• Revenues are lower than expected at the midpoint of the year (but higher than last year).
After accruals are posted, we are still lower than 50%, but are closer (44%). • Staff believes that revenues are lower than budgeted mainly because of a slowing down of the economy.
The same as last year.
• Expenditures are lower than expected at the midpoint of the year. 47% vs. expected 50%. • Staff believes that expenditures are lower than budgeted mainly because of staff vacancies, but not as prevalent as last year.
• We are more fully staffed this year (at mid-year) vs. last year, causing an increase in expenditure (closer to the 50% expected). This also should correlate with better community services. • We have seen some expenditure overages (overtime, particularly) that we are addressing that will positively impact spend in the second half of the year. 25 AT 12/31/24,

86201, WELL #7 IN ORDER TO REPAIR WELL #7 PUMP AND
ASSOCIATED ELECTRICAL WORK
BACKGROUND:
In January 2025, staff was alerted to a power failure at Well #7 (Corp. Yard), and responded per protocol. The back up generator was running, and power was out over the entire Corporate Yard.
The PGE breaker was tripped, and the generator breaker was on. Upon further investigation of the PGE panel, no power was coming from the PGE side. The PGE breaker was reset but there was still no power coming in from PGE. The power coming from the generator was then tested and no power was coming from the generator. Thus, the generator was running but not sending voltage to the main electrical panel. The generator transfer switch never transferred to the “Emergency Power” and was still on the “Normal Power” side. The generator main breaker had tripped. This breaker was reset and then the transfer switch was able to detect power from the emergency side and transfer the emergency power accordingly. Emergency power was restored and the booster pumps started running.
Well #7 was still not functioning under emergency power. The motor lead wires inside the motor control panel were megged and found that each of the three phases was going to ground, indicating a short in the motor or line that feeds the panel. The well motor was then isolated from the rest of the wiring and megged. The motor lead wires were shorted to ground, and unfortunately, the motor will need to be rewound or replaced.

32 In short, when the motor shorted to ground, the three-phase power was sent to ground, and all breakers detected the short and tripped. In reviewing Well 7 data, there were no observations of any signs of overload (high amps) that would cause the motor windings to run hot and burn. The soft start of the well should detect such conditions and stop the motor- that did not occur.
Well #7 was constructed in 2007. The submersible pumps have failed three times since then, 2019, 2023, and 2025. The average submersible pump has a lifespan of 8-10 years, of which is not occurring in this particular location. The current submersible pump has been pulled and is currently being analyzed.
Staff is recommending to transfer CIP funds from Backflow Device Repairs to Well 7 as we are experiencing a significant cost savings within the Backflow Device Repair CIP budget as staff is replacing a majority of the designated backflow devices in house.
BUDGET AND FINANCIAL IMPACT:
There is no additional financial impact, as the request is to transfer funds from one Water CIP to another Water CIP, which was originally budgeted from the water enterprise fund. The amount below would be the maximum amount needed for the Well #7 repairs The transfer, if approved, would be as follows:
FROM TO AMOUNT
504-390-86211 504-390-86201 $60,000
RECOMMENDATION:
Staff recommends the City Council adopt the proposed Resolution to transfer Capital Improvement Funds as outlined in this staff report for the repair of Well #7.

TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GREENFIELD ESTABLISHING THE POSITION OF PUBLIC
SAFETY DIRECTOR, DEACTIVATING THE POSITION OF FIRE
CHIEF AND APPOINTMENT OF POLICE CHIEF TO PUBLIC
SAFETY DIRECTOR POSITION AND AMENDING THE SALARY
SCHEDULE
BACKGROUND:
Our current fire chief, Jim Langborg, is retiring from service at the end of February, 2025. This will necessitate the filling of his leadership position for the fire department.
As fiscal year 2024 – 2025 progresses, it is also becoming more evident that actual revenues will probably not meet budgeted expectations for the entire fiscal year.
Instead of conducting a Fire Chief recruitment, and hiring a new fire chief, city management would like to make a few changes that would accrue some financial savings by reducing executive headcount and salary.
The proposal is to (1) deactivate the Fire Chief position, (2) create the position of Public Safety Director, and (3) assign our Police Chief, Bill Mixer, as Public Safety Director.
Chief Mixer has been very successful in leading the Greenfield Police Department, and we are proposing that the Fire Department and Police Department be combined for the purposes of executive management only.
There will be a number of managerial modifications that will be required in implementing these changes, including working with the Fire Captains’ labor group and city staff are already working through them in anticipation of City Council approval.

