TITLE: CONSIDERATION OF TAXI PERMIT APPLICATION BY
EDUARDO BRAVO GOMEZ, U.S.A TAXI CAB
BACKGROUND
On April 16, 2025, Eduardo Bravo Gomez of U.S.A. Taxi Cab submitted an application in order to operate a taxi within the City of Greenfield. Municipal Code Section 5.20 governs taxicabs, including the requirement for a public hearing in order to obtain a permit to operate within the City limits. Per Section 5.20.050, the City Council must approve each company’s permit to operate. The Chief of Police may grant additional taxicab permits under that company.
PROJECT REVIEW AND ANALYSIS
Municipal Code Section 5.20.030 requires the following certain information in order to consider the taxi permit.
Name and Address: Eduardo Bravo Gomez, Salinas, CA 93901 Description of Vehicle: 2007 Mercury Grand Marquis
Schedule of Rates: $3.50 Flag Drop, $3.50 per mile, $35 per hour waiting time Name and Insignia on Cab: As shown per attached application Hours of Service: Service is generally available 24 hours a day, with primary operation from 5:00AM to 8:00PM. The applicant will be publishing and advertising the business to better inform residents of services along with cab advertising.
Unlike in larger cities where taxicabs are generally made available in certain public locations, this service is generally pre-arranged and no specific taxi stand location is being proposed within Greenfield. Outside of regular business hours, the cab is proposed to be stored outside of the 43 City Limits at the location at 321 Lang Street within the City of Salinas. The taxicab is subject to inspection at any time by the chief of police or his authorized representative. Any taxicab which is found after such inspection to be unsafe or in violation of any of the provisions of Chapter 5.20 shall be immediately ordered out of service and shall not again be placed in service until it has been put in safe and proper condition.
The applicant is the Driver/Operator of the business. Section 5.20.180 requires that permits may not be issued to any person under the age of twenty one (21) years, any person who has been convicted of a felony or of a crime involving moral turpitude, any person who has been convicted of reckless driving or driving while under the influence of intoxicating liquors or narcotics; provided, however, that the city council may, in its discretion, issue a permit in cases where such conviction occurred more than three (3) years immediately preceding the filing of the application, any person not possessing a valid driver's license issued by the state of California required to drive or operate any of the vehicles defined in section 5.20.010 of this chapter.
All taxicabs operated in the city shall be subject to the following regulations:
• Any driver employed to transport passengers to a definite point shall take the most direct route possible that will carry the passenger to his destination safely and expeditiously. • No driver of any licensed taxicab shall refuse any person prompt taxi service in the city at any time while such taxicab is on the public streets of Greenfield, ready for service, unless such taxicab is already engaged in the carrying of one or more passengers or is en route to answer a call for taxicab service; provided, further, that nothing in this subsection shall require any owner or driver to furnish taxicab service to any person under the influence of intoxicating liquor or narcotics, or to any person who is insane or who is a criminal.
• Every driver, upon request, shall give a correct receipt for the amount of payment received.
• No driver of any taxicab shall accept, take into his vehicle or transport any larger number of passengers than the rated seated capacity of his vehicle. • No driver shall carry any passenger other than paying passengers or persons authorized by or on company business.
• Every driver shall at all times display his driver's permit in a conspicuous place in the taxicab which he is operating.
• Any violation of the provisions of this section shall be cause for the revocation of the permit of the driver guilty of such violation.
44 Insurance is required and shall have minimum general liability limits of $500,000.00 for bodily injury per person and/or occurrence and $100,000.00 property damage per occurrence; or $500,000.00 combined single limit bodily injury/property damage. On all policies of insurance hereinabove referenced, the operator shall name the city, its officers, agents, representatives, and employees as additional primary insured.
