TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

GREENFEILD ADOPTING THE FINAL SALINAS VALLEY SAFE

ROUTES TO SCHOOL PLAN PREPARED BY THE

TRANSPORTATION AGENCY OF MONTEREY COUNTY
(TAMC)
BACKGROUND:

The Transportation Agency for Monterey County, Monterey County Health Department, Ecology Action, and the cities of Gonzales, Soledad, Greenfield, and King City have partnered to develop the Salinas Valley Safe Routes to School Plan ("Plan"). The three-year planning process identified barriers to safe access to 22 public schools in South Monterey County cities and recommended infrastructure and non-infrastructure improvements.

The Salinas Valley Safe Routes to Schools Plan identifies barriers to safe, convenient transportation and will guide future improvements around 22 public schools in five school districts. Recommendations included in the Plan are designed to help address school-based traffic congestion and improve student health by fostering increased biking, walking, and carpooling. The project team, comprised of staff from the Transportation Agency, County Health Department, Public Works staff from the four cities, School Districts, and non-profit Ecology Action, have engaged administrators, parents, and students in school bike/walk assessments, mapping activities, street demonstrations, and surveys.

The Salinas Valley Safe Routes to School Plan kicked off in spring 2022 with outreach in the City of Greenfield. The planning team conducted walking audits at each of the six public schools in Greenfield, gave 10 presentations at parent meetings, and received 540 responses to an online parent survey. In fall 2022, the planning team drafted and received community input on a list of infrastructure and non-infrastructure recommendations around the Greenfield schools. Starting with Greenfield in fall 2022, the planning team planned and implemented four pilot projects, one in each city, to demonstrate some of the recommendations included in the plan and get community feedback. The Greenfield pilot projects was held on 12th Street. The planning team City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
59 also formed Steering Committees in each of the four cities. Steering Committees led a democratic process, called Participatory Budgeting, where community members vote to decide how public funds are spent. TAMC is providing up to $250,000 to each city to implement the highest voted projects.

REVIEW AND ANALYSIS
TAMC staff provided a presentation on the draft plan on November 12th, 2024 and are now requesting adoption of the final Salinas Valley Safe Routes to School Plan, including infrastructure recommendations to improve access to the six public schools in Greenfield. The Executive Summary is included as an attachment to this report, and the full Plan for Greenfield is linked below. Once the Plan has been adopted, the Cities of Gonzales, Soledad, Greenfield, and King City and TAMC staff will pursue funding to implement recommendations in the Plan.

The Plan includes Citywide recommendations for bicycle and pedestrian corridor improvements, as well as recommendations around each school site and non-infrastructure recommendations for education and encouragement programs. All recommendations are planning-level and require further analysis prior to construction.

The projects in this plan will be implemented over time as funding becomes available. With limited funding, the City of Greenfield must decide how to prioritize the recommendations. The Plan identifies a list of eight high-priority corridors that were evaluated based on common grant criteria.

These corridors were scored to help City staff and decision-makers prioritize projects and identify the most competitive projects for various grant opportunities. Grant programs often prioritize large-scale, corridor-wide improvements, and future grant applications are likely to focus on improvements to one or more streets in Greenfield rather than individual projects.

Some projects that are low cost and have community support can be incorporated into the City’s maintenance programs and installed as part of ongoing road maintenance. City staff will review the Safe Routes to Schools Plan project list when planning maintenance projects to look for ways to incorporate bike and pedestrian improvements. This allows for a highly cost-effective strategy for implementing the projects included in this plan. For larger projects, leveraging local funds with additional grant funding will be critical. Having an approved Safe Routes to Schools Plan in place is a strategy to make Salinas Valley cities more competitive in future grant applications for construction funding.

FINANCIAL CONSIDERATIONS:

TAMC secured grant funding to develop the Plan through Caltrans’ Sustainable Transportation Planning grant program and provided Measure X Safe Routes to School Program matching funds.

Greenfield City staff have contributed staff time to develop the plan.