35 BUDGET AND FINANCIAL IMPACT:
The financial impacts will arise from the following changes:
1. Freezing/Eliminating Fire Chief position,
2. Freezing/Eliminating Deputy Fire Chief position,
3. Establishing the Public Safety Director position and filling it with Police Chief, suggesting a 20% compensation increase,
4. Potential compensation increase for Police Captain position for additional workload increase,
5. Potential cursory increases (yet to be determined) for the Fire Captains (who may be assuming additional administrative duties),
6. Potential outside Fire Marshall services,
7. Potential compensation increase to Administrative Assistant position(s) for added workload
The net financial savings to the city for the remainder of FY24-25 is estimated to be $97,911, which includes $28,000 estimated (avoided) cost of a fire chief recruitment. The net financial savings to the city for next fiscal year is estimated to be $217,505.
PLEASE NOTE: The “potential” increases cannot be calculated at this time, as negotiations with labor group(s) involve a level of uncertainty, which makes their impacts unknown. City staff would estimate that total increases would be in the range of 20%-30% of state net savings.

TITLE: FOLLOW-UP DISCUSSION REGARDING ADVISORY BODY
MEMBER APPOINTMENT PROCESS AND DIRECTION TO
STAFF
BACKGROUND
On January 28, 2025, City Council was presented with a staff report regarding the appointment process for Planning Commissioners and Parks and Recreation Committee members. The report outlined the current Municipal Code provisions, bylaw requirements, and past practices. The City Council discussed this matter, during which additional issues were identified regarding conflicts within the City Municipal Code provisions and inconsistent past appointment practices.
DISCUSSION
Government Code Requirements
During the January 28, 2025, meeting, a question was raised about potential conflicts between the Government Code and City Municipal Code provisions. Upon review, there are no conflicts with the Government Code. The relevant Government Code sections provide broad authority to cities regarding planning agency appointments:
• Government Code section 65100 authorizes city legislative bodies to assign planning agency functions to a commission by ordinance.
City Council Memorandum
599 El Camino Real Greenfield CA 93937 831-6745591
www.ci.greenfield.ca.us
38 - 2 -
• Government Code section 65101(a) requires the legislative body to specify membership, mandating at least five (5) members, but leaves term requirements and other membership details to local discretion.
Municipal Code Conflicts
While there are no conflicts with state law, there are inconsistencies within the City Municipal Code regarding the appointment process. Specifically:
1. Section 2.20.010 A 2. Says that “appointments shall be for a term of three (3) years, except that an appointment to fill a vacancy shall be for the remainder of the term of the office in which such vacancy occurs.” (emphasis added.)
2. Section 17.10.050 C states that, when filling a vacancy, “the City Council by majority vote shall appoint another person to serve for a three (3) year term commencing with the date of the appointment.” (emphasis added.)
Inconsistent Past Practices
A review of recent appointments reveals varying practices:
• January 26, 2021: Three incumbents (Martinez, Gallardo, Urquides) were reappointed without public recruitment, despite receiving an outside application from Cynthia Zavala. • February 9, 2021: David Mendoza’s resigned and his vacancy was filled by Cynthia Zavala without public recruitment.
• December 13, 2022: Cynthia Zavala was reappointed based on a letter submission. • July 11, 2023: Tina Martinez’s resigned and her vacancy was filled through a public recruitment process, resulting in Jose Vazques’s appointment. • January 9, 2024: Gallardo and Urquidez were reappointed based on letter submissions without public recruitment. Vazques also submitted a letter but was not reappointed because he did not appear at the City Council meeting. Diego Mendoza submitted an application and was appointed.
• December 10, 2024: Stephanie Garcia reappointed based on a letter submission.
This inconsistency in practice, combined with conflicting City Municipal Code provisions, creates confusion and potential fairness concerns in the appointment process. Therefore, a specific process should be chosen that is clear, consistent and transparent. 39 - 3 -
POTENTIAL OPTIONS
1. Amend the City’s Municipal Code to resolve current conflicts and establish a consistent process for both new appointments and reappointments.
2. Amend the Planning Commission and Parks and Recreation Committee Bylaws to clarify the Commissioner and Committee member appointment process.
3. The City Council may have other options that have not been presented in this report.

