Anthony Elowsky, Robert Niehaus, Inc., gave a power point presentation.
Mayor White opened the public hearing at 7:39 p.m.
Carlos Ruiz Martinez stated that a few years ago, the sewer and water rates had increased and that they were told they had increased because the other cities around Greenfield were charging more. He asked that the Council should look for State or Federal grants before asking the residents. He stated that the City did not notify everyone of the increase because some residents rent their homes and the landowners pay for the utilities. He also stated that the Triqui people speak a different language and the City did not take that into account. He stated that the older population were on social security and they only get a 3.4% living adjustment but the increases were a lot more than that. He asked that the Council re-consider the increase and think about all the residents.
Kuei Villa asked how the letter was sent. City Clerk Rathbun stated that all property owners and account holders were mailed a letter 45 days prior to the public hearing. Mrs. Villa stated that she opposed the increase and submitted a protest letter. She asked that the City look for grants to pay for this and asked that more time be given to people to protest.

Bryon Roy stated that the water rates have been good; however, now he was retired and on a fixed income. He asked that the Council consider people that were on fixed incomes and those that couldn’t afford the increase.
Bertha Cornejo stated that everything in Greenfield was the same and there were no opportunities here for anyone. She stated that people don’t have the money for increases. She stated that people had to travel outside of Greenfield to work and the price of gas was very high. She stated that with the high rent and high cost of living, people on fixed incomes were having a hard time and stated that her family sometimes had to choose to pay bills or eat. She stated that the prices for everything were very expensive and this increase was adding to it.
Maria Aceves stated that she was okay with the increase; however, wanted the Council to remember that there was a lot of older people that were on social security and they might not be able to afford the increase.
Aurelio, stated that he worked in the fields and they got paid $15.50 per hour and received a $.50 increase this year but that wasn’t enough because everything was increasing such as rent, water, food, etc. He asked that the Council put more attention to the town. He also stated that there were some residents being taking advantage of at 923 Walnut and that the residents were being asked by the landlord that they needed to pay $200 to $300 per resident in cash for PG&E and water and that the City should look into this matter.
Beatriz Diaz asked that the City look into the matter that Mr. Aurelio was talking about.
Mayor White closed the public hearing at 8:12 p.m.
City Clerk Rathbun stated that there were 3 protest letters received and there were 139 signatures on the petitions submitted by Mr. Ruiz Martinez stating that they opposed the increase. DATE: July 6, 2023
AGENDA DATE: July 11, 2023
TO: City Council
PREPARED BY: Brent Slama, Housing Element Consultant
TITLE: RECEIVE UPDATE ON COMMUNITY OUTREACH AND
SURVEY RESULTS, CONSIDER DRAFT HOUSING SITE
INVENTORY, AND DISCUSS POTENTIAL NEW HOUSING
PROGRAMS FOR THE 2023-2031 HOUSING ELEMENT
UPDATE
BACKGROUND AND ANALYSIS
Under State Housing law, each City and County in California is required to prepare an up-to-date Housing Element to address the housing growth needs of the municipality and regional planning area. The Housing Element is part of – and must be consistent with – the other elements within the City’s General Plan. The State establishes that each municipality prepare for State Department of Housing and Community Development (State HCD) review and approval on an 8-year cycle.
Cities and counties in the Association of Monterey Bay Area Governments (AMBAG) regional planning area are required to submit their Cycle 6 (2023-2031) draft Housing Element updates to State HCD by December 31, 2022.
On February 14th, 2023 the City Council entered into an agreement with Brent Slama Consulting to prepare Greenfield’s 6th Cycle Housing Element Update. On April 11, 2023, the City Council and Planning Commission held a joint meeting to discuss the Housing Element and provided comments and feedback. Since that time, the City and consultant has held multiple public meetings, has attended events, reached out to organizations, and has been asking Greenfield residents about all issues related to housing.
As has been noted, the City has been the regional leader in producing housing and meeting its Regional Housing Needs Allocation (RHNA) during the previous 5th cycle, including meeting its targets for all income groups. The City Council has been taking actions to consistently ensure that Greenfield is doing its part to solve the housing crisis. 27 In order to meet the requirements of the 6th Cycle, there are three major components specific to this submittal that the City Council will need to look at in advance of adopting the Housing Element Update at the end of the 2023.
