17 MEMORANDUM: January 5, 2023
AGENDA DATE: January 10, 2023
TO: Mayor and City Council
FROM: José S. Sánchez, Community Science Workshop Director Jesús Pérez, Recreation Program Coordinator
TITLE: A RESOLUTION OF THE CITY OF COUNCIL OF THE

CITY OF GREENFIELD TO AUTHORIZE THE

ESTABLISHMENT OF THE POSITION OF RECREATION
DEPARTMENT – GRANTS & SPECIAL PROJECTS

ASSISTANT AND TO AFFIRM THE SALARY SCHEDULE

FOR THE POSITION

BACKGROUND
On June 8, 2021, the City Council approved a biennial (two-year) budget for fiscal years 2021- 2022 and 2022-2023. The purpose of passing a biennial budget is to better coordinate multi-year strategies and projects over a longer period of time.

Even though we have a budget in place for both this year and next, planning is an inexact practice and adjustments need to be made periodically. This is especially true for departments like the Greenfield Community Science Workshop and the Recreation Department, as these departments are continually seeking grants for new programs as well as fee-for-service contracts with local and regional organizations. These grants and contracts add to the original projected expenses and require new expense categories that were previously unforeseen when crafting the biennial budget. They also require additional staff, both in new and existing positions. City staff has identified a need to create a new position to carry out the work outlined in the Outdoor Equity Grant, a State grant awarded to the City of Greenfield in 2022.

The City of Greenfield has been awarded a grant in the amount of $698,885 from California State Parks to create and expand access to outdoor experiences for youth and families in Greenfield. The grant application was shaped by the people of Greenfield and reflected the needs and wants expressed by the community in three public input meetings. Online and in-person surveys were also conducted as part of the application process.

City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
18 Funding will allow the Greenfield Community Science Workshop (Greenfield CSW) and the Greenfield Recreation Department to become hubs for outdoor activities in local public spaces.

Local activities that will be offered to the public include bike rides and exploration of local nature areas, outdoor art classes, paid youth outdoor leadership opportunities of various types, and employment opportunities for high school and college students. The grant also provides funding for the creation of a Park Cleanup Task Force.

Funding will also be used by the Greenfield CSW to organize trips to natural areas and outdoor activities such as:
• Hiking at Pinnacles National Park
• Camping, hiking, and swimming in Arroyo Seco
• Kayaking in the Elkhorn Slough
• Whale watching in the Monterey Bay
• Summer and winter camping trips to the Sierra Nevada Mountains • Snowboarding in the Sierra Nevada Mountains
• Rafting in the South Fork of the American River
In order to execute activities and fulfill obligations outlined in the Outdoor Equity Grant proposal, we are requesting that the City Council create the position of “Recreation Department – Grants and Special Projects Assistant”. This is a grant-funded position that will allow the Recreation Department to assemble and deploy the Park Cleanup Task Force.

Salary Schedule:

Hourly Wage Range: $15.5 - $22.00
The Clean Parks Task Force will consist of a group of up to 8 high school and college students.

The group will be tasked with conducting two park cleanup events per month. The group will be responsible for recruiting, promoting, organizing, and executing the cleanup events, all under the supervision of the Greenfield Recreation Department Coordinator. Students will also be responsible for creating and promoting educational materials that will be shared via social media and in-person during outreach events at large local gatherings such as Greenfield’s Farmers Market, school events, festivals, church services, and sporting events. The group will also make presentations about the importance and impact of their work to local groups such as the Greenfield City Council, the local school board, and the Rotary Club. .

BUDGET IMPACT
The creation of the Recreation Department - Grants and Special Projects Assistant is a grant-funded position and will NOT impact the City’s General Fund. Unless new additional funding is secured, employment of individuals in this position will expire when the current funding from the Outdoor Equity Grant expires in 2026.
19 RECOMMENDATION
Staff is recommending that Council authorize the creation of the position Recreation Department – Grants and Special Projects Assistant, a grant-funded position.

TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE

CITY OF GREENFIELD ACCEPTING GRANT FUNDS

CALIFORNIA DEPARTMENT OF JUSTICE TOBACCO

GRANT PROGRAM

BACKGROUND
In 2016 the California Healthcare, Research and Prevention Tobacco Tax Act created the Tobacco Grant Program to support local law enforcement efforts to reduce the illegal sale of tobacco products to minors. For fiscal year 2022-23 grant cycle, the Greenfield Police Department was awarded $56,155 to be used from 2023 through 2025.

The Police Department's proposed use of these funds is to work with Greenfield High School students to create an educational video and flyers about the dangers of tobacco; conduct enforcement actions against businesses that sell tobacco to minors; and cite the offending businesses and sellers.

In addition, the grant states, “Applicants selected for funding must provide a resolution of the applicant’s governing body authorizing the applicant to enter into a contract with the state and authorizing the applicant to incur grant related expenses and receive reimbursements for those expenses. The resolution should expressly authorize future amendments, if any, for the purpose of increasing funding provided in the original contract, without an additional resolution from the governing body.”

