FROM: Paul Wood, City Manager
TITLE: DISCUSS, RECEIVE, AND FILE A PRESENTATION
REGARDING CITY OF GREENFIELD STAFF VACANCIES
PURSUANT TO GOVERNMENT CODE SECTION 3502.4
BACKGROUND
On September 22, 2024, Governor Newsom signed Assembly Bill 2561 (“AB 2561”) into law to amend the Meyers-Milias-Brown Act (“MMBA”) and create Government Code Section 3502.3 (GC 3502.3), thereby creating a new obligation for public agencies to publicly address the status of their vacancies. As basis for the new requirements, the California Legislature determined that vacancies are a widespread and significant problem in the public sector.
Vacancies require employees to take on heavier workloads, resulting in burnout and increased turnover, which negatively impacts the delivery of public service. Further, the legislature declared there is a statewide interest in ensuring that public agency operations are appropriately staffed and that high vacancy rates do not undermine public employee relations.
GC 3502.3 requires public agencies to present the status of their vacancies and recruitment and retention efforts during a public hearing before their governing board at least once per fiscal year prior to the adoption of a final budget for the fiscal year. During the presentation, the public agency is also required to identify any changes to policies, procedures, or recruitment activities that may lead to obstacles in the hiring process. This is our second year presenting to City Council.
Additionally, if the number of vacancies meets or exceeds 20% of the total number of authorized full-time positions in a particular bargaining unit, the public agency shall include the following information in its presentation upon request of the recognized employee organization:
City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us
36 1. The total number of job vacancies within a bargaining unit.
2. The total number of applicants for vacant positions within the bargaining unit.
3. The average number of days to complete the hiring process from when a position is posted.
4. Opportunities to improve compensation and other working conditions.
GC 3502.3 entitles recognized employee organizations, regardless of the vacancy rate, to make a presentation before the governing board of a public agency during the same public hearing in which the public agency makes its annual presentation on vacancies.
City of Greenfield Bargaining Groups
There are 5 (5) bargaining groups and one non-represented at the City, consisting of 121 FTE which includes part-time positions.
Recommendations and information in this report are following Assembly Bill No. 2561, Chapter 409, an act to add Section 3502.3 to the Government Code that was signed into law on September 22, 2024, and became effective January 1, 2025 (Attachment A).

Vacancies
Position vacancies are created for a number of reasons including when newly budgeted positions are approved, there is internal movement such as a promotion or transfer, or when an employee leaves the organization due to retirement, voluntary resignation, or involuntary termination. When vacancies occur, it is a high priority for Human Resources/Risk Management and the City’s hiring managers to fill vacant positions in order to ensure continuity of services, maintain operational efficiency, minimize the need for overtime, and minimize disruptions to departmental functions. Timely recruitment and hiring efforts help the 37 City sustains its workforce, meets community needs, and upholds service standards while also providing opportunities for internal growth and external talent acquisition.
Although AB 2561 now requires staff to present annually on the status of vacancies and efforts to recruit and retain staff, it has always been a priority for departments to fill vacancies as soon as reasonably possible.
As of June 8, 2026, the vacancy rate for each bargaining unit was under 20%. The vacancies are calculated quarterly, as the quantity of vacancies is divided by the quantity of FTEs:
City of Greenfield Bargaining Group Vacancy Rate
Service Employees International Union Local 521 3.12%