Public Participation
Per the updated requirements of State law, the City shall in the Housing Element update “describe the diligent efforts the jurisdiction made to include all economic segments of the community and/or their representatives in the development and update of the housing element.” and a “summary of the public input received and a description of how it will be considered and incorporated into the housing element.”
Since the April 11th, 2023, joint City Council/Planning Commission meeting, the City has held three public workshops, outreach meetings at the Farmers Market and the Senior Social held at Memorial Hall, and has had meetings with representatives from Centro Binacional and Center for Community Advocacy. The City has also engaged in efforts to survey the city, allowing residents to submit surveys online and in person at either City Hall or at events for the Housing Element the City has participated in. The City also conducted a housing survey among City staff to gauge housing issues from those who work in Greenfield. The response from the public has been substantial and a summary of comments received, and survey data is included as an attachment to the report.
Affirmatively Furthering Fair Housing
In the 6th Cycle, one new requirement in the Housing Element is the duty to Affirmatively Further Fair Housing. This analysis reviews various metrics to ensure that local housing decisions are made with an equity lens. and that all housing decisions are taken to ensure fair housing opportunities for all. Upon review of the analysis, while there are limiting factors separating neighborhoods within the city of Greenfield; there are significant factors between South County cities and other areas within Monterey County and the AMBAG region.
Those factors identified as part of the AFFH analysis include:
• Greenfield residents experience overcrowding above regional averages • Greenfield residents experience significant overpayment for homeowners and renters • Greenfield renters are at a high risk of displacement due to high rents • Greenfield residents lack opportunities compared to higher resource areas to the north (Salinas and the Monterey Peninsula) in transportation, environment, jobs, education, health care, retail and entertainment, etc.
• Supply is not keeping up with demand for housing units statewide As part of the requirements of the Housing Element, the City is required to address specific goals and actions to meaningfully address furthering fair housing. These recommendations include the following:
28 • Promote the construction of all types of housing for all income levels in all areas within the City that meet applicable zoning
• Establish a rental registry list
• Establish an Inspection Upon Sale Ordinance
• Dedicate staff to address housing issues within the City • Coordinate with rental advocacy groups to assist tenants in Greenfield • Seek funding for additional programs for residents (First Time Homebuyers, Rental Assistance, Housing Rehab, etc.)
• Survey the condition of existing housing stock
• Rezone to allow developments by right pursuant to Government Code section 65583.2(i) when 20 percent or more of the units are affordable to lower income households to accommodate the lower income RHNA that was previously identified in past housing elements.
Site Inventory
As has been noted previously, the City is required to ensure that zoning is sufficient to allow for 730 new housing units over the next eight years. To do this, the City must give HCD a detailed list and map of potential housing sites, and where necessary, plans to increase zoning in order to accommodate the required RHNA.
For Greenfield, 101 of these units shall be for very-low incomes, 66 low income, 184 moderate income and 379 above moderate income, or market-rate. It is important to note that the AMBAG methodology assigns more affordable housing to higher resource areas (such as the Monterey Peninsula) and more above moderate income units to lower resource jurisdictions, including all the South County cities.
In order to assure that the City can meet its site inventory needs, it is important to allow for more than the required inventory and provide a buffer in case should State HCD modify or reject housing sites and it helps with compliance with No Net Loss laws which specify that if a site is developed with fewer units than anticipated in a certain category, that the jurisdiction ensure there are always sufficient sites available to meet RHNA. The first draft of the Site Inventory includes 1,240 proposed units.
Things to note with the Site Inventory are:
• Special by-right rules apply to projects on sites identified that have been previously identified in past housing elements
• Distribution of sites throughout the jurisdiction and must be in line with Affirmatively Furthering Fair Housing
• Some sites are in various stages of development
• Focus on vacant lots or large lots with high development potential • Does not include all approved sites
• Does not include new annexations to Greenfield
• Does not require any upzoning in Greenfield
• No commercial/retail buildings proposed for conversion or demolition • Some rezoning required for mixed use sites or for by-right locations • Does not consider new Accessory Dwelling Units
29 Upon review of these items and after receiving any necessary direction, the City will soon be releasing a public review draft for 30 days on the City website and at City Hall. Based on comments received, the City will respond to those comments prior to submitting the draft Housing Element to State HCD for its first review.
