CITY COUNCIL BUSINESS

SECOND READING AND ADOPTION OF AN ORDINANCE OF THE CITY COUNCIL OF THE

CITY OF GREENFIELD ESTABLISHING A TEMPORARY MORATORIUM ON THE

ISSUANCE OF BUILDING PERMITS REQUIRING A NEW WASTEWATER CONNECTION OR

THAT WILL RESULT IN INCREASED WASTEWATER FLOW TO THE CITY OF

GREENFIELD WASTEWATER TREATMENT PLANT
ORDINANCE #575
Staff report was given by City Attorney Thompson.

City Clerk Rathbun reported that the City received two letters regarding the moratorium, one from Monterey Bay Economic Partnership and another from Peoples Self Help Housing.

John Huerta Jr. stated that he disagreed with Item #4 regarding grant-funded projects. He stated that this would affect the City’s recreation center. He stated that the ordinance stated that the City could not build the recreation center because it could not be hooked up to the sewer and that doesn’t make sense. He stated that this would delay the project, and he disagreed with this language and it shouldn’t be included. He stated that a lot of people and staff have worked hard in getting this grant.

Emily Baranek, representing Peoples Self Help Housing, stated that they had a project in the works for the past five years, but they were not aware of the deadline for the project. She stated that their project was an affordable for ownership project at 296 Apple Avenue with 34 new homes. She stated that they originally submitted the plans March of 2021 and have been working on the project. She asked that the City make an exemption to the moratorium for their project and if that was not possible then to have the opportunity to discuss other options.

Veronica Garcia, representing Peoples Self Help Housing, stated that she was here to express their concern about the proposed moratorium. She stated that their organization had pending financial commitments to the project that would be jeopardized due to the proposed moratorium which included grants that were secured to deliver the housing and to administer the program as well as financing that was obtained to secure the land. She asked that Council continue this matter for further consideration or at minimum confirm that the 296 Apple Avenue project be exempt from the proposed moratorium. She stated that they have significant legal questions because the project could be derailed and shut down by the moratorium.

Councilmember Garcia stated that this had not been easy and stated that she had met with a lot of people and she does hear the concerns; however, she was trying to do what was best for everyone.

Mayor White stated that the Council and staff does not take this lightly and that the City was blindsided by the State. He explained that the State had stated that they would fund the new wastewater treatment plant completely and then said no. He stated that the plant was over 70 years old and this Council had inherited this problem; however, they had to move forward.

Councilmember Ortiz stated that this Council had been talking about this for over 2 years and does not take this lightly. She stated that the Council does not want to stop growth; however, something needed to be done.

A MOTION by Councilmember Jones, seconded by Councilmember Ortiz to read, by title only, second reading and adopt Ordinance #575, “An Ordinance of the City Council of the City of Greenfield Establishing a Temporary Moratorium on the Issuance of Building Permits Requiring a New Wastewater Connection or that will Result in Increased Wastewater Flow to the City of Greenfield Wastewater Treatment Plant”. TITLE: A RESOLUTION AWARDING A PROFESSIONAL SERVICES

CONTRACT TO HARRIS & ASSOCIATES IN AN AMOUNT NOT
TO EXCEED $28,220.00 FOR DESIGN SERVICES FOR A BASIS

OF DESIGN REPORT FOR THE REPLACEMENT OF THE

TYLER LIFT STATION, AND AUTHORIZING THE CITY

MANAGER TO NEGOTIATE AND EXECUTE THIS CONTRACT

AND ASSIGN ADDITIONAL WORK IN ACCORDANCE WITH

THIS RESOLUTION
______________________________________________________________________________ BACKGROUND:

At the July 24, 2025 City Council meeting, a Professional Design Service contract for the Tyler Lift Station Replacement with Harris & Associates was presented for approval with a total not to exceed $441,493 (down from the original proposal of $463,175). After further negotiation, a resolution was not met, and the contract was further negotiated to reduce the scope and complete a Basis of Design Report (BDR) in the amount of $28,220.

A Basis of Design is a document written by the designer or engineer of record. It serves to capture many aspects beyond what you might find in specifications or design drawings and introduces narrative statements on the thought processes behind major design decisions. It provides the designer’s underlining motivators, and the “why” behind their design decisions.