AB-2561 Local public employees: vacant positions. (2023-2024) Assembly Bill No. 2561
CHAPTER 409
An act to add Section 3502.3 to the Government Code, relating to public employment. [ Approved by Governor September 22, 2024. Filed with Secretary of State September 22, 2024. ]
LEGISLATIVE COUNSEL'S DIGEST
AB 2561, McKinnor. Local public employees: vacant positions.
Existing law, the Meyers-Milias-Brown Act (act), authorizes local public employees, as defined, to form, join, and participate in the activities of employee organizations of their own choosing for the purpose of representation on matters of labor relations. The act requires the governing body of a public agency to meet and confer in good faith regarding wages, hours, and other terms and conditions of employment with representatives of recognized employee organizations and to consider fully presentations that are made by the employee organization on behalf of its members before arriving at a determination of policy or course of action.
This bill would, as specified, require a public agency to present the status of vacancies and recruitment and retention efforts at a public hearing at least once per fiscal year, and would entitle the recognized employee organization to present at the hearing. If the number of job vacancies within a single bargaining unit meets or exceeds 20% of the total number of authorized full-time positions, the bill would require the public agency, upon request of the recognized employee organization, to include specified information during the public hearing. By imposing new duties on local public agencies, the bill would impose a state-mandated local program. The bill would also include related legislative findings.
The California Constitution requires local agencies, for the purpose of ensuring public access to the meetings of public bodies and the writings of public officials and agencies, to comply with a statutory enactment that amends or enacts laws relating to public records or open meetings and contains findings demonstrating that the enactment furthers the constitutional requirements relating to this purpose.
This bill would make legislative findings to that effect.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement shall be made pursuant to these statutory provisions for costs mandated by the state pursuant to this act, but would recognize that a local agency or school district may pursue any available remedies to seek reimbursement for these costs.

SECTION 1. The Legislature finds and declares as follows:
(a) Job vacancies in local government are a widespread and significant problem for the public sector affecting occupations across wage levels and educational requirements. (b) High job vacancies impact public service delivery and the workers who are forced to handle heavier workloads, with understaffing leading to burnout and increased turnover that further exacerbate staffing challenges.
(c) There is a statewide interest in ensuring that public agency operations are appropriately staffed and that high vacancy rates do not undermine public employee labor relations.
SEC. 2. Section 3502.3 is added to the Government Code, to read:
3502.3. (a) (1) A public agency shall present the status of vacancies and recruitment and retention efforts during a public hearing before the governing board at least once per fiscal year. (2) If the governing board will be adopting an annual or multiyear budget during the fiscal year, the presentation shall be made prior to the adoption of the final budget. (3) During the hearing, the public agency shall identify any necessary changes to policies, procedures, and recruitment activities that may lead to obstacles in the hiring process. (b) The recognized employee organization for a bargaining unit shall be entitled to make a presentation at the public hearing at which the public agency presents the status of vacancies and recruitment and retention efforts for positions within that bargaining unit.
(c) If the number of job vacancies within a single bargaining unit meets or exceeds 20 percent of the total number of authorized full-time positions, the public agency shall, upon request of the recognized employee organization, include all of the following information during the public hearing:

(d) This section shall not prevent the governing board from holding additional public hearings about vacancies. (e) The provisions of this section are severable. If any provision of this section or its application is held invalid, the invalidity shall not affect other provisions or applications that can be given effect without the invalid provision or application.
(f) For purposes of this section, “recognized employee organization” has the same meaning as defined in subdivision (a) of Section 3501.
SEC. 3. The Legislature finds and declares that Section 2 of this act, which adds Section 3502.3 to the Government Code, furthers, within the meaning of paragraph (7) of subdivision (b) of Section 3 of Article I of the California Constitution, the purposes of that constitutional section as it relates to the right of public access to the meetings of local public bodies or the writings of local public officials and local agencies. Pursuant to paragraph (7) of subdivision (b) of Section 3 of Article I of the California Constitution, the Legislature makes the following findings:
It is in the public interest, and it furthers the purposes of paragraph (7) of subdivision (b) of Section (3) of Article I of the California Constitution, to ensure that information concerning public agency employment is available to the public.
SEC. 4. No reimbursement shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code for costs mandated by the state pursuant to this act. TITLE: A RESOLUTION OF THE CITY OF GREENFIELD ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2026-27 FUNDED BY
SB1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017
BACKGROUND AND ANALYSIS
In April 2017, the Governor signed Senate Bill 1 (SB1), also known as the Road Repair and Accountability Act (RRAA) of 2017. Beginning November 1, 2017, the State Controller will begin to deposit funds generated from increased fuel taxes and vehicle registration fees, into the newly created Road Maintenance and Rehabilitation Account (RMRA). The four sources of revenues for the RMRA are:
• A 12-cent per gallon gasoline excise tax, effective November 1, 2017 • A 20-cent per gallon diesel excise tax increase, effective November 1, 2017 • Vehicle registration surcharge, effective January 1, 2018 • A $100 per year zero-emission vehicle registration surcharge, effective January 1, 2020 A portion of the RMRA funds will be distributed annually to eligible cities and counties for basic road maintenance, rehabilitation, and critical safety projects on local streets and road systems. The distribution will be made using the same formula that applies to the existing base 18-cent per gallon gasoline excise tax. The City’s estimated projected revenues of RMRA funding for FY 2026-27 is $583,196.
SB1 emphasizes the importance of accountability and transparency in the delivery of California’s transportation programs. As outlined in the RRAA Reporting Guidelines, recipients of the RMRA funding are held accountable through performance goals that are tracked and reported. In order to be considered for funding in Fiscal Year 2026-27 agencies must provide a proposed list of projects to the California Transportation Committee by July 1, 2026. This will enable the RMRA funds to be included in the City’s annual road maintenance budget.
The City of Greenfield has previously, through the SB 1 program, completed the following projects:

