34 A Proclamation of the City of Greenfield Proclaiming Building Safety Month — May 2024
Whereas our city is committed to recognizing that our growth and strength depends on the safety and essential role our homes, buildings and infrastructure play, both in everyday life and when disasters strike, and; Whereas our confidence in the resilience of these buildings that make up our community is achieved through the devotion of vigilant guardians–– building safety and fire prevention officials, building officials, building inspectors, permit technicians, architects, engineers, builders, tradespeople, design professionals, laborers, plumbers and other building professionals––who work year-round to ensure the safe construction of buildings, and; Whereas these guardians are dedicated members of the International Code Council, a nonprofit that brings together local, state, territorial, tribal and federal officials who are experts in the built environment to create and implement the highest-quality codes to protect us in the buildings where we live, worship, learn, work and play, and;
Whereas these modern building codes include safeguards to protect the public from hazards such as hurricanes, snowstorms, tornadoes, wildland fires, floods and earthquakes, and;
Whereas Building Safety Month is sponsored by the International Code Council to remind the public about the critical role of our communities’ largely unknown protectors of public safety––our local code officials––who assure us of safe, sustainable and affordable buildings that are essential to our prosperity, and;
Whereas “Mission Possible,” the theme for Building Safety Month 2024, encourages us all to raise awareness about building safety on a personal, local and global scale, and;
Whereas each year, in observance of Building Safety Month, people all over the world are asked to consider the commitment to improve building safety, resilience and economic investment at home and in the community, and to acknowledge the essential service provided to all of us by local and state building departments, fire prevention bureaus and federal agencies in protecting lives and property.
NOW, THEREFORE, I, Robert White, Mayor of the City of Greenfield, do hereby proclaim the month of May 2024 as Building Safety Month. Accordingly, I encourage our citizens to join us as we participate in Building Safety Month activities. ______________________________________________

This is a more effective approach than repeatedly arresting individuals for, in effect, living in public.
The cleanups are also in response to community members who had negative interactions with homeless persons and their erratic behavior.

TITLE: Housing Element Annual Progress Report (2023)
BACKGROUND
California Government Code Section 65400 mandates that cities and counties submit an annual report on the status of their Housing Element and any progress in its implementation to the California Department of Housing and Community Development (HCD). This Annual Progress Report (APR) fulfills statutory requirements to report certain housing information, including: the local agency’s progress in meeting its share of Regional Housing Needs Allocation (RHNA), certain rezoning activities, actions taken towards completion of Housing Element programs, and local efforts to remove governmental constraints to the development of housing.
APRs must be presented to the local legislative body for review and acceptance, then filed with HCD. The APR should be filed by April 1 of each year, and as such, City staff have submitted the report to HCD. However, should any changes be directed by the City Council, a revised report can be filed. The APR reports numbers of units planned and completed in the previous calendar year. Housing units issued building permits are counted toward the City’s RHNA objective for the current Housing Element Cycle. The City’s 5th Housing Element Cycle runs from December 2015 through December 2023.

62 This year’s APR reports on the housing production for Calendar Year 2023, which is the last year of the 5th Housing Element Cycle. The city has remained current in its APR reporting requirements since 2019, following years of noncompliance.
SUMMARY
For the 2023 calendar year, the City issued building permits for 28 very-low-income units (Greenfield Commons), 72 low-income units (Greenfield Commons), and 28- moderate income units (ADUs and SFH) for a total of 128 building permits. This APR marks the final report for the 5th Regional Housing Needs Allocation (RHNA) cycle (2015-2023). In these eight years, the city exceeded its RHNA allocation in all income categories, with 363 new units required and 746 units permitted, as seen in Table I.

