The Gann Spending-Limitation Initiative, Article XIII B of the California Constitution, was adopted as Proposition 4 in June 1979, and was subsequently modified by Proposition 111 in June 1990. Under this article of the State Constitution, every California city is required to annually adopt a resolution setting a limitation on the annual appropriation of proceeds from taxes. For FY2026-2027, staff project that the City’s appropriations subject to limitation will be approximately $4,784,025, which is about $31,869,229 less than the calculated limit of $36,653,254.
BACKGROUND:
The Gann Spending-Limitation Initiative provides for the limitation of state and local government appropriations. The Gann Initiative is actually a limitation on tax revenues, rather than a direct limitation on appropriations. Following are the major provisions of the Gann Initiative and subsequent Proposition 111 modification:
1. Appropriations subject to limitation may not exceed appropriations made in 1978-79, except as adjusted for increases to the cost of living, population and service responsibility transfer. (Adjustment factors are discussed below.)
2. Appropriations financed through service fees (to the degree that they do not exceed the cost of performing the service), grant programs, fines and forfeitures, and other specified “non-tax” sources are not subject to the appropriations limit. Essentially, with the exception of major capital related expenditures, all appropriations funded through tax revenues are subject to limitation.
3. For the purpose of identifying “proceeds from taxes’ under the Gann Initiative, state subventions that are unrestricted as to their use (e.g., Homeowners Property Tax Relief) are considered to be tax sources. On the other hand, the use of subventions like Gas Tax is restricted by the State, and as such, is classified as non-tax sources. 38 4. Under the original Gann Initiative, all proceeds from taxes received in excess of the appropriations limit were required to be returned through refunds or revision in tax rates and fee schedules within the next two fiscal years – or voter approval to increase the appropriations limit was required. Any voter-approved increase to the appropriations limit cannot exceed four years. Proposition 111 provides a one-year carryover feature to determine excess revenues under which refunds can be avoided, if the City is below the limit by the amount of the prior year excess in the subsequent year.
5. Originally, the Gann Initiative required no formal review; however, Proposition 111 requires that the annual calculation be reviewed as part of the City’s annual financial audit.
The annual adjustment factors of changes in population and cost of living for the appropriations limit calculation must be selected by a recorded vote of the Council, and include the following:
1. Population – Based on data provided annually by the State Department of Finance, cities may annually choose the population growth factor of either their city or the county.
For this year’s calculation, the City’s population growth factor (which exceeded the County’s factor) is the recommended population adjustment.
2. Cost of living – Local governments may annually choose either the percentage change in California per capita personal income, or the percentage change in their jurisdiction’s assessed valuation for non-residential new construction.
Data for the percentage change in California per capita personal income is provided annually by the State Department of Finance. Data to calculate the change in nonresidential assessed valuation is not available from the County. Therefore, the California per capita personal income change is the recommended cost of living factor.
The City’s appropriations limit for 2026-2027 of $36,653,254 is calculated as follows:
Appropriations Limit Calculation
2025-2026 Appropriations Limit $34,313,708
Adjustment Factors:
A. Cost of Living Options
1. Percentage change in assessed value due to new non-residential Construction
data not
available
2. Percentage change in California per capital personal income 4.95% B. Population Options
1. Percentage change in City population 1.78%
2. Percentage change in County population 0.08%
Combined Adjustment Factor 1.068
2026-2027 Appropriations Limit $36,653,254
The options underlined in italics above are the recommended adjustment factors in determining the City’s appropriations limit for 2026-2027.
39 BUDGET AND FINANCIAL IMPACT:
There is no budget or financial impact resulting from the adoption of this limit for 2026-2027.
The City’s appropriations limit for FY 2026-2027 has been calculated at $36,653,254. The portion of the City's budget that is subject to the appropriations limit (i.e., the proceeds of taxes) totals $4,784,025, which is well within the appropriations limit and provides a favorable variance of $31,869,229.

TITLE: INTRODUCE AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GREENFIELD AMENDING SECTIONS 10.12.030 AND
17.58.040 OF THE GREENFIELD MUNICIPAL CODE RELATED
TO RECREATIONAL VEHICLE PARKING
BACKGROUND
At the June 25, 2024, City of Greenfield (“City”) Council meeting, the City Council directed staff to add an item to a future City Council meeting agenda to discuss citizen concerns related to recreational vehicle (“RV”) parking on City streets. At the July 23, 2024, City Council meeting, the City Council directed staff to create an RV, boat, and trailer parking pilot program. On September 10, 2024, the City Council approved the RV, Boat, and Trailer Parking Pilot Program which includes allowing RVs, boats, and trailers to park in front and side street yards.
On May 12, 2026, City Council discussed the effectiveness of the program and found it to be largely successful in promoting orderly parking on City streets. The City Council wishes to formally codify the RV, Boat, and Trailer Parking Pilot Program.
On July 14, 2026, City Council considered amendments to the Municipal Code to extend the RV, Boat, and Trailer Parking Program indefinitely. During that meeting, City Council asked for additional information regarding whether the Municipal Code restricts where recreational vehicles may be parked on private property and whether vehicles must be parked on paved or other solid surfaces.
EXISTING MUNICIPAL CODE SECTIONS RELATED TO RECREATIONAL
VEHICLE PARKING
The City’s parking regulations are found in Chapter 10.12 and Chapter 17.58 of the City Municipal Code. Those regulations found in Chapter 10.12 generally apply to parking on City streets while regulations found in Chapter 17.58 generally regulate how parking is constructed as part of a new development project. Although section 17.58.020 states that chapter 17.58 only applies to new developments, changes in use, and modifications to existing structures, other City Council Memorandum