Also, this SB1 bill includes a “Maintenance of Effort” (MOE) requirement for local funds contributed to street and road repairs to help ensure that the new funding augments existing budgets for road repairs. Specifically, it requires each city to spend no less than the annual average from its general fund during FY 2010 through FY 2012. The City tracks this also for purposes of reporting our Maintenance of effort for Measure X funds. The estimated, average MOE for the City of Greenfield currently is $11,436. Sources of local funds include Gas Tax, Special Tax Revenue Funds, and Street Capital Funds.
In order to receive SB1 funds through the Transportation Agency for Monterey County (TAMC), the City must enter into an agreement with TAMC for the allocation of funding. The attached resolution and Agreement is requested by TAMC for this purpose.
FINANCIAL AND BUDGET IMPACT
Estimated FY 2026/27 annual revenue anticipated from SB1 is approximately $583,196. This amount will be included in the Revenues for FY 2026/27 and will be added as a funding source for These identified CIP project improvement projects. These monies will augment the General, Gas Tax and Measure X funds for the indicated maintenance and improvement projects. 49 RECOMMENDATION

During the current fiscal year, the Public Works Department has experienced personnel vacancies and staffing changes that have resulted in salary savings and reduced expenditures within the bilingual pay account. These budgeted funds are not anticipated to be fully utilized by the end of the fiscal year.
At the same time, the Department has experienced increased operational costs associated with maintaining critical public infrastructure, specifically wastewater related public works services.
Reallocating available salary savings will allow the Department to address operational needs without increasing the overall departmental budget.
Staff has reviewed current budget expenditures and projections and determined that sufficient savings exist within the salary and bilingual pay accounts to support a budget transfer to operational expenditure accounts. The proposed reallocation will ensure adequate funding is available for necessary operational expenses for the wastewater division.

54 BUDGET AND FINANCIAL IMPACT:
The proposed budget amendment is budget-neutral and does not increase overall appropriations.
Funds are being reallocated within the existing Public Works Department budget from personnelrelated accounts to operational expenditure accounts.
The proposed budget transfers are as follows:

TITLE: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GREENFIELD APPROVING AN INCREASE TO THE FIRE AND
MEDICAL EMERGENCY PARCEL TAX
BACKGROUND AND ANALYSIS
On January 24, 2017, the City Council of the City of Greenfield (“City”) adopted a Resolution calling for an election to implement a special parcel tax to fund fire and emergency medical services to be provided by the City (“Measure C”).
Following passage of Measure C, on June 27, 2017, the City Council adopted Ordinance No. 524, adding chapter 3.22 to Title 3 of the City Municipal Code to codify the special parcel tax.
Section 3.32.020 of the City Municipal Code authorizes the City to increase the tax equal to the inflation index. The City has not increased the special parcel tax since its adoption.
This agenda item is for consideration and potential approval of an increase of the parcel tax pursuant to the Consumer Price Index for All Urban Customers (“CPI-U”). Despite being authorized to increase the parcel tax each year since inception, City staff is recommending that the City Council increase the parcel tax for only the most recent year. Since 2025, the CPI-U has increased 4.2 percent (4.2%).
FINANCIAL AND BUDGET IMPACT
Increase of the parcel tax is projected to provide approximately $37,082.85 in additional funding for fire and emergency medical services in fiscal year 2026-2027.