The City’s progress on the 5th Cycle Housing Element was reported to HCD on April 1st, 2024. The main housing production summary table is Table B, which is included as Attachment 1 to this staff report. The full 2023 APR can be accessed on the Community Development Department’s webpage at the following link:
https://ci.greenfield.ca.us/166/Community-Development .
Next year, the city will begin reporting for the 6th RHNA cycle (2023-2031). For this cycle, the City has been tasked with planning for a total of 730 new housing units. This includes 101 units for very low-income households, 66 units for low-income households, 184 units for moderate-income households, and 379 units for above-moderate income households.
The City’s new Housing Element (document) will create the framework for the future of housing development in Greenfield from 2023-2031 and is currently being prepared by Housing Element consultant Brent Slama. The second draft of the Housing Element is posted on the city website and will be passed back to HCD following a public review period.

FROM: Jamie Tugel, Public Works Director
TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GREENFIELD TO
APPROVE A NEW FULL TIME EMPLOYMENT POSITION OF UTILITY SYSTEM
OPERATOR (USO) FOR THE WASTEWATER DIVISION AND MAKE A
SUPPLEMENTAL APPROPRIATION OF $9,000 TO THE 2023/2024 FISCAL
YEAR BUDGET TO FUND THE USO POSITION
BACKGROUND:
The Public Works Department, Wastewater Division, is in dire need of a Utility System Operator (USO) FTE to be added to the Wastewater Division.
The Wastewater Division currently has 4 FTE positions:
2 Utility System Shift Operator’s; 1 of which is vacant, application opportunity closed April 30 1 Utility System Operator
1 Maintenance Worker; staffed commencing May 7th
This request is to add 1 FTE Utility System Operator immediately to assist in keeping the WWTP functioning to the City’s best abilities possible in preparation for the New MBR Treatment Plant when constructed. This position is crucial as the Wastewater Division is currently being supplemented by the Water Division staff daily, which in turn provides for a deficit of staffing in the Water Division.
If approved, the new USO FTE position recruitment would take place immediately and have a short application window to expedite the hiring process, given applicants meet the minimum qualifications of the job description.
BUDGET AND FINANCIAL IMPACT:
If approved, the $9,000 supplemental appropriation would accommodate wages, uniforms, safety gear, and benefits for the remainder of the fiscal year. This amount would be from the Sewer Enterprise Fund.