TITLE: DISCUSS AND PROVIDE DIRECTION TO STAFF REGARDING

ADVISORY BODY MEMBER APPOINTMENT PROCESS

BACKGROUND
At the December 14, 2024, City if Greenfield (“City”) Council meeting, the City Council considered reappointment of a Planning Commissioner whose term ended but who was interested in continuing to serve. As a part of the discussion, the City Council expressed interest in discussing the process by which Planning Commissioners are appointed. In particular, the City Council expressed interest in ensuring that the appointment process is fair and transparent, while also retaining the knowledge gained by long-term Planning Commissioners. This report provides background information regarding appointments to both the Planning Commission and the Parks and Recreation Committee.

The City currently has two (2) active advisory bodies: (1) the Planning Commission; and (2) the Parks and Recreation Committee. Every city is required to have a planning agency but in the absence of a separate planning agency, the City Council serves as the planning agency. (Gov.

Code, § 65100.) The Planning Commission serves as the City’s planning agency and is responsible for, among other things, “exercise[ing] such functions with respect to land divisions, planning, and zoning as may be described by City Ordinance” and “[t]he functions, powers and duties…set forth in sections 65101, 65102 and 65103 of the Government Code of the State of California.” (Planning Commission Bylaws D1; GMC, § 2.20.020.) The Parks and Recreation Committee is not a required advisory body but was formed by the City to “review parks and City Council Memorandum

recreation facilities within the City and to provide recommendations to the City Council.” (Parks & Recreation Committee Bylaws C.1.) The City Council is responsible for appointing Planning Commissioners and Parks and Recreation Committee members.

The City Municipal Code sets forth the process to appoint and reappoint Planning Commissioners as follows:
“There shall be a planning commission consisting of five (5) members who shall be appointed by majority vote of the city council. Said appointments shall be made as follows: …

2. Appointments shall be for a term of three (3) years, except that an appointment to fill a vacancy shall be for the remainder of the term of the office in which such vacancy occurs.

3. There shall be no limit on the number of terms that a planning commissioner may serve; however, upon completion of each three (3) year term, planning commissioners shall prepare a written request to the city council to be considered for an additional term.” (GMC, § 2.20.010 A.)
“Membership and Term: …People interested in becoming commissioners must submit an application for review by staff and the city council. The city council approves applications and appoints planning commissioners by majority vote….” (GMC, § 17.10.050 A.) “Vacancies: If a member of the planning commission is unable or unwilling to complete his or her term, the planning director shall publicize the vacancy in the local newspaper and on the city website. The planning director is responsible for accepting applications and agendizing review of the applications by the city council within a reasonable period. The city council by majority vote shall appoint another person to serve for a three (3) year term commencing with the date of the appointment.” (GMC, § 17.10.050 C.)
The Planning Commission Bylaws to not provide additional information with respect to appointing Planning Commissioners.

Past practice has been that if a Planning Commissioner term ends and the Planning Commissioner does not submit a written request to the City Council to be considered for an additional term, or a Planning Commissioner resigns prior to the end of their term, the City accepts applications to fill the vacancy. However, in the past, if a Planning Commissioner submitted a written request to be considered for an additional term, the staff brought the written request to the City Council for consideration and approval without first accepting other applications.
78 - 3 -
The Parks and Recreation Committee appointment process is described in the Parks and Recreation Committee Bylaws as follows:
“When a vacancy occurs, either by the conclusion of the Member’s term, resignation, or otherwise, the City shall solicit applications from individuals interested in becoming a Committee Member. City Staff shall compile and review applications and provide the same to the City Council, as where necessary, make recommendations to the City Council. The City Council shall then make appointments by majority vote.” (Parks and Recreation Committee Bylaws A.4.) Unlike with the Planning Commission, the Parks and Recreation Committee bylaws do not provide an option for a Committee member whose term is ending to submit a written request to be considered for an additional term but Committee members “may be reappointed by majority vote of the City Council.” (Parks and Recreation Committee Bylaws A.4.)