Public Hearing
Any interested person may file written objections or protests to the granting of such permit and license at any time before the hearing. The council shall consider all the objections or protests, and in conducting its hearing shall have the right to call such witnesses as it may see fit. In such hearings the burden of proof shall be upon the applicant to establish by clear and convincing evidence which shall satisfy the council that public convenience and necessity require such operation of the vehicle or vehicles for which said application has been made and that such application in all respects should be granted. The city council, in determining whether or not public convenience and necessity exists, shall take into consideration all facts which it may deem pertinent and proper. No such application shall be granted unless the council shall first make its specific findings that each of the following conditions exists:
A. The applicant is financially responsible;
B. The applicant is of good moral character or the officers of said applicant are of good moral character;
C. The persons holding permits or licenses for the operation of motor vehicles for hire are under efficient management, earning a fair and reasonable return on their capital devoted to such service;
D. Persons holding permits or licenses for the operation of vehicles for which application is being made are, under normal conditions, adequately serving the public; E. The applicant has complied with the provisions of all city ordinances and all state and federal ordinances and all state and federal laws applicable to the proposed operation; F. Such additional service will not result in a greater hazard to the public and will not create traffic congestion in parking;
G. Each vehicle described therein is adequate and safe for the purpose for which it is to be used, and is equipped as herein required.
BUDGET AND FINANCIAL IMPACT
The applicant is responsible for all costs required for review and processing of the application, permits, and future renewals. The financial impact of approving a taxi permit is negligible.

TITLE: ANALYSIS, DISCUSSION, AND POSSIBLE DIRECTION
REGARDING POTENTIAL TAX MEASURES
EXECUTIVE SUMMARY
The City of Greenfield (“City”) currently receives revenue from a variety of locally adopted taxes, including from the City’s Transient Occupancy Tax (“TOT”), Business License Tax, and Sales Tax, which support the provision of municipal services. From time to time, the City Council may consider whether to renew, extend, or adjust these revenue streams to address expiring authorizations, maintain service levels, respond to infrastructure and operational needs, or to reflect changing economic conditions. To make such changes to these tax rates, such as increasing and/or renewing the tax rates, the City must put a measure on the ballot to allow voter approval; however, before placing a measure on the ballot, City Council must approve the proposed tax rate change by resolution or ordinance.
As such, this report provides information for City Council’s analysis of the applicable law relating to each of the taxes, the process by which the City may make changes to those tax rates, and discussion regarding potential ballot measures to increase and/or renew certain local taxes.
BACKGROUND
Taxes are compulsory charges levied for the purpose of financing services performed for the common benefit and must be approved by the voters. (Cal. Const. XIII C, § 2; Gov. Code, § 53724.) The votes required to approve taxes will vary depending on the purpose for which the tax is being allocated. General taxes, which are imposed for general governmental purposes and are deposited into the general fund, only require a majority vote of the electorate (50% + 1). (Cal. Const. Art. XIII A and C.) Special taxes, which are collected and earmarked for a special purpose and deposited into a separate account, require a two-third vote of the electorate. (City and County of San Francisco v. Farrell (1982) 32 Cal. 3d 47; Cal. Const. Art. XIII C and D.) City Council Memorandum

Tax increases can be adopted for a period of years or indefinitely. As you will see below, the City has adopted tax increases both with sunset dates and with no expiration.
1. Transient Occupancy Tax.
The City may impose a “transient occupancy tax” on persons staying thirty (30) days or fewer in hotels, motels, and similar lodgings, including mobile homes located outside of a mobile home park. (Rev. & Tax. Code, §§ 7280-7283.51.)
The City’s current TOT applies only to hotels and is assessed at eight percent (8%) of the rental rate charged. (City of Greenfield Municipal Code (“GMC”), § 3.28.030.) The TOT revenues flow through to the City’s general fund, where they are available for any lawful purpose. This is significantly less than many jurisdictions, who may charge as much as fourteen percent (14%) and charge TOT on all transient occupancy types, such as AirBnB or VRBOs.