RECOMMENDATION
It is recommended that the City Council accept the report from Brent Slama Consulting regarding public outreach, goals and actions specifically related to fair housing, and review the proposed site inventory list and provide necessary direction prior to distributing the Housing Element for a required 30-day public review.

BACKGROUND
EAH Housing, the developer of the Greenfield Commons multi-family residential housing project at 41206 Walnut Avenue has requested use of tax exempt bonds for the financing of the first phase of the project. As such, under the Tax and Equity Fiscal Responsibility Act (“TEFRA”), the local municipality must hold a public hearing and approve the financing of the project by the California Municipal Finance Authority (the “CMFA”), a joint exercise of powers authority and public entity of the State of California.
Issuance of the TEFRA bonds by the CMFA is for the benefit of Greenfield Commons EAH, L.P. (the “Borrower”) a partnership of which EAH Housing (the “Developer”) or a related person to the Developer is the general partner, to provide for the financing of the Project. The adoption of a resolution approving the issuance of the requested bonds is solely for the purposes of satisfying the requirements of TEFRA, the Internal Revenue Code of 1986, and the California Government Code Section 6500 (and following).

65 SUMMARY
Greenfield Commons EAH, L.P. is requesting up to $80,000,000 in TEFRA bonds financing for Phase I of the Greenfield Commons project, which was approved by the City in March 2021, and for which building permits are pending. The proceeds of the Bonds will be used to finance or refinance the acquisition, construction, improvement and equipping of the approved multi-family rental housing project.
CMFA Information
The CMFA was created on January 1, 2004 pursuant to a joint exercise of powers agreement to promote economic, cultural and community development, through the financing of economic development and charitable activities throughout California. To date, over 350 municipalities, including Greenfield, have become members of CMFA.
The CMFA was formed to assist local governments, non-profit organizations and businesses with the issuance of taxable and tax-exempt bonds aimed at improving the standard of living in California. The CMFA’s representatives and its Board of Directors have considerable experience in bond financing.
There are no costs associated with membership in the CMFA, and the City will in no way become exposed to any financial liability by reason of its membership in the CMFA. In addition, participation by the City in the CMFA will not impact the City’s appropriations limits and will not constitute any type of indebtedness by the City. Outside of holding the TEFRA hearing, adopting the required resolution and executing the Joint Exercise of Powers Agreement of the CMFA, no other participation or activity of the City or the City Council with respect to the issuance of the Bonds will be required.
CEQA REVIEW
The approval of use of these TEFRA bonds is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3), the common-sense exemption that CEQA only applies to projects which have the potential for causing a significant effect on the environment.
FISCAL IMPACT
The Bonds to be issued by the CMFA for the Project will be the sole responsibility of the Borrower, and the City will have no financial, legal, moral obligation, liability or responsibility for the Project or the repayment of the Bonds for the financing of the Project. All financing documents with respect to the issuance of the Bonds will contain clear disclaimers that the Bonds are not obligations of the City or the State of California; rather, they are to be paid for solely from funds provided by the Borrower.
66 RECOMMENDATION
Staff recommends that the City conduct the TEFRA Hearing and adopt the associated resolution in favor of the issuance of the Bonds by the CMFA.

TITLE: INTRODUCTION AND FIRST READING OF AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF GREENFIELD
ADOPTING AN ORDINANCE ADOPTING A COST RECOVERY
POLICY
RECOMMENDATION:
That the City of Greenfield (“City”) City Council adopt an ordinance adopting a cost recovery policy for nuisance abatement (“Cost Recovery Ordinance”.) BACKGROUND AND DISCUSSION:
The adoption of City Municipal Code Chapter 9.80 will allow the City to recover the costs associated with abating public nuisances. In general, a nuisance is “[a]nything which is injurious to health…or is indecent or offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property.1 ” A public nuisance is one
that “affects at the same time an entire community or neighborhood, or any considerable number of persons.2” Examples of public nuisances include substandard buildings and building code violations and conditions on property amounting to a fire hazard, such as excessive weeds. More specifically, this Cost Recovery Ordinance defines a public nuisance as any violation of the City municipal code.