TITLE: DISCUSS AND PROVIDE DIRECTION TO STAFF REGARDING
ADVISORY BODY MEMBER APPOINTMENT PROCESS
BACKGROUND
At the December 14, 2024, City if Greenfield (“City”) Council meeting, the City Council considered reappointment of a Planning Commissioner whose term ended but who was interested in continuing to serve. As a part of the discussion, the City Council expressed interest in discussing the process by which Planning Commissioners are appointed. In particular, the City Council expressed interest in ensuring that the appointment process is fair and transparent, while also retaining the knowledge gained by long-term Planning Commissioners. This report provides background information regarding appointments to both the Planning Commission and the Parks and Recreation Committee.
The City currently has two (2) active advisory bodies: (1) the Planning Commission; and (2) the Parks and Recreation Committee. Every city is required to have a planning agency but in the absence of a separate planning agency, the City Council serves as the planning agency. (Gov.
Code, § 65100.) The Planning Commission serves as the City’s planning agency and is responsible for, among other things, “exercise[ing] such functions with respect to land divisions, planning, and zoning as may be described by City Ordinance” and “[t]he functions, powers and duties…set forth in sections 65101, 65102 and 65103 of the Government Code of the State of California.” (Planning Commission Bylaws D1; GMC, § 2.20.020.) The Parks and Recreation Committee is not a required advisory body but was formed by the City to “review parks and City Council Memorandum

recreation facilities within the City and to provide recommendations to the City Council.” (Parks & Recreation Committee Bylaws C.1.) The City Council is responsible for appointing Planning Commissioners and Parks and Recreation Committee members.
The City Municipal Code sets forth the process to appoint and reappoint Planning Commissioners as follows:
“There shall be a planning commission consisting of five (5) members who shall be appointed by majority vote of the city council. Said appointments shall be made as follows: …
2. Appointments shall be for a term of three (3) years, except that an appointment to fill a vacancy shall be for the remainder of the term of the office in which such vacancy occurs.
3. There shall be no limit on the number of terms that a planning commissioner may serve; however, upon completion of each three (3) year term, planning commissioners shall prepare a written request to the city council to be considered for an additional term.” (GMC, § 2.20.010 A.)
“Membership and Term: …People interested in becoming commissioners must submit an application for review by staff and the city council. The city council approves applications and appoints planning commissioners by majority vote….” (GMC, § 17.10.050 A.) “Vacancies: If a member of the planning commission is unable or unwilling to complete his or her term, the planning director shall publicize the vacancy in the local newspaper and on the city website. The planning director is responsible for accepting applications and agendizing review of the applications by the city council within a reasonable period. The city council by majority vote shall appoint another person to serve for a three (3) year term commencing with the date of the appointment.” (GMC, § 17.10.050 C.)
The Planning Commission Bylaws to not provide additional information with respect to appointing Planning Commissioners.
Past practice has been that if a Planning Commissioner term ends and the Planning Commissioner does not submit a written request to the City Council to be considered for an additional term, or a Planning Commissioner resigns prior to the end of their term, the City accepts applications to fill the vacancy. However, in the past, if a Planning Commissioner submitted a written request to be considered for an additional term, the staff brought the written request to the City Council for consideration and approval without first accepting other applications.
42 - 3 -
The Parks and Recreation Committee appointment process is described in the Parks and Recreation Committee Bylaws as follows:
“When a vacancy occurs, either by the conclusion of the Member’s term, resignation, or otherwise, the City shall solicit applications from individuals interested in becoming a Committee Member. City Staff shall compile and review applications and provide the same to the City Council, as where necessary, make recommendations to the City Council. The City Council shall then make appointments by majority vote.” (Parks and Recreation Committee Bylaws A.4.) Unlike with the Planning Commission, the Parks and Recreation Committee bylaws do not provide an option for a Committee member whose term is ending to submit a written request to be considered for an additional term but Committee members “may be reappointed by majority vote of the City Council.” (Parks and Recreation Committee Bylaws A.4.)
DISCUSSION
It is not clear, based upon the City Municipal Code and Bylaws, whether the City Council is required to accept applications when a Planning Commission incumbent whose term is ending has submitted a written request to be reappointed. It seems that, by including the option for an incumbent to submit a written request, which is different from the process described for vacancies without an incumbent to be filled, that the Municipal Code intends the process to be different. In addition, there are two circumstances described in which the City is required to accept applications: (1) upon initial appointment (GMC, § 17.10.050 A); and (2) when a commissioner is unable or unwilling to complete their term (GMC, § § 17.10.050 C.) That being said, the City Council is welcome to change or clarify the appointment process.
There are pros and cons to reappointing incumbent Commissioners and Committee members.
On one hand, the incumbent likely has gained institutional knowledge and, as such, is a valuable resource to the Commission or Committee and the Commissioner or Committee member has demonstrated a desire to continue serving by submitting a written request to be considered for reappointment. On the other hand, automatically reappointing an incumbent does not give other community members the opportunity to apply to become a Commissioner or Committee member and, in fact, if the City does not make the vacancy available to the public, community members may not know about the opportunity.
City staff polled the cities of Soledad, King, and Gonzales to determine whether they advertise Commissioner vacancies when a current Commissioners would like to retain their seat. Neither the City of Soledad nor King City advertise. As of the drafting of this staff report, the City had not hear back from the City of Gonzales.