2. Sales Tax.
The City’s Sales and Use Tax rate, adopted pursuant to the Bradley-Burns Uniform Local Sales and Use Tax Law, is capped at one percent (1%). (Rev. & Tax. Code, § 7202, subd. (h)(1).) However, separate statutory authority permits local Transactions and Use Taxes that may increase the total sales tax rate beyond one percent (1%), but this is currently limited to two percent (2%) by the rate set forth in Revenue and Taxation Code section 7252.1. (See e.g., Rev. & Tax. Code, §§ 7285.9 (authority for cities to adopt transaction and use tax for “general purposes” at rate of 0.125 percent or multiple thereof) & 7285.9.) The City’s current local sales tax consists of a one percent (1%) Sales and Use Tax and a threequarters percent (0.75%) Transactions and Use Tax, for a combined rate of 1.75 percent. The most recent increase occurred on November 3, 2015, following voter approval of Measures V and W. Measure V authorized the continuation of the one percent (1%) Sales and Use Tax without a sunset date, while Measure W imposed a three-quarters percent (0.75%) Transactions and Use Tax for a limited duration of five (5) years, sunsetting March 31, 2021. Voter approval of Measure T on November 3, 2020, then extended this three-quarter percent (0.75%) Transactions and Use Tax for an additional limited duration of six (6) years, set to expire March 31, 2027.
To continue the Measure T three-quarter percent (0.75%) Transactions and Use Tax without interruption, the City Council must adopt a resolution to add this to the November 2026 ballot.
3. Business License Tax.
Pursuant to Government Code section 37101, the City may levy business license taxes for revenue purposes. The City’s current business tax fee structure was created in the 1940s and requires that every person transacting and carrying on business within the City, as described in Chapter 5.04 of the City’s Municipal Code, must pay a license tax as designated within the Code. (GMC, § 5.04.120.) The City currently requires these individuals to pay flat fees. 57 - 3 -
The City Council could consider increasing the flat fee or charging business according to a different structure, such as a percentage of their gross receipts or by number of employees.
Percentage of gross receipts and by number of employees are just two examples of how jurisdictions calculate business tax.
4. Process and Timeline for Ballot Measures to Change Taxes.
A. Step 1: The City Must Propose the Tax by Resolution or Ordinance and City Council Must Approve it by Two-Thirds Vote.
Pursuant to Elections Code section 9222, City Council may place a measure on the ballot for voter approval at a subsequent regular or special City election by approving an ordinance or resolution. The election must then be held at least eighty-eight (88) days after the election is called. (Ibid.)
To impose, raise, or extend a general tax, the City must first put the tax proposal forward through an ordinance or resolution. (Gov. Code, § 53724, subd. (a).) That proposal must clearly state the kind of tax, the tax rate, how the tax will be collected, and the election date. (Ibid.) Proposing a new general tax requires approval by a two-thirds majority of City Council before the measure can be submitted to voters. (Gov. Code, § 53724, subd. (b).) Similarly, the City may place a special tax measure on the ballot through an ordinance or resolution adopted after providing notice and holding a public hearing. (Gov. Code, § 50077.) The ordinance or resolution must also state the kind of tax, the tax rate, how the tax will be collected, and the election date, but must also state the purpose of the special tax. (Gov. Code, § 53724, subd. (a).)
B. Step 2: The City Must Place a Measure on the Ballot with a Regular City Council Election, Except in Cases of Unanimously Declared Emergencies, Declared or Special Taxes.
An election to approve a general tax must be held at the same time as a regularly scheduled City Council election, unless the City Council unanimously declares an emergency. (Cal. Const. Art.
XIIIC, § 2, subd. (b).) In other words, without a unanimous emergency finding, the proposed tax increase must be approved at an election in which City Councilmembers are also on the ballot, which would occur in November of this year. By contrast, there are no timing restrictions on when an election for a special tax can be held.
C. Step 3: General Taxes Must be Approved by the Majority of Voters, and Special Taxes Must be Approved by Two-Thirds of the Registered Voters.
Once a general tax is on the ballot, it must receive a majority of votes to be approved. (Cal.
Const. Art. XIIIC, § 2, subd. (b); Gov. Code, § 53723.) In contrast, a special tax proposed by City Council requires approval from at least two-thirds of the voters who participate in the election on that measure. (Cal. Const. Art. XIIIA, § 4; Cal. Const. Art. XIIIC, § 2, subd. (d).) 58 - 4 -
DISCUSSION
1. Transient Occupant Tax.
City staff seek to have City Council consider increasing the City’s TOT rate from eight percent (8%) to twelve percent (12%). To do so, the City must place a measure on the ballot for voter approval, as described above. The City Council may also consider whether it wants to broaden the tax base of the TOT, such as applying it to motels and short-term home rentals (e.g., AirBnB) that are not already taxed. Broadening the tax base would be considered a tax increase and would similarly require voter approval.
