dried in freeze dryers
• The dried trichomes are now called water hash or bubble hash d. Pre Rolls
• Raw cannabis plant material is ground, then rolled or shaken into a rolling paper. • Concentrates may be placed/rolled on the exterior.
e. Dried Flower
• Dried flower is placed into containers for retail sales.

INVENTORY CONTROL
a. The location and nature of cannabis and cannabis products involved in manufacturing operations will be tracked within the premises using the METRC track and trace system. • The business will have a member of the manufacturing management team acquire the appropriate training in order to manage and track all inventory through METRC.
• Manufacturing training will cover METRC training specific to manufacturing operations as well as the method in which batches and strains are tagged and numbered, in order to eliminate any cross contamination and mislabeling of products.
100
b. Manufacturer will conduct an audit for any case in which on-hand inventory does not meet the track-and trace records.
• A designated manager will be assigned to the task of calculating all physical inventory along with all inventory which has been sold or transported in order to match the Track and Trace records.
• This will allow the manager to audit on-hand inventory to identify any potential discrepancies of inventory and find a reasonable solution for unaccounted for inventory.
• The applicant will ensure the CDPH is notified within 24 hours of any inventory discrepancies exceeding 5% by having the designated audit manager contact the CDPH by all necessary means of contact such as phone or email.

QUALITY CONTROL
The business has established a comprehensive manufacturing quality control program to ensure cannabis products are not contaminated or misbranded, which includes all of the following aspects of operations: Grounds, Building, Manufacturing Premises, Equipment & Utensils, Personnel, Cannabis Product Components and Manufacturing Processes and Procedures.
a. Processing operations must be maintained in a clean and sanitary condition including all work surfaces and equipment.
• The applicant will conduct inspections on all incoming and outgoing products and any damaged or cross-contaminated material will be subject to elimination. • Elimination shall be executed in accordance to the company’s waste management protocols.
• Proper procedures will be invoked for processing operations in order to prevent contamination.
• All employees will be subject to routine hand washing when handling cannabis. a. All working and manufacturing facilities will receive inspections and will be fitted to ensure that they are OSHA and CDPH compliant, without question. • Lab spaces will be properly ventilated with hoods and will maintain dry, sterile environments suitable for manufacturing of cannabis goods. • All goods will be stored in their designated containers and properly refrigerated per the needs of the given product/product type.
• Employees will log all activity when raw materials are pulled in and out of storage. 101
• Each log entry will be signed by the employee who recorded the entry so the source can be tracked in the case of an adverse event.
• The company will act in good faith by using the METRC system to properly maintain the track and trace of all raw materials, ensure no product is mislabeled, and provide overall product quality assurance.
• The system will be used to oversee that no contaminated products ever leave the facility and instead are disposed of per the waste management guidelines.

MANUFACTURING WASTE MANAGEMENT PLAN
a. Cannabis waste must be composted or disposed of in a manner which prevents unauthorized use and such disposal must be documented.
• Disposal should not violate any other ordinance, code section or provision of law regarding disposal of cannabis.
b. A a third party, local waste management company, Easy Cannabis Waste (www.easycannabiswaste.com) will be sourced in order to handle and dispose of the waste that is produced on site by the facility.
c. Per the EPA, cannabis waste also must be made “unusable and unrecognizable” before disposal, mixed with at least 50 percent non-cannabis waste (such as non-consumable solids), and stored in a secured waste receptacle and then hauled by a third-party waste facility.
d. The area in which waste is stored will only be available to the executive employees who deal directly with the waste management facility.
• These waste receptacles will be housed inside of a secure bind located inside the facility in a designated storage area.
• This area will be secured by multiple surveillance cameras with electronic door locks only accessible by keypad entry.
• The area will only be available to essential workers and executive employees that will deal with the waste management facility directly.
• Keypad entry codes will be exclusively shared with essential workers and executive employees responsible for managing waste.
• Waste haulers will be checked in at reception and monitored by video surveillance when invited onto the premises.

TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

GREENFIELD AUTHORIZING THE APPROVAL OF BUDGET

ALLOCATION TRANSFERS FOR THE COMMUNITY
DEVELOPMENT BLOCK GRANT (CDBG) FOR ACCOUNT 215-
501-78135.000 IN THE AMOUNT OF $170,000 AND
ACCOUNT #215-43615.00 IN THE AMOUNT OF $200,000
FROM FISCAL YEAR 2021-2022 TO CURRENT FISCAL YEAR
2022-2023

BACKGROUND
As an entitlement jurisdiction, the city receives its CDBG grant allotment directly from the County of Monterey. The City received an allotment of Community Development Block Grant (CDBG) funds from the County of Monterey in April 2022. The City of Greenfield was awarded a $200,000 grant to assist businesses impacted by the Covid - 19 pandemic. The City Council approved a contract with Angel Johnstone for consulting services to administer the grant in the amount of $30,000, as part of the $200,000 grant.

This grant will be distributed to three qualified businesses as loans, each loan ranging between $35,000 to $100,000. Once the business has completed all mandatory paperwork requirements with Angel Johnstone, the loan will become a grant. The City of Greenfield will process check payment for recipients after all paperwork is completed and approved in accordance with grant guidelines. A request for reimbursement will be submitted to the County as grant checks are being processed to business recipients.

The businesses then use these funds for equipment purchase, inventory, and working capital. In addition, the businesses must create or retain one job for loans up to $85,000 and two employment positions for loans over $85,000.
110
A budget allocation in the amount of $170,000 for Small Business Grants expense account #215-501-78135.000, and $200,000 for CDBG Grant Revenue account #215- 43615.000 was approved by the City Council for the fiscal year 2021-2022. However, no expenditure was incurred in the prior year 2021-2022 period. The City of Greenfield has received its first CDBG recipient in the current year 2022-2023 fiscal year and a check will need to be processed, but at present there is no budget allocated for the current fiscal year. Consequently, staff requests that the above noted accounts be transferred from the prior year to the current year budget. To be able to process checks for grant recipients, the budged allocation accounts, expense and revenue, need to be transferred to the current fiscal year. It is projected to process all three grants for business recipients and receive reimbursement from the County of Monterey within the current fiscal year.

CURRENT YEAR BUDGET ACCOUNT FOR
ADMINISTRATION OF THE CITY’S REGIONAL EARLY

ACTION PLANNING (REAP) GRANT

BACKGROUND
At a meeting of the City Council on June 29, 2020, the City Council directed staff to apply for money’s available through the Housing and Community Development Department’s (HCD’s) state Regional Early Action Planning (REAP) grant, administered by the Association of Monterey Bay Area Governments (AMBAG). This program availed jurisdictions to approximately $119 million for the purpose of preparing planning products. The program was developed to assist jurisdictions with implementing Regional Housing Needs Assessment (RHNA) policies and activities. AMBAG awarded the city of Greenfield $65,000 as its share of the program.

In accord with the approval, the city of Greenfield was awarded financial assistance in the form of a $65,000 grant. The HCD agreed to make the grant to provide financial assistance for preparation and adoption of planning documents, and process improvements to accelerate housing production and facilitate compliance to implement the sixth cycle of the regional housing needs assessment. The City entered into an agreement and has taken the necessary steps to implement and spend $65,000 in accord with the terms and conditions of the Agreement. Staff requests that the City Council authorize staff to create a new current year budget account to budget and account for said grant proceeds not to exceed $65,000.