POTENTIAL OPTIONS
1. Amend City’s Municipal Code to clarify the Commissioner and Committee appointment process.
2. Amend the Commission and Committee Bylaws to clarify the Commissioner and Committee member appointment process. If the City Council chooses this option, it is recommended that the City Council also amend the Municipal Code to ensure the Bylaws and the Municipal Code are consistent.
3. Make no change to the Municipal Code and/or Bylaws and continue to follow past practice.
4. The City Council may have other options that have not been presented in this report.

. Recording of Votes - Minutes of the Commission proceedings shall show the vote of each Commissioner, including whether s/he is absent or failed to vote on a considered matter.

When a person disqualifies him/herself, s/he shall state prior to the consideration of such matter by the Commission that s/he is disqualifying him/herself due to a possible conflict of interest, state the nature of the conflict and shall not participate in voting or discussion.
. Allowable Actions of Commissioners who stand down from discussion, pursuant to item #4 above, are from the California Code of Regulations and are not subject to amendment by the Commission:
a) A Commissioner may appear at a hearing or otherwise before the commission to represent personal items if the commissioner does so in her/his private capacity and if the matter in question relates only to the commissioner’s private interests and not to his or her official duties. The purpose of this exclusion is to allow citizens to exercise their constitutional rights to communicate with their government.
However, the exclusion is limited in that it applies to situations in which the decision will solely affect the commissioner’s personal interests (e.g. real property or business solely owned by the commissioner or members of her/his immediate family).
b) A commissioner is prohibited from in any way attempting to use his or her official position to influence a governmental decision when the official has a financial interest. This restriction is intended to ensure that public officials do not act directly to affect her or his private economic interests by utilizing their official status or activities. Contacts with agency personnel or other attempts to influence on behalf of a commissioner’s business entity, client, or customers are prohibited.
These commission regulations specifically exempt oral or written communications by an official as a member of the general public solely to represent his or her personal interests.
Personal interests include:
1. An interest in real property;
2. Or a business entity which is wholly owned by the
commissioner or members of his or her immediate family; 51 6.

The rule arises when the lack of a quorum results from several members of the commission having a conflict of interest on the same issue,
Abstentions: When a member of the Commission abstains from voting for any reason (other than a conflict of interest), the abstention shall be counted with the affirmative vote.