This Basis of Design Report will include data collection and review of available documents including record drawings, reports, testing results, maintenance records, and the like, a hydraulic City Council Memorandum

44 analysis and pump physical constraints analysis, preliminary research, general electrical design approach, and recommended options. The BDR does not include design plans or specifications bid documents.

BUDGET AND FINANCIAL IMPACT:

The funding for this Capital Project is from the Sewer Impact Fund. The estimated total project cost is within the FY 25/26 CIP budget.

RECOMMENDATION:

City Staff recommend the City Council award a Professional Services Contract to Harris & Associates for a basis of design report, not to exceed $28,220.00, and authorize the City Manager to negotiate and execute the contracts for these services.

PROPOSAL FOR BASIS OF DESIGN REPORT – TYLER LIFT STATION Dear Ms. Tugel,
Harris and Associates (Harris) appreciates the opportunity to present our proposal to the City of Greenfield for the Basis of Design Report (BDR) for the Tyler Lift Station Replacement (“the Project”). We have prepared this Scope of Services and Fee based on our August 25, 2025, virtual meeting with the City, project background provided in the Tyler Lift Station Replacement RFQ (dated April 24, 2024) and the Wastewater Collection System Master Plan Update (dated May 2021).

PROJECT UNDERSTANDING
The City is proposing improvements to the Tyler Lift Station. Our understanding of the major improvement objectives are summarized below:
• Accommodate future operating conditions
• Comply with current Water Board standards and requirements • Meet safety and local regulatory requirements
• Remain within the City’s right-of-way
• Provide a planned transition from the existing lift station to the new lift station • Compatible will the new emergency generator (installed by the City) This proposal outlines the development of a BDR to evaluate two lift station replacement options. The BDR will support the City’s decision-making process in selecting a preferred lift station design and will serve as the foundation for detailed design (not within this presented Scope of Services). The two options to be evaluated will be discussed during the Project Kick-Off meeting and confirmed by the City prior to beginning BDR development.

SCOPE OF SERVICES
PHASE 1: PROJECT MANAGEMENT AND MEETINGS
TASK 1.1: GENERAL PROJECT MANAGEMENT
This task generally includes internal meetings, coordination with the electrical subconsultant, correspondence with the City, invoicing with progress summary reports (3 months assumed), and other miscellaneous commitments to execute the Project.

Deliverable(s): Monthly Invoices with Email Summary of completed Work.

TASK 1.2: PROJECT MEETINGS
Harris has assumed one (1) in-person kick-off meeting and site visit; one (1) virtual 1-hour coordination meeting with the City that may be required to resolve questions and conflicts, which will be scheduled as necessary; and one (1) virtual 1-hour BDR review meeting.

Deliverable(s): Meeting Minutes (via email) distributed to attendees and participants. Deliverable(s) will be in electronic PDFs, or simply as bullet points via email depending on content.

PHASE 2: BASIS OF DESIGN REPORT
TASK 2.1: DATA COLLECTION AND REVIEW
Harris will review available and pertinent information form the City including, but not limited to, record drawings, reports, testing results, maintenance records, and anecdotal staff input to understand issues with the current station, what the station design points are, what the system curve (flow to head-loss relationship) looks like to best select suitable pump option, and what the O&M staff desires to make the station more user friendly, as well as to address any issues currently experienced.

Deliverable(s): Findings will be documented in Task 2.3.

TASK 2.2: HYDRAULIC ANALYSIS AND PUMP PHYSICAL CONSTRAINTS ANALYSIS Understanding the inflows, the system storage, and the intake and force main piping configurations is critical to correctly assessing the system hydraulics. Harris will take the time necessary to fully understand the system, and why the current configuration is only pumping approximately 193 gpm. Based on our preliminary review of the City provided information, the current station should be pumping at approximately 400 gpm. With the flows being significantly lower, it can only be assumed that the hydraulic losses are not properly accounted for, or the pumps, motors and impeller selections were not correctly specified.

The force main shown on the record drawings shows the force main leaving the site in the south-eastern direction, yet the discharge point has been identified as being a manhole near South El Camino Real and Huerta Avenue. A preliminary system curve has been developed, and the only way to achieve losses in this range is to assume the force main crosses South El Camino Real around Tyler Avenue, and that the force main condition is extremely poor and has significant friction losses. Harris will review available O&M records, record drawings, and flow/pressure test results from previous assessments to understand the current system issues.