BUDGET AND FINANCIAL IMPACT
There is no net financial impact, as all the expenditures the City makes will be offset by the revenues from the grant itself. The budget for the program is attached, and we expect to incur expenditures from the following accounts – Patrol Salaries 100-215-51100 and Police Services 100-215-63400. The revenues from the grant will be distributed to the same accounts. 25 2

33 AGENDA DATE: January 6, 2023
MEETING DATE: January 10, 2023
TO: Mayor and Councilmembers
PREPARED BY: City Attorney’s Office
TITLE: FILLING VACANT CITY COUNCIL SEAT
RECOMMENDATION:

That the City Council determine a process to fill the vacant Councilmember seat for the remaining two-year term and direct Staff to proceed accordingly. Staff further recommends that Council fill the vacant seat by appointment by ad hoc committee.

BACKGROUND:

The office of Mayor was considered by voters at the General Election of November 8, 2022. On November 30, 2022, the Monterey County results for the General Election were certified by the Registrar of Voters. The certified results demonstrate that Mr. Robert White, a standing Councilmember (2020-2024), would assume the office of Mayor (2022-2026). This result created a vacancy on the City Council.

Government Code section 36512(b) addresses vacancies of elected officers. Pursuant to Section 36512, a vacancy must be filled by the City Council, and can be done in the following ways: (1) appointment by the City Council within 60 days of the commencement of the vacancy; or (2) calling a special election within 60 days of the vacancy to fill the vacancy. Any person appointed or elected to fill the vacancy holds the office for the unexpired term of the councilmember whose seat is vacated.1
1 Government Code section 36512(c) also authorizes the City Council to enact an ordinance that does any of the following: (1) requires a special election whenever there is a vacancy on the City Council; (2) requires a special election when a petition bearing a specified number of signatures is filed with the City; and/or (3) provides for the appointment to fill a vacancy pending the special election. The City currently does not have such an ordinance in place. If so directed, staff could prepare such an ordinance for the City Council’s consideration. However, due to timing constraints in the drafting and passing of such an ordinance, this option may be impractical and result in significant delays to filling the vacancy.

A person appointed to the unexpired term of a city councilmember must satisfy the same residency requirements as the member who created the vacancy.
2 More specifically, the Attorney General
said that if an appointed member holds office “for the unexpired term of the former incumbent,” then it makes sense to use the former boundaries for the same unexpired term.3 Council member White held an “at-large” Council seat so his predecessor, whether elected or appointed, will also occupy an “at-large” council seat until the November 2024 election.

On December 13, 2022, the Council voted to proceed with appointment but was unable to reach consensus as to the best method to appoint a successor councilmember.

DISCUSSION:

There is no legal requirement that the Council use a particular method of appointment, however, below are four options, which the City Attorney has seen utilized in other cities, that the Council may consider:

Option 1: Invite Applications
One common approach to fill a vacancy by appointment is for the Council to notice the vacancy and invite applications. Council may interview applicants or simply discuss the candidates based on applications or letters of interest submitted, or other information known about the candidates.

All interviews, discussions, and the final appointment with respect to the new councilmember must be made in public. Appointment of a vacancy is not a permitted closed session discussion or decision.

Option 2: Appoint an Ad Hoc Committee
An ad hoc committee is a temporary committee appointed to perform a specific task. The Council may appoint an ad hoc committee of two Councilmembers who will be tasked with choosing a successor whom they will then recommend to the full Council for confirmation. The ad hoc committee will be responsible for choosing and vetting a candidate whom they believe will best serve the City of Greenfield and whom will be confirmed by at least a majority of the entire Council.

Option 3: Council Nominations
Council may consider allowing each Councilmember to make one nomination to then be voted upon by the entire Council. The Council may consider presenting their nominations and then inviting the nominees to an interview in open session to allow the entire Council and the public an opportunity to become familiar with the nominees prior to voting. Alternatively, the Council may choose to vote upon the nominations without conducting interviews. 2 97 Ops.Cal.Atty.Gen. 12 (2014); 104 Ops.Cal.Atty.Gen. 80 (2021) 3 97 Ops.Cal.Atty.Gen., (2014), pg. 16

Option 4: Call a Special Election
Despite opting to appoint the successor Council member, calling a special election remains an option. If the Council votes to call a special election, the election will be held “on the next regularly established election date not less than 114 days from the call of the special election.” Staff has been informed by the County Elections Office that the next regularly scheduled election will be held in March 2024. The Elections Office also informed Staff that the cost of the special election would be at least $41,000 and may be as high as $118,000. In addition to the cost of the special election in March 2024, the individual elected would only serve for the remainder of Councilmember White’s term (2020-2024), and the regularly scheduled election for the Councilmember seat would be held in November 2024 as scheduled.

If a special election is held, the candidates must satisfy the same residency requirements as the member who created the vacancy.4 The residency requirement for the vacated councilmember seat was “at large” so special election candidates may reside in any by-trustee district.

TIMELINE AND STAFF RECOMMENDATION:

Councilmember White assumed the office of the Mayor on December 13, 2022, which triggered the 60-day statutory deadline for the Council to fill the vacancy, which will expire on February 11, 2023. This means that the Council has approximately one month to fill the Council vacancy. Staff recommends that the Council choose the method by which they would like to fill the vacancy tonight and complete the process by choosing a successor at the next Council meeting on January 24, 2023. If the Council does not believe that two weeks is enough time to engage in the process they choose tonight, a special meeting may be scheduled sometime between January 24 and February 11, 2023.