The City has the authority to protect the health, safety and welfare of the community, including the ability to protect and enhance the natural environment and the City wishes to encourage the maintenance of well-kept properties and recognizes that property values and the general welfare of the community are founded in large part on the appearance, maintenance, and safety of 1 Civil Code, § 3479
2 Civil Code, § 3480; Penal Code, § 370

properties. The existence of property in a condition constituting a public nuisance is injurious to the public health, safety and welfare of the residents of the City and such conditions contributes substantially and increasingly to the necessity for excessive City expenditure for protection against hazards, diminution of property values, and the preservation of the public health and safety.
Under California law, local governments have standing to intercede and to abate a public nuisance because the existence of public nuisances of the type designated and the abatement of them, is reasonably related to the proper exercise of the police power in protecting the health, safety and welfare of the public, and the exercise of that power by the City is authorized by the constitution of the state and applicable laws. Unless uniform and expedient corrective measures are available to be undertaken to alleviate such conditions, the public health, safety and general welfare and the property values and social and economic standards of this community will be substantially depreciated. The abatement of such conditions will enhance the appearance and value of such properties and will improve the tax base of the City. It is in the public interest to establish a cost recovery procedure so that the abatement of a public nuisance is at the expense of the person(s) creating, causing, committing, or maintaining the nuisance.
Cities may provide by ordinance for the abatement of any nuisance at the expense of the persons creating or maintaining the nuisance. City Councils may establish an ordinance for the recovery of abatement and related administrative costs by a nuisance abatement lien or by a special assessment. Without this Cost Recovery Ordinance, the City may only seek cost recovery through invoicing and collections which are not the most effective method of cost recovery.
It should be noted that, City staff pursues every avenue to obtain voluntary compliance to abate public nuisances prior to escalating enforcement actions.
REASON FOR RECOMMENDATION:
Chapter 9.80 provides staff additional tools, enforcement options, and the authority to recover the cost of abating public nuisances. The City Attorney and staff believe these enhanced regulations will provide greater tools to deal with code enforcement issues, enhance the City’s ability to deal with current cases, and strengthen the City’s enforcement actions in the future.

9.80.010 Findings and purpose.
The City Council finds that substantial public resources are spent each year to enforce the Municipal Code and State laws, as well as Federal and County laws that may fall within the jurisdiction of the City, which are enacted to protect the public health, safety and welfare. 72 2
The City Council finds that the responsibility of these costs should be properly placed on those persons responsible for violating the Municipal Code or federal, state and county laws and/or causing public nuisances. The City Council further finds that the recovery of costs incurred by the City to enforce these laws and to collect penalties issued to those persons causing public nuisances and/or violating these laws is important in deterring future violations and maintaining the integrity of the City’s code enforcement system. The purpose of this article is to provide a means for the City of Greenfield under its police power authority and other applicable law to recover these costs and penalties from those persons responsible for creating, causing, committing or maintaining a public nuisance or Municipal Code or other law violation.
9.80.020 Definitions.
Unless the particular provision or the context otherwise requires, the definitions and provisions contained in this section shall govern the construction, meaning, and application of words and phrases used in this article.
(a) “Abatement costs” are the actual and reasonable costs incurred by the City to abate a public nuisance. These costs include all direct and indirect costs to the City that result from the total abatement action, including, but not limited to, investigation costs, costs to enforce the Municipal Code and any applicable federal, state or county law, clerical and administrative costs, costs incurred to provide notices and prepare for and conduct administrative appeal hearings, and costs to conduct actual abatement of the nuisance. Costs include staff costs, administrative overhead, costs for equipment, such as cameras and vehicles, staff time to hire a contractor, and reasonable attorneys’ fees incurred by the City. Costs also include those incurred in seeking cost recovery. Abatement costs may be established in the Master Fee Schedule.