Deliverable(s): Findings will be documented in Task 2.3. 49 Harris & Associates, Inc.  Proposal For Basis of Design Report – Tyler Lift Station 3 of 4 TASK 2.3: BASIS OF DESIGN REPORT
Harris will summarize findings from Tasks 2.1 and 2.2 and evaluate two alternatives for the lift station replacement in a Basis of Design Report (BDR). As part of the BDR, Harris via subconsultant TJCAA will complete a site visit and provide recommendations related to PG&E service modifications and general electrical design approach. A draft BDR will be submitted for the City’s review. Harris will incorporate comments on the draft BDR and resubmit a final BDR.

The anticipated BDR sections are:

1. Executive Summary

2. Introduction

3. Existing Conditions

4. Design Criteria

5. Alternatives Analysis
a. Alternative 1 – Submersible Station
i. Conceptual Layout Sketch
b. Alternative 2 – Packaged Station (Smith and Loveless) i. Conceptual Layout Sketch
c. Electrical Design Approach

6. Preliminary Engineer’s Opinion of Construction Cost

7. Construction Considerations
a. Preliminary Bypass Plan or Connection Plan

8. Appendices
Deliverable(s): Basis of Design Report (Draft and Final). Deliverable(s) will be in electronic PDFs.

ASSUMPTIONS AND EXCLUSIONS

1. Topographic surveying, potholing, condition assessments, structural assessments, utility mapping or investigations, flow monitoring, and geotechnical investigation is not included in the Scope of Services.

2. All meetings will be virtual, except for the Kick-Off.

3. The preliminary schedule for draft submittal of BDR after Notice to Proceed is 3 months. After receiving City comments, the final BDR is anticipated to be submitted in 3 weeks.

4. Work is expected to begin in October 2025 and be completed in December 2025,

5. All professional services have been reasonably quantified but are estimates of time commitment based on hours. Continued support of these Scope of Services beyond the hours or fees listed herein will be discussed with the City and an Amendment will be coordinated, agreeable, and executed.

TITLE: A REPORT ON THE 2025 SEWER RATE & FEE STUDY AND

PROVIDE DIRECTION TO STAFF
______________________________________________________________________ BACKGROUND:

The City is in the process of planning improvements to the wastewater systems to meet the needs of a growing population and changes in the regulatory standards. The City recently completed the process of updating the Wastewater Collection and Wastewater Treatment Plant (“WWTP”) master plans and the Sanitary Sewer System Management Plan. These plans identified the need for major capital improvements and increased operating costs. The City is also in the process of implementing long-term wastewater improvements to comply with the recently issued Waste Discharge Requirements mandated for the WWTP as required by the Regional Water Quality Control Board. The City is developing a financial strategy to address these needs, and a major component of this strategy is an adequate rate structure for wastewater services and to fund potential increases in debt service.

The City of Greenfield is committed to maintaining a fair, equitable, and financially sustainable sewer enterprise system that meets operational, maintenance, and capital improvement needs. To achieve this, it is essential to regularly update sewer service charges and connection fees in accordance with state law, financial best practices, and evolving community needs. The City last conducted a comprehensive sewer rate study in 2023. That study assumed that the costs for the WWTP upgrades required to meet the new State of California standards, would be covered by State Water Quality Grants (“Grant Funding”). The City has recently been advised that the Grant Funding requirements have been changed and the City no longer qualifies for 100% Grant City Council Memorandum

53 Funding. Based on this change in Grant Funding guidelines, a new sewer rate and connection fee study is necessary.

The City retained Robert D. Niehaus, Inc. (RDN) to prepare a comprehensive Sewer Rate & Fee Study (“Rate Study”) on July 22, 2025. The final report, dated August 27, 2025, presents a ten‑year financial plan (with a five‑year rate period), cost‑of‑service analysis, rate design, and proposed capacity charges to support replacement of the City’s WWTP and ongoing system needs.

SUMMARY OF KEY STUDY FINDINGS
The 2025 Sewer Rate and Fee Study identifies the financial, operational, and policy steps necessary to ensure the City can meet long-term wastewater system needs and upgrade the existing WWTP. Key findings include:
• WWTP Upgrade:

The existing WWTP must be replaced at an estimated cost of $111.3 million. Completing all phases together is the most cost-effective approach, avoiding an estimated additional $29 million in phased costs.