DISCUSSION
It is not clear, based upon the City Municipal Code and Bylaws, whether the City Council is required to accept applications when a Planning Commission incumbent whose term is ending has submitted a written request to be reappointed. It seems that, by including the option for an incumbent to submit a written request, which is different from the process described for vacancies without an incumbent to be filled, that the Municipal Code intends the process to be different. In addition, there are two circumstances described in which the City is required to accept applications: (1) upon initial appointment (GMC, § 17.10.050 A); and (2) when a commissioner is unable or unwilling to complete their term (GMC, § § 17.10.050 C.) That being said, the City Council is welcome to change or clarify the appointment process.

There are pros and cons to reappointing incumbent Commissioners and Committee members.

On one hand, the incumbent likely has gained institutional knowledge and, as such, is a valuable resource to the Commission or Committee and the Commissioner or Committee member has demonstrated a desire to continue serving by submitting a written request to be considered for reappointment. On the other hand, automatically reappointing an incumbent does not give other community members the opportunity to apply to become a Commissioner or Committee member and, in fact, if the City does not make the vacancy available to the public, community members may not know about the opportunity.

City staff polled the cities of Soledad, King, and Gonzales to determine whether they advertise Commissioner vacancies when a current Commissioners would like to retain their seat. Neither the City of Soledad nor King City advertise. As of the drafting of this staff report, the City had not hear back from the City of Gonzales.

POTENTIAL OPTIONS

1. Amend City’s Municipal Code to clarify the Commissioner and Committee appointment process.

2. Amend the Commission and Committee Bylaws to clarify the Commissioner and Committee member appointment process. If the City Council chooses this option, it is recommended that the City Council also amend the Municipal Code to ensure the Bylaws and the Municipal Code are consistent.

3. Make no change to the Municipal Code and/or Bylaws and continue to follow past practice.

4. The City Council may have other options that have not been presented in this report.

Appeals
The City Council of the City of Greenfield is the city’s legislative body. All final decisions on standard subdivisions, legislative acts such as ordinances, general plans, housing elements, zoning or re-zoning of properties lie with the City Council, with recommendations from the Planning Commission.

When an applicant or other interested person is dissatisfied with the Commission’s decision on a land-use matter, that person may appeal the Commission’s decision to the City Council.

The appeal is considered a “de novo” procedure, meaning that the entire case may be repeated anew. The appeal is not limited in scope to a review of the Commission’s record. The right to appeal is not limited to a dissatisfied applicant. State land use law expresses the intent that planning agencies ensure participation by the public and, through that involvement, the ability to appeal.

. Allowable Actions of Commissioners who stand down from discussion, pursuant to item #4 above, are from the California Code of Regulations and are not subject to amendment by the Commission:
a) A Commissioner may appear at a hearing or otherwise before the commission to represent personal items if the commissioner does so in her/his private capacity and if the matter in question relates only to the commissioner’s private interests and not to his or her official duties. The purpose of this exclusion is to allow citizens to exercise their constitutional rights to communicate with their government.

However, the exclusion is limited in that it applies to situations in which the decision will solely affect the commissioner’s personal interests (e.g. real property or business solely owned by the commissioner or members of her/his immediate family).
b) A commissioner is prohibited from in any way attempting to use his or her official position to influence a governmental decision when the official has a financial interest. This restriction is intended to ensure that public officials do not act directly to affect her or his private economic interests by utilizing their official status or activities. Contacts with agency personnel or other attempts to influence on behalf of a commissioner’s business entity, client, or customers are prohibited.

These commission regulations specifically exempt oral or written communications by an official as a member of the general public solely to represent his or her personal interests.

Personal interests include:

1. An interest in real property;

2. Or a business entity which is wholly owned by the
commissioner or members of his or her immediate family; 87 6.

The rule arises when the lack of a quorum results from several members of the commission having a conflict of interest on the same issue,
Abstentions: When a member of the Commission abstains from voting for any reason (other than a conflict of interest), the abstention shall be counted with the affirmative vote.

Procedures for Chairing Meetings:

The Planning Department should be contacted as soon as possible for instructions on appeals.