MEETING DATE: May 14, 2024
TO: Mayor and Councilmembers
PREPARED BY: City Attorney’s Office
TITLE: DISCUSS AND PROVIDE DIRECTION REGARDING CITY
COUNCIL SOCIAL MEDIA AND MEDIA/PRESS POLICIES TO
AMEND THE CITY COUNCIL CODE OF CONDUCT
RECOMMENDATION:
Discuss and provide direction related to integrating social media usage and media/press policies into the City Council Code of Conduct.
BACKGROUND:
At the April 4, 2024, City Council study session regarding amendments to the City Council Rules and Protocols and Code of Conduct, Councilmembers stated a preference to add rules regarding social media usage and media/press interaction. The City Council directed the City Attorney to research social media and media/press policies for Councilmembers at other cities.
DISCUSSION:
Social Media Policies
Social media policies for Councilmembers predominantly focus on ensuring that Councilmember social media usage does not violate the Brown Act or the First Amendment of the United States Constitution.
The Brown Act
These policies focus on preventing serial meetings or other types of prohibited conduct under the Brown Act. City Councils address this issue in one of two manners. Some City Councils prohibit Councilmembers from interacting with official social media sites in all manners including comments, “likes,” “shares,” “retweets”, et cetera. Other City Councils allow City Council Memorandum
599 El Camino Real Greenfield CA 93937 831-674-5591
www.ci.greenfield.ca.us
69 2
Councilmembers to interact with official social media sites but limit the interactions to prevent serial meetings or other violations. Typically, in these policies, only one Councilmember can interact with a post or topic on an official social media site. Additionally, Councilmembers are prohibited from interacting with other Councilmembers in any manner on official social media sites. For example, if Councilmember A “likes” a post then Councilmember B cannot like or interact with the post or Councilmember A’s response. The Brown Act prohibits members of a legislative body from directly responding to any communications on a social media site made by another member of the body if the matter is within the legislative body’s jurisdiction.
Additionally, the Brown Act prohibits the majority of members of a legislative body from using social media to “discuss among themselves” matters within the legislative body’s jurisdiction. (Gov. Code, § 54952.2, subd. (b)(3)(A).) The Brown Act defines “discuss among themselves” to include communications made, posted, or shared on social media including the use of comments and digital icons used to express reactions. (Gov. Code, § 54952.2, subd. (b)(3)(B)(i).) The First Amendment
In March 2024, the United States Supreme Court established a test for determining whether an official or government employee’s actions on social media constituted a government action or a personal action. This is an important distinction because if an official’s social media use constitutes a government action, any attempt to quiet speech on their social media platform may constitute a violation of the speaker’s First Amendment right to free speech.
An official’s actions constitute a government action if the official possessed actual authority to speak on the government’s behalf and the official purported to exercise that authority when he or she spoke on social media. The Court stated that the analysis is fact- and action-specific. For example, deleting a person’s comments from a specific post would focus the analysis on that post. However, blocking a person would focus the analysis on the entire site. Under the Supreme Court’s analysis, on a site with a clear disclaimer that the site was the official’s personal site and all content expressed the official’s personal opinion, there would be no government action and therefore no First Amendment violation. However, on mixed-use sites (i.e. both personal and official content exist on the site) the analysis is more nuanced. First, the official must have the actual authority to speak on the government’s behalf. This authority must be based on law or an established custom, not a general job description. The Supreme Court’s example of established custom was a City Manager position where multiple City Managers had spoken in an official capacity on specific matters over time. Even if the official has the authority to speak officially, the official’s actions are only government action if the official purports to be speaking in an official capacity. For example, a mayor who posts a new ordinance only on his or her personal site is likely purporting to exercise his or her official authority. In contrast, a Mayor who repeats or shares publicly available information is likely expressing a personal opinion. (Lindke v. Freed (2024) 601 U.S. 187.)
Recommendation
In light of the Supreme Court decision, the City Attorney recommends that the City Council consider establishing social media policies to reduce the risk of liability to Councilmembers for potential First Amendment and Brown Act violations. As a general best practice, Councilmembers should establish separate personal and official Councilmember sites and clearly denote on each site which is which. Additionally, Councilmembers should include a disclaimer 70 3
on their personal social media site and in any posts related to the City establishing that the opinions expressed are the Councilmember’s personal opinion and do not express official City positions. Similarly, Councilmembers should consider including a link to the City’s official social media post in their post instead of posting the information directly. These actions will help a Councilmember establish that their speech was not a government action if a First Amendment violation is alleged.
In addition, the City Attorney recommends the City Council consider establishing a policy prohibiting Councilmembers from commenting upon, liking, sharing, or otherwise engaging with one another’s social media posts and/or pages.
Implementing these two recommendations will ensure that the City Council Code of Conduct and Rules and Protocols are in compliance with state and constitutional law.
Media/Press Policies
Most cities orient their media/press policies toward managing the city’s brand and ensuring consistent responses across councilmembers and staff. As a result, cities with media/press policies tend to designate individuals for media/press contact. Depending on the size of the city, one person, a department, or department designees are designated to interact with the media/press. This includes both scheduling and messaging. Cities that designate one individual as the media/press contact tend to designate either a Public Information Officer or City Manager.
Additionally, some cities designate a location within a city building for all councilmember interviews or photo sessions.
That being said, councilmembers do not lose their right to speak freely to the press when they are elected. This means that City Councils likely cannot prohibit councilmembers from speaking to the press. For this reason, some City Councils require councilmembers to clearly indicate to the media/press that they are representing themselves as individuals and not representing the City or City Council in an interview or statement.