The City explored several options as part of the Wastewater System Master Planning effort, including upgrading the existing WWTP and several traditional WWTP design alternatives but finally decided that a package Membrane Bioreactors (MBR )WWTP alternative would provide a higher level of treatment, facilitate recycled water production and allow the WWTP to be upgraded in phases if the City is not able to obtain all of the required funding immediately. The current design includes four 0.5 Million gallons per day (MGD ) units providing a total capacity of 2 MGD. While a three-unit phased approach was initially considered in the Rate Study, it is no longer viable given the current influent flows already exceed the capacity of 3 MBRs/units, and which also exceeds the City’s currently permitted discharge requirements. At this point, all four units are necessary to adequately and safely treat current and projected flows.

An additional advantage of moving forward with the full project is that the design is 90% complete and proceeding with the full project as designed means that no redesign will be required. The City estimates this approach will save approximately $29 million compared to the phased alternative. Accordingly, staff believes the only viable option is to proceed with the MBR WWTP as currently designed, without phasing.
• Funding Options:
- Option 1 assumes the City secures approximately $75 million in grants and gets a loan for the remaining $36.3 million with a low-interest State Revolving Fund (SRF )loan. - Option 2 assumes no Grant Funding, requiring the full $111.3 million to be financed with a the maximum loan amount available from the SRF program, $50.0 million, and the remainder being made up by private loans ($61.3 million) resulting in higher annual loan payments. 54 Additional Study findings:
• Debt Service Coverage Ratio (DSCR): The SRF financing program requires the City to demonstrate that net operating revenues (revenues minus operations and maintenance (O&M) are at least 120% of annual loan payment. This 1.20 times coverage provides a financial cushion to protect against revenue shortfalls. • Operating Costs: With the new WWTP online in FY 2029, annual O&M expenses increase to $4.1 million, rising further to $4.25 million in FY 2030. These costs reflect additional staffing, power, and treatment needs of the upgraded WWTP as compared to the current WWTP.
• Reserve Policies: The Study recommends strengthening financial reserves to protect against reduced revenues and unexpected maintenance costs, by:
- Building an Operating Reserve equal to three months of O&M ($658,000 in FY 2026).
- Establishing a Capital Replacement Reserve equal to 2% of system asset value ($343,000 annually), supporting a 50-year asset replacement cycle. • Rate Structure Modernization: The Rate Study recommends moving away from Equivalent Dwelling Unit (ERU)-based rates which establish rates as multiples of the average discharge of single family homes, and adopting:
- A uniform fixed monthly charge per account.
- A variable charge per 1,000 gallons of water use, capped at 5,000 gallons for singlefamily residential customers. • Capacity Charges: Capacity Charges are designed to ensure that current customers are not paying to maintain or develop capacity for new customers joining the Sewer system.

A new $7,286.34 per Equivalent Dwelling Unit (EDU) capacity charge is recommended, combining a ‘buy-in’ to existing assets and an incremental share of future growth. This fee will be updated annually using the California Construction Cost Index. • Customer Impacts:
- For average single-family customers, bills will rise from $63.36, under current rates, to $91.22 per month in FY 2026.
- Non single family-residential customer bills will vary with actual water use, ensuring costs are proportionally allocated based on system demand. • Legal Compliance: The proposed structure meets Proposition 218 requirements, aligning charges with cost of service and ensuring revenues are no greater than the reasonable cost of providing wastewater service.

Current vs. Proposed Rate Structures
Under the current rate system, customers are billed a fixed $5.14 per account per month plus $58.22 per Equivalent Residential Unit (ERU), with ERUs assigned by customer class. This approach is based on averages and does not account for the actual wastewater flow contributed 55 by individual customers. The proposed rate structure modernizes this system by eliminating ERUs and instead applying: (1) a uniform monthly fixed charge per account and (2) a variable volumetric charge based on metered water use in 1,000-gallon increments. For single-family residential customers, the variable charge is capped at 5,000 gallons per month to reflect average indoor wastewater generation. Non-residential customers will pay for their actual wastewater contributions, with a variance process available where water use does not reach the WWTP. Both Option 1 and Option 2 apply this modernized rate framework; the difference lies in the magnitude of annual revenue adjustments and resulting rate levels, with Option 2 requiring steeper increases to fund the full WWTP replacement without reliance on grants.