2. Sales Tax.
City staff seek to have City Council consider renewing the Transactions and Use Tax, that would otherwise expire on March 31, 2027, on an indefinite basis.
3. Business License Tax.
City staff seek to have City Council consider implementing a new business license tax structure.
Implementation of a new business tax ordinance could potentially increase business tax revenues for the City. For example, a business tax ordinance, tied to gross receipts of a business or other City-identified metric, could be used to generate potentially significant tax revenue.
In addition to tying the business tax to gross receipts, there are other alternative approaches the City may consider, such as basing the business tax on the number of employees the business has working within City limits or square footage based on the size of the business’s physical location.
FISCAL IMPACT
None. This is for discussion and direction only with respect to the possible tax measures.
Potential annual revenue increases are dependent on the increase of tax rates.
RECOMMENDATION
Discuss and provide possible direction to staff regarding possible tax measures relating to the City’s TOT, Sales Tax, and Business License Tax.
PROPOSED MOTION
None. This is for discussion and direction only with respect to possible tax measures.

TO: Mayor and City Council
FROM: Paul Wood, CPA – City Manager
TITLE: APPROVAL OF AGREEMENT WITH CAPITAL RIVERS
CONNECT FOR ECONOMIC DEVELOPMENT SERVICES IN
THE AMOUNT OF $60,000
______________________________________________________________________ BACKGROUND:
The City of Greenfield continues to prioritize economic development and expansion of the local retail and commercial base as a key fiscal sustainability strategy. Retail leakage to surrounding jurisdictions remains an ongoing challenge, and commercial vacancies within the City represent unrealized revenue potential.
Capital Rivers Connect is a California-based economic development and retail advisory firm operating under Capitol Rivers, Inc. The firm specializes in retail strategy, tenant recruitment, and market positioning services for municipalities and property owners.
The proposed Agreement formalizes CRC’s engagement to provide two primary service components during the Initial Term:
• CRC Connect Masterclass
• Full-Service Partnership
If the Agreement extends beyond the Initial Term, services transition to ongoing components of the Full-Service Partnership, including Retail Fit Analysis, Data Concierge Access, CRC Strategy Exchange, and Developer Perspective.
City Council Memorandum

60 SUMMARY OF KEY STUDY FINDINGS
The proposed Agreement with Capital Rivers Connect (CRC) provides the City with a structured, data-driven retail recruitment and economic development program designed to expand Greenfield’s commercial base and increase sales tax revenues.
The Agreement establishes a one-year Initial Term at a fixed cost of $60,000, with an optional month-to-month extension thereafter at $5,000 per month. The contract includes defined service components, performance expectations, reporting structure, termination protections, and comprehensive insurance and indemnification provisions.
Approval of this Agreement will provide the City with professional retail recruitment tools and direct engagement strategies that are not currently available through in-house staffing.
Scope of Services (Exhibit A)
CRC will provide market positioning, retail fit analysis, data access, advisory support, strategic engagement with retailers and developers, and structured collaboration through its CRC Strategy Exchange model.
Term and Flexibility (Section 1)
• Initial Term: Twelve (12) months
• Automatic month-to-month continuation thereafter
• Either party may terminate month-to-month extension with 30 days’ notice • Written notice required 60 days prior to end of Initial Term to cancel automatic extension Compensation Structure (Exhibit B)
• $60,000 lump sum for Initial Term
• $5,000 per month during any extension period
Fiscal Controls and Oversight
• No compensation for additional services without prior written authorization • City Manager authority limited to 15% of contract amount or $25,000 (whichever is less) • Council approval required beyond that threshold
• Audit rights retained for three (3) years
Termination Protections
• City may terminate without cause with 10 days’ notice • Consultant must cure default within 10 days
• City retains full legal remedies
Insurance and Risk Management
The Agreement requires $2M/$4M General Liability, $2M Auto Liability, $1M/$2M Professional Liability, Workers’ Compensation coverage, additional insured endorsements, primary and non-contributory language, waiver of subrogation, and three-year professional liability continuity.