general restrictions are included, which expand beyond processes requiring permit applications. (See Greenfield Municipal Code section 17.58.040, subd. (B)(1), restricting living in vehicles.) So, it seems that some of the Chapter 17.58 regulations appear to apply to parking on private property outside of a new development context.
Greenfield Municipal Code section 17.58.040 (General Parking Regulations), as it relates to the City Council’s request for more information about existing City recreational vehicle parking regulations says that:
• “parking spaces shall not be located within any required setback area of a parcel;” (GMC, § 17.58.040 A.2.a.)
• “vehicle parking (and access thereto) shall be on permanent paved and other approved surface;” (GMC, § 17.58.040 A.2.b.)
• “parking spaces shall not preclude direct and fee access to stairways, walkways, elevators, any pedestrian accessway, or fire equipment.” (GMC, § 17.58.040 A.2.d)
Because it is not clear whether the above regulations apply outside of the development process, if the City Council would like to ensure that these general parking regulations are applicable to recreational vehicles parked on private property, we recommend that the City Council direct staff to add language to the below proposed Municipal Code amendments.
MUNICIPAL CODE AMENDMENT
To formally codify the RV, Boat, and Trailer Parking Pilot Program, the following changes to the City Municipal Code are needed.
First, Greenfield Municipal Code section 10.12.030 states: “No person who owns or has possession, custody, or control of any vehicle, trailer, mobile home or boat shall park such vehicle, trailer, mobile home or boat upon any street or alley for more than a consecutive period of seventy-two hours.” To incorporate the RV, Boat, and Trailer Parking Program, the following addition should be made to section 10.12.030, after the first sentence: “. . . Storage of boats, trailers, and mobile homes by an owner, tenant, or guest of real property is permitted in required front and street side yards, provided that the boat, trailer, or mobile home does not encroach into or upon any public sidewalk or public right-of-way.” Second, Greenfield Municipal Code section 17.58.040, subdivision (C), paragraph (3) states:
Recreational Vehicle Parking: Recreational vehicles of an owner, tenant, guest, or visitor may be parked on any highway (street) for a maximum period of seventy-two (72) hours. Any request to extend this period for guests and visitors shall be submitted in writing to the chief of police for consideration and authorization. Recreational vehicle storage is prohibited in required front and side street yards, However, recreational vehicle parking is permitted outside of required front and street side yard setback areas and within interior side and rear yards when screened by a solid six foot (6') tall fence, wall, and/or landscape 43 - 3 -
barrier. Screening shall be consistent with chapter 17.52, "Fences And Walls", of this title.
To implement the RV, Boat, and Trailer Parking Program, the following changes are proposed:
Recreational Vehicle Parking: Recreational vehicles of an owner, tenant, guest, or visitor may be parked on any highway (street) for a maximum period of seventytwo (72) hours. Any request to extend this period for guests and visitors shall be submitted in writing to the chief of police for consideration and authorization.
Recreational vehicle storage is prohibited permitted in required front and street side yards, provided that the recreational vehicle does not encroach into or upon any public sidewalk or public right-of-way. However, recreational vehicle parking is permitted outside of required front and street side yard setback areas and within interior side and rear yards when screened by a solid six foot (6') tall fence, wall, and/or landscape barrier. Screening shall be consistent with chapter 17.52, "Fences And Walls", of this title.

Guillermo Mixer, Director of Public Safety
RESOLUTION TO ORDER THE DIRECTORE OF PUBLIC
SAFETY TO ABATE HAZARDOUS CONDITIONS ON
NUISANCE PROPERTIES
BACKGROUND AND ANALYSIS
In accordance with Greenfield Ordinance 8.16 (Removal of Vegetative Growth and/or Refuse), the City Council must order the Director of Public Safety resolution to abate hazards located on nuisance properties. This allows the Director of Public Safety and/or his designee to legally enter a property and take all action needed to ensure it is free of hazardous vegetation and refuse. To ensure that staff has followed Ordinance 8.16 and made a good faith effort to work with property owners, the following attempts to communicate were taken:
• In March of 2020, the City Council adopted revisions to Ordinance 8.16 which addressed public safety hazards caused by the accumulation of hazardous vegetation and refuse.
The City followed all required public notification mandates. • Between the months of March and May, courtesy letters were sent to previous noncompliant properties, a flyer was included in the Greenfield April water bill, GFD posted information on their Facebook page notifying residents of fire season, and three additional courtesy letters were sent to remaining noncompliant properties. • On May 26, 2026, the Greenfield City Council adopted a resolution declaring all out of compliance properties as Public Nuisance. This was the first step in accordance with Ordinance 8.16 to enable the City to abate the hazards on nuisance properties. • On May 27, 2026, properties that remained out of compliance were tagged with an order to abate notice and mailed a USPS certified letter containing an order to abate. Property owners were also advised that they would have the opportunity to contest any further action by attending the June 16, 2026, City Council Meeting. There was no meeting on June 16th and two of the 4 properties are located in the District, which led to the council City Council Memorandum 599 El Camino Real Greenfield CA 93937 831-674-5591 www.ci.greenfield.ca.us

meeting being extended to July 28th to give adequate time to confirm if the City or District will be responsible for issuing the abatement order, the costs incurred by abatement, and who will place the property lien after abatement. At the time that this staff report was written, one property remained out of compliance.
FINANCIAL AND BUDGET IMPACT
All expenses associated with abatement will be passed onto the property owner. Staff is committed to ensuring the city is cost neutral and that no expenses are subsidized by taxpayers.
As in past years the city will notify the County Assessor to apply past due expenses from property owners who did not reimburse the city for abatement services.
RECOMMENDATION
It is the recommendation that the City Council adopt the attached resolution, ordering the Director of Public Safety to abate the hazards on the properties listed Exhibit-A.