CURRENT YEAR BUDGET ACCOUNT FOR
ADMINISTRATION OF THE CITY’S LOCAL EARLY

ACTION PLANNING (LEAP) GRANT

BACKGROUND
The California Department of Housing and Community Development (HCD) issued a Notice of Funding Availability (NOFA) on January 27, 2020, regarding HCD’s Local Early Action Planning Grants Program (LEAP). Like the Regional Early Action Planning program, HCD’s LEAP grants, also, reflect the state’s commitment to work in partnership with local governments to address California’s critical housing needs. Local governments are using the grant awards for the preparation and adoption of planning documents, process improvements that accelerate housing production, and to facilitate compliance in implementing the sixth cycle of the regional housing needs assessment (RHNA).

The city of Greenfield responded to said NOFA and applied for said grant resources. On February 4, 2021, HCD notified the city of Greenfield that it had been awarded this grant award in the amount of $65,000. The grant agreement executed in March 2022, provides grant funds through fiscal year 2022-2023 for approved purposes. Consequently, staff requests that the City Council authorize the creation of a current year budget account for administration of the city’s LEAP grant award of $65,000.

STAFF TO APPLY FOR GRANT MONEYS FROM THE

CALIFORNIA AUTOMATED PERMIT PROCESSING

PROGRAM

BACKGROUND
In 2021, the National Renewable Energy Laboratory launched a collaborative effort with building code officials, jurisdictions and the solar industry to help develop standardized plan review software. This software could run compliance checks and process building permit approvals for eligible rooftop solar systems. The software program also could provide the following benefits:
(1) Integrates with existing government software
(2) Automates plan review, permit approval, and project tracking (3) Standardizes up to 90% of standard system plans and (4) Provides inspection checklists and final sign-off after installation.

The program is authorized under Senate Bill 129 (Skinner, Budget Act of 2021) and offers grants to interested jurisdictions. The amount of available grant funds for Greenfield is $40,000. The grant funding is intended to help local governments in California recover the cost of establishing an automated, online solar permitting platform. In most cases, most of the funding will be used to reimburse staff or consultant time associated with implementing the software.

Following the adoption and launch of a qualifying permitting platform, the Energy Commission may request annual data relating to this program. Requested data would include the number of permits issued in a given period of time, as well as relevant characteristics of the permitted systems such as system capacity. 117
Existing law requires a jurisdiction to administratively approve applications to install solar energy systems through nondiscretionary permits and encourages cities to develop a streamlined permitting process for the installation of small residential rooftop solar energy systems. The State Energy Resources Conservation and Development Commission (Energy Commission) in the Natural Resources Agency also provides additional initiatives to administer programs for the installation of solar energy systems. A successful grant application would assist the city of Greenfield in accomplishing its objectives as pertains to solar panel installation.

AGREEMENT WITH THE UNITED WAY OF MONTEREY COUNTY
BACKGROUND:

Monterey County began the Emergency Utility and Rental Assistance Program on March 2021 partnering with United Way of Monterey County to administer a program that targets low-income residents adversely impacted by the COVID-19 crisis who are at risk of becoming homeless, these ERAP Round 1 funds were expended.

Monterey County was awarded $22,317,870 in Round Two of Emergency Rental Assistance block grant funding from both the U.S. Treasury and the State of California.

The City of Greenfield applied to be a sub-recipient (via the United Way) previously receiving $399,763 and an additional 525,000 during “Round 1” in order to better serve our city. These ERAP Round 1 funds have been completely expended since March 2022.

In Round Two of Emergency Rental Assistance block grant funding from both the U.S. Treasury and the State of California the City of Greenfield applied to be a sub recipient (via the United Way Monterey County). We were accepted by the United Way and have been awarded $1,026,000 (Account 100- 43401.000) to distribute to the community (see attached award letter).

BUDGET AND FINANCIAL IMPACT:

The Greenfield budget is attached and details the expenses that we expect to incur in providing this service ($126,000) (Account 100-105-51100 and related payroll accounts) as well as the amounts we expect to distribute to the public in assistance ($900,000) (Accounts 100-105-68201, 100-105-68202).