61 BUDGET AND FINANCIAL IMPACT
The total cost for the Initial Term is $60,000. Funding is available within the Community and Economic Development budget.
Recruitment of even a single mid-sized retailer or restaurant could generate recurring sales tax revenue sufficient to offset a substantial portion of the annual contract cost, with long-term revenue likely exceeding the one-year investment.

Staff recommends that the City Council:

This Section 5b shall survive the termination of this Agreement.
6. DEFAULT OF CONSULTANT. If the City Manager or his or her delegate determines that the Consultant is in default in the performance of any of the terms or conditions of this Agreement, it shall serve the Consultant with written notice of the default. The Consultant shall have (10) days after service upon it of said notice in which to cure the default by rendering a satisfactory performance. In the event that the Consultant fails to cure its default within such period of time, the City shall have the right, notwithstanding any other provision of this Agreement, to terminate this Agreement without further notice and without prejudice to any other remedy to which it may be entitled at law, in equity or under this Agreement. Consultant shall be entitled to retain any and all payments received prior to such termination, whether or not the underlying services are fully complete, provided that this right to retain payments does not and shall not act as a limitation on City's legal remedies for damages caused by Consultant's default. If the failure by the Consultant to make progress in the performance of work hereunder or to comply with the provisions of this Agreement arises out of causes beyond the Consultant's control, and without fault or negligence of the Consultant, it shall not be considered a default.
7. OWNERSHIP OF DOCUMENTS.
a. Consultant shall maintain complete and accurate records with respect to sales, costs, expenses, receipts and other such information required by City that relate to the performance of services under this Agreement. Consultant shall maintain adequate records of services provided in sufficient detail to permit an evaluation of services. All such records shall be clearly identified and readily accessible. Consultant shall provide free access to the representatives of City or its designees at reasonable times to such books and records, shall give City the right to examine and audit said books and records, shall permit City to make transcripts therefrom as necessary, and shall allow inspection of all work, data, documents, proceedings and 66 3

With respect to computer files, Consultant shall make available to the City, upon reasonable written request by the City, the necessary computer software and hardware for purposes of accessing, compiling, transferring and printing computer files.
8. INDEMNIFICATION. The Consultant agrees to defend, indemnify, protect and hold harmless the City, its officers, officials, employees and volunteers from and against any and all claims, demands, losses, defense costs or expenses, or liability of any kind or nature which the City, its officers, officials, employees, and volunteers may sustain or incur or which may be imposed upon them for injury to or death of persons, or damage to property arising out of Consultant's grossly negligent or intentionally wrongful acts or omissions in performing or failing to perform under the terms of this Agreement, excepting only liability arising out of the negligence of the City.
9. INSURANCE REQUIREMENTS. Consultant shall procure and maintain for the duration of the contract insurance against claims for injuries to persons or damages to property which may arise from or in connection with the performance of the work hereunder by the Consultant, its agents, representatives, or employees. Consultant agrees to provide insurance in accordance with the requirements set forth in Exhibit C, attached hereto and incorporated herein by this reference as though set forth in full. If Consultant uses existing coverage to comply with these requirements and that coverage does not meet the requirements set forth herein, Consultant agrees to amend, supplement or endorse the existing coverage to do so.
10. INDEPENDENT CONTRACTOR.
a. Consultant is and shall at all times remain as to the City a wholly independent contractor. The personnel performing the services under this Agreement on behalf of Consultant shall at all times be under Consultant's exclusive direction and control. Neither City nor any of its officers, employees or agents shall have control over the conduct of Consultant or any of Consultant's officers, employees or agents, except as set forth in this Agreement. Consultant shall not at any time or in any manner represent that it or any of its officers, employees or agents are in any manner officers, employees or agents of the City. Consultant shall not incur or have the power to incur any debt, obligation or liability whatever against City, or bind City in any manner.
b. No employee benefits shall be available to Consultant in connection with the performance of this Agreement. Except for the fees paid to Consultant as provided in the Agreement, City shall not pay salaries, wages, or other compensation to Consultant for performing services hereunder for City. City shall not be liable for compensation or indemnification to Consultant for injury or sickness arising out of performing services hereunder.