At any administrative hearing, judicial action or special proceeding where the City elects to recover attorneys’ fees in connection with an abatement action, the prevailing party shall be awarded attorneys’ fees not to exceed the amount of reasonable attorneys’ fees incurred in the action, hearing or proceeding.
(b) A “Bona fide encumbrancer” is a person who: (i) receives a lien or encumbrance on the subject property after the City incurs abatement costs or enforcement costs; and (ii) at the time he or she acquired the interest did not have actual or constructive knowledge of the City’s interest in the property.
(c) A “Bona fide purchaser” is a person who: (i) purchases any portion of the subject property after the City incurs abatement costs or enforcement costs; and (ii) at the time he or she acquired their portion of the subject property did not have actual or constructive knowledge of the City’s interest in the property.

If there is more than one responsible party, each responsible party shall be jointly and severally liable for the costs. Costs incurred by the City are recoverable even if a public nuisance, Municipal Code, or other law violation is corrected by the property owner or other responsible party. (b) Applicability. This article shall govern the procedures used to recover all abatement and enforcement costs incurred by the City in the abatement of a public nuisance or Municipal Code violation and/or the enforcement of the Municipal Code or other law pursuant to the procedures and authority found in the Municipal Code. The administrative review shall be an informal proceeding where the enforcement department and requesting party may present any evidence they deem pertinent to the amount of the costs. The scope of review shall be limited to the amount of the costs unless there has been no opportunity for a hearing on the underlying violation. (c) City Manager’s decision. The City Manager may affirm or reduce the costs if the City Manager determines that they are not supported by the evidence or upon a showing that the costs were unnecessary or unreasonable. The City Manager will not pass upon the validity of the underlying enforcement action or the amount of any penalties unless there has been no opportunity for a hearing of the underlying action. The City Manager’s decision shall be memorialized in writing. The City Manager may, with the approval of the Finance Director or their designee, approve a payment plan for the costs.

There is no right to administrative review to confirm costs under this section if they have been previously upheld in an abatement or other administrative hearing held under chapter 25 of title 1.
9.80.060 Recovery of penalties.
Administrative penalties unpaid after the required time set forth in the Municipal Code, or within fifteen (15) days from the final decision after an appeal, may be collected in the manner set forth in this article except the City is not required to send an invoice under Section 9.80.040. Interest shall accrue at a rate of ten percent (10%) per year on unpaid penalties until paid. (f) Form of Notice of Special Assessment and Lien. The Notice of Special Assessment and Lien for recordation shall be in the form substantially as follows:

(i) The City of Greenfield Police, Fire, Community Development, and Public Works Departments provide normal services to residents and business owners of the City, which are funded through taxes collected by the City and paid principally from the City’s general fund or user fees.
(ii) The Departments are frequently called upon to provide services that exceed what is normally provided by the Departments, or otherwise covered by user fees. (iii) Extraordinary services arise when the Departments are called upon to respond to the same or similar incidents on multiple occasions, and those services are not covered by a user fee.
(iv) Residents and business owners abuse the services of the Departments when the Departments are forced to repeatedly respond to the same or similar incidents. (v) These extraordinary services are in excess of what the Greenfield taxpayers expect and are prepared to pay for.
(b) Purpose. The purpose of this article is to provide a mechanism for the recovery of the costs for providing extraordinary Department services that are not otherwise covered by user fees.
This article is enacted pursuant to the authority of article XI, section 7 of the California Constitution, California Government Code section 36901, and pursuant to the general police powers of the City.
9.80.220 Definitions.
(a) “Department” means the City of Greenfield Police Department, Fire Department, Planning and Development Services Department, or Public Works Department. 79 9
(b) “Response costs” are all actual and reasonable costs incurred by the Departments in responding to a nuisance, including, but not limited to, costs of personnel, including salaries and benefits, administrative overhead, costs of equipment and materials used in the response, and costs related to investigation of the underlying call for service. Response costs do not include costs covered by a user fee.