This action established budgeted amounts on both the revenue and expenditure side, balancing the budget by itself. All revenue provided by the grant will, by definition, be offset by expenditures in assistance or overhead expense (see budget attachment).

There is no net financial impact as all of the expenditures the City makes will be offset by revenues from the grant itself.

ASSISTANCE (LATA) GRANT IN THE AMOUNT OF UP TO
$500,000 TO COVER 100% OF PRE-DEPLOYMENT PROJECT

COSTS THAT ADVANCE THE DEPLOYMENT OF BROADBAND

INFRASTRUCTURE
BACKGROUND:

With the enactment of SB 156 in July 2021, $6 billion was allocated to the California Public Utilities Commission for broadband deployment across four program areas:
• Middle Mile ($3.25 Billion) – state owned and operated, open-access middle mile infrastructure
• Federal Funding Account (FFA)/Last Mile ($2 Billion) – formula allocations calculated on a county basis to provide last mile grant funds to the designated unserved/underserved areas (Important note: monies, while allocated on a county basis, do not flow to the counties – they are available to providers who apply for funds and commit to delivering a minimum 100/100 service to ALL unserved/underserved addresses in the area in which they applied) • Loan Loss Reserve fund ($750 Million) – available to municipalities to serve as security against financing models that attract private investment • Local Agency Technical Assistance (LATA) Fund ($50 Million) – provided to eligible local agencies (including counties) to cover 100% of pre-deployment project costs that advance the deployment of broadband infrastructure City Council Memorandum

The Local Agency Technical Assistance (LATA) Fund
The LATA program provides 100% funding to eligible applicants for identified projects that advance the deployment of broadband infrastructure. Counties (and other eligible entities – cities, utilities, co-ops, tribes, etc.) can apply for up to $500,000 to fund 100% of identified projects that are considered pre-deployment, i.e., not construction or equipment purchases.

Applications that are submitted for $500,000 or less progress through a Ministerial Review process at the staff level. The funding is provided on a reimbursement basis.

Golden State Connect Authority
Monterey County is a member of the Golden State Connect Authority (GSCA) Joint Powers Authority, which was established to support and assist our member counties with the advancement of broadband for all across rural California. GSCA represents thirty-nine member counties.

In support of this mission, GSCA is encouraging and supporting our member counties to pursue LATA funds for the advancement of broadband deployment via the development of construction-ready, low-level network designs for priority unserved and underserved areas of their jurisdictions. To streamline and enable as many GSCA member counties as possible to take advantage of the LATA funding opportunity, GSCA has structured the grant request in a manner that assures minimal impact on existing staff capacity.

LATA Application
Member counties apply for LATA funds and enter an MOU with GSCA for the management of the grant and project development. GSCA would contract with the professional network design firm for the development of individual county network designs, oversee the development of work product, manage the grant cash flow, and provide required grant reports to member counties for timely submittal and reimbursement. The advantages to GSCA member counties under this scenario include:
• GSAC will provide grant management on behalf of member counties o GSCA provides required reporting to member counties for submittal to CPUC o Member counties do not have to contract directly with professional network design firm(s). Instead, GSCA will enter contracts with professional network design firm(s) and manage individual member county projects, as LATA projects are approved by CPUC.
• Eliminates cash flow issue for member counties as 100% reimbursement occurs upon project completion. GSCA would absorb the cash flow ebbs and flows.

It is anticipated that the CPUC will review applications very quickly upon the close of each application window (monthly). Once approved, the awardee has 30 days to accept the grant. If not accepted within 30 days, it is deemed not approved and the application is removed from consideration.

The application portal opened on August 1st. The first round of applications were accepted during the month of August. It is anticipated that these funds will be exhausted quickly, perhaps during the first funding round. Time is of the essence to take advantage of the funding 137
opportunity presented by the LATA program to advance preparation for the deployment of broadband in Monterey County.

BUDGET AND FINANCIAL IMPACT:

No budgetary impact.