11. LEGAL RESPONSIBILITIES. Consultant shall keep itself informed of State and Federal laws and regulations which in any manner affect those employed by it or in any way 67 4
affect the performance of its services pursuant to this Agreement. Consultant shall at all times observe and comply with all such laws and regulations. City, and its officers and employees, shall not be liable at law or in equity occasioned by failure of Consultant to comply with this section.
12. RELEASE OF INFORMATION.
a. All non-public information gained by Consultant from the City in performance of this Agreement shall be considered confidential and shall not be released by Consultant without City's prior written authorization. Consultant, its officers, employees, agents or subcontractors, shall not without written authorization from the City Manager or unless requested by the City Attorney, voluntarily provide declarations, letters of support, testimony at depositions, response to interrogatories or other information concerning the work performed under this Agreement or relating to any project or property located within the City. Response to a subpoena or court order shall not be considered "voluntary" provided Consultant gives City notice of such court order or subpoena.
b. Consultant shall promptly notify City should Consultant, its officers, employees, agents or subcontractors be served with any summons, complaint, subpoena, notice of deposition, request for documents, interrogatories, request for admissions or other discovery request, court order or subpoena from any person regarding this Agreement and the work performed thereunder or with respect to any project or property located within the City. City retains the right, but has no obligation, to represent Consultant and/or be present at any deposition, hearing or similar proceeding. Consultant agrees to cooperate fully with City and to provide City with the opportunity to review any response to discovery requests provided by Consultant. MEMORANDUM: March 5, 2026
AGENDA DATE: March 10, 2026
TO: Mayor and City Council
FROM: Fabiola Lopez, Community Engagement Manager
TITLE: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GREENFIELD FOR AN ACCEPTANCE OF GRANT FUNDING
FROM INTERNATIONAL CITY/COUNTY MANAGEMENT
ASSOCIATION (ICMA) IN THE AMOUNT OF $354,000 AND
APPROVING A BUDGET ADJUSMENT FOR SUPPLEMENTAL
REVENUES FOR FISCAL YEAR 2025-2026
BACKGROUND:
Based on current activities and focus of the City’s Community Engagement Department, staff applied for and were awarded grant funding from the International City/County Management Association (ICMA) in the amount of $354,000.
The Grant was designed to support the hiring of a new position or the restructuring of an existing role dedicated to improving and expanding economic opportunities for Greenfield residents. In part, economic opportunity means ensuring residents have access to resources and support systems necessary to build stability and advance in their personal and professional lives.
Economic mobility reflects the long-term outcome of those opportunities that are accessible.
According to research, opportunities like workforce readiness, confidence and skill building, youth leadership development, mentorship, and civic engagement opportunities are predictors of economic mobility. The Community Engagement’s programs are already structured to provide these.
This funding will allow the Community Engagement Manager to focus on expanding current efforts and identify clear strategic priorities and strengthening them across departments and partners. The role will also support ongoing measurement, and evaluation to develop models that can be replicated by other local governments. The community engagement department has already laid important groundwork, and this funding will allow us to move forward in a focused and structured way alongside a national cohort of peers hired through the same funding source. 77 The City will receive $354,000 in grant revenues from ICMA over a 30-month period for the following use
• $250,000 - Allocated to cover the Community Engagement Manager salary over 30- month timeline.
• $25,000 - Allocated to support staff.
• $25,000 – Consulting and co-design activities.
• $30,000 -Implementation expenses.
• $24,000 -Travel and Professional Development for support staff and the Community Engagement Manager
BUDGET AND FINANCIAL IMPACT:
There is no net financial impact as the grant related expenditures the City makes will be offset by revenues from the grant itself.
RECOMMENDATION
Acceptance of the awarded grant from ICMA in the amount of $354,000 and approve budget adjustment for supplemental revenues for FY 25-26 to carry out grant related activities in the amount of $ 198,333.34