9.80.230 Multiple responses to nuisances.
(a) Applicable nuisances. If a Department is required to respond to a nuisance as defined in title 9 more than once in any one hundred twenty (120) day period, including a second response during the same day or night as the first response, and the response requires intervention by the Department to protect the public health, safety or welfare, the persons set forth in subsection (b) of this section shall be jointly and severally liable for the response costs, regardless of whether the City issues an administrative citation or initiates a code enforcement action. The multiple response shall apply to the same or similar nuisances occurring during the applicable time period.
(b) Persons liable.
(i) The person or persons who own the premises where the nuisance took place if any of the following are the case: (1) the owner resides on or adjacent to the premises; (2) the owner was present when the Notice described in subsection (f) of this section was first posted; or (3) the Notice described in subsection (f) of this section was mailed to the owner and fourteen (14) days have elapsed since the date of mailing. For purposes of this subsection, where a nuisance takes place within the confines of a single unit in a building owned by a housing cooperative, the owner of the property shall be deemed to be the owner of the single unit and not the members of the housing cooperative in general. Where the gathering took place in the common area of a building owned by a housing cooperative, only the members of the cooperative owning units in the building where the gathering took place shall be deemed the owners of the property for purposes of this subsection. Other members of the housing cooperative may still be liable if they fall within the categories of person made liable by this subsection.
(ii) The person or persons residing on or otherwise in control of the property where the nuisance took place.
(iii) The person or persons who organized or sponsored the activity or event causing the nuisance.
(iv) All persons who engaged in any activity resulting in the public nuisance. (c) Exception for uninvited guests. Nothing in this section shall be construed to impose liability on the resident or owners of the premises or sponsor of the activity or event causing the nuisance, for the conduct of persons who are present without the express or implied consent of the resident or sponsor, as long as the resident and sponsor have taken all steps reasonably necessary to exclude such uninvited participants from the premises. Where an invited guest engages in conduct which the sponsor or resident could not reasonably foresee and the conduct is an isolated instance of a guest at the activity or event violating the law which the sponsor is unable to reasonably control without the intervention of the police, the unlawful conduct of the individual guest shall not be attributable to the sponsor, owner, or resident for the purposes of determining whether the activity or event constitutes a public nuisance under this section. 80 10
(d) Exceptions for same day responses.
(i) There shall be no liability under this article for a subsequent response during the same day or night as the prior response, unless a reasonable time has been provided to abate the public nuisance, taking into account the size of the activity or event causing the nuisance, the time of day, and other relevant factors.
(ii) There shall be no liability under this article for a subsequent response during the same day or night as the first response when a person who would otherwise be liable under subsection (b) of this section seeks assistance from the Department to abate the public nuisance, and the person cooperates fully with Department personnel while taking reasonable action to abate the public nuisance.
(e) Billing and collection. The provisions of article 1 of this chapter shall apply to the billing and collection of the City’s costs.
(f) Notice.
(i) When a Department responds to an activity or event which constitutes a public nuisance subject to this article, the Department shall post the premises where the nuisance occurred and provide a copy to persons liable for response costs who are present during the response, describing the nuisance and applicable Code section, the date and time of the Department response, and that any subsequent or second response with respect to the same or similar nuisance within one hundred twenty (120) days of the first response, including a second response that same day or night, shall result in the joint and several liability of the following persons for the Department’s cost of responding to the nuisance: any guests causing the public nuisance; persons who are residents or in control of the property at which the public nuisance occurred; persons who sponsored the activity or event constituting the public nuisance; and owners of the premises.
(ii) The residents and persons in control of such property, and the sponsors of the activity or event, shall be responsible for ensuring that such notice is not removed or defaced and shall be liable for a civil penalty not to exceed one thousand dollars ($1,000.00) in addition to any other penalties and costs which may be due under this article, if such notice is removed or defaced; provided, however, that the residents of the premises or sponsor of the event, if present, shall be consulted as to the location in which such notice is posted in order to achieve both the security of the notice and its prominent display. The notice shall remain posted for the entire one hundred twenty (120) day period and unless the premises are reposted, shall not be removed until one hundred twenty (120) consecutive days have elapsed without a call for service.
(iii) The Notice shall also be mailed to any property owner at the address shown on the City’s property tax assessment records. Where known, a copy may also be provided by email.
(iv) The Notice shall be in substantially the following form:
